colorado landfill. investigators expected to search the landfill tomorrow. the larimer county sheriff's office in wyoming tells us a 13-month-old boy disappeared this weekend. his mother told investigators she allowed a man named santiago to take the little boy fishing. they're now questioning that man who tells investigators that the body was left in a dumpster at a community college. then taken to a weld county landfill. new developments asic release body camera video from an officer who shot and killed a man in parker. that suspect shot and badly wounded a douglas county sheriffs detective. the whole scene played out near sierra middle school. >> officers responded to a man with a gun earlier this month. we showed you when the injured deputy, dan brite, left a hospital for rehabilitation. all the hospital workers cheering on his recovery. jennifer brice live in douglas county. you just got your hands on the

who killed the suspect. >> this report from the district attorney's office actually in arapaho county actually clears the officer who took that fatal shot on that day. the officer we've learned has only been with parker pd about two years and just a month prior to that instant, he had rifle training. what you're about to see is body camera video from his body cam on that day. >> reporter: in this body camera video you see police officer ronnie dorrell run toward the armed suspect and barricade himself behind the door. >> he's down. he's down. >> reporter: that one fatal shot hit suspect randy rodick in the head. they commend dorrell for having presence of mind in a chaotic situation. minutes earlier the suspect shot danbrite and continued on a

down, to know people are being shot at, to know this guy is armed to the hilt, to be able to stop yourself, take in the sight picture, slow your breathing and pull that trigger one time. >> reporter: district attorney george brauchler justifies the police shooting. he said it was the suspect's wife who called 911 alerting cops her husband was drunk and heavily armed. this all started at the couple's parker home and unfoldled near seattle middle school which w placed on lockdown. rodick had an arsenal in his suv. a shotgun, handgun, thousands of rounds of ammo. >> this guy continued to fire. at that point in time we have to stop that threat immediately. >> what if this guy's wife had not alerted law enforcement to his behavior and what he was doing and law enforcement wasn't able to try to keep him in this very small area as he loaded his rv full of all of these

here when detective brite, the injured officer actually left the scene after being shot, we were told he did not have a pulse. we were told he was coded, he coded out in the e.r. and his family was told that he only had 1% chance to survive his wounds. he is currently though in a rehab facility doing very, very well. making a wonderful recovery. live in arapaho county, jennifer brice, cbs4 news. now to new details on the case of a former colorado police officer james ashby will send 16 years behind bars. the court found him guilty of second degree murder of 27-year-old jaques in the town of rocky ford. jaques was shot in the back of his own home. >> i would like to see more but i can see the necessity of mr. ashby reuniting with his family

nothing. some justice is better than no justice. >> ashby claims the shooting was self-defense. developing now, the city calls it a health hazard. so does mobilizing once again to clean up a big homeless camp in downtown denver. that spot near broadway and park avenue west was the scene of a controversial sweep of the homeless just last march. cbs4's rick sallinger reported on that sweep. he's back on the story tonight. it sounds a time around. >> it was. the police, sheriff's department and the department of public works along without reach workers were out here today but this time around as you can see the homeless were allowed to stay. >> reporter: they're life possessions in a shopping cart. the home is a sidewalk. the landlord arrived today not to kick them out but to clean up

hazard. crystal priest was tidying it up on her own. >> why are you here after they've cleaned everybody out and moved them away? >> there's no place to go. >> reporter: she called the shelters like a prison yard with all the restrictions, even though they have hundreds of open beds. >> just -- so you get kicked out or you say something stupid to somebody one day, get kicked out forever. >> reporter: the area is beginning to did before last march when the city of denver moved the homeless out and cleaned the place up. people who work around here are not happy. >> garbage, people using our building like a bathroom and things like that. we certainly were hoping that was going to stop. >> reporter: but the people who come here say it's because they feel safer in numbers. the city says it is addressing the problem with outreach workers and compassion. >> it's not right for people to be living on the streets,

it with resources. >> reporter: while we were there the police arrived after a paramedic reported a homeless man had threatened him with knives. sometimes even trying to help can be hard. the city of denver issued a statement today saying, even with increased outreach, people are still sleeping outside and refusing services. this cannot continue. we firmly believe people are best served indoors. live at broy west, rick sallinger, cbs4 news. now to the latest on the stolen super bowl ring from the home of broncos player demarcus ware. the two suspects accused in the case did appear in court today. police say that sergioirreza and billy mccaslin broke in to the home. anonymous tips helped police

,, developing tonight, armed soldiers and officers begin arresting protesters who set up camp on private land in north dakota. they're trying to block construction of the dakota oil pipeline. after a last chance to leave yesterday, more than two dozen were arrested late today. that pipeline willar opponents say it threatens the drinking water and disturbs native american cultural sites. new developments on those responsible for the irs phone scam. federal prosecutors have now indicted 61 people for impersonating irs agents to extort money from people. half of the defendants are from overseas tied to a network of call centers in india. in the u.s. police are rounding up the suspects criminals in nine states. authorities say scammers are

from the southwest. dry desert air. that's where the jet stream is. then it dips down. we've got the cold air that's produced some snow. portions of canada in to new york. vermont, new hampshire, massachusetts. that is snow and they're getting pretty good snow back there as well and the temperatures are cooler as a result. only 50 in new york city. colder to the north of that. we're still with this bubble of warm air. you see that 99 in phoenix. 83 today. 80s to near 90 degrees over the ut center with lauren whitney. the word drought is one we're using more and more. >> the new drought monitor came out today. from last week we went to the state being about 50% in a drought and now it's up to about 65%. one area that it did expand in is parts of larimer county. parts of the high country are already under this. the big area under this drought in to the abnormally dry area is all of the eastern plains. northeastern plains are now

the d-1 area has expanded in to parts of weld county and larimer county. all the way down in to parts of douglas county as well. the drought has expanded a bit. we do have dry weather continuing for the next several days. we're not going to get any moisture to help us out with this. the moderate area, that's also almost doubled from last week as well. our dry conditions and warm temperatures certainly aren't going to improve any time soon and actually record breaking today. >> that's right with all that dry weather and temperatures like this, does not situation. 83 degrees, the old record was 80 set back in 1959. 83 downtown. yes, a record high today after starts in the mid 40s. from our weather watchers, 79 in peetz. 84 in arvada. 80 and 81 right now. southwest wind at 13. dry with 9% humidity and a falling barometer. this is meadowwood park in aurora. golden leaves still on the tree
