after this attack in breckenridge, two men charged with a hate crime. a man kills 18 and wounds

illegal pot go. how far does this scandal grow? >> how many dead voters is acceptable? first at 10:00, we have breaking news from boulder county. police are using robots to try and defuse a possible explosive device in nederland. someone planted it right outside the town's police station. live tonight, stan, this tense situation has certainly been unfolding for hours tonight. >> reporter: and it continues as we speak, here's what we a nederland officer came to police headquarters and saw a backpack abandoned outside. he brought that bag inside and looked through the contents and found what he thought was an improvised explosive device. that led to the immediate evacuation of the park that you see behind me. this is essentially one of the busiest areas in nederland. there are several shops here in the grocery store. now the entire area completely abandoned. we're standing outside of what is considered the blast radius for this device.

called in to assist the police department in this. investigators were able to dismantle several items from that device but they could not say if the device was fully deactivated. the items were taken to a lab in boulder for forensic testing to determine the origin. just about 30 minutes ago, we sought to bomb robots that appeared to be dismantling the final piece of that device. looked like a plastic bag that was full of powder. poli hindrance in their investigation. but they are moving deliberately slowly so they don't destroy any evidence in this case. police have not said if there is a suspect or if there's even video of that person dropping the bag off in front of police headquarters. they also have not been able to confirm whether or not any threats were made to police in the days before this incident. we'll have the latest when we have it, live in maryland, stan

now our weather alert, a big cooldown overnight and some rain is falling right now. lauren whitney is in colorado's weather center, with what we can expect for tomorrow. >> looking at much cooler temperatures tonight and tomorrow. just know that you may actually meet the jack tomorrow morning and right now cold front is working its way through. 53 at the double-a, but much cooler air will be sinking in after this fund passes through. right now 24 in cody, 35 in cheyenne, hit our direction. still a little bit windy, fort collins, limon winds much stronger ahead of that fund. and our satellite and radar, you can see a lot of rain out there in some areas. snow into parts of the high country, front range mountains and most of our thunder storms on the eastern plains. but there's a lot of rain in parts of weld county right now up near greeley. into parts of eaton and nunn. up to our north as we zoom on into the denver area, a little bit of rain for us as well

areas but once you had north there will be a little bit more rain out there right now. taking a look at futurecast, some of this doesn't stick around overnight but we'll start to clear, drizzle overnight tonight and early tomorrow morning. also some fog to start out your day and we're looking at those clouds to slowly clear a bit more. we're going to talk abt cooler temperatures tomorrow in a moment. and then how long that will last. back to you. tonight we are also finding out more about the man who caused a deadly in a lake at city park. jeff todd has been covering this story since it broke. that man is talking only to cbs4. >> reporter: karen, he says he was probably driving about 90 miles an hour down this road. the speed limit around here is just 35 miles an hour. investigator told me last night this was a bad one. some evidence, a headlight in

the side of the road tonight as the cars on this road started bouncing around like balls on a billiards table. >> i was on the interstate. a car came out in front of me. i don't really remember after that. i thought i was dead. >> reporter: tyler white is from tennessee but had recently come to denver to start a new life. he told cbs4's jennifer brice he smoked marijuana yesterday afternoon. >> i wasn't high at the time when i was driving. you smoke, a couple hours later, out your system. wasn't like i was stoned to death driving. >> reporter: white is believed to have been in this charger. he reentered this pre-is killing the driver. and setting off a chain reaction. >> we do suspect that alcohol or drugs or both are involved in this particular incident. >> reporter: white is charged with vehicular homicide and leaving the scene of a fatal crash. about three hours after that crash, white was found by paramedics inside a pond in city park.

