training their officers to handle aggressive dogs and say this incident fit the bill. they released this 12-page incident report with three different officers accounting what happened, all justifying the use of deadly force. but the dog's owner doesn't agree with any of that. she was here for the last moments of that dog's life, and now she's considering a lawsuit. >> oh, there they go. oh, my god. >> reporter: panic on 911 when woman surrounded by two aggressive dogs. >> we got two pit bulls on the loose. one has attacked somebody. please, hurry, hurry, hurry. >> reporter: police say when the officer approached the larger of the two dogs grould, taking an aggressive stance. the officer said he was frightened and shot the dog. >> to say he's never seen dogs act aggressively, it should come with some credence that he does

to put her dog down from his wound. this video of their final moments together has gone viral. >> he didn't deserve to get shot. >> reporter: rios showed us the other dog in the incident. they're often mistaken as pit bulls, something even officers on the scene did. but this afternoon aurora police released documents showing they were permitted in town, saying responding officers exaggerated about the incident. >> she was not attacked. angeid him go. a vicious dog would have killed that dog. >> police say based on the dog's behavior, the breed didn't matter. >> if we're able to comprehend or recognize aggressive behavior then the officers are going to do what they feel is necessary to protect the public and themselves. >> aurora police say that dog did have a prior citation for being an aggressive animal. police officers were wearing body cameras during this

been made public yet. we have new details of a first look at the chaos that unfolded last month when a parker police officer killed a man who just shot a detective. today police released this video from the body camera that that officer was wearing that day. lauren dispirito joins us in parker where the events took place. >> police tell us the shooter was firing from this field. one of as to pass through an office building through interior walls, through a computer monitor and in to a hospital exam room. there's also a middle school near here and there was traffic in the shooter's path. >> what kind of car is it >> reporter: parker police officer ronnie dorrell's body-worn camera was rolling on september 2nd as he ran toward the sound of gunfire. investigators say the shooting

dan brite and was still firing at law enforcement. his wife told 911 dispatchers her husband was drunk and heavily armed. >> where's he at? move, move. >> reporter: the footage shows officer dorrell take cover as he fires the one fatal shot that stops rodick. >> i got him. he's down. he's down. >> reporter: district attorney brauchler. >> to have the presence of mind with all that's going on, to know there's an officer d t to know this guy is armed to the hilt, and to be able to stop yourself, take in that sight picture, slow your breathing, pull the trigger and end this thing. >> reporter: brauchler says not only dorrell but all officers who fired weapons in an attempt to stop rodick were justified, bringing to a close the investigation in to what

recover. >> investigators tell us that officer dorrell had recently gone through additional weapons training shortly before that shooting. live tonight in parker, lauren dispirito, cbs4 news. a rash of home break-ins has one woman trying to unite her neighborhood to stop the bad guys. she talked to jeff todd. she's hoping those neighbors do more than keep an eye out for trouble. >> e things like get security cameras or add lights at the very least to deter the criminals. at best to catch them. >> one day we were walking up and down, just talking to everybody that had been hit. >> reporter: her own shed was broken in to. >> if there was anything small enough to take. just stuff they can put in their backpack. >> reporter: when she started realizing how much crime was going on around her, she went to

neighbors together. >> we had a home invasion right across the street a couple weeks ago and a couple of days ago we had a home invasion two doors down and the last two weeks we've had nine or 10 houses hit from behind. >> reporter: she lives on a small street only three blocks long. westminster police told us they only have two incidents since the beginning of september for the street. that was news to her when we told her. >> i know the 10 house break-ins were reported because the police told us how many houses had been hit on this block. >> that's what's motivating her to keep the neighborhood vigilant. >> i have protection 1. we have new locks on all the gates. flood lights front and back. and a 9 millimeter. >> any time you're able to improve the security around your house you're always recommended to do so. this isn't just happening in westminster. we've heard about these crimes of opportunity happening all

tonight, jeff todd, cbs4 news. new information now on the two men accused of breaking in to the home of the broncos' demarcus ware. billy mccaslin and sergio irezza. they stole ware's super bowl ring and other items after breaking in to the home monday night. security cameras provided these pictures of the thieves. police say that generated hundreds of tips. a pawnshop employee recognized one of the suspects a customer. >> i knew they were going to find him. just because the fact he's such high profile. >> demarcus took to twitter to thank broncos fans for helping solve the crime in less than 36 hours. how much of you is stuck? >> i started at like knee deep and i'm already all the way up to the bottom of my chest. >> a tense 911 call details

in northern colorado. emergency crews had to rescue him from mud that was like quick sand. karen morfitt live for us. >> crews say he was about 15 feet in to the water which means he took a pretty good stroll through some of this really soft mud that starts at the bank and goes in to the pond. police say it can act similar to quick sand. >> 911. what ie emergency? >> i'm at the lake state wildlife area. i'm stuck in quick sand. every time i take a step, i go farther down. >> reporter: that was the frantic call fire responded to. >> he was approximately 15 feet off the shore in water up to his chest and he was stuck in the mud up to about his knees. >> reporter: the teen was hunting around simpson ponds in loveland when he went in to the water attempting to retrieve a duck he had shot.

the teenager uses his cell phone to call for help. >> i'm slowly -- i'm not moving but i'm slowly going down deeper. i'm waist down in mud now. >> reporter: battalion chief rick davis says the quick sand was actually soft mud at the bottom of the pond that can act similarly. >> it's really soft and it just sucks them in. it can feel like you're going to continue to go in. the more they work the more they go in. >> reporter: the teenager was able to keep from sinking further in the water and stayed on the pep arrived. >> i'm not letting you go until they're right in contact with you. they're talking to you. okay? >> okay, i see someone. i'm here! okay, he sees me. >> loveland fire also says this area was hit pretty hard after the floods and that it's possible that some of the new silt and sand deposits may have played a role in the incident. luckily the teen escaped with no

