smile, we've learned that this assistant city attorney who was put on paid leave 20 months ago was just given a raise and a successful job rating even though he did nothing. >> reporter: why are we paying someone who is sitting at home? does it seem odd that someone on administrative leave gets a raise? >> we followed the due process and the administrative process for all employees >> reporter: they put him on leave in july of 2014 saying they were reviewing his handling of a case, they agreed to pay

they increased his salary and now the city says his job performance last year was successful, even though he was ordered not to come to work and not assigned any cases they just awarded him another 3% raise bringing his salary to $147,000 that salary bump for sitting at home doing nothing. >> where does the buck stop? >> at the end of the day, the buck stops with me? >> so why won't you answer any questions about this? >> two days after the report, they lifted his suspension and told him he could start working again but from home he refuses to answer brian's questions about why he was put on leave and what the 19-month-long investigation turned up and why he was allowed to go back to work.
