district attorney's job to prosecute them and put them in jail. but a district attorney is an elected official. in lynn county the term is four years. he was just on the ballot in 2014. there is voter accountability but that does not supersede the fact that there's a close relationship that can sometimes create a perception of in the community. >> most prosecuting attorneys or district attorneys tend to be elected by the voters. but again, the reality is that they have to work with the local police as well. >> certainly competing viewpoints here as this unfolds. we're waiting for the grand jury to be pulled together. but he does not intend to pull

scott, back to you. the family of the woman shot and killed inside coral ridge mall has resolved a lawsuit against the mall and the shooter. she was gunned down in june 2015. kosak is now serving a life sentence for first-degree murder. now they've dropped the suit. would not disclose the final agreement. a deadly crash at a walmart that shocked a central iowa community. an older man was behind the wheel of a truck when it slammed into the store at a high rate of speed. three people are dead including two store employees, the driver was injured. everyone is rattled by what happened.

issues with the normal until saturday evening. here's what happens are the u.s. model. it takes a weak area of low pressure and runs it up to minnesota. not really an organized storm. and snow totals are 1 inch. >> scooping up moisture and it has about 10 cedar rapids. and the problem right now is that we're just not getting good data to sample with the models. the storm energy is way out in the pacific. and until that can come on shore in the western united states, we're not going to get got agreement. we'll have an idea of which solution with be correct. i'm not prepared to go out on a limb with either.

election day. a change to federal overtime rules that was supposed to take effect today is now on hold. president obama ordered the change, requiring overtime pay for anyone making $47,000 a year or less. right now that threshold is $23,000. but airframe judge in -- lawsuits can be settled. >> the current rules remain in effect for 44,000 iowain's who -- employers would have to pay overtime or raise salaries above the threshold. it's not taking effect today but some employers have already adjusted to match the rule change. >> many employers probably felt a sense of relief that it was
