>> in the news this saturday morning bay area police searching for a suspect that shot a fremont police officer. this morning the officer is in critical condition. and guards shoot at inmates in the main yard at folsom state prison to break up a riot involving 200 inmates. at least seven inmates were taken to the hospital with non-life-threatening injuries. >> good morning. breezy at the airport. cool air is filtering into the bay area and maybe even passing showers. >> i'm theresa garcia this morning a manhunt is still underway for a suspect who shot a police officer in east oakland. authorities say 20-year-old andrew baranto shot at officers,

stole a car and disappeared. that officer has undergone surgery and is listed in critical condition. here's lillian kim with the latest. >> bullet casings mark the spot where police officers engaged in a shoot-out with a wanted felon. it happened in east oakland where a officer came to serve a search warrant on a known gang member. the man they wanted started shooting at him when they saw them walking down the street. the gonzalez family lives a block away. he ran out when one of the officers was hit. >> somebody got shot and somebody was on the floor and two people were helping him. to see what happened. >> this is the man police are looking for, 20-year-old andrew barantos. 5 feet 7 inches tall and 240 pounds. he has dakota on the back of his

neck tattooed and dakota on his forearm. >> we're here to locate the suspect before he hurts anybody else. >> he was intent on leaving the area as quickly as possible. he ran a few blocks and attempted to carjack the driver of this acura. he carjacked a driver of a mazda. cameras caught it all on tape which has since been turned over to investigators. >> and back to his car. somebody just came and ran. just take his car and ran away. >> here's a photo of the green mazda 626. the license plate 4 mje 548. if you see this car or the suspect, oakland police want you to call them. >> the officer remains in

critical condition in the icu. doctors say he was shot in the groin area and that his condition is still touch and go. abc 7's lisa amin gulezian has more. >> fremont police officers refuse to leave one of their own. the cars remain outside highland hospital. doctors are doing everything they can. >> he's required some surgery. he's going to require more surgery. i would actually urge the public to donate blood if possible. had to trans fuse him extensively. >> the officer joined fremont police six years ago after spending 16 years at the newark police department. the officer is with the south alameda county major crimes task force. he was serving a warrant for the dea when he was shot. >> this task force deals with the most dangerous, the high end drug dealers and gangsters and a tough neighborhood in oakland so it's even more dangerous. he's a pretty tough guy, a good cop. >> which is why police are

confident the officer who's a husband and a father will pull through. he has to. the thought of losing him isn't an option for this department. >> there's a lot of trauma on the department, psychological trauma called by this. certainly everybody's on pins and needles until the officer makes it through. >> the last time a fremont police officer was shot was more than 20 years ago. >> the officer is in and out of consciousness. doctors are purposely sedating him in hopes of stabilizing his condition. in oakland, lisa amin gulezian, abc 7 news. here's another look at the man police are trying to find. 20-year-old andrew barantos. he's a wanted felon and considered armed and dangerous. he was last seen in a green mazda, 4 mje 548. if you see him or this car call 9-1-1. police do not want you to approach him.

this morning folsom state prison is on lockdown following a riot that the department of corrections classifies as major. it involves 200 inmates. seven inmates were injured and taken to local hospitals by ambulance. guards started shooting in the main yard to break up that fighting. it's not clear if the injured inmate suffered gunshot wounds or if they were hurt during the fighting. it started 7 last night and was broken up about 30 minutes later. >> it started on and it was a spur of the moment thing. we had no indication this was gonna happen. it was 35 to 40 staff initially involved to respond to the incident. we fired three green grades, chemical agents. we also fired 20 .40 millimeter less lethal impact emissions and five mini shots were fired. >> no officers were hurt. officials are investigating to figure out what incited the

