we have breaking news on cbs4 news at 6:00. demarcus ware has that diamond studded super bowl ring back. denver police have arrested two people now for breaking into his home in cherry creek and stealing the ring along with a safe. the break-in happened while ware was at mile high for the broncos game against the texans. >> even the police weren't everything was put out there, everybody really jumped on it. not only was the 12th man when we were out there playing, but off the field. they did their job. and get everything out there. i want to thank them too and everybody that's helping. >> the home does have a security came and was able to take this video. the two people in custody are billy mccaslin and sergio irreza. see what we've learned about them and their past run-ins with the law coming up later

this is the news in campaign 2016, people getting ready to rally behind republican vice presidential candidate mike pence. he'll be talking to supporters at the top of the hour at an event in colorado springs. political specialist shaun boyd is here. a lot of surrogates have been passing through. colorado is still in play? >> reporter: really only four states left that are toss-ups. cbs news battleground tracker shows florida, north carolina, iowa, and colorado. the states that could decide the presidential race. maybe even control of the u.s. senate. >> it is entirely possible 13 days from today that control of the senate will come down to the state of colorado. >> reporter: republicans chances of winning the presidency shrinking, their focus has turned to maintaining control of the u.s. senate. >> i want to do everything i

president whoever that president may be. >> reporter: ted cruz campaigned in loveland for republican senate candidate donald -- darryl glenn who is trailing michael bennett by double digits. the election comes down to turnout and glenn has the grassroots behind him. cruz one of several high- profile surrogates in colorado. the wife of clinton's running mate tim kaine in wheat ridge today. while trump's running mate mike pence is in the springs tonight. and eric trump will be here tomorrow. co clinton leading by two points. but florida may be the most coveted swing state. clinton campaigned there today as pulls in that state titan as well. >> florida can make the difference. and if people get out and vote, we will have a victory on november the eighth. >> reporter: north carolina one of the other states that can make a difference.

three promises. safe communities, great education, and high-paying jobs. >> reporter: vice presidential candidate mike pence rallied supporters in colorado springs. stan bush is there. >> reporter: trump's running mate is campaigning in the most conservative pockets. both campaigns right now are making their closing arguments to voters. the strategy base and also get out the vote operation. i spoke with trump supporters who stood in line for mike pence four hours. all of them to a man unfazed by the weeks of negative publicity to the campaign. >> the clip of him on the bus, the show with bush, that kind of shook me because it does go to character issues. i get that. >> reporter: but it doesn't change your vote? >> it doesn't. >> i don't find it nearly as alarming as what clinton has allowed the two of them have allowed with women.

louder than words. >> they say donald trump did this and that. i had to live with bill clinton. as president of the united states. and his wife. and i'm done. >> reporter: the indiana governor is expected to speak at 7:00 this evening. i'll have a full breakdown at 10:00. in colorado springs, stan bush, cbs4 news. only one sixth of all ballots mailed out in colorado have been returned so far. the majority of them are from democrats. more than 166,000 democrats have returned ballots followed by republicans and then independents. so far more than 416,000 ballots have been returned in all but again that is a small fraction of the total ballots that have been mailed out. while voters are paying more attention to this election than any other in modern history, most are also really unhappy with their choices.

competing factors have on turnout. >> yeah. the fact so many are are yet to be turned in, maybe people are still deciding. >> maybe. lakewood police calling the drowning of a young girl a tragic accident. that little girl was only 18 months old. it happened in a backyard pond at a house on west louisiana yesterday afternoon. andrea flores in that neighborhood for us tonight, investigators still trying to figure out how this happened. >> reporter: work to be done here but lakewood police tell us the young girls autopsy was scheduled today. of course it will be a few weeks before we get those results but we do know that the young girl was staying with her grandparents when the unfortunate accident unfolded. >> it's a dark day. >> reporter: this neighborhood is still in shock after learning a one and a half-year- old girl drowned tuesday afternoon. neighbors tell us the girl was out front with her grandfather

