time for a variety of crimes, including auto theft. he was in the same prison as the aurora theater shooting mass killer james holmes, and their paths crossed. at the colorado state penitentiary in canyon city, special attention was made to keep the theater gunman apart from the other prisoners. by chance, james holmes and mark daniels came face-to-face last october after a guard's radio battery died. in a letter to cbs 4, daniels asked us to contact his father who would speak for him. i asked about the allegation that guards were in on the attack. >> i would have to say they would have had to turn the cheek for a couple minutes for him to get a hold of him. >> reporter: documents we obtained say daniels punched holmes on the back and on the top of his head. daniels responded "this is your fault, you control the doors, i don't." but the director of prisons told

no truth to daniels' claims of >> i would say it's an allegation that offender daniels actions. >> reporter: daniels has now been moved to the state prison facility at sterling where he is on 23-hour a day lockdown. as for holmes, he was quietly moved out of state. we talked with the district attorney who prosecuted holmes. he feels the doc should be protecting its inmates and says holmes should be in colorado. a 14-year-old girl who survived a mass shooting in michigan is making a remarkable recovery. abigail opened her eyes and took a few steps at the hospital this week. she was shot in the head during a random shooting spree by an uber driver. abigail's parents had been making arrangements to donate her organs when she

the confessed shooter will be undergoing a mental competence exam. scott kel seback in the -- kelly is back in the u.s. after spending almost a year in space. he arrived in houston to a warm welcome from family and friends. his 340-day journey to the international space station was the longest for any american astronaut. now he says he could have lasted another year but he's very happy to be back home. a border collie is strutting his stuff down a runway in michigan. piper, decked out in special gear. his job is chasing birds and other wildlife off the runways to he does not get a paycheck, but he loves his work. it's been a problem for but nothing we're talking about what can happen to

test that shows what some experts believe happened to her. she was in the driver's seat. watch as the front seat collapses, driving the dummy's neat into the backseat. >> and once i was laying down, i couldn't move. >> reporter: her neck was broken. she is paralyzed for life. >> i was very angry. i wanted to die. >> reporter: in other accidents, there are children in the backseat. the death of 7-year-old crystal butler. we interviewed her mother when we first reported the story in 2002. >> an ambulance was coming toward us. we pulled over to the side of the road. and we were struck from behind. >> reporter: stephanie collins' seat collapsed and her head slammed into her little girl. crystal died from massive internal bleeding. >> my child got turned into a human safety device. an airbag. she saved my life. it wasn't

>> this is the seat that was involved in the accident. >> yes, the right front seat that mom was in. >> reporter: when we spoke to a structural engineer and accident investigator in 2002, he told us the federal safety standard for seat back strength was grossly inadequate. and 14 years later? >> nothing's changed. >> reporter: he provides expert testimony in lawsuits against carmakers and says car seats exceed the federal standard and are generally stronger than they were in 2002. >> but they're not reliably stronger all the time. sometimes they could be adjusted and become weaker. >> reporter: but there are steps you can take to help protect the kids in the backseat. and they're very simple. if there's no one in the passenger seat, then put the child behind the empty seat. if someone is in the passenger's seat, put them behind the lightest, shortest person. and that will give kids a better chance of surviving a rear end collision. the national highway traffic safety administration responded to our story with this

oscar 50orrias's long battle may be coming to an end. we're covering the world for you tonight. south africa's highest court rejected an appeal of his murder conviction today that. clears the way for the judge to sentence pesterias in a hearing later this month. he spent one year in prison for a manslaughter charge that was later overturned and declared murder. he is now facing a minimum 15 years in prison. new zealanders will soon decide whether to keep the country's existing flag or get a new one. millions of ballots are being sent out over the next week . they chose the silver fern as a finalist from five designs. so it goes up the current flag featuring that british design which is flown over that country for over 100 years. the prime minister argues

representative of new zealand. a pair of giant pandas from china arrived in south korea today. they got a warm welcome at the airport. they come from a research and breeding facility. the chinese government is loaning the pandas to south korea for 15 years as a symbol of friendship. >> can you see the pandas? seriously? bring me some bamboo. teen, 20s for the high country, 20s, 30s out west. and tomorrow 60s, 70s for the eastern plains. 40s and 50s in the mountains! out west, 50s, 60s to around 70 degrees. for tonight, denver will look for partly cloudy skies. we'll be in the mid-to upper 30s for the overnight lows. for tomorrow, partly cloudy skies, breezy, 63 and 61 for the highs. and then the next several days, we'll stay that way on saturday with 63. 70 degrees on sunday. then there's the change. chance for rain or showers and cooler 56. partly cloudy on tuesday. we'll stay cool at 53. a wonderful visit at black rock elementary in erie. say hello to all the 2nd graders! >> hell oh, 2nd graders! >> there you go. google is donating $1 million to the fight against the zika virus. the money will go to the united nations humanitarian relief agency. zika has been linked to almost 5,000 cases of a catastrophic birth defect in brazil. new developments at subway. the chain says it will no longer use chickens raised with antibiotics. bowing to customer pressure, subway started selling the antibiotic free chicken at sub restaurants today but says it will take until 2025 for every north american restaurant to have antibiotic free chicken. >> this is a problem that's been brewing for decades and getting seriously worse. >> it's a danger to consumers from meat that doesn't have antibiotics in it? >> absolutely not. >> the danger is not the antibiotics themselves but the
