it's saturday, august 13th. this is the news on cbs 4. the district attorney's office says it through not file criminal charges against the mother arrested after her daughter drowned in the pool. what the woman, who tried rescuing the girl has to say. details on a colorado chief and his we more than $120,000 from a fire station. you won't have to wait for the state fair to have the fried twinkie. live from control control's newschannel, this is cbs 4 morning news. good saturday morning to you. i'm kelly.

stories coming up. first, chris spears in the colorado weather center. let's have a check of the weather. >> a beautiful start to the day this morning for everybody across the state. we have our mile high camera. it's one of the days where you have sunshine and you'll worry about thunderstorms in the denver and the high country is pretty small. temperatures around the state, chilly in the high countries, 40s and upper 40s. 59 in grand just, smoky from the wild fire. in the metro area, pretty similar story. one of our weather watchers checking in from thought aurora, ron 56 degrees with a little bit of wind.

new mexico state line. coming up, we'll have a few thunderstorms in our state. i'll talk about where that might be. a 7-year-old girl is dead after drowning in a pool. her mother was arrested for the leaving both of her daughters alone. the district attorney has decided no to charge the mother. >> i came out here and she was face down in thisl. the tree. i got it and put it on her body and pulled her. >> my daughter heard another scream. she said there was a girl by the pool not moving. >>reporter: it was around 6:00 thursday night when the 911 calls started. residents called for help. >> she was laying here, had foam

>>reporter: 7-year-old schiphra fini was pronounced dead at the hospital. the younger sister witnessed the incident. >> i feel bad for the mom and kids. the little one, she was so devastated. >>reporter: 27-year-old eve gbeugre was arrested in felony child abuse, resulting in beth for leaving the children unattended. late friday, the district attorney said charges were not appropriate at this time. the residents, who raced to help are still coping with the young girl's death. >> it with that. i don't know why they were out here alone. >> that was jeff today reporting. eve gbeugre has been released from the jail. in a statement, the district attorney says the investigation into this matter will continue and charges may be filed against one or more persons in the future. right now, uber drivers in the metro area say they're nervous after an apparent road

early yesterday morning. his back and passenger written does were blown out. he chased the other car north on i-25 until speeds got too fast. police caught up to the suspect's vehicle near highway 52. two week were arrested. a developing story in eagle, where the fire chief and his wife have both been arrested. their accused of stealing more than $100,000 from the chief's former karen tells us the reactions to the charges against kurt vogel and his wife. >> kurt was the fire chief in sterling for six years. investigators believe he may have been stealing from the department for the majority of the time. >> more than $120,000 is missing from the city of severaling. the former fire chief, kurt vogel, and his wife are accused

experience and numerous accomplishments. he was launched into the public eye during flooding in 2014. >> i think it's awesome. i love technology. this is amazing. >> he left the department in april to become the fire chief in eagle county. after he left, city officials discovered a number of bookkeeping errors and that firefighting equipment was missing. >> we found inconsistencies with invoices. we asked the district attorney's office t >> while few details have been released, we know the vogels are facing charges, flash flood warning felony theft and trying to influence a public servant. the city manager says the money could be used early where. >> that's a couple of pieces of equipment, a couple of employees. it's not something to brush off. >> vogel has been put on leave by the fire department.

will consider taking stronger action next week. heavy rain and floods leave at least two people dead and force dozens from rescues from high water in southeastern louisiana. more of the same is in the forecast for that area and the state's governor has declared state of emergency. a flash flood watch is in effect through tomorrow morning. numerous rivers in southeast louisiana and southern mississippi are overflowing and threatening flooding since the storm started thursday. let's get a forecast here at home. chris. >> kelly, good morning. nothing like that here at home. i want to show you the radar. look here. it's a dire situation there's an area of low pressure stuck, nothing to move it.

when it comes to weather in colorado, anything goes, especially in the mountains. webcams show a dusting of snow on pike's peek yesterday morning. it's not mountains to have a summer snow. it's hard to think. september isn't that far away. we're talking 90s now. >> weather men don't like to say promise and guarantee too often. i will use those words today with regards to snow. no worried for you. live view of the mountain camera. if you're going to they in the high country, look what you have

range. there's a chill in the high country, upper 30s and low to mid-40s. 59 in grand just. kirk patrick, light wind, 57 in north lafayette. our weather watcher in mesa has a front row view of the latest fire that has broke out to his south. this is not too i-70 -- i-70. there's a fire warning. there's a disturbance dlib -- clipping southern colorado. if s fire today, they will likely be in southeastern colorado. here's futurecast. it's doing a good job of indicating moisture on the southeastern flank of the state.

