tonight's top story, a decorated fire chief is arrested. the eagle fire chief and his wife both accused of stealing more than $120,000 from the last department he ran. >> vogel left as fire chief from the town as sterling. she accused of leaving the department with a lot more than his final paycheck. matt kroschel is live in eagle with our top story. >> reporter: for firefighters here at this firehouse, they were just getting to know their new boss. now they're reeling from the allegations and the arrest. and they're scrambling to figure out who is going to run day-to-day operations now that their chief is in handcuffs. serious felony charges landing this fire chief and his fwhief hot water.

than $120,000 during his stint at the sterling fire department. he started his new post in eagle county a few months ago. these are pictures from his swearing in. on the eastern plains, sterling city officials releasing a statement in part saying the city of sterling will not tolerate any misconduct by any city or former city employee. to maintain the public's trust and integ rid, the city has already strengthened its internal controls. the vel being told they are held without bail until they go before a judge. the d.a. telling me by phone the investigation continues and more charges could be filed. we have learned all of this investigation started when several pieces of firefighting equipment turned up missing. there were some red flags in the bookkeeping as well. officials

they're gonna do moving forward. for now the chief is on leave. matt kroschel, cbs4 mountain newsroom. a large grass fire in eastern arapahoe county now under control. no homes were threatened. firefighters are looking into this one. developing now, this mother facing a charge of child abuse resulting in death after one of her kids drowned in arapahoe county sheriff's deputies say she left her two young daughters alone at their apartment on parker and florida. one of the girls, a 7-year-old, drowned in the outdoor pool last night. her sister ran to get help from neighbors who tried to save the victim. i came out here, and she

>> she told deputies she was at a walmart because she needed to get away from the children for a while. denver police believe road rage may be to blame after shots were fired at an uber driver's car early this morning. the shooting happened near i25 and 20th. the shooter's vehicle then sped north on the interstate after being stopped by the state patrol near i-25 and highway 52 the uber driver says someone pulled up and just started shooting. he chased the vehicle but gave up when speeds got too high. another driver says news of the shooting has him on edge. >> i would have been scared and pulled over right away and made a phone call to the police. >> police did pick up the chase and the state patrol laid down sticks that stopped the vehicle north of high 52. a man and

>> reporter: it would allow vaping but no cigarette smoke inside. only outside under strict conditions. the other initiative backed by the national organization for the reform of marijuana laws offers a different type of place to use pot. >> it would know in a private club -- autobiography in a private club setting. so a person would have to fill out a membership form. >> reporter: there are some places i allow people to bring in their own marijuana and use it together. but not in the city of denver. one of initiatives would require approval of registered neighborhood groups. >> what we're looking for is places in neighborhoods that want them to test the waters. >> what happens if both of these pass? >> i think we're gonna have a lot of interesting places for people to consumer marijuana. >> reporter: one place it's not supposed to be consumed is in