>> reporter: white also had a message for the family of the woman he allegedly killed. >> i'm sorry that i took your daughter's life. and i just pray that you forgive me and asked for repentance. i'm sorry. >> reporter: so far we don't know anything about that woman other than the fact she was 25 years old. as for the people that were in the third and fourth cars, did not have serious injuries. live in denver tonight, jeff todd, cbs4 news. >> thank you. another story only on cbs4 tonight, a hate crime caught on camera in breckenridge. you can see a man on a bicycle get punched and then thrown to the ground. investigators say he was targeted because he's gay. now these two men george howard and raymond solis are charged with bias motivated crimes and assault. developing story and ready to -- murder charges for the

one teenager and critically injuring another. investigators believe the teenagers hopped the fence trying to steal the man's illegal pot plants. karen morfitt joins us live tonight. you've been taking a closer look at whether colorado's make my day law will actually come and play here. >> reporter: karen, when those teens hopped the fence onto someone's property, that raised the question but under that law, homeowner can only shoot and believe the person intends to commit a crime. and use physical force. but that right stops at the door. backyards are not included. in this case they say self- defense could be an argument that's used. investigators say two teenagers were shot after hopping a fence into the backyard of this home. 15-year-old keylin mosley did not survive and a 14-year-old he was with was critically injured. >> we heard the shots go off, there was about six initially and then a little break and then two more.

charges of murder and attempted murder. according to paperwork hammock may have been trying to protect his illegal marijuana plants. >> the law doesn't say that you can use deadly force just to defend your property. >> reporter: hammock allegedly told police the teens jumped over his fence and he found them lying on the ground. officers would later discover two rifles and spent cartridges near hammock's second floor window. rm steinhauser says it's more likely that the suspect would argue self-defense. >> if you have facts where there is no warning shots, people are in a yard, and the other person is shooting from an upstairs window, it's going to be hard to argue that he felt physically endangered. >> reporter: hammock is also facing charges of illegal cultivation of marijuana. denver district attorney will

live in denver, karen morfitt, cbs4 news. on the campaign trail a twitter firestorm from donald trump, he not only went after hillary clinton but his own republican party. spot donald trump blasted paul ryan for refusing to back his campaign. on twitter trump complained it is hard to do well when paul ryan and others give zero support. and called ryan very weak and ineffective. toronto -- republicans distan far more difficult than crooked hillary. they come at you from all sides adding it is so nice that the shackles have been taken off me. >> i did try and [ bleep ] her. >> reporter: republicans have been pulling away in droves since the video came out. like john mccain. >> when mr. trump's attacks women, and demeans the women in our nation and in our society,

we are following breaking news in nederland, someone left an explosive device outside the police department. sam -- stan bush live there for us tonight. the bomb squad trying to defuse that device. >> reporter: that's right, the investigation continues, this ied or apparent ied found in a backpack outside the police department which is inside this plaza which has been evacuated for most the day is one of the busiest areas in town. we're just outside of what's considered the blast radius. 45 minutes ago the bomb robots were dismantling what appears to be the last piece of that package. earlier in the day two other

this apparent ied. and then taken into a forensics lab in boulder. we were not -- it wasn't clear if that had fully deactivated the device. the investigation is continuing on. nederlandse police department says they are intentionally taking a long time so that they don't damage any evidence. it's also not clear if there is a suspect or video of a suspect at this time. stay tuned to the cbs4 morning news for any updates. as this situation looks stan bush, cbs4 news. >> thank you. a twitter campaign to raise awareness about sexual assault. hours after the donald trump tape made the news on friday, author kelly oxford launched a twitter feed asking women tweet me your first assault. they are not just stats. i'll go first. old man on city bus grabs me and smiles at me, i'm 12. >> sharing personal experience and when you do that you put yourself in a very vulnerable position. >> the response, explosive. with more than a million women

the not okay hashtag. a developing story tonight, wisconsin where a clown prank ended with a couple in big trouble, dashcam video showing officers stopping two men dressed as clowns. they were chasing cars trying to scare people. a woman was driving that pair around. turns out the woman and one of the men have a 4-year-old daughter which they left home alone. the parents are now facing child neglect charges. have you seen this today? a bridge implosion bust in arkansas. the first attempt to bring down the 93-year-old bridge failed. so if you hours later they tried again. -- a few hours. they tried again. second time is a charm. now the contractor has until 10:00 a.m. to get the metal out of the river to reopen the navigation channel. we've been talking about it for days but the cooldown is finally here.