,, tonight cbs4 investigates a rape case in boulder that left many people stunned and angry. the attacker got no prison time and the victim feels lik >> she's sharing her story for the first time. she talked with brian maass who joins us tonight with more. >> she thinks the system essentially let her down in this case by not putting the rapist in prison. she agreed to be interviewed but we're withholding her name. >> how much of this did you consent to? >> none. >> none? >> none. >> reporter: she is young, bright, and for now, crushed. >> i have got the maximum sentence of a life sentence of

because of this. >> reporter: this was an acquaintance rape in boulder. in march 2014 she was partying with friends including an acquaintance, austin wilkerson. after a night of heavy drinking that led to her vomiting, she ended up at his home. >> i had just begun to fall asleep and he grabbed my face and said i'm going to take care of you. underwear, performed oral sex, penetrated him. >> reporter: a jury convicted wilkerson of sexual assault. his first criminal conviction. but the surprise for her was what came next. judge patrick butler gave him 20 years of probation and work release, meaning nights in jail but days could be spent working or in school. prosecutors pushed for prison time, as had his victim. >> i just wanted justice which

sentence. >> you wanted him to go to prison? >> yes. >> reporter: the sentence sparked outrage. 82,000 people signed this online petition seeking the judge's recall for what was characterized as a lenient sentence. >> is it just a slap on the wrist? >> not at all. >> reporter: lisa moses, a defense attorney who's represented numerous sex assault suspects but not austin wilkerson, says the sentence is not soft at all. >> those sex offender treatment programs are not through. for anybody. >> reporter: how unusual was wilkerson's sentence? we analyzed 169 recent sex assault sentences to young offenders and as many were sentenced to prison as various probation. 58% sentenced to prison or jail. 42%, nearly half, sentenced to deferred sentences or various

unique. >> reporter: while she wanted wilkerson to go to prison, she acknowledges his sentence is not unusual. >> i think the general community believes that if you get convicted of a felony sex assault, you're going to prison. >> is that true? >> no. >> that's little consolation for the 21-year-old victim who says the rape shattered her life, sending her in to a deep depression. >> the rapist chose to ruin his life. but like the sexual assault itself, without my consent. >> she does say she's doing better now thanks to therapy and a lot of support she's received from family and friends. this young woman made an impassioned plea at the sentencing hearing about 13 minutes long. we put that on cbsdenver.com. >> very courageous going public with her story. now to the campaign trail. hillary clinton got a boost from first lady michelle obama today. the two campaigned together in

remove demonstrators blocking construction of the line. more than 100 people were arrested including a woman who fired three shots at the officers. the big operation took six hours. a texas company is trying to finish the pipeline that will take oil from north dakota to illinois. breaking records today. let's get to ed greene and lauren whitney. >> indeed we did. high clouds drifting across the eastern plains. only moisture we could find on couple clouds around here. they kind of drift out of the area. i'm going to run it through friday where you see a mix of clouds and sunshine across the state. here's saturday morning early, 3 a.m. couple showers. maybe snow at higher elevations but only flurries. don't last long. let's run it through saturday and we'll go to sunday morning and again a couple showers, even less chance though. i'm going to run it up to sunday. halftime at the bronco game. partly sunny skies. and mild temperatures persist. you'll see that in the 5-day forecast. here we are under the ridge of

that's taking that rain and changed it to snow. showers. a few thunderstorms. then in portions of western new york, eastern new york state also vermont, new hampshire, portions of massachusetts, in to maine, all got snow from this and you can see that still going on right in to canada and you can see we have that high pressure ridge around here. that's where the warmer air is. here's where the cooler air is and how much warmer was it? 100 degrees in phoenix today. that warmth moved our way, it's been dry around here. you couple that with record highs. let's go back to lauren in the colorado weather center. the drought monitor proved that we're underscoring dry weather around here. >> we are, and compared to last week, actually a whole new section of the state is under an abnormally dry area so the northeastern corner of the state last week wasn't under this, but now they're covered in new drought area. because we've had really several months of dry weather on the

about four months without decent moisture. compared to last week at this time, about 50% of the state was in a drought. now we're up to 65%. another big change is here the front range mountain areas, down in to parts of douglas county and jefferson county, we're now under a moderate drought area. now it's extending a bit more in to the foothills. our dry weather is starting to actually cause a little bit of damage out there. it is going to be dry for the next several day weather certain record breaking today and maybe even tomorrow. >> dry, getting drier, and now you have the record highs. 83 degrees today. the old record was 80 set way back in 1933. we're also 83 downtown after a mild start to the morning. and our weather watchers, 79 in peetz. kiowa, same with wheat ridge. 80. 84 in arvada. as we take a look at current conditions, very mild. 63. look at the airport. 67 degrees. even that is 6 degrees above

broncos runningback cj anderson underwent surgery on his knee. we're still waiting to hear of the severity of the injury. devonte booker will get the start at runningback on sunday, and don't be surprised to former csu ram kapri bibbs get work as well. he has four carries this season. with cj out, that number likely to go up in a hurry. >> i'm excited to see him play. kapri changed himself from a -- in my opinion just watching him work, he's a better player this year than he was last year for us. going to have an opportunity now. >> we're going to be gamers. we're gamers the same way.