riots. san jose firefighters have rejected a proposed 9% pay and benefits cut. it would have allowed the city to rehire 49 of their laid off colleagues. yesterday 88% of the firefighters voted against the offer. the union says it was shot down because the proposal does not include a guarantee there will not be layoffs in future contracts. san jose faces ace $10 million deficit. 1800 other city employees have accepted cuts. a retired presbyterian minister is appealing her case after being found guilty of misconduct for officiating same sex marriage ceremonies. the panel censured the reverent by 2 to 4 yesterday in napa. she performed the marriages when same sex marriage was legal in california before prop 8 paled. the church allowed ministers to bless same sex unions but not imply or represent they were marriages. she was accused of violating that policy. >> this i think is a sad day for

show host glenn beck. some 100,000 people are expected to attend. the rally is being held at the lincoln memorial where martin luther king jr. delivered his i have a dream speech exactly 47 years ago today. beck says the timing is coincidental and says his rally is a tribute to american troops and isn't political. yesterday beck prepped the event at a freedom works rally in washington d.c. freedom works is a nonprofit group that helped organize the tea party movement. arrested again. paris hilton was still being held in las vegas jail a few hours ago. police arrested the 29-year-old on cocaine possession charges last night after stopping the car she was riding in on a las vegas street. officers pulled over the car after noticing what they suspected was marijuana smoke trailing out of it. well, paris is expected to be released on her own recognizance later this morning. she also had a run-in earlier this summer at a world cup match in south africa when police

arrested her on suspicion of marijuana possession. that case was later dropped. in 2007 she pleaded no contest to alcohol-related reckless driving and spent 23 days in jail. two computer rivals are locked in a bidding war for a small bay area data storage company. dell and h. p. want to buy free par in fremont. that's a company that makes servers and software that allows large amounts of data to be stored and retrieved. both companies are trying to expand into a fast-growing tech field called cloud computing. >> i have all kinds of information and applications that i access via my phone. when i go home, i put my phone away and pull out my i-pad and i have the same applications, the same information all available to me because it's no longer stored on the devices, it's stored up in the clouds. >> well, dell thought it had a deal at $18 per share.

very unusual potholes. >> the city of pinole paid a contractor to repave this stretch of the avenue last year. >> we were all very happy because it was going to be beautiful. and it was beautiful two or three days. >> just days after the job was finished last november, these potholes appeared at the intersection with pinole's main drag, pinole valley road. >> everybody has to go very slow. >> so andrea took this video with her i-phone and e-mailed it to us at abc 7 news. >> your lock being brakes take effect and then you slide. there you go. >> she says drivers are swerving into the oncoming lane to avoid the potholes creating a dangerous situation for children and others who cross this busy intersection every day to get to the nearby swimming pool. >> i'm worried that somebody will be avoiding a pothole and not see a person crossing the street. they're so busy avoiding the potholes. >> she called public works to

complain but she says nothing has been done since the potholes first appeared about ten months ago. >> i'd like them to tell us what are their plans? what happened? why did this occur? what's going on? why is it taking so longto fix these potholes? >> dean allison is the director of public works for pinole. he says the city has filed a lawsuit against the contractor bruce paving and grading and in this complaint the city alleges that the avenue project has serious defects including potholes that are expected to continually get worse. it also demands the contractor redo the entire job. >> we paid for a brand new roadway and by golly we're getting a brand new roadway from this contractor. what we have now is certainly not that. >> one of the city's attorneys tells us the contractor has not been served with a lawsuit yet and he did not return our calls for comment. but on the same day we started asking questions, the council voted to pay a different contractor to repave seemuss

up 6:36. cloudy in the south bay. a few peeks of sun there early on. but wide ranging temperatures, 46 degrees. santa rosa, los gatos and in between a warm 60 in oakland. we have the wind to factor in today, a much chillier air mass and even moisture that's headed to the north and west of us. here's a look at our wind gusts. oakland 32 mph. the airport 40 mph. you'll see the gusts in concord just 30 mph, through the delta, fairfield, 28 mph from the southwest but will calm out in santa rosa, that allows to you chilly in the mid-40s. a slight chance of showers, call them sprinkles north bay this morning, peninsula through the overnight hours and then we see warmer conditions, steadily warmer next week. 60s and 70s even into our east bay valleys today where we should be the upper 80s to only 60 downtown. a windy day today. that's 10 degrees below the

