in the news this sunday morning, another pit bull attack. a 7-year-old girl is bitten in the face by a neighbor's dog. and the u.s. and south korea begin four days of war games in the sea of japan. north korea is threatening to retaliate with nuclear weapons. >> good morning. marine layer fairly thick, mount tam cam, 52 degrees in san francisco. accu-weather forecast coming up. >> good morning. thanks for joining us the i'm carolyn tyler. we have developing news in san jose this morning. firefighters are on the scene of an apartment fire that has killed a seven-year-old girl and left nine others injured. it started just before 2:00 this morning at the building on hamilton and meridian avenues. they had knocked down in 20

minutes. two adults and five children live in the apartment unit that burned. young girl was pulled from inside the burning building by firefighters, but they were not able to save her. >> in the back bedroom, they found her and brought her out. she was transported where she was pronounced dead. >> her surviving members have been treated. three other people also slightly hurt. investigators are now trying to determine how that fire started. a 7-year-old girl is reported in stable condition at children's hospital oakland. she is recovering from surgery after being attacked by a pit bull. emergency crews were called to oakland. the girl was bitten in the face while meeting the dog for the first time. that was after the pit bull's owner assured her it was a nice

dog. >> as a 7-year-old child she doesn't understand what is going on. all she knows is a dog bit her. >> family members tell us the little girl is going to be fine after undergoing surgery last night. the dog's owner has been interviewed by police. so far no charges have been filed. his pit bull is being held by animal services. on thursday, a two-year-old concord boy died after being attacked by three pit bulls. a contra costa supervisor is looking into legislation to try to prevent another attack. san francisco has a mandatory spayed nighter lay that was passed after a 12-year-old boy was mauled to death in 2005. >> this morning investigators are trying to determine what sparked a grass fire in eastern solano county yesterday. firefighters were able to beat back the flames and save a home. the fire broke out along a road an area between vacaville and

dixon. they credit a man for alert ago 76-year-old woman who was asleep when the flames came a few feet of her home. >> about five minutes, went to the lady's house, tried to open the door. she wasn't answering the door. other lady came up and got her out. firemen helped her get down at the end. >> wildfire burned about 25 acres and destroyed a shed along with some other outbuildings. one firefighter is expected to recover after suffering from heat exhaustion. >> in sonoma county a lot of people were dialing 911. they saw all this smoke from this fire burning along highway 37 near lakeville road. it turned out to be a scheduled control burn in a field a few miles south of infineon raceway. >> concord police are making

extra patrols at a park where three possible pipe bombs have been found since wednesday. on friday police bomb squad detonated one suspected pipe bomb at a community park. it was found by a jogger near turtle creek road. 25 police officers searched for more explosives used especially trained dogs. on wednesday, two other suspected pipe bombs were found nearby. parents attending this weekend's soccer tournament are understandably nervous. >> it made us a little nervous about coming to the soccer tournament but got the family aside and told them basically what went on, be aware of their surroundings. >> people are being told don't pick up anything that doesn't belong to them. so far police say they have no suspects. their investigation is continuing. oscar grant's mother sat down for the first one on one

interview since the verdict against the man who shot her son to death. former bart police officer johannes mehserle. wanda johnson appeared in berkeley yesterday. she spoke with callers during the gospel experience show. >> i think it's a healing process for me as well as those hearing my voice having a healing process. i think to face what i faced and what some of callers have faced is tragic. >> grant's family is encouraging rallies across the country on october 23rd to public for the strongest sentence possible for mehserle. it could range from probation to several years in prison. >> for us as a community to come together to join hands and to believe and trust that the system will work. it will be a sad day a

sentencing comes back of probation. we do not see that and, we do not believe that. >> mehserle's sentencing is november 5th, he remains in los angeles county jail after being convicted of involuntary manslaughter earlier this month. >> on tuesday the novato city council will consider putting a half cent sales tax on the november ballot. leaders declared a fiscal emergency laying off 20% of the work force and cutting $4 million from the budget. today's marin independent journal says the proposed sales tax increase would generate $3 million a year for five years will. it would bring the sales tax to 9.5%, matching san rafael's rate. >> let's turn to some world news the united states and south korea have begun a four-day show of force in the sea of japan. north korea is warning the exercises could lead what it calls a sacred war.

north korea made these threats before but this one is causing more anxiety. >> with one of america's most powerful warships poised to take part in joint military exercises north korea is threatening to use its nuclear deterrence in response. north says the exercises will result in what it calls a retaliatory sacred war. >> we should be very worried about this. north korea is comfortable with a state that makes nuclear threats. >> all this just days after the secretary of state and defense secretary visited the demilitarized zones announcing new sanctions and saying the military exercise sizes are meant to send a clear signal. >> we have seen nothing that gives us any reason to believe that north korea is ready to end its provocative behavior.

