this developing story leading off cbs4 news at noon's, a deadly shootout at a car wash. part of the evidence used to indict and arrest violent gang members. tonight eight of them are off the streets. a tactic never before used by law enforcement is targeting the illegal use of guns. dillon thomas live in denver tonight, this is a first for >> reporter: they actually used racketeering laws in order to indict those criminals. local and federal officials say the eight arrested were actually so organized that they use violence as a source of business. sometimes going as far as murder. thousands of dollars in cash, drugs and guns all confiscated during the collaborative forensic investigation to stop gang members in denver. >> talking about two violent

one in douglas county, one in arapahoe county. and two shootings in denver. one individual shot in the back while he sat in his car at a denver apartment complex and another shooting of a house occupied at the time by 11 people. >> reporter: we'll show you surveillance video of the violence. this deadly shootout shows rival gangs confronting each other, just feet away stand two children exposed to the gunfire. law enforcen >> it makes violent crimes like murder, robbery and assault with dangerous weapons federal crimes, when they are committed in connection with the racketeering enterprise of the game. >> the focus is the criminal organization not a single individual. >> reporter: now local and

officials say they actually used a technology called shot spotter to link those different shootings. they say at one point a woman was used as a human shield during a home invasion. all those suspects were arrested. between age of 20 and 22. and all now face years in prison. live in denver, dillon thomas, cbs4 news. a former postal service worker is accused of delaying or destroying 26,000 pieces of mail. authorities recovered the mail addressed to peo and fort morgan. the mail vanished over a two- year period. the postal worker goes to court next week. the search for a group of thieves that hit a liquor store and then opened fire on a witness. it happened just before noon today at the woodmar plaza near pq and wadsworth. three men one woman stole booze, and after the robbery they shot at a witness. >> somebody outside the store at the time, saw them go in and they looked suspicious.

as they were leaving. they opened fire. >> they got away in a blue nissan ultima. jennifer brice talked to the witness off camera, he's a former state trooper, the bullet barely missed him before hitting his car. deputies arrest two evergreen high school football players for crimes related to bullying and hazing. they will not be joining their teammates on the field tonight. melissa garcia live tonight in evergreen, with the very latest on this. melissa? >> reporter: the evergreen high ol letter informing parents of the bullying. school officials say the district took swift and appropriate disciplinary action in what deputies describe as ongoing harassment and hazing. the evergreen high cougars will be without two players at friday night's football game against the conifer lobos. deputies arrested the 15 and 16- year-old sophomores on wednesday for felony menacing and misdemeanor harassment.

16-year-old allegedly threatened students with a piece of broken glass. a jefferson county sheriff's spokesperson said the broken glass is considered a deadly weapon. >> our school is really good but some of the people in our school make really poor choices. >> reporter: officials say the police have targeted for of their peers for months. those victims are 14 and 15- year-old students who also attend evergreen high school. on camera, the students we spoke with say staff and faculty go out of their way to try and prevent bullying. >> i think this is the best one in the state that has lowest bullying. this is the first incident i've heard of. >> we have posters everywhere, stop bullying. that really helps our school. but some people just ignore it. and make a stupid decision. >> reporter: a spokesperson says in addition to the criminal charges, the district suspended the two players from school and kicked them off the football team.

bullying. an investigator with the sheriff's office has been assigned to the case and officials tell us tonight's game will go on despite the arrests. live in evergreen, melissa garcia, cbs4 news. new development on the investigation into what started a large wildfire in larimer county. a juvenile has been charged with arson. the beaver creek fire broke out june 19 north of walden. the flames burned 38,000 acres and investigators have not said how it started because the suspect is a juvenile, firefighters continued to battle this one. it is 75% contained. ski season is underway in colorado. arapahoe basin opened one lift this morning. the first resort to open in north america. matt kroschel was there as the first chair went up. >> we knew it would be ready eventually. >> reporter: before the sun came out, snow guns placed the

hillary clinton telling supporters donald trump threatening democracy by saying he might not concede if he loses. trump told supporters in several states today the polls are wrong. he says he is going to win. shaun boyd gives this week's developments a reality check. >> reporter: 18 days to go. a lot to talk about. cbs4 analyst republican dick wadhams, democrat penfield tate as always. let's start with the final debate. penfield? >> i don't think so. one thing i would say for

debate was the most substantive on policy. and i think he got a couple opportunities to articulate his position. but when it's all said and done , he needed a grand slam and he didn't come close to getting it. so hillary supporters are feeling good. donald supporters are probably feeling he didn't do enough. >> she was leading in the polls heading into this. and he really needed a grand slam at this point. but it did take up some policy side. second amendment, abortion. >> what's sad is that we got a glimpse of what could have been in this presidential race. it could have been a great debate and a debate that would have put hillary back on her haunches. effect is that if we could have had an hour and half of donald trump rather than just a half- hour, he would have done much better but penfield is right. he needed a grand slam and he

