the latest on campaign 2016 coming up. let's get a good look at the forecast. >> lauren whitney is tracking that for us. >> another warm and dry day here across the front range but on the western slope and into the high country a chance for rain. temperatures starting with 50 in denver, 40 lyman, 35 let bill . temperatures are mild and we will talk about the heat and a cool down coming good morning. we've been talking about cones for the last half hour and this is an area where you were running -- you will run into a few of them. a lot of this construction has been moved out of the way and that is what we are seeing on 285 as well. a case that folks assist desk focused attention on marijuana medicals. a judge is expected to rule if richard kerr can stand trial.

courthouse and has been following the process. this is been a long process.>> reporter: it was a year ago that richard kirk changed his plea to guilty by reason of insanity and at that time he was sent to the colorado mental health institute in pueblo for evaluation. this morning that evaluation is finally ready and it will go before a judge and she will make that decision. the judge will review that comp e for trial or if richard kirk could go to pueblo for treatment at the state mental hospital. a doctor hired by the defense wrote that when kirk -- when kirk killed his wife he was experiencing psychotic symptoms due to a marijuana candy. he was so impaired by the candy he may not have been intending to kill his wife. the kirks young children filed a lawsuit against their father for negligence but also when

they claim the manufacturer and the store that sold the edibles failed to properly warn of potential side effects and that the recklessness led to their mother's death. christine kirk told dispatchers before her death that her husband was acting more drunk and violet and crawling three bedroom window cutting his legs on broken glass. prosecutors argue that he had the wherewithal to remember the code to a locked gun safe and pressed the weapon to his wife's head. richard kirk degree murder charges and the judge is set to evaluate kirk and reveal -- review that competency this morning at 8:30 am. jamie leary, cbs4. police in a small town in south carolina want to know why a teenager opened fire at an elementary school. the teenager first shot and killed his father yesterday before going to a small elementary school in town fell.

year-old boys. one remains in critical condition. the suspect is now in police custody. more about the online threats saying there could be clown attacks in greeley. criminal charges against a 15- year-old student who posted a threat to facebook. the post warned of halloween shootings at northridge high school and franklin middle was caught with a bb gun at school. the 11-year-old told classmates he would be wearing clown gloves when he used the gun. the boy was sent to a youth detention facility. let's go to lauren and joel. weather and traffic every 10 minutes. dry across the front range but on the western slope a few

we are a week and to fall and you know what that means. just days away from flu season. it runs from october to may and as the health specialist cbs4 health specialist kathy walsh reports, experts say now is the time to get immunized. dr. min kao but garris with kaiser permanente is getting set for the season with the flu shot. the infectious disease physician got a high dose vaccine recommended for people

be epidemics this year and we never know that in advance. it's good to be prepared. >> there is a choice of vaccines this year. some are trivalent. effective against to a strains and one be strain. other vaccines are quite travailing, and they target the three strains and an additional be. you will need to be brave. flumist isn't an option. >> the centers for disease control recommend this year not to use the flumist because in two of the past three flu season's the flumist was shown to be ineffective. disease pharmacy specialist for kaiser permanente, says everyone over the age of six months should get the flu shot. >> you absolutely cannot get the flu with the flu shot. >> if you are 65 or older the center for disease control recommends pneumococcal vaccines given in a series to prevent certain types of bacterial infections that can cause meningitis and ammonia. >> you can get pneumonia?

out to the, we're getting moisture flow coming up and we have a lot of rain in arizona and parts of new mexico and nevada and utah. we have this moisture flow coming in from the southwest so we will see thunderstorms and parts of utah and arizona and new mexico and the western slope and the high country with a chance. high pressure to the east is keeping things nice and driver the front range and keeping us in those 80s. one more day of dry comfortable weather and then we will get changes. looking at future cast, more rain on the western slope as we head into the later morning and early afternoon but again we are dry across th the high country and doesn't make it into the foothills because of the high pressure keeping us on the dry side and heavier rainfall possible in the southwest tonight. that will shift to the north into the morning and in denver maybe some clouds but we do have the chance of the rain heading towards us tomorrow afternoon and into the evening. we may get in on some of that action. today, 83 denver, 82 greeley, 76 burlington, 86 la junta. 68 steamboat. 71 grand junction. five day forecast tomorrow, little bit cooler and a chance for storm. sunday mainly isolated side and cooler on monday. a bigger cool down by tuesday.

an important date coming up for college students and families. financial aid form which is the free application for student aid is available this saturday, october 1. three months earlier than in previous years. the fafsa form. what you need to know with joe slush and your. it's important jill. i know. but students need so important and why was this release date moved up. >> reporter: despite allen's sarcasm pay attention because this is the most important form you will get. it is determining how much money students and their families will qualify for college. this includes free grants, scholarships, low interest loans and the release date was moved up to make sure that the most recent tax information was

may say it's available this weekend but the deadline is not until june 2018. you are right with a big exception. the state and school probably have earlier deadlines to receive aid. for some states it is not even a date. they say it is as soon as possible after october 1 because they have a limited pool of funds that could run out. if you want to maximize your potential aid you will get cracking and get busy and submth as possible. >> that's great advice especially for people who are procrastinators. what prevents families from receiving the aid. >> it's amazing because according to nerve while it over the last year to .7 billion to $.7 billion in free federal grant money went unclaimed.

submitted their fafsa. they don't do that probably because they think they earn too much. the department of education knows aid is not based on a simple income line in the sand. it depends on your personal circumstances like the year the student is in school and the number of kids you have in school at the same time. your family income. and the cost of attendance. i should point out that a lot of people didn't receive aid and this and i do it again. the circumstances can change in so you are -- your award could change. even though you don't get the pell grant maybe you could be eligible for other types of aid like work-study and low interest loans. for more on how you can scoop up the $2.7 billion for college go to jail on money.com. good info. great to see you. >> we need all the help we can get.>> that fafsa is saying --

talk about the team and that is one of the reasons the team was so excited when trevor got the game ball after the win on sunday. he deserved the nfl weekly award and the first player with over 300 yards and four touchdowns and no pics any first career word start. that is good progress for a former seventh round pick. >> it's great to watch him grow and play like that on the road. it not only brings players and everybody together. everybody pulls the trigger every week. trevor is very sharp low key from the standpoint of tone this down and keep going and this week is another tough test. i like the way he has things together and his teammates respect that. >> broncos on the road this week taking on tampa bay at pm
