far? the case now has the department's top brass rewriting the rule book. and this weekend the effort begins to clean up the san bruno neighborhood leveled by the gas explosion. >> good morning. clear skies and 50s and 60s around the bay. big warm-up for the first weekend of autumn. how long will it last? stay tuned. >> good morning everyone. i'm theresa garcia. a san jose police officer who intended to scare a teenager has the department's top brass rewriting the code of conduct for officers who get involved with people they know. it all began with a fake arrest that was recorded on cellphone video. it ledded to a police department internal investigation, plus a district attorney's investigation. abc 7's lisa amin gulezian shows us the video but the case involved juveniles so we blurred out faces to protect identities. >> growing up being in high school. cop's daughter not the one to mess around with. >> the father of a 15-year-old boy accused of having sex with a

san jose police officer's stepdaughter secretly to this cellphone video on august 30th. he gave it to our media partner, the san jose mercury news. and we showed it to the independent police officer. the judge couldn't comment directly because she's looking into all the allegations. but she did pinpoint two policies listed in the department's duty manual that should be scrutinized. >> when a officer is on duty or is off duty that officers will avoid becoming officially involved in quarrels or disputes occurring in their own neighborhoods. >> the other is an article that deals with an officer's code of conduct involving personal feelings. the teenager's parents insist the officer was out of line that night. >> this does not bode well. do you know what that means? no. not a good thing when the person you had sex with is a cop's daughter! we'll file charges.

>> but the officer's attorney paints a different picture one of a concerned father who was actually given permission by the boy's parents to use scared straight tactics. >> at no time do you hear the parents of the young man objecting, getting upset crying. so the video is absolutely exculpatory from the cop's perspective. >> the attorney even points to this moment when the father speaks to his son while he's cuffed. >> use your head. >> his department in the meantime is reviewing the duty manual which does not make specific mention of this type of behavior. >> we determined that there should be probably a very specific section that addresses this. we're several versions into actually creating one. >> sergeant lopez says the officer may have violated more than just those two policies. he is currently on administrative leave. in san jose, lisa amin gulezian, abc 7 news. >> california's first execution

under a new lethal injection procedure is scheduled for one minute after midnight wednesday morning. now, pending any last-minute appeals albert brown will be put to death inside san quentin's new death chamber and by 6:00 this evening he has a choice how his life will end. he can choose to be executed using a three-drug combination as used in the past or with a single lethal dose of the sedative sodium pentothal. lillian kim reports. >> barring any last-minute appeals executions will resume at san quentin prison next week. albert brown will receive a lethal injection wednesday morning. the victim's rights group citizens against homicides says it's about time. >> truth in sentencing needs to happen. and i think that moving forward so that these families can have some sort of closure is a positive thing. >> it will be california's first

execution in nearly five years. a federal judge gave the go-ahead now that prison officials have complied with his order. they built a roomier death chamber and revised how the execution team is selected and trained. >> given that brown's attorneys bear the burden of coming in with evidence that there's about to be an unconstitutional execution he finds that the evidence is just not there and there's no reason that he can find legally to bar this execution. >> albert brown was convicted of raping and murdering 15-year-old susan jordan of riverside county 30 years ago. brown grabbed her, tied a shoelace around her neck and pulled her into an orange grove. later that night brown called jordan's mother telling her you will never see your daughter again. jordan's family is counting on next year's execution. they say their 30-year wait has been long enough. >> we are a christian family. we believe that we will see susan again and so will he. >> supporters of brown however aren't giving up. attorneys with the aclu are

helping with the legal challenges. >> there is much more litigation to come. there is much more legal chaos to come. all the more reason why we need to stop these proceedings. the stakes here really are too high and there are too many unanswered questions for this to continue. >> lillian kim, abc 7 news. >> monday attorneys will ask a marin county judge for a temporary restraining order suspending those executions. they will be taking their case to the 9th circuit court of appeals. there are 708 people on death row in california. 690 of them are men all at san quentin. 18 women are waiting for their execution at the central california women's facility. cleanup is in full swing this weekend in the heart of the san bruno disaster zone. 29 of the 35 residents who lost their homes have signed a liability waiver which includes a guarantee they won't have to spend any out-of-pocket expenses. pg&e says it will ultimately pick up the estimated $60,000

cost per house. the cleanup is being done according to strict environmental regulations. and as those crews clean up the debris many said good-bye to three victims of the fire. nearly 1,000 mourners paid tribute to three generations of one family yesterday. abc 7's amy holyfield shares the story of the bullis family (playing taps) >> almost a thousand people gathered in burlingame to remember three members of the bullis family. 85-year-old levon her 50-year-old son greg and his 17-year-old son will. >> they loved one another. they loved their community loved their church community. they played together laughed together. pretty great family. they touched a lot of lives. >> so many the church and the neighborhood ran out of parking spaces. buses ferried people from the parking lot at mills high school. outdoor seating and speakers were provided to handle the large crowd. >> he was hysterical.