lauren whitney now and talk about this big change for at least one day. >> it is going to get cool around here. cold front working its way through. that will bring much chillier temperatures. 64 in grand junction, 39 in gunnison, 54 in avon, 48 in fort collins, 54 out in burlington. that front is working its way through and behind it check out all these cool temperatures. 29 in casper, 24 in cody, 27 gillette. those temperatures are sinking down our way. right now 55 degrees in denver, 53 at dia. starting to cool off quite a bit, winds out of the east northeast at about eight miles an hour. upper 70s, we almost hit 80 today. 79 out at dia, 77 in the downtown area. average is 67 so we were significantly above where we should be. tomorrow we're going to drop 10 degrees where -- below where we should be. a big swing heading our way. a little bit windy up to the

better than they were earlier. weather watcher debbie bidwell in fort collins says it's raining pretty moderately there right now, starting to pile in the street and this is the most rain they've seen in a very long time so let's get to the satellite and radar. so you can see what's happening. rain all the way from the western slope snow in parts of the high country and weld county actually getting some pretty decent rainfall. first we're going to start off in the denver thornton into brighton, of that direction you have a little bit heavy rainfall, some in the city right now. it's north that we definitely have more action going on. as you head up towards fort collins, johnson's corner area up towards loveland towards grover into eaton area, greeley, heavy rainfall and right now up into parts of rocky mountain national park into the front range mountains, snowfall on the western slope all the way from the craig hayden area down into yampa,

area of low pressure. we may still get a little bit of action in the denver area overnight. a little bit of drizzle and then as the front moves on through, skies were clear but temperatures are going to drop 15 to 20 from today. futurecast again overnight tonight, a little bit of rain possible and tomorrow morning we have potential for a little bit of fog out there as well. still a little bit of drizzle to start the day. 39 to 19 denver, 39 in boulder, 37 in burlington. 39 in frisco and 46 in grand junction. big changes when you notice it, 58 in denver, 57 boulder, 55 or 54 in burlington, 61 in eagle, 65 in craig and 73 graham johnson. five-day forecast after tomorrow right back up to the 70s, even some 80s on friday, 70s this weekend, really looks lovely, next week we have some cooler temperatures on the way. maybe a chance for a little bit of rain on monday but down into the 60s by monday. >> plus a little more normal. mail in ballots for the presidential election go out next week.

and other cases of voter fraud. brian maass breaking new information for us tonight and you've uncovered a real problem, brian. >> it's illegal to take a dead person's ballot and vote in their place. but that's what we uncovered last month and again this month. 88-year-old irvine of loveland died on september 2011. six weeks after his death, a vote was cast in his name. >> we did find a single voter that did vote. unfortunately. >> reporter: so a dead person delta? >> yes. >> reporter: larimer county clerk and recorder angela myers says that was uncovered due to the cbs4 investigation. dying to vote which found some dead coloradans bolted from the grave. myers says after his death, someone duplicated the registered republican signature on his mail-in ballot and voted. >> you definitely don't think this was an accident at this

>> i don't think so. no. i don't think it was an accident. >> reporter: someone intentionally voting fraudulently? >> i think someone signed his name to his ballot envelope. and that's fraud. >> reporter: officials say with nearly 4 million votes cast in colorado elections, some fraud is expected. >> how many dead voters is acceptable? >> none. >> reporter: clerk and recorder is surprised there aren't more from the grave. >> that's a success story. and i think it really to me, reinforces my faith in colorado's system. >> reporter: but in recent years in several counties we found cases of people convicted of voter fraud. for filling out someone else's ballot or boating twice. >> so you do have people down here in douglas county to commit voter fraud? >> we've had cases. we catch them and send them to the d.a. >> reporter: how does it happen? ask mike simmons. >> ballots kept coming to the

her death is on file with the state of colorado and in other government databases. but simmons says every year since her death, ballots kept coming to her boulder home. >> if it shows up in the mailbox, there's a temptation that somebody could open it up, throw it out and send it in. >> reporter: simmons saved her ballot from last fall. >> so this was october of 2015. so that would have been five years and after she passed. i'm not convinced that my mom's case is a singular event. i think it happens quite a bit. there is an ethical responsibility if you receive someone else's ballot that you return it. and mark it deceased. >> reporter: we will be turning daisy simmons ballot over to voting authorities. presumably they will scratch her from voting rolls. officials emphasize that while