>> threats from the north are nothing new but take on more meaning after the singing of a south korean naval vessel, killing 46 sailors. >> white house is not commenting on latest north korean threat but it doesn't mean the exercises haven't created a war of words. >> it will be physical response. >> that statement from a north korean spokesman, answered by the defense secretary. >> taking steps that further strengthens deterrent and cnn straits our determination not to be intimidated. >> 89,000 troops and 200 aircraft and 20 ships. >> up next, cleanup crews head back out into the gulf after a tropical storm fizzles out. also a scary crash at an air show in canada. pilot gets out in the nick of time.

officials are warning they may have to evacuate again depending on what happens during the rest of hurricane season. by the way, that cap on the well deepwater horizon is working that has kept it from leaking for more than a week now. they hope the weather stays clear so they can plug the well for good. >> a pilot survived the fiery crash of his fighter jet while practicing for an air show in canada. you won't believe the pictures. the pilot ejects just seconds before his cf-18 fighter hits the ground bursts into flames. 60 miles north of border separating montana and canada. the pilot was only 30 feet above the ground when he ejected. he landed a few yards away from that giant fireball. investigators still don't know what caused that mishap on friday. >> in san francisco, it's if the city wins the bid to host

welcome back. time is 6:17. thanks for spending part of your sunday morning with us. we appreciate the company. this is a live look showing you the embarcadero and there is a san francisco marathon going on. just a few minutes ago there was a few stragglers left. some guys that are still back there. the race started at 5:30. 24,000 racers. you can expect street closures in san francisco as well as the golden gate bridge. they will be heading that way, as well. i shouldn't call them stragglers at least they got out there and ran. >> 5:30 is when they started. probably just to get underway to keep the traffic moving later in the day marathon started at 5:30 and half marathon should start here

shortly, as well. here is a look at the gold and there go the runners. make their way on the other side and head back the other way toward golden gate park and wind up at the ferry building. good luck to everybody out there. doing a little run this morning. temperatures are on the cool side for the joggers, 52 degrees. you saw the fog. that is what we're going to see again throughout much of the morning hours. by the afternoon, we should clear out. 60 degrees at antioch. los gatos, 57 degrees. winds on the gusty side, gusting up to 35 miles an hour. how about the weather for this time of year, cooler than average summer. average high is 71 degrees. we've been checking in the lower 60s each afternoon so definitely below average. as far as rainfall goes, almost 15 inches of rain. that is about an inch and a

third. sunset is 6:08. >> same kind of weather pattern. we've been dealing with keeping the fog along the coast. marine layer is 1500 feet. drawing in a lot of subtropical moisture. i'm looking for more thunderstorms this afternoon in the sierra around lake tahoe they could see big thunderstorms fire up again. possibility for dry lightning to produce some fires. closer to our area, you can see the fog beginning to burn off and continues to move off shore. sunshine replaces it. inland, temperatures in the 80s, 70s in the east bay. cooler and upper 50s aening lo the coast. san francisco will top out right around 66 degrees or so. again, kind of a cool day like we had yesterday. close to 80 in san jose.

santa clara, 77 degrees. campbell should make it up to 80. breezy and yesterday in the city winds really picked up in the afternoon. that is what we could see again today as the marine air begins to filter back in later this afternoon and evening. fog will begin to redevelop for your monday morning commute, as well. 62 downtown today so another cool one, 70s up across the north bay. east bay, free concert out in oakland, 68 degrees. should be nice weather for that. 91 in antioch and 88 in livermore. foggy conditions along the monterey bay with 63 degrees there. seven-day forecast, shows kind of a cooling trend, lower 80s by advertise and wednesday. 70s in the east bay and cooler on a along the coast. not a dramatic change. just a few degrees cooler. felt like a cool summer so far.

welcome back. californians start using less water -- that is the message from the latest report on the state's water crisis. new report looked at the delta which has long been ground zero for quench go our thirst. as that net miranda it has fueled debate over what to do. >> about two-thirds rely on the delta for drinking water. but a new report find that residents need to severely cut back in order if for the project to survive or delta to survive. >> if we don't change anything else it's going to take more water to restore the ecosystem of the delta. >> diverting water for decades has been blamed for changing salinity and flow. to restore it is based water

flow alone, sending water supplies down to central california could be reduced by one-third. north, it could be slashed 70%. >> cutbacks are already happening to deal with the three year drought and to save the endangered smelt. what else can a person get water for residents and farms. >> there is nowhere else to get water and the report isn't going to be implemented on its own. they don't have any regulatory clout. >> more you cut back, more challenges you have. we have to find something that works. >> still, environmentalists warn the findings can't be dismissed because water flow is a major part of the delta's problem. >> it's probably one part of the ecosystem we have affected the most. we have changed the flows of our advertise more than we've actually polluted it. >> report will be forwarded and

ishimaru reports. >> this stretch of dirt will some day be the southbound battery tunnel of the new presidio parkway. this animation shows what the tunnel will look like when completed. >> this tunnel is about 800, 900 feet. >> cars will come into daylight before heading that another tunnel where pedestrians will have an uninterrupted view between the main post-and crissy field. when the tunnel is built it will connect with the bridge. first detour road projects are getting started started a year ahead of schedule thanks to stimulus funding. >> we rebuild the infrastructure of america. >> this is legitimate stimulus project. this is a shovel ready project that would not have taken place a year ahead of schedule which will save the taxpayers some $90 million had it not been for the leadership of pelosi and president obama.