as we roll into the afternoon. couple of dots over the higher terrain that will be nothing more than sprinkles. we don't have the right setup to force the atmosphere and get widespread showers. you may luck out and get a brief one early afternoon. we're going to tack about 3 to 6 degrees on to the democrats yesterday. denver's high was 83. today # in colorado springs. 92 in grand just. overall, it's a drying and warming trend over the next 5 days, temperatures ticking up through the 80s and low 90s as you with go back do work and school. wednesday of next week, we'll watch for a change and start to cool down.

welcome back to cbs 4 morning news on this saturday. so nice to have you with us. look at that view of elich gardens. you would go there if nothing to do. just wear sunscreen. we are tracking a bad situation in mesa. the spring creek fire broke out yesterday. it's near horse mountain. there's a road called house top road that has a fire warning in effect. this fire is threatening to spread into a populated area.

definitely growth of clouds. it's dry across colorado. 27% state abnormally dry area, denver included. for today, a lot of sunshine around the state. those temperatures much like yesterday, only a couple of degrees warmer. we're going to go into the 80s here in the metropolitan area, about 87 or so mid afternoon. kelly, there will be a couple of clouds that form in the afternoon. somebody may look out and get a sprinkle. tens of millions of volkswagen vehicles may be vulnerable to theft. security experts say hackers can copy the signal that opens some volkswagen remotely and duplicate the signal. cell initial vehicles are audis and jettas.

menu and challenging other fast-food chains to do the same. the sandwich chain is removing all artificial ingredients and preservatives from it menu. panera says they want encourage children to eat unhealthy foods. the new menu will includes soups, salads, pasta, along with water, juice, and milk.

marijuana is legal until our state, but smoking it in bars not. that could change this fall when denver voters will decide on two pot proposals. rick explains. >> these petitions for the latest in an effort to crew crate places to socially consume marijuana in denver outside of homes. one ballot proposal would allow in it certain bars and other businesses. >> we felt that adults, who enjoy using cannabis should the same rights and same ability to congregate and socialize with other adults as those who consume alcohol. >> it would allow vaping but not marijuana smoking inside, only outside. the only initiative offers a different type of place to use pot. >> it would be in a private club setting, so a person would have to fill out a membership form for each different type of

the premises. >> there are a few places in the denver area that allow people too to bring in their own marijuana and use it together but not any city of denver. one of the initiatives would require approval of registered neighbor groups. >> what we're looking for here is a couple of places in neighbors that want them to test the waters. >> what happens if both pass? >> i think we're going to have a lot of interesting places people to consume marijuana. the denver election division will take a few weeks to determine if each petition has enough valid signatures to make the ballot. a former cu student convicted of rape gets no prison time. why our legal analyst says the

squeeze out rain. we are following breaking news in our news room. this is happening in lakewood. police are asking everything in the area of 1st and sheridan to stay in doors as they try to arrest a suspect. reverse 911 calls have been made to residents in the area. the after a convicted rapist in boulder avoids a sentence. >> after deciding not to send a former cu student for prison for rape, boulder judge patrick butler is now the subject of an online petition to remove him from the bench. his decision faces criticism from the colorado attorney general, who took to twitter writing no prison time for

message. a jury found austin guilty in the rape. karen says if the judge had sentenced him to prison, he would not have been able to decide when, if ever, wilkerson, would get out. >> under colorado law, if somebody is convicted of a class 3 felony sex offense like this and the judge would sentence him to prison, the judge didn't have any control over sentence could be. >> in determining sentencing, adopted in 1998, leaves that decision up to a parole board, potentially making judges reluctant to send sex offenders to prison. >> it does create issues. >> on probation, wilkerson will suspend the next 20 years registered as a sex offender, limited in where he can live and