normal for oakland, san francisco, santa rosa and on the peninsula. just a few peeks of sun and a very breezy day for you. here's a look at live doppler 7 hd. been quite some time but we are looking at some moisture here. in the northern mountains. none of it yet working towards the bay area. but you can see a few sprinkles as you're headed up to the sacramento valley. as this system swings through later on today, i think perhaps around the peninsula, the overnight hours and the south bay you can see a few sprinkles. here's our low. there's the cold front. it's gonna bring a cool pool of air with it and that's gonna allow for pressure gradients. that means windy conditions today. here's the way it pans out. partly cloudy skies around the bay today but then through the early morning hours notice you could see a few areas of light presip around the peninsula into the northern mountains but you get high enough and it's snow right through yosemite through tomorrow afternoon. so definitely cloudy and cool

here over the weekend into the early part of the week. but we'll be recovering quickly after this system passes with some temperatures near normal into next week. today though, yes, can you believe it, just 68 in sunnyvale and milpitas. 73 saratoga. look for a lot of clouds, windy conditions. some gusts up to 30 and 40 mph around san mateo. the gap and 57 for the sunset. 60 downtown, 70 novato and only about 70 for wine country. near east bay low 60s for berkeley with only mid-60s for san leandro, partly cloudy skies. a few peeks of sun, not doing much to warm you up in antioch. 69 pleasanton and by the monterey bay, more 60s than 70s but 72 gilroy. so even tomorrow we're gonna begin to warm up a little bit but still this cool air mass could bring the slight chance of showers. but by next week it's like indian summer. some of the trees are starting

♪ good morning. a new report indicates the economy is even weaker than analysts thought. the u.s. economy grew at the rate of just 1.6% this spring. it was expected to be 2.4% and even that was low balling it. the sluggish growth is attributed to a dismal housing market and slow business spending and manufacturing. in sacramento time is running out and the pressure is on for a piece of legislation that would protect california homeowners from foreclosure. some believe it is a critical step towards slowing the number of people losing their homes. but as abc 7's capital correspondent nanette miranda reports, critics say it's a mistake. >> it seems like a no-brainer. lenders from foreclosing california homes if buyers are in the process of buying a loan

modification. it allows them to sue lenders if they went ahead and took the property anyway. >> they have very deep pockets. >> the lending industry is out in full force making sure the bill gets killed. they counted 20 lobbyists applying pressure to lawmakers. >> trying to protect those foreclosures which can be avoided. >> the assembly is a final hurdle before approval and lawmakers rejected it earlier this week. they insists their no-vote wasn't influenced by lobbyists. they just didn't think the bill was needed since federal law prevents it during loan modification. >> if we don't allow the market to achieve a level where we're at the bottom and keep holding it up artificially, it's just going to prolong the pain. >> but points out the federal program covers only 80% of lenders and more needs to be done.

realtytrack found near one in 400 homes in the u.s. received a foreclosure filing last month. it's worse in california with one in 200 homes. from modesto, ground zero for the state's housing crisis it's one in 102 homes. >> that doesn't seem right. >> jane went through a sucklessful loan modification and wished he had the protection during his agonizing eight-month application process. >> every day that's all you worry about, losing your house. >> time is running out. senator leno must bring the bill up before the legislative session ends on tuesday. >> in the east bay the caldecott tunnel's fourth bore project just entered a new phase and the digging has begun. it's been 20 years in the making. transportation reporter explains cal tran will soon be drilling nearly all day and night. >> at the east portal, a massive drill studded with 60 points is digging its way west.

