we have new information on a man shot and killed in boulder. we've learned he had served in the marines. and he had two young children. 29-year-old brandon simmons was carrying a machete and threatening people. >> officer shot him after they say he would not put down that machete. andrea flores live at the marine recruiting office with new information about simmons tonight. >> reporter: guys, friends tell us and we know this much so far brandon simmons was a marine as you mentioned. but was discharged and moved to colorado about five months ago. loved ones tell us he was battling some demons and moved to the denver area to try and get some help. we are learning more about the man shot and killed by police on cu boulder's campus after

friends say this man 28-year-old brandon simmons was an active marine for 10 years but was recently discharged. they say he was last stationed in san diego and spent time serving in iraq. his last facebook post early wednesday morning reads, i command you to stop eating creatures from the water. sunday he posted this photo from the film gangs of new york with a man that appears to be holding a machete and a cleaver. those closest may have been suffering from ptsd or depression. they tell cbs4 he grew up in and out of foster homes and shelters in texas, loved ones say he leaves behind two young kids. friends say he moved to colorado less than a year ago but investigators are still trying to figure out what ties he may have had to the campus. and we learned just a little bit ago police have named those two officers involved in the

are on paid administrative leave as the investigation continues. reporting live in denver, andrea flores, cbs4 new. >> thank you. the man who kidnapped a woman and shot a good samaritan who tried to help her is now in custody. home surveillance video of the attack is something we showed you only on 4. it shows a man grabbing a woman and shooting her in the leg. later the homeowner intervenes and gets shot too. police arrested jesus garcia chavez assault, kidnapping and domestic violence charges. the search for a man believed to be dead. john cizek was last seen at a mcdonald's in alamosa and is thought to have been murdered somewhere in jefferson county. his friends in california say he can to colorado to pan for gold. while officers found his wallet and credit cards, with a gunman

june. police arrested the gunman david little. little then led police to his bloodstained rv. which is why police believe he killed him. little has since killed himself in jail. the disability community is demanding action after reports of abuse at the pueblo regional center. federal investigation found patients were burned with blow dryers, some even had words that were cut into their skin. cbs4's jennifer brice live at the state capital tonight. disability groups say this is a statewide crisis. >> reporter: that's right, karen. these advocate groups say that they believe it is the governor's job to fix what they call is a broken system and they are demanding action here at the capital today. documented abuse at pueblo regional center ended with eight employees fired. now this room of advocates for people with disabilities are demanding statewide changes. this father says his son had a near-death experience.

weeks. at his arapahoe county host home. and he has profound disabilities , could not speak for himself, -- >> reporter: and he miraculously survived. he says his son's case was investigated but the abuser was not held criminally responsible. >> the abuser was fired but since there is no caregiver registry in colorado, he is free to continue to provide caregiving and other settings. >> reporter: advocates say ti become liable, they do not believe abuse will stop. the people here want legislation to protect the disabled. >> we are not here to vilify the industry, the people, there are some amazing people out there but we do need more checks and balances. we need to fix this very broken system. >> reporter: kathy hartman says her son was at a regional center for two years. she too is outraged about his care. >> many of the same problems

>> well, it's not any big surprise. it's consistent with the other behaviors we are familiar with. of donald trump. so i'm not sure this will add any more to his problems. and yet there probably are some evangelical voters that might be hanging by a thread on this candidacy that could be impacted but they saw another side of the trump-pence ticket earlier when pence did such a wonderful job on tuesday night. so during that debate. we'll see what happens. >> what do you think? >> i agree with dick. no surprise. but i think it's hurt trump badly because i think some voters were saying well, he's done this, he's done that but we'll give him another chance. he's running out of chances like evangelicals. and i don't think mike pence can do enough to repair the damage that donald trump is doing to himself. >> the second presidential debate is this sunday, a town

