ere. this is cbs4news at noon. a judge says a denver man is competent to stand trial for the murder of his wife even while he was high from a pot edible at the time. this is the news on cbs4. i'm alan gionet. it has taken two years to get to this point. the wife made a desperate call

20114. she said her husband was behaving oddly after he was eating a marijuana infused product. he shot her while police were on the way. he had to undergo a psychiatric evaluation. here is more. jamie. >> reporter: there were two options richard kirk was either going back to the mental health institute or he stand trial. that is what the judge decided today. he will stand trial. now, even though the judge decided that here today, he will stand trial, last year kirk pled guilty by reason of insanity. that still stands but the evaluation indicates he was competent to stand trial. officials with the d.a.'s office said even though he was

either way. he has been in custody since the murder of his wife. his defense said he was so impaired by the candy, he may not have intended to kill her, but he had the wherewithal to remember the code to the lock gun safe and pressed the weapon to his wife's head. >> he is facing a first-degree murder charge and the trial is slated for march 6th and two weeks set thanks for your work out there. >> a family hopes an autopsy reveals clues because her and her sister were found dead. she joined her at that expensive resort in the island off east africa. stan bush explains the mysterious circumstances. >> reporter: the 37-year-old

dream. the skate ter and her sister robin were staying at r this $2,000 a night resort, a luxurious area. two days after posting these on facebook, both sisters were found dead in their hotel room. the cause of death, a mystery. according to reports in the newspaper, the two were drinking the day they died and needed help their villa. they were found by hotel staff in their beds the next morning. there was no sign of a physical owl tercation but undisclosed medications were taken from the room as part of the investigation. she was a synchronized skater. she left the team this year to join her sister on their vacation on the island in the indian ocean. >> she talked about it as a trip of a lifetime and i think she and robin felt like it was

their relationship and their love of travel and adventure >> reporter: their family has flown there to recover the sisters and get more information about their deaths. >> stan bush, cbs4news. developing right now. an internal investigation is under way after a ten--year-old denver police horse died. that horse which was named mc hammer showed symptoms of colic. they took it to a tuesday. nay decided to put the animal down. cbs4 raised concerns about the potential of abuse. they are investigating to see if there was any negligence involved there. >> >> new details now about the shooting of an elementary school in south carolina and what happened ner. a 16-year-old remains in critical condition after he was shot in the leg. another student and a teacher are out of the hospital. the 14-year-old shooter never got into the elementary school

firefighter. as you have heard, one of our firefighters did that and probably saved lives. he was not armed. police say the teenager first shot and killed his father at home, a family friend said the 14-year-old was being homeschooled after he had been suspended for bringing a weapon to school previously. >> >> one person is dead, more than 100 hurt, some critically after a commuter train plowed into a stat arrived at the scene and we just heard from the n.t.s.b.. >> reporter: the commuter train slammed through a wall at full force inside the rail station in hoboken, new jersey. a transit employee was inside the terminal, 30 feet away from the crash. >> i ob severed it's coming at a high rate of speed.

our sleeves for flu shots. the season runs from october to may so you want to be ready. there will be between 157 and 168 million doses available. there are different varieties too. some are effective against the a and b strains and others against a b plus another b strain but you need too get the shot, even the kids. >> it is disease control recommendingot mist because in the past three seasons it was ineffective. >> well, it is recommended everybody over the age of six months get the flu shot and if you're over 65 or older, obviously, the centers for disease control and prevention says to get two neumococcal vaccines that could cause meningitis and pneumonia. >> when it feels warm like it

it hurt. but you really have to get it. it was the after affects, a little sore. let's take a look outside nis afternoon. blue skies here in denver. we're off to a beautiful start to our lunch hour and on the other side of the state we have rain to start off this lunch hour. it has been raining on the western slope as well. we have seen pretty decent range but here we're on the sunny side and we should stay that way today. it will be nice for temperatures once again in the 80s. it will be pretty comfortable for us. you will get a cooldown next week. let's take a look at our satellite and radar again. we have seen that rain for a little while now. eastern plains we're dry. all the way from just parts of our southwestern corner into moffett county scattered through aspen a little snow

it has been going nicely all the way from mac through parts of pal la sade as well. we have seen pretty decent rainfall in that western side of the state. again moisture flowing up and tropical moisture for us for parts of idaho and colorado today into new mexico and arizona. we have the rain. but for the front range, high pressure is keeping us dry side. that doesn't cross the continental divide. maybe into the foothills for a couple and 80s for that. that rain will continue art times pretty heavy. we may see scattered showers well into the evening hours. we do stay on the dry side and there could be rain tomorrow morning from telluride into craig and parts of steamboats. then tomorrow evening some will

tomorrow night. we're cooler in parts of the state. western slope is raining so they are cooler. eastern plains a little bit, as well, a backdoor cold front. 72 towards burlington and limon. 6 el in the springs. 65 in craig and 59 in grand junction. temperature is 83 in denver. 80 ft. collins. a lot of of 60s in the high tomorrow we head down to the 70s here in denver. a chance for storms. we may get more on saturday, maybe some on sunday. then monday fairly dry. our next system may come barreling our way on tuesday and alan, there is a chance for snow in the high country so if you want to look at the fall leaves, this weekend i would try to get up there if you can. >> or they get knocked off f by the force. >> yes.