outcome. >> reporter: so trump claims the system is rigged against him. he points to the media saying the media is biased and a poll yesterday showed most people agree with him. and that he points to the voter fraud but doesn't give any specific examples of the voter fraud. any legitimacy to these claims? are people buying into them? >> no. there's been a debate within his own campaign. his manager and daughter and vice presidential nominee all said that's not what he was tain he came out and said no, i was talking about voter fraud. it's not going to happen. the process around the nation, are -- they are just too responsible and too elevated to be messed around with. >> but he said he's going to challenge the results if he loses. what are the ramifications of that? >> the ramifications are that he will likely lose, heal challenge and the challenge

at the rate he's going, this is not going to be a close election. and i saw him today on tv telling his voters, his supporters, don't blow it. and so he's now putting it on them. if i lose it's your fault. >> [ laughter ] >> reporter: as you mentioned, his pastor victory is getting very narrow and republican scaring -- getting very worried he will hurt down ballot republicans. is the gop in danger of losing the house or the senate? >> i don't think so. i think the retain control. going to lose some seats. same thing in the senate but i think republicans will still have 52 seats. we currently, after this election, you -- you see the incumbents like richard burr in north carolina, pat toomey in pennsylvania, rubio in florida, their numbers are actually close and closer than they should be probably. but they are strong incumbents and they'll be able to hang on. >> do you have thoughts?

there's a good possibility democrats will retake the senate and if you watch the clinton campaign that's why she's going to states like arizona and other places because she's trying to sort of push down ballot in terms of her sway, in popularity to bring democrats into the majority of the senate. getting the u.s. house is too many seats to pick up this cycle but she may well start a trend and a movement towards of these people who are saying i got to vote for clinton, they are doing it only because they've been moved that direction. they don't like clinton. there will be a certain percentage of voters who will say i'm going to vote for this republican because i want a check on her even though i'm going to vote for her because trump is so unacceptable. that's the factor as well. >> we'll see how it shakes out. thank you for being here. back to you, karen and jim. a reminder you can watch all of shaun's reality check reporting just by visiting

before you fill out that ballot. time to check on the forecast. >> pretty nice day today. earlier this week we had temperatures with highs in the 50s and 60s. now 50s and 60s have spread over a great deal of the nation down to the south even warm, brownsville just 82. they've been in the 90s near 100. new york was 85 a couple days ago. now they are 69. you see the cooler air moving in. the only place we have is on the te 87 in miami, over here in the west, 97 in phoenix, 88 in san diego, 89 in los angeles. that heat is pushing up into our area. only 60s yesterday. look where we were today. 78 officially at the airport. 79 downtown. 37 and 36 are the lows. 63 and 35 would be normal for this time of year. so the lows were right on but then we warmed up today. official high was 15 degrees above normal this time of year. 83 in 2003 is the record high

record low and how cold it can get on a day like today. 70 right now downtown, 65 dia, pretty pleasant evening. east wind at 12. humidity up, it was 9% at 5:00. now 13%. the barometer holding steady at 30.10. jack dempsey opening day at arapahoe basin. this border looks like he had some pretty good snow to ski on. as we take a look at elaine cunningham, shot. from arvada. and take a look at this one, rachel rough and cherry creek. this was the cloud they saw. again looks like ufos to me but actually this lenticular cloud that takes the odd shape in the sky. temperatures for tonight mostly in the 30s and 40s over the eastern plains. higher up temperatures in the 20s and 30s. out west 20s, 30s to the low 40s. tomorrow maybe even warmer than today. with 70s and 80s even mid-80s

higher elevations temperatures mostly in the 60s and out west temperatures in the 60s and 70s. let's take a look at our forecast for tonight, clear skies 42 and 40 overnight lows. for tomorrow, pretty nice day, mostly sunny and warm. early september temperatures in the lower 80s. and then for the next several days 75 on sunday, low to mid- 70s for monday, tuesday and wednesday. we have sunny skies dry conditions all the way. quarterback at northwestern has the smarts to pick up from other guys. >> exactly. northwestern is better than asu. i take it back. trevor siemian says he learned a lot last year but also from the guy he will face on monday

standstill. netflix paypal and twitter are among the companies reported outages. mark alpert following this developing story from washington. mark, could it be related to the recent russia cyberattacks? >> reporter: that is the key question. u.s. government has not assigned blame but all throughout today we saw three expanding waves of attacks. in total lasting nearly seven hours. the hardest hit provider says onslaught and restored service. as the government tries to figure out who is attacking the web. shortly after 7:00 a.m. on the east coast some of the country's most well-known websites suddenly went off- line. twitter, reddit, spotify, airbnb, netflix, visa and others. after two hours the sites were back online and then a second wave of attacks just before noon. around the same time the white house briefing got underway. >> i'm not aware that any

malicious activity -- >> reporter: the department of homeland security tells cbs news it is investigating all potential causes. the attack appears to have targeted dyn, a major internet management firm that provides services to scores of websites. someone unleashed a denial of service attack. that's when a flood of bogus traffic overwhelmed servers affecting the internet's central directory. >> they targeted the core of how the internet works. r he says a slew of recent tax just before the election is part of a new reality. >> just kind of shows you this is the new wave of warfare we're dealing with right now and while we don't know where this is coming from, the magnitude does lead to believe it was targeted at american- based companies. >> reporter: no group has claimed responsibility. kennedy told us on a scale of one to get 10, this attack