innovative solutions such as what is it going to happen to the final contracts. it will be a public-private partnership. >> the first of the two battery tunnels are so named because they are right along side the historic batterys once manned by the presidio gunners. it has to be replaced because the 1936 structures because it's seismically very dangerous. >> san francisco's marathon is well under way. first wave of runners started about an hour ago outside the ferry building. here is a live look from the golden gate bridge camera showing you runners as they make their way along the route. organizers say more than 24,000 registered runners are expected to take part this year. you can expect street closures, traffic delays, detours all along the marathon route

talking about lake tahoe. red flag warning for m the sierra, so we get dry lightning. actually touched off a few wildfires in the sierra. we'll keep an eye on that. we'll stay dry here. just kind of foggy. area of low pressure, it's the same system we've been talking about. hasn't moved much. counterclockwise circulation continues to drive in the fog, the marine layer, about 1500 feet. that is going to be kind of the same deal again today. more mountain thunderstorms are expected as some moisture from the south. weather forecast looks like this foggy and cool, temperatures in the on a this morning. lower 60s by this afternoon. further inland, looks pretty good, temperatures in the upper 80s with more sunshine expected again today. around the area, your highs look like this. lots of 80s in the south bay.

assistance from the government. san francisco tried to help by providing transitional housing but the city's latest project is being met with a wall of resistance. >> when she entered the foster care system when she was five years old. she aged out when she turned 18, meaning no nor government assistance. >> it's like, where do you go from here? >> this is where they want to put two dozen kids that are aging or others at risk for homelessness. it's a bed and breakfast in the marina. plans are to turn it into permanent housing with on-site services. >> we have concerns on how this facility is going to interact with our neighborhood. >> john is president of the

marina community association which questions everything from the $9 million financing to the size of the project. >> if we can scale this back, make it a more manageable facility or break night two. >> we think that 24 in this location should be no problem. >> kent is in charge of affordable housing. this would be the first of its kind in the marina, a neighborhood where the meadeian household income is nearly $85,000 a year. >> it's an opportunity for them and it could be a very good one, but it also could be an opportunity that could make them feel awkward when they see they are quite different from the rest of the people in the neighborhood. >> i have to eventually live somewhere. just because they are foster youth or coming from the system,

that doesn't mean they will be a problem in the neighborhood. >> the head of the city's human services department says critics have wrong idea about who will live here and how the place will be run. >> i think that the neighbors feel we are going to putting people there had that are drug abuse isers or active alcoholics and that is simply not the case. >> he says the kids will be in school, job training or working will. >> some of rhetoric is really disappointing to me. >> the mayor is fully supportive of the project. >> we want to share the responsibility of integrate ago social services network. but to actually do it. who are these people. these are people like you and me. >> the project opponents feel they feel unfairly important trade and want more information.

>> state authorities have forced the closure of an east bay car dealership for failure to pay state taxes. still what going to happen to customers that feel cheated by the same dealership. michael finney looks into that. >> alicia's life has spun oust control ever since she purchased this monte carlo. >> it looks good on the outside but overall its horrible car. >> she made a $2,000 down payment on pontiac grand prix but they confiscated the car six months later for something she blames on the car dealer. >> i paid that money to put down for this car. i feel horrible. >> both purchased their cars

from elite auto in pittsburg. both times elite auto failed to transfer ownership of the vehicles within the 30 days required by the state. bonisha has been waiting for six months. >> the car is registered to the previous owner. i went down to the department of motor vehicles i was unable to get any type of paperwork because the dealer has not submitted anything that says they told me the car. >> she bought her car in march of 2009. dmv confirms police towed the car because the registration had expired. >> i feel like the auto has ruined my life. >> shirley went to the auto return tow yard to get her car back but refused to give it to her because she had no proof of ownership. she currently has no car. >> i actually feel really alone, as a mom i can't even get my

children to on where they need to get to. >> we went to looking for answers, the dealership denied they are doing anything wrong. >> he says shirley stopped making her payments. she showed us $2600 worth of receipts and says she only stopped paying when elite didn't transfer the ownership. >> i talked to the dmv around i talked to the dealership and ask asked them, if they sent anything to the dmv. >> they sold the car on january 6. dmv records show that five days later, elite auto did transfer ownership to shirley but it was too late. car had been sold at an awnings to somebody else. dmv continues to investigate elite auto. they have been stripped of their license by the board of

equalization and dmv for failure to pay taxes. the sales manager says the owner is the victim of hard times. >> what is the reason for the closure? >> basically a lot of people, just like this one, he ran out of money basically. >> shirley took them to small claims court and won a $5,000 judgment. she is still waiting for them to pay. she some working with an attorney and says she'll sue elite if necessary. >> up next, zero to 60 in seven seconds. electric cars 16,000 mile
