he's accused of failing a sobriety test after dropping off 30 students on his bus route yesterday. that cherry creek bus driver faces a judge for a dui charge. shawn chitnis with a closer look. good morning, shawn. >>reporter: good morning, britt. we know that hobbs will not return to the school district. he was hired last year in october and didn't have issues before that. here's what we understand what happened yesterday while dropping off 30 students from west valley middle school. a woman with the school district contacted staff to tell them that she thought she smelled alcohol on him. so while he was on his route, she told the transportation department, she didn't think he looked our sounded drunk based on how he was walking or talking. hobbs was driving a route that has one stop and all 30 students from west middle school got off the bus safely. after finishing his route, the

he was and medics checked him out and they said he was fine. the arapahoe county gave him a sobriety test and said he didn't pass. this possible dui may not be related to alcohol. hobbs said he had the flu and taking medications to treat it. the results of his blood test is still pending. hobbs will be in court later today. live in greenwood village, shawn chitnis, cbs 4 morning news. >> shawn, very concerning for parents. developing now, new legislation would make sexting between teens legal in mexico. teens can be prosecuted for sexual exploitation if they share porn graphic images. it will allow those -- as long as it's consensual. the bill is signature.

gunman dead after he opened fire at a product company in kansas. the police searched the home the of the gunman. this happened 35 here's dawn champion. >>reporter: investigators describe a chaotic scene inside of this plant near wichita kansas when a gunman opened fire. >> the shooter was actively firing on any target it came across. >> an employee shot 15 people at excel -- >> he remembers the moment he got hit. >> they said somebody was shooting and next thing you know, i fell. i got hit in the leg and that's when i started running. >> a law enforcement source tells cbs 4 news, the shooter was cedric ford and killed in a
