live from colorado's newschannel this is cbs4 news at noon. >> the colorado supreme court makes a big ruling in the case of two teenage girls accused of threatening mountain vista high school. thanks for joining cbs4. i am alan gionet. they have been charged as adults. defense attorneys argued they should be tried as juveniles

state's high court ruled on today. let's find out what that is about. cbs4's jennifer brice joins us from the newsroom. and the defense really won this round. >> reporter: yeah. the supreme court said siena johnson does not have to produce mental health records in order to get her case against her back to juvenile court. siena johnson and brooke higgins were charged as as for the alleged murder of mountain vista high school. their lawyers asked for this reverse transfer. that means they want the cases to be moved back to juvenile court from adult court. a judge has to make that decision. the judge ordered the girls to produce mental health records after prosecutors asked for them. the supreme court made a ruling in johnson's case saying a court cannot order those

requires the court to consider mental health records the made available. the supreme court only made a ruling in johnson's case. in the higgins case the ruling set the questions they asked for hypothetical and not based on facts. they state the ruling from the johnson case. we asked the district attorney's office for a comment, but they said it would be inappropriate t both johnson and higgins will be back in court later this month. jennifer brice, cbs4 news. investigators are trying to determine why a young driver went off in arapahoe county road rolling a car that burst into flames leaving five dead. we are waiting for the corner to reside in these of those five. three young men died and two and woman also inside the car died. two of the dead graduated from lincoln high school. this happened on county line

drivers to speak to that area well above the posted limit. >> well, you get a lot of kids that come out and go to that third bridge. usually they are flying down the road at 100 or 100 plus. >> that sedan led skidmarks in the early morning crash yesterday. the car was so badly damaged it was difficult for investigators to figure out it's make and model. investigators in aurora trying to determine if speed and alcohol played a role in a crash in dayton, florida. the driver and another man died any woman who is a passenger has some minor injuries. right now police are investigating a shooting in centennial. this happened on aberdeen where a homeowner called 911 to report a shooting. that man was found in a car a few blocks away.

right now the caribbean is racing for a category 4 hurricane. we are only one notch from the most category five. winds are over 130 miles-per- hour as people are feeling storm surges. mark strasburg has the very latest. >> reporter: limbless downpours triggered floods. as hurricane matthew hit jamaica on sunday. in kingston rushing water covered streets of stranded cars with drivers pushing vehicles down e city of mcgrail a waterspout was spotted over the ocean. officials issued an evacuation order throughout the island. >> we are sure jamaica will be within the 90% of the storm. >> reporter: in haiti the storm is expected to do between 15

the government has opened 1500 emergency centers that could hold 340,000 people. matthew will make its way toward cuba with hurricane conditions early tomorrow. the us has already evacuated many family members in guantanamo bay. the statement has told nonessential personnel in jamaica and haiti in the bahamas to evacuate if they can but if not to hunker down. it is still too early to forecast the impact of matthew on the u.s. of you living on the east coast could feel it by the end of the week. marcus ross men, cbs news, jamaica. if it threatens the united states, it will be friday or saturday and it will be the carolinas. there is still a lot of conversations about the track it will take. if it did threaten in the u.s, it will probably not be a major hurricane.