developing right now hurricane matthew left plenty of damage along the eastern coast but it could've been worse. trees torn apart by the damaging winds at cocoa beach. and the siding was pulled off some homes. more than 1 million people have lost power. and a million remain under evacuation orders from jacksonville all the way up to the north carolina spinning north. some people who live in the past are likely to be working in denver this weekend. over at the great american beer festival. melissa garcia caught up with breweries visiting here from matthew's evacuation zone. >> reporter: as they get their booth ready to show off their craft beer in denver, andy elliott and mike fielding can't help but think about their storefront back home in johns

brewing is in the upper part of hurricane matthew's path. staff boarded up the windows with plywood and packed the doors shut with sandbags. >> it's a semi-new building and hopefully the roof doesn't get ripped off. but our biggest concern is with loss of power for over eight hours potentially. that would cause the. to spoil. >> reporter: in an area where parts of downtown light below sea level, fielding hopes the brewery will prove stronger than the storm. >> the brewery bit of a high ground. it's at 21 feet above sea level which is a lot better than five feet above sea level. when the storm is coming so hopefully we survive this one. >> reporter: a handful of other breweries are also from the evacuation region. at least one of those has backed out from the festival due to the hurricane. florida beer company and cape canaveral shutdown shop and posted this sign with a hurricane evacuation plan. grab beer and run like hell.

warm temperatures. back up into the 70s but by tuesday we have a dip coming through, another system so by tuesday we have slightly cooler temperatures along with chance for some showers so we'll talk more about that. right now over to ed. >> . speaking of showers here is hurricane matthew category two right now, winds 110 moving north at 12, just north of jacksonville as you see, the luck they have had as he skirted the coast is on the east side of the eye, where the strongest winds are. westside, they are less winds, but lots more moisture coming their way. that's where they are going to have flooding problems. this is where the path was. this is where it is right now. here is the projected path. all these models show a different path. but most of them are showing curving and coming back down where it's been. some of these areas maybe the bahamas and cuba could get hit a second time from the same storm. as we take a look this is pike's peak southeast, you can

earth. you can see a beautiful clear shot from there. 67 and 68 today after a start of 32, so officially we had freezing at the airport. 36 downtown, 69 and 40 would be normal. for the weather watchers walden 51, fort collins 63. 65 in evergreen. west, 68 degrees today. 65, southeast 10 for the windows. some pictures from the storm county, nice shot from doug peters, this is gordon with a dusting of snow. this is leo chavez near leadville, the snow coming down right at them and look at this from carolyn the route, rabbit ears pass, nearly leafless branches covered with snow. temperatures tonight mostly in the 20s and 30s. 20s higher up, 30s and 40s out west. tomorrow we start to get a little bit milder with mostly 70s of the eastern plains. nearing 80 degrees.

hurricane matthew continues to crawl along the atlantic coast pounding florida will -- at least four deaths blamed on the storm that includes two women who died after trees fell on their homes. debris litters the streets. ed greene joining us now. storm is coming. there's a lot left in this one. >> a lot of rain and a lot of moisture to work with. and strong winds are still around. don champion is in daytona beach right now. he is live where the hurricane has passed by. what can you tell us? >> reporter: a good evening. certainly we are still seeing powerful wind gusts and the rain is falling. you may remember last hour we were on the other side of one of the main bridges here at daytona beach. while we have crossed that

tell you it is just jaw- dropping to see the damage that matthew and least. the power is out here, so it's getting harder to look at the damage. you can see this building here clearly part of the roof was ripped off, there's a small boat in front of the building here. and further up the coast, matthew is not even done wreaking havoc. hurricane matthew pounded the florida coast with blinding rain and winds that gusted over 100 miles an hour. e moves north. >> it could be the worst part of this is still to come. >> reporter: hurricane force winds snapped trees and destroyed the side of a boathouse in smyrna. all over the state debris littered streets. >> i've seen trees uprooted. i've seen downed power lines. i've seen carports falling on cars. >> reporter: in jacksonville huge waves crashed sure. overtures are worried matthew