>> friends remembered greg's sense of humor saying he was always playing practical jokes on people. his son will was a senior at mills high school and a youth deacon at church. he was remembered for his gentle presence. and 85-year-old levon was described as a warm and patient woman who served as a deacon at church. friends say surviving members of the family at times feel overwhelmed by grief. >> they don't have any evidence of wills. they don't have anything to go by as far as how to just handle the normal sorting issues when it comes to the death of a loved one. everything was literally consumed in the fire. >> the family decided to keep the funeral private but did step outside to watch members of the marine corps honor greg who served in the navy. (gunfire) >> the coroner's office wasn't able to confirm the deaths of the bullis family members until

12 now. a florida bank was robbed yesterday by one of its own tellers who had been turned into a human bomb. police say it began early in the morning when three men burst into the teller's home and held him hostage. 8 a.m. they strapped a bomb to his chest drove him to the bank and ordered him to rob it or he would be blown up. >> once he was able to secure the money with the assistance of the branch manager he gave it to the two individuals waiting in the parking lot. he was ordered back into the bank. and the individuals left in a presented mustang. >> this is the teller after the heist. f.b.i. investigators are since cleared and released him. the drug enforcement agency is hoping that you can help solve a serious problem by taking action today.

a prelude to some pretty hot temperatures to come, especially inland. but warm day at the coast, too. lisa argen will detail more just ahead. a warning for those who go to pinto lake in watsonville. it is off limits for now because of a toxic algae bloom. health officials say people should avoid swimming in the lake and keep their pets from getting in the water or drinking it. the toxic blue-green algae is blamed for nervous disorders in humans and caused deaths in dogs elsewhere in the country. it typically occurs in august or september when the weather warms up like right now and can last into november when the winter storms flush the lake or the cold kills off the algae. so talk about september, it's hot this first fall weekend. >> very hot. it's going to get even hotter still towards the next week. so gonna last a couple of days. the fog is gone. starting out with clear conditions and from ballmer peak looking at mount diablo this morning where really a pretty start to the day.

sun coming up at 7:00 setting at 7:02. and autumn comes your way. the warm temperatures have headed back into the bay area. so starting out this morning with numbers in the 50s and some 60s. we're in the upper 60s in fremont with 59 in oakland, 50 napa. 60s in the city with upper 40s along the coast. so the longer days allowing us to really cool off and retain a little bit of the heat from yesterday. we are 6 to 7 degrees warmer from the city to mountain view this morning and concord is warmer than you were yesterday as well as santa rosa and napa. no change in fairfield. so we don't have the fog to talk about this morning. it will be warmer today and in fact the temperatures holding just about steady tomorrow and the ridge we builds again on monday for the hottest day we'll see in quite some time and then a slow cooldown into next week. so all the heat we're looking at spare the air day today with poor air quality in the santa

clara valley and just about moderate air quality here in our inlet east bay. good elsewhere but as we head into tomorrow and monday we will look at the cumulative effects of the heat, the poor air quality, the higher pressure pressing down on the atmosphere. more particulate matter and perhaps a heat advisory as we head into monday. so the clear sky and temperatures anywhere from 3 to 6 degrees warmer today. plenty of 90s around the bay. staying comfortable in the 70s at our coast with that very light west wind. we will see at the surface though a slight offshore flow and that's because of a building ridge of high pressure which is allowing for the heat wave or the warm temperatures to continue today. so as for tomorrow there is a trough in the gulf of alaska that wants to bump up against the ridge. we may see a few patches of clouds, areas of fog along the shoreline allowing the heat wave or the warmer temperatures to pause a little bit tomorrow. but then the high pressure ridge

goes again on monday. upper 80s in sunnyvale to 90 cupertino. look for 90s santa clara and milpitas. los gatos warming to 93 and on the peninsula clear conditions. half moon bay pacifica. it's a fogfest not today, maybe a patch of it tomorrow. 90 palo alto san francisco coming up a few degrees with 84 downtown, 83 south city. and in the north bay getting pretty warm through novato, sonoma and calistoga with mid-90s for you. 86 sausalito. near east bay, more mid-80s for richmond with upper 80s, san leandro, newark. you head inland and temperatures mid-90s so warm one for concord and livermore. monterey bay 92 at the beach in santa cruz with salinas warming to 92. the accu-weather seven-day has been beautiful if you like it warm. 70s 80s, 90s around the bay. even warmer monday and a gradual

