arrested for another crime. cbs4's shawn chitness live at the courthouse in denver where investigators will be anxiously awaiting the arrival of this man. he knows he's wanted, shawn. >> reporter: right, alan. in a few hours from now we'll find out if he does show up for charges related to domestic violence. denver police hoping samson whit more shows up so they can arrest him with charges of graffiti on the 32-year-old is a registered sex offender and considered violent and stalking the campus. graffiti was found around the university and united methodist church near the school was done by whitmore. they were able to identify what was spray painted across campus and tie it back to the suspect. they found it in several different places. now they're waiting to see if he does show up at the court appearance scheduled for 8:00

thank you. the wildfire in southern colorado is doing more damage than initially thought. it's already burned more than 25 square miles near pueblo. it has already destroyed five homes so far and there is zero containment. here's our matt kroschel with the latest. >> reporter: at a community meeting here in florence last night, people who have evacuated, and there are more than 300 of them, were able to get more information about their homes in particular. the sheriff houses have burned and 13 other buildings. today we were on the fire lines as we watched a lot more of the aircraft start to attack from above. right now about 12 aircraft are being assigned to this fire. 300 firefighters working on the ground and right now the fire more than 16,000 acres and it's continuing to burn in several different directions. in westcliffe, smoke completely

towards the west. here on the eastern flank of this fire, the commute of whetmore is watching as the smoke gets closer and the flames continue to move. now the sheriff says evacuations remain in place. they'll be contacting homeowners as they continue to explore this fire area and it's a very large fire burn area. if they find any more homes that were lost, they'll call those homeowners directly. i'm mountain newsroom. donald trump spent time in colorado before tonight's final debate in las vegas. polls show him trailing in several swing states, including colorado. he insists the polls are wrong. as for hillary clinton, she's been off the campaign trail preparing for that debate. here's our weijia jiang. >> reporter: donald trump spent the evening before the final debate vowing to bring term limits to congress as president.

police department. investigators identified the 64- year-old by a cell phone that failed to trigger the device. >> lauren dispirito reporting. so far this theory remains unproven. it's not yet clear whether it will be part of federal prosecutor's case against ansberry. you will notice more safeways in the metro area. overnight the final eight former albertsons are no more. they have safeway signs and fixtures. they're in aurora, denver, louisville, northglenn and thornton. there will be a ribbon cutting in aurora at 10:00 this morning. one of denver's most neglected neighborhoods is getting improvements. officials will break ground today in the westwood neighborhood for more housing. this plan will add 197 unit housing complex on morrison road and the city approved plans back in july to make much needed changes for the 17,000 people living in westwood.

at this time in the morning you may be brushing your teeth. well, there is a new toothpaste that combats plaque, heart attacks and even strokes. a new toothpaste shows users where plaque is hiding and scientists say it also has another benefit, reducing inflammation that can lead to heart attacks and strokes. florida researchers tested people for a protein that signals inflammation, then had them brush with plaque hd for two months. the protein significantly lower. more teeth news now, cdc is asking states to create school programs that put sealants on kids' teeth. less than half of all school age children get them, which protects against 50% of cavities. lower income children are 20% less likely to have them. a new study finds a compound can help women with

researchers say the compound found in red wine and grapes helps moderate hormone imbalance. good news for a colorado teenager who has what her doctors describe as the worst case of cancer he's ever seen. now the mother of 16-year-old peyton says her daughter is in remission. peyton was diagnosed on her 16th birthday with stage four ovarian cancer, it usually affects women four times her ever diagnosed. she has had six rounds of chemo and seven-hour surgery to remove the tumors. the mother says remission is unbelievable. >> that is so amazing for her. we need bright spots of news. we do. unfortunately we did not see any measurable precipitation overnight in denver or fort collins. we did get about .02 inches of rain in longmont.

the season, the month, the year. the drought situation of course is just going to get worse and worse. in the mountains we have a little bit of light snow falling. it's not much. along i-70 above idaho springs maybe a few snowflakes, and in the higher hills a snowflake, that's it. these clouds won't last long. what we had in terms of snow out west has ended as well. wider picture here, big ridge of high pressure that's currently centered over las vegas will make it east over the next three or four days. as that high slowly moves over colorado, it will keep the skies sunny and will allow temperatures to start warming up after tonight. tonight is going to be a cold night. in fact, we expect freezing temperatures tomorrow morning in denver. for now we're above freezing. we won't get to the 32 mark this morning. that will be tomorrow morning. 30s and 40s on the eastern plains this morning. 27 currently in leadville. we'll be in the 40s and 50s for the mountains later on today.
