7-year-old girl did not know how to swim. her mother had left for about an hour. she went to a walmart down the street, until authorities called her. snooe >> she was faye down on the pool. >> my daughter looked at me and yelled and said there little girl in the pool not moving >> reporter: residents raced to help. >> she was laying right here, she had foam coming from her mouth. i just started cpr on her immediately. >> reporter: she was pronounced dead at the hospital. >> i feel bad, for the mom and for the kids. and the little one, she was so devastated. >> reporter: 27-year-old eve was arrested last night for

unattended. late friday, the district attorney said charges were not appropriate at this time. the residents who raced to help are still coping with the young girl's death. >> it was really horrible. >> reporter: kurt vehicle og, you l was fire chief here for six years. he may have stealing from this department for the majority of that time. more than $120,000 is missing from the city of sterling. kurt and his wife hope are accused of stealing it. >> it happened within a week of his departure. there were questions from the new chief whoed what this into the public eye during flooding in 2014. >> i think it's awesome. i love technology. and this is just -- it's amazing >> reporter: he left the department in april to become the fire chief in eagle county. shortly after he left, city officials discovered a number of bookkeeping errors, and that firefighting equipment was missing. >> we found some inconsistencies with some of our invoices, and that was enough that we asked the district attorney's office to take a look at it.

after a convicted rape nist boulder avoided -- rapist in boulder avoided a prison sentence. why the victim thinks the sentence is not too lenient. >> she made it clear she wanted -- prison for her attacker. she said she was asking the judge to have as much mercy for her rapist as he did for me the night of the sexual assault, which was none. she went on to say the rapist chose to ruin life but like the sexual assault itself, "my life has been ruined without my consent." today she called the sentence light but indicated it was worth the trauma of trial hoping to make sure wilkerson could never attack again. our analyst says the punishment in this case is

>> marijuana is legal in colorado. smoking is in bars is not. that might change this fall. >> reporter: these petitions are the latest in an effort to create places to socially consumer marijuana in denver outside of homes. one ballot proposal would allow it certain bars, and other businesses. >> these are adults who enjoy using cannabis. they should have the same rights and ability to congregate and socialize with other adults as those who consume alcohol. >> reporter: it would allow vaping but no marijuana cigarette smoking inside remember only outside under strict conditions remember the other t -- conditions. the other initiative backed by the organization for the reform ever marijuana laws offers a different type of place to use

club -- be in a private club setting so much a person would have to fill out a membership form for each business. >> reporter: there are a few places in the denver area that already allow people to bring in their own marijuana and tuz together. but not in the city of denver. one initiative on would require approval of registered neighborhood groups. >> really what we're looking for is a couple places in neighborhoods that want them to test the waters. >> what happens if both of these lot of interesting places for people to consume marijuana. >> the denver election division will take a few weeks to determine if each petition has enough signatures. a developing story from thailand. investigators combed the scene of bombings that killed at least four people. dozens were hurt, include something tourists.

they were in plants on a busy street. not clear who carried out attack. voofz a high school chase -- video of a high school chase in houston. police surrounded the truck with guns drawn as they tried to get the suspect out of the truck. they eventually arrested him. not clear why he ran from police. alligator in his garage. >> the man listens outside houston. says he came within a foot of that thing. he tried wrangling it. no luck. emergency crews stepped in. they were able to capture the gator and haul it away to a child life refuge. louisiana is under a state of emergency. intense storms dumped as much as 3 inch was rain an hour in some parts.

partly cloudy tonight. 50s for the overnight low. another cool, comfortable night. mostly sunny tomorrow. a few isolated storms, a 10% chance or less of that. 85 ought to be the official high tomorrow. and a little warmer on sunday at 88. near 90 on monday. upper 80s to start the week. only isolated afternoon thunderstorms. 10% chance each day. and that carries us all the way into there's no way where we're gonna get soaked. >> certainly no snow. just watching the rockies this week has been exhausting. so many blown leads, tough losses, and will players ld philadelphia. 3 errors on the field. and the phillies just wore out jon gray! especially cesar hernandez who had a pair of 13 at-bats against gray. this turned the 5th into a real long one! gray was at 110 pitches for the night when he gave up a grand slam to ryan howard and he knew it. maybe david dahl a bit worn out as well. 0 for 4