>> we begin with a story you'll see only on abc 7. two court employees under arrest accused of fixing tickets in exchange for cash. vic lee reports from fremont. >> juan hernandez was arrested in late august after deputies and say he got caught in a sting set up by alameda sheriff office in the fremont courthouse. a woman they're not identifying came up to the traffic window to pay a ticket. a source says it was a large fine. deputies and say hernandez offered to fix the ticket in return for cash. instead she reported the bribe offer. >> according to sources familiar with what happened the deputies and gave the woman marked bills. one source tells us they were $100 bills. our sources say the woman then handed the money over to

hernandez as deputies and watched. >> this is sheriff's spokesman sergeant j. d. nelson. >> that person did in fact go forward and do that. had their record taken care of basically a third less than what it would have cost. >> early last week felix chavez was arresteded after they launched an investigation to see who else may have been involved. >> they did an audit of their books and found some discrepancies and at that point mr. chavez was also arrested. alameda court administrators declined our request for an interview. they did issue a statement confirming the arrest but said according to judicial cannons of ethics and other restrictions were unable to comment on pending cases and related issues. but appropriate administrative actions have been taken. both the court and sheriff's office say they're investigating. >> the investigation on these two people is ongoing and to see how far back it goes and how

widespread it is. >> now, hernandez is charged with accepting a bribe, embezzlement and grand theft. and chavez is also charged with embezzlement and grand theft. the big question is now just how widespread with these bribes and are they occurring in other courthouses. that is the focus of the investigation. vic lee, abc 7 news. >> san jose police chief is considering developing new rules for his officers on how they interact with people they know. the call for new policies stems from this cellphone video. it shows an officer confronting a 15-year-old boy who had sex with the officer's 14-year-old stepdaughter. the boy's father secretly recorded the video and shared it with our media partner the san jose mercury news. the officer even handcuffed the youth. san jose's independent police officer is pinpointing two policies that should be scrutinized while the officer's lawyer insists the boy's parents

gave him permission to use scared straight tactics. >> while an officer is on duty or off duty officers will avoid becoming officially involved in quarrels or disputes occurring in their own neighborhoods. >> at no time do you hear the parents of the young man objecting getting upset crying. so the video is absolutely exculpatory from the cop's perspective. >> the officer remains on administrative leave. the district attorney is also reviewing this case. a judge has now temporarily suspended criminal proceedings against a man accused of kidnapping jaycee dugard and holding her prisoner 18 years. her client may be mentally incompetent to participate in his defense. garrido faces charges including kidnapping, rape and false imprisonment in the 1991 disappearance of dugard. >> what we're talking about here is whether or not a citizen is making -- is able to make a

decision about his case. when somebody wants to either go to trial for crazy reasons or wants to not go to trial for crazy reasons, that person is not competent. >> the judge said he based his decision on talks with garrido's attorney and observing the defendant in court over the past few months; however the judge did not halt proceedings against garrido's wife nancy. believe it or not killers, rapist can provide in-home care for an elderly person you love. now the governor wants to change the law to prevent violent felons from working as home care providers in california. abc 7's capital correspondent nanette miranda reports other some of california's most vulnerable citizens: the elderly and disabled who need state subsidized in-home care. but hundreds of those caregivers have violent pasts. >> you can burn someone's house down? >> yes. >> murder somebody? >> yes. >> rape a three-year-old?

>> yes. >> governor schwarzenegger got legislative approval for background checks for service workers last year. state data since then identified a thousand convicted felons working or seeking jobs in the program. 800 were hired but 200 continue to work because a court subsequently ruled the state can only disqualify those who had committed just three specific crimes. physical child abuse not sexual. elderly abuse. and defrauding public assistance programs. there are still 70000 workers needing background checks. >> when you're talking about a population of people that are extremely vulnerable and that are in their own homes of course it's concerning that people with serious criminal backgrounds could have contact with them. unbelieve by privacy laws prevent authorities telling the elderly and disabled the caregiver has committed a violent or financial crime. >> but the union representing in-homeworkers say out of 400,000 caregivers 200 is a

small number. while the crimes do sound scary, john wilkins say two of his providers had criminal pasts and did a good job. >> someone's criminal background does not prevent him from providing good care for an individual like myself. >> the governor has already sent a letter to the legislature demanding a fix to the system. >> it's the equivalent to a rapist or murderer come into my grandmother's home and take care of them. >> they're in a bind to know a felon's past and not being able to fire or deny them employment. nanette miranda, abc 7 news. >> steven colbert testified on capitol hill yesterday about his brief experience as a migrant farm worker. he delivered his testimony in character. >> well sorry, we can't show that to you right now but i can tell you he was out to testify based on his one day's experience working on a farm as part of the united farm workers take our jobs campaign. it was meant to show that few

weekend. lisa argen will have more on the weather coming up. heavy rains in venezuela has caused flooding and landslides of that killed seven people. several streets in the capital city were blocked by a river of mud that carried away cars and anything else in its path. venezuela television says a house collapsed from the flooding and that caused a break in the city's main water pipeline. a river also flowed over the banks in some parts of the city and that triggered the evacuations of dozens of residents. really difficult those pictures there to see what's going on and then we have a fantastic weekend in store really. >> finally feeling like summer around the bay. temperatures well above the average. we were above average yesterday and today gaining on that with temperatures as much as 4 to 6 degrees warmer. starting out clear from our ballmer peak camera looking at mount diablo. clear all across the bay and temperatures very widely work with the clear conditions.

