our andrea flores joins us now. >> reporter: her children will get the money and a federal lawsuit continues against the jail. but nor now, the family attorney says the settlement is a small win in a much bigger fight. the family says they are one step closer to justice after a $2.5 million settlement with jefferson county. >> there will be nothing that will replace jenn lives. no amount of money can replace that. >> reporter: lobato died of opioid withdrawal. despite attempts to call for help, no help came. >> she is throwing up on herself and her stuff. >> reporter: crystal chavez shared a cell with her and described the moments leading up to her death.

out. you reporter richard mcclintock sent us pictures of the flames. it grew to ten acres. now, to the latest out of iowa where the man wanted for killing two police officers overnight is now in custody. investigators say scott greene flagged down a natural resources worker to call 911 to turn himself in. he ambushed two police officers. >> definitely was an opportunity to not defend themselves. both were seated in their cars and were shot while say were sitting. >> the officers were identified as anthony biminio and justin martin. greene had several run-ins with police over the last few year. we don't know his motives. new developments on the ban

their ballots. a federal judge is now considering blocking that selfie law huh? >> reporter: yeah, you know, jim, i love selfies so this has never been a problem before. taking a selfie with your ballot. you can't see who you voted for. but, when you take a selfie with your ballot that shows who you voted for, that is where things get complicated. right now, three different entities are being sued in this case. the groups are the attorney general's office, the denver dict all of them agreeing today in court in front of that judge that they would not enforce this law. meaning if you do post a photo of your mail-in ballot and it shows who you voted for, they wouldn't be punishing you. but hen asked if they would make a public statement letting voters know about the change, there was not a direct answer. this law has been around for 1

voter coercion. they would be willing to take the statement off the website and that a warning to voters. but, the attorney did not say if they would be willing to post a clarification. owen healthys it is sometime to get rid of the law. >> if we are not using the law, we need to let everyone know it does not apply. it is is a violation of the first amendment. we need to give people the confidence they can post these things. >> reporter: so, went on all afternoon. all morning long. and, still, no decision from the judge. they will be back at it tomorrow morning at 10:00. there is definitely some fear here that all of this confusion about the ballot selfies could interfere with people at the polls. so, for right now, they are saying hey, just don't take the selfie. let's figure this out in court. we are live, matt kroschel, cbs4 mountain news room. >> thank you matt. no rest for those presidential campaigns. >> republican presidential

our political specialist shaun boyd is live at the larimer county fairgrounds an he is expected any minute. >> reporter: yeah, and you can see a lot of people gathers here waiting for him. this place filled almost as soon as the doors opened. it is pence's fifth visit to colorado. trump has been here at least 10 times in the last three months. today, he is campaigning in the swing state of florida holding several rallies and staying on message while capitalizing hillary clinton's private e- mail server. >> now it has been reported that there are fbi inquiries probing virtually all of hillary clinton's inner circle. and, many of the things that she has done over the years. it is about time. >> reporter: florida, one of the most-win states for trump,

and the campaign rallies will continue this week. tomorrow, donald trump jr. expected to attend a rally in fort collins. friday, former president bill clinton will campaign for his wife at stops in pueblo, denver, and fort collins. and stay with cbs4 and cbsdenver.com as the election comes to an end in less than a week. an update now on a career college in denver that shut down without warning leaving angry students and staff with very few options. viewers tipped us off to the yesterday. heritage college is located on harlan street in northwest denver just south of i-70. cbs4 investigator rick sallinger has been reporting on the frustrating plight of many career college students and rick, i know you heard more tough stories out there today. >> reporter: westwood college, itt before. heritage college has now shut its doors here and around the

education. their money. their futures on the line. a neighboring business called the police. >> we don't have is a problem with you being here. as long as you don't disturb the other businesses. >> reporter: the students responded they were just looking for answers. >> i'm in debt because of this school. what am i supposed to do? >> reporter: on the door, a note stating the closure is because heritage did not have the cash to continue. now, students like taylor diamond are worried cash. complaining high-pressure tactics were used to sign them up. >> that was all the money i had and it was saved up for college and it went down the drain. >> reporter: other students repeated familiar things about for profit colleges urging students to get government loans. >> they were federal student loans. >> did the school encourage you? >> yes. they encouraged us to do it and ... they just really let us believe

year. that is up from 21 cases last year. doctors say afm usually peaks in late summer early fall. so, cases should be declining. kathy walsh, cbs4 news. >> the cdc tells us disease prevention is always important. so, washing your hands, staying up to date on the vaccines and protecting yourself from mosquito bites are all important. so let's get over to ed greene. a little bit cooler. >> we a high. got to 62. i don't know what i was thinking. you can see in telluride, a little batch of snow and lightning. there might have been some thunder snow. elsewhere around the state, a lot of sunshine over the eastern plains. we have the t scattered showers an they sort of end as the evening goes on. the clouds begin to bubble up from the south. there is a system there that will drift our way. as it does, it will send moisture into the state.

we might see a scattered shower in the med row. otherwise, they end up over the eastern plains. with the coolinger air coming in right behind it, 70 today. or yesterday. and 62 today. so, that cooler weather kind of pushing into albuquerque. 71, even el paso cooler. temperatures in the 80s ahead of that to around 90 degrees. there is the cool front that swept on through. a little moisture along with it down to the south. it will be under the influence of warmer air coming our but let's go back to lauren whitney in the colorado weather center. a cool day today. just nod going to last all that long. >> reporter: it won't. but the good news is we are not warming back up to the upper 70s like we were. we had the warm day monday. halloween. today, 62 degrees. tomorrow, upper 60s and we will be there again friday. it should be fairly mild outside. and we have this area of low pressure in close to arizona. that will still build over the next couple of days. and then it will slowly make

this week. thursday, you may notice a few more clouds out there. this is going to swing us up moisture coming from the gulf of mexico. so, down into parts of southern colorado, there could be heavier snowfall with this. might pack down pretty quickly. it might be the wet sticky snow. but there could be several inches in is san juans. what we are going to see is is a little bit of right rain and snow. that just flashed past there. rain. here across the denver area out to the eastern plains so, ed, there is the nt away. >> temperatures we have not seen in some time. 62 the high both locations. should be at 58. so even though it was cooler still four degrees above normal this time of the year. starting off in the 40s , should be right at 30 degrees with minus six. 33% humidity. we have a steady barometer and a nice shot here, you can see the fog up in estes park. for very pretty colorado shot.
