in the news this saturday morning, september 25, cell phone video captures a san jose police officer attempt to keep a teen straight but did he go too far. and the effort begins to cleanup a san bruno neighborhood leveled by the gas explosion. >> one of the warmest weekends we've seen for quite some time. hot weather and not any fog along the shore. >> good morning, i'm teresa garcia. a san jose police officer who intended to scare a teenager has the department's top brass rewriting the code of conduct for officers who get involved

with people they know. it all began with a fake arrest that was reported on cell phone video. it has led to an internal investigation plus a district attorney investigation. lisa amin gulezian shows us the video that this case involved juveniles so wee blurred out faces to protect their identities. >> the father of a 15-year-old boy accused of having sex with a san jose police officer's stepdaughter secretly took this cell phone video on august 30th. he gave it to the san jose mercury news. we showed it to the independent police auditor. they couldn't comment directly because she is looking into all the allegations but she did pinpoint two policies listed in the manual that should be scrutinized. >> when an officer is on duty or off duty, that officers will

avoid become officially involved in quarrels or disputes. >> the other is the code of conduct involving personal feelings. teenager's parents insists the officer was out of line that night. >> but the officer's attorney paints a different picture, one of a concerned father that is given permission by the boy's parents to use scare tactics. >> at no time do you hear the parents of the young man upset or crying. so the video is absolutely exculpatory. >> they point to this moment when the father speaks to his

son while cuffed. >> his department in the meantime, is reviewing the duty manual that does not make specific mention of this type of behavior. >> we determine that there should be probably a specific section that addresses this where several versions into actually creating one. >> the officer may have violated more than just those two policies. he is currently on administrative leave. lisa amin gulezian, "abc 7 news." >> california's first execution is scheduled one minute after midnight wednesday morning. albert brown will be put to death in san quentin's new death chamber. he has to make his choice how his life will end. he can choose to be executed with a three drug combination or a single dose of sodium

pentathol. >> barring any last minute appeals executions will resume next week. albert brown is scheduled to receive a lethal injection wednesday morning. a person from the victims rights group says it's about time. >> truth in sentencing makes it happen. moving forward so that these families can have some sort of closure is a positive thing. >> it will be california's first execution in nearly five years. a federal judge gave the go-ahead. they built a roomier death chamber and revised how the death team is selected and trained. >> given that brown attorneys bear the burden to come in the evidence that there is an unconstitutional evidence and the evidence is not there. there is no reason reason he can find to bar this execution. >> albert brown was convicted of raping and murdering 15-year-old

susan jordan of riverside county 30 years ago. brown grabbed her,fied a shoe lace around her neck and pulled her into orange grove. later she called the mother and said, you'll never see your daughter again. they are counting on the execution. they say the 30-year wait is long enough. >> we are a christian family. we believe we will see susan again. >> they are helping with the legal challenges. >> there is much more litigation to come. there is much more legal chaos to come. all the more reason we need to stop these proceedings. the stakes really are too high and too many unanswered questions for us to continue. >> attorneys will ask a marin county judge for a temporary restraining order suspend go those executions. they will also take their case to the court of appeals.

>> there are 708 people on death row. 18 women are waiting for their execution at the central california's women's facility. >> governor swarzenegger is calling on state lawmakers to amend the law so convicted violent offenders can't work as home caregivers. he wants to make illegal for them to work in the health care program. some say a person's past does not affect their ability to provide care, the governor says they pose a grave threat to many people. >> the equivalent to a rapist or murderer, come in my grandma's home and take care of her. >> it's not providing good care for an individual like myself. >> the documents show there are 210 violent felons who are working in the program or have applied for jobs. and cleanup is in full swing in the heart of san bruno disaster zone. 29 of the 35 residents who lost

their homes have signed a liability waiver which includes a guarantee they wouldn't have any out-of-pocket expenses. pg&e says it will ultimate liquor pick up the estimated $60,000 cost per house. the cleanup is being done according to strict environmental regulations. as they clean up the debris, many said goodbye to three victims. fire. nearly 1,000 mourners paid tribute to one family today. amy hollyfield shows us the story of the bullis family. came up to the traffic window to pay a ticket. twa as large fine. deputies say hernandez offered to fix the ticket in return for cash. instead she reported the bribe offer. >> according to sources, the deputies gave her marked bills. one source says they were hundred dollar bills. the woman handed over the money to hernandez as deputies watched. >> this is jsmd d.nelson. >> that person did go forward and do that. had their records taken care of. >> earlier last week, fe licks chavez was arrested. >> after we arrested mr. hernandez, we fond discrepancies and a that point mr. chavez was also arrested. >> they declined our request for

an interview but they did issue a statement confirming the arrest. but according to other restrictions, we're unable to comment on pending cases and related personnel issues. but appropriate administrative actions have been taken. both the court and sheriff's offices says they are investigating. >> the investigating of these two people are ongoing and to see how widespread it is. >> shrgz charged with accepting a bribe and embezzlement and grand theft. chavez is charged with embezzlement and grand theft. the big question now just how widespread were these bribes and are they occurring in our courthouses. that is the focus of the investigation. san jose's police chief is considering developing new rules on how officers interact with people they know. it stems from a cell phone video

that shows an officer confronting a 15-year-old boy who had sex with the officer's 14-year-old stepdaughter. the boy's father secretly recorded the video and shared it with our media partner. the officer even handcuffed the youth. they are pinpointing two policies that should be scrutinizing rules. >> when an officer is on duty or is off duty, that officers will avoid becoming officially involved in quarrels are disputes occurring in their own neighborhoods. >> at no time do you hear the parents of the young man, objecting, getting upset or crying. so the video is absolutely exculpatory. >> the officer remains on administrative leave. the district attorney's office is also reviewing the case. a judge has temporarily

proceedings against the man that kidnapped jaycee dugard. philip garrido public defender says he may be mentally competent to participate in his defense. >> what we're talking about here is making a decision about the case. whether somebody wants to either go to trial for crazy reasons or not go to trial for crazy reasons, that person is not competent. >> the judge says he based his decision on talks with garrido's attorney an observing the defendant in court over the past few months. the judge did not halt proceedings against his wife nancy. >> killers and rapists and other violent offenders can end up providing inin-home health care.

nannette miranda reports. >> they are some of california's most vulnerable citizens, the elderly and disabled who need in-home care. but hundreds of those caregivers have violent pasts. >> you can murder somebody and rape a 3-year-old? >> yes. >> the governor got approval to ask for background checks. they have identified 1,000 congress victory felons seeking jobs in the program. 800 were fired but at least 200 continue to work because a court subsequently ruled they can only disqualify those that committed three specific crimes, physical child abuse, elderly abuse and defrauding public assistance programs. there are 70,000 workers needed background checks.

heat and a very gradual cooling trend. spare the air day today. with moderate air quality in the east bay. sanity championship, poor air quality. this will continue tomorrow into monday while the good air quality closer to the water, a high pressure continuing to build with each and every day taking a hit on the air quality. in particular by monday, we could see a heat advisory. with the rapidly warming temperatures, look for numbers to be in the 90s from the north bay, south bay, inland valleys and upper 80s around the bay. half moon bay and ocean beach enjoy the 70s. big ridge of high pressure building in the gulf of alaska. any storms that want to head to the south can't do that. we're looking at a light offshore flow. we are looking at a big trough here. that will begin to bring in a few areas of fog tomorrow