likely wandered to the neighbors backyard and into this pond. >> the worst that could possibly have happened. >> reporter: neighbors saw her fall in and pulled her from the pond but it was too late. a steady stream of visitors were seen stopping by the grandparents home wednesday afternoon. a father of two lives across the street and knows how quickly kids can move. >> fast. fast. fast. faster than you can ever imagine. it's nightmare. >> reporter: detectives are working to figure out how long the young girl was in the water before she was found. the jefferson county da's office was in the neighborhood earlier today to investigate the circumstances surrounding this case. but lakewood pd tells us so far it seems unlikely that the grandparents will face any charges. reporting live at lakewood, andrea flores, cbs4 news. the judge throws out a second lawsuit involving the

a 13-year-old boy when he disappeared from his father's home in southwestern colorado four years ago, his remains were found months later. the boy's parents continued to squabble. now a judge has dismissed the lawsuit, his father mark filed against his mother. elaine hall. redwine accused hall of intentionally inflicting emotional distress saying the dad was responsible for dillon's death. last year a judge dismissed hall's lawsuit making similar allegations. screen robbers, the roope terrorized the front range accused of violent bank robberies jumping kang -- and threatening workers. also accused in a crime spree that included two carjackings and random shootings. 200 people have been summoned for jury selection in what is expected to be a long trial that is expected to last two days with the rest of the trial plan for six weeks. a day after a cattle truck

tell them that's the right way to go. >> reporter: volunteers mounted up 24 hours after the crash setting out to recapture nearly 20 of the original 80 cattle on board the big rig when it flipped tuesday morning. >> they scattered all over up in there. >> reporter: volunteers like dan lincoln from the jefferson county horse evacuation assistance team. >> we're amateurs. we don't heard cattle very often. >> reporter: answering the calls for help as cattle roamed through town and dangerously close to interstate traffic. >> terrain is rough. of the wrangling operations making sure to steer clear of the upset cattle and keep them calm. volunteers used ropes and dogs to round up these four. nearly a dozen remain unaccounted for. >> we're happy to do this. >> reporter: a community rallies to round up cattle. a tough job following an unfortunate crash. >> they may be there all

this is the news in campaign 2016. colorado's u.s. attorney's office will be on duty this election day and night to protect people's right to vote. nationally the u.s. justice department will work through election night as well along with the fbi to protect the integrity of the voting process. recent cbs4 investigations have uncovered several cases of voter fraud. this time with people voting twice. brian maass has more. >> reporter: lincoln was owns property in colorado and in

the registered republican voted in both states in 2010, 2012, and again in 2014. one man, three elections, six votes. kansas secretary of state chris kovacs. >> you'd be surprised how often people double vote. >> reporter: wilson is one of five coloradans charged with voter fraud by the state of kansas. >> we want to get the word out. don't do it. we'll catch you. >> after each election they double ballots and clean up the database. kovac -- >> reporter: he still believes 10,000 people are registered in colorado and kansas. >> anyone of those 10,000 people could probably succeed in casting two votes. >> reporter: some people like bruce ricky have been charged with trying to vote twice in colorado elections. prosecutors say ricky was cut voting in el paso and elbert counties at the same time. >> there are individuals who break the law.

record high tomorrow is 80 degrees. that's all the way back from 1966. and then the record high for friday is 80 degrees from 1994. so we may tie tomorrow and break the record on friday. as of right now heading towards our fifth warmest october on record. so we have very warm temperatures to end the month. planning trick-or-treating already, i think it's going to be on the dry side. but let's talk about the warm temperatures. it's going to be toasty. >> it is. take a look at the eastern plains. 70s and 80s. mid-80s here up in the mountains, mostly 60s and out west temperatures also in the 70s. here is your denver forecast. tonight clear skies. temperatures in the mid-40s. then for tomorrow, mostly sunny skies, remember the high is 61. 79 and 80 degrees. and yeah, could be a record high for tomorrow or at least tie it, do it again on friday with 81.

the saying among football teams is next up booker. c.j. anderson not at practice today. he was out of town getting a second opinion on his knee injury. the broncos had their best running game of the season on monday. 190 yards and two touchdowns. c.j. had 107 of those and book added another 83. gary kubiak wanted to get booker more touches. probably not this way. if he is the primary back on sunday, he says he'll be ready. >> my coach talked about it pretty much every day.