we've cooled off significantly in some parts of the bay with 50 napa. elsewhere pretty mild, 56 fremont. 69 los gatos with 46 along the coast. so we'll look for temperatures to warm 40 to 50 degrees today with numbers well into the 90s. and tomorrow looks to be just as warm. 24 hours ago we were cooler so we're gaining 5 degrees of warmth from where we were this time yesterday in menlo park and fremont. 10 degrees warmer in mountain view and 5 degrees warmer in santa rosa and novato. highlights even warmer today holding steady tomorrow and the heat peaks on monday as the ridge of high pressure right over the bay area. so with hot weather, the air quality taking a hit today especially in our east bay valleys and the santa clara valley. poor air quality. so today still good air quality around the bay even though our sea breeze almost nonexistent at our coast a weak one keeping the air quality good in the north bay, the south bay and along the coast.

but i think that's gonna change as we head towards the latter half of the weekend and into monday. with high pressure getting even stronger. so 3 to 6 degrees warmer plenty of 90s north bay south bay, inland valleys. upper 80s in our east bay and looking at 70s on the coast. so you have to be right at the beaches to get that cooldown because you head a mile or two inland and you're already in the 80s. so we have a combination of a strong high pressure ridge building into the northwest a light offshore breeze and that allows for the warming to continue today. tomorrow a trough of low pressure wants to displace the ridge. it's not going to have any suck sells but will maybe bring a patch of fog along the shoreline so that will keep temperatures about the same. maybe a degree or two cooler and that goes back, that ridge of high pressure for monday. santa clara and milpitas with low 90s, saratoga, los gatos. a nice afternoon, pacifica half moon bay, mid-70s for you, 89

redwood city and mountain view. 77 daly city. nice afternoon for golden gate park. it will be very busy i know. 95 in the valley and sonoma and napa coming in in the mid-90s. nice mild day for bodega bay and stinson beach. finally beach weather in late september. upper 80s oakland and san leandro warming to the low 90s for fremont, union city about 90 today and you head inland, everyone's going to be in the mid-90s. low 90s brentwood, delivers and concord with 96 pleasanton. the monterey bay look for 80 there while santa cruz warms to 92. so maybe a patch of fog will differentiate today from tomorrow. but otherwise about the same, even warmer monday. not a lot of cooling on tuesday. really getting more fog and an onshore flow. not until the middle of the week wednesday last day of the month is thursday. so for the rest of september very warm. >> you think we might have

another spare the air day beyond today? >> i would think so yeah. maybe even a heat advisory as we head towards monday. because it's just building. >> with the dryness also. >> yeah. fire danger definitely something to think about although no high fire danger officially from the national weather service but always be mindful of that. >> absolutely. thank you. bart service should be back to normal this morning after a train struck a deer on the tracks. this happened outside the pleasant hill bart station late last night. the 10:45 p.m. incident damaged the train enough to require it to stop between stations and then transfer those passengers to another one. now, the service on that line was delayed 45 minutes. a replacement train connected directly to the damaged one so the passengers didn't have to go outside. a bart spokesman says the train has since been moved to a service yard. 75 pilot whales stuck since wednesday on a remote new zealand beach has had little

success. volunteers managed to save 14 whales by trucking them elsewhere and sending them back into deep water. but two died in transit and seven more were euthanized after they quickly beached themselves again. the scientists haven't been able to determine were whales and dolphins frequently strand themselves in new zealand during migration in and out of antarctic waters. don't go away. medicines in their cabinet. >> we're talking about vicodin, oxycontin and other types of medications that people will use to get high. >> some of those drugs wind up being sold here on the streets and officials say teenagers are the most likely to experiment with pharmaceuticals they find in a family home. according to the drug enforcement administration one in 17 teenagers admit they've used prescription drugs to get high. most teens say pharmaceuticals are easier to obtain than illegal drugs. overall, 6.2 million americans abuse medication that is not prescribed to them. that's more than the number who use heroin hallucinogens and cocaine combined. now, law enforcement agencies across the nation are asking everybody to empty their medicine cabinets of unwanted pills. police and sheriffs across the bay area are opening their doors to let you drop off your drugs for free. legal drugs, that is.