it's called a road header and it was built in germany just for this job. >> it's brand new. state of the art of equipment. probably the largest in the united states. this is world class job here so to mine this type of ground you have to buy the best equipment. >> the road header can be operated from the cab or for barrett view of the work outside with a remote control. it took a day and a half to excavate the first 5 feet. after that the portal walls and space had to be sprayed with concrete to stabilize the soil and rock. now they're on to the next section. >> we're gonna advance to 1.4 meters, shockcrete, bracing, and then shockcrete that and then that will be our day today. >> this has been a training week for the four men who will run the road header. next week they'll work continuously over two ten-hour shifts monday through friday.

the remaining 4 hours a day will be for maintenance. every three hours the sharp tips are replaced if the carbide is chipped. on wednesday a manager was injured when the road header hit a steel dowel. >> hit a piece of steel that was supposed to be in there and it flew off and hit someone in the leg. >> next month a smaller road header starts digging at the west portal. this road header will go two-thirds of the way and the other about a third of wait and we'll meet. >> this shows how the west portal looks now and how it will look when fun initialled. expected to be opened for traffic three years from now. the injured manager was back on the job the next day. the two meet in the tunnel after 260 days of simultaneous drilling. abc 7 news. >> the cost of the project is $420 million. that new fourth bore is expected to be open late 2013. there are new interesting

figures that reflect a change in the american family. we are now seeing the opposite of a baby boom in this country. the u.s. birth rate has fallen to its lowest level nay contract. experts believe that economy is what's keeping people from expanding their families. amy hol amy hollyfield shares a look at the numbers. >> americans having fewer of them. that's news to dr. emily hue. >> i said that's interesting because i feel like it's the same. >> dr. hue delivers babies in daly city and says she's as busy as ever. we asked her officer manager to crunch the numbers for us and they support dr. hue's gut feeling, the number of births is holding steady. >> i would say i'm seriously seeing a plateau across the last several years. >> the doctors here also work at a low income clinic and the numbers show there was a 10%

drop in births there last year but this year they say the numbers look strong. >> seems to me people have having more kids. haven't you noticed a lot of people kind of have three kids. three is the new two. >> the mother of five-month-old jenna falls in that. >> this is number four for me. i don't think it's impacted me at all. i like having family and having babies. >> yet the birth rate across the country has fallen to its lowest in a century. demographers say it could take a few years to turn this around. marsella can relate. they're living on one income. three-year-old nikki will be an only child for now. >> we're postponing creating or adding to our family just because of that. you know, the prices right now are so high. >> they're not surprised by the new numbers but sad it has to be this way. they would love for nikki to be a big brother. >> it's one of those things. we gotta wait and be responsible. wait and see whether we can afford another one or not. >> this is the second year in a row the birth rate has dropped

she owed wells fargo $44.96. >> he says, oh, there was a 4 cent balance on your account when you took out the $100. i said why didn't you tell me. why didn't you give me $100.04. >> that 4 cents was an interest payment from the bank to elaine that elaine didn't know about. the bank never closed the account because that 4 cents was still there. instead, wells fargo began charging her maintenance fees, $44.96. elaine called the bank and said keep the 4 cents and close the account. >> then she said there's nothing more we can do for you. you will just have to contact the collection agent and make arrangements for payment. i said i'm not going to pay $44 over 4 cents. >> now elaine worried her credit could be ruined. >> you know, a whole thing over 4 cents. we're not talking hundreds of

dollars. 4 cents! i was so angry that i did, i finally said i'm calling "7 on your side". >> she did. and we contacted wells fargo. it took action. the bank immediately reversing the charges and promising the incident would not appear on elaine's credit report. the bank said wells fargo reviewed this matter and believes there was opportunity to better serve ms. pete. while there's more to the story, we must respect the privacy of the customer. if wells fargo makes a mistake, we strive to make it better. thank you "7 on your side" for bringing this to our attention. >> i am very grateful, i am grateful to channel 7 for this wonderful service because i would be like everybody else not knowing what to do. >> the lesson here, it's not enough to simply withdraw the remaining money in your account. you need to make it clear to the bank you're closing the account. wells fargo tells us customers should not go to a teller but to