>> this is the news covering the nation this morning. seven people are hurt after a fire at a texas crude oil plant. we're learning four of them do have critical injuries. it happened last night while the group was welding at sunoco. three were taken to burn centers. california firefighters contained a fire that 30 homes southeast of san jose. the brush fire grew to more than 15 acres yesterday. firefighters dropped water and retardant in the area. no one was affected and no one was hurt. the cause remains under investigation. now to oregon, where a fire tornado is caught on camera near portland. the cornelius fire department captured the firenado on video. they happen when wildfires

greeley, fort collins, unhealthy for the sensitive groups and air quality problems in mesa. 59 in east frank town, eastern douglas county. 50s and 60s on the eastern plains, 62 in denver. higher up, it's chillies, 30s and 40s up there. 59 on the big picture, low pressure in northern minnesota, areas of disturbed area occasional rotate around that. they may clip eastern colorado. there's moisture on the southeastern plains. as we roll into the afternoon on futurecast, we'll get a few of those storms on the east central and southeastern plains. here in the front range, the atmosphere will try it's best to

it supports good behavioral health. with us is ricky allen. tell us, what is rmcp and hope floats? >> it's a statewide 24/7 community system of crisis intervention from which people experiences mental health our substance abuse crisis can be assessed. hope floats fund-raising event to support those programs that go along with that. it is a rubber duck derby where we race 5,000 rubber ducks. each one has didn't adopted for a donation of 5,000. those ducks race down the waterway to run prizes, our grand prize being $1500. we also have a live band and tons of free activities for kids anticipate families to participate in. >> wow. >> it sounds so fun.

>> can you elaborate on what it supports? >> rocky mountain crisis partners has a couple of different programs that we offer. our crisis line, this is staffed by masters level clinicians. anybody can call into that line for free and talk to a professional about any sort of issue they may be having. we also have a peer support line, which is people, who lived with experience in dealing withe substance abuse issues in recovery, who can offer the emotional support anybody might need during trials. we also have a text line and you can access us online through chat as well. >> such an important cause. what a fun way to get people involve and to bring attention to an issue. real quickly, how can people support hope floats or what can they do to be involved?

we see have been dealing with this for a long period of time. so we see a lot of patients who are frustrated, they sometimes feel lost because they've been told nothing else can be done, and then they're just having to deal with the side effects of decreased quality of life. you know, oftentimes it they can't sleep at night. they suffer with a lot of burning pain,. they have numbness or they have issues with balance, and it's very frustrating. what causes it? well the majority of cases we see are caused by blood sugar problems or diabetes. but there can be a number of things, whether it's toxicities, side effects of medications, and some cases are idiopathic, we don't know the cause. all right, well treatments then, what are the traditional treatments that are out there? well most patients we see that have been dealing with this, they're on medications like gabapentin, larotin, lyrica, and all of which are good. they can manage the symptom of pain, but it does nothing for the nerve. so as the medication wears off the pain is back, and it's just this ongoing process. why do people continue to suffer even though they are taking the medication. well that's just it, the medications can be good for managing that symptom of pain but it does nothing for the

e pain is right back. well talk about what you do in your office, because you're having great results and, really, people that have been told that nothing can be done for your pain, you're helping them. yeah, the technology that we use is what we call electronic signaling treatment. it's a form of current that we use at very high frequencies depending on the type of nerve damage patients have. nerves are electrical. we want to get these nerves to fire better. now with this technology, we also use what's called a vasopneumatic device which helps increase blood flow or circulation to the nerves, so by stimulating the nerves, getting all right, well talk about the results that you're getting then. well, number one is we want to see subjective improvement, patients feel better. we want to see that they can sleep at night. they're not fall risks, they can have better balance, and they can just do more. we also want to see an improvement in nerve function, so we monitor that very carefully by assessing patients as we go through, because the goal is to improve function. all right, now you're very unique in what you're offering, because you are helping people that have been that they can't be helped. but talk about what else you do in your office.

qualification process to make sure we understand not only what's driving their condition but also what type of nerve damage they have. there's different types of neuropathy, and we specifically want to know, because that affects how we treat the individual. all right, we actually talked to a few of your patients, and let's take a listen and see what they had to say. great. when i first started coming to dr. anderson, i had no feeling in my feet. it was very, very difficult for me to drive a car because i couldn't feel the brake pedal anymore. i no longer fear losing my balance as i walk, i have feeling in my feet and lower legs again, and driving a car makes me much safer on the roads than i used to be. he told me he though he could help me and found out that it's probably my autoimmune system isn't working correctly. i then went through the treatments, and right away i
