in the news this saturday morning, october 2nd, better late than never as lawmakers reach a deal on the state budget. also, a speeding ticket will now cost you more being caught with pot. >> cooler temperatures and breezy winds, i'll tell you about it next. >> i'm teresa garcia. a lot of details still have to be ironed out but california's $19 billion budget gap will be closed with the new budget agreement just reached by the governor and leaders from both parties. it took a lot of work to bring them into agreement. this is a picture from

schwarzenegger's twitter feed. as the deal they say includes no new taxes. lilian kim reports on the agreement. >> legislative leaders emerged as what was described as an intense five-hour meeting. >> we want to announce we have a comprehensive agreement that we intend to bring our members back next week. >> no world how it bridges the budget gap. details won't be released until a public hearing on wednesday. the governor spokesperson says that schwarzenegger got some of the key things he wanted including pension and budget reform. >> i'm not going to get into the details of the agreement but i can tell you the governor has said since day one, he is not going to sign off on a budget that includes tax increases or the reforms we need.

>> it signals a plan to end the stalemate the longest in california yesterday. the state has not been paying employees and vendors. right now $3 billion is owed to state contractors. >> this is difficult tiles, not a lot of celebrating, but we all stepped up and did the work we had to do. er thank these gentlemen and the governor. >> they will spend the next few days drafting the language of the budget. then they'll be a public hearing followed bay a vote as early as thursday. there should be enough support to pass the budget on a two-thirds vote. >> possessing up to an houston of marijuana carries a maximum fine of just $100. that is the same as a traffic ticket. governor swarzenegger signed a bill reducing possession of pot from a misdemeanor to

infraction. the governor says he still opposes prop 19 but he says the new bill will save the state millions of dollars in court fees. prop 19 advocates says california will benefit more by legalizing pot and taxing it. >> the hundred dollar ticket often costs us a thousand dollars in enforcement alone, never mind a few hours of a cop off the street. we're not yet taking control of the situation. we have an opportunity by voting yes on prop 19. >> all right. they claim to be selling medical marijuana and delivering it to homes but an agency south bay area task force says they were plain old pot dealers that advertised online and in magazines.

agencies seized 25 pounds of marijuana, 223 pot plants and nine guns and rifles an oakland woman accused of badly beating her daughter is under arrest for child abuse. it happened in this home you see on lynn street. the toddler remains in hospitalized in guarded condition. neighbors say they heard the woman screaming out a window in spanish. we spoke to a witness who didn't want to be identified. >> she was yelling, my daughter, i love you. that was the daughter's name. she was saying, help me. call police. >> the woman ran from the house wrapped only in a blanket. she had been arrested five months ago for allegedly beating an older son. child protective services are working on where to place the toddler after she is released from the hospital. >> prosecutors in eldorado

county have confirmed the indictments of philip and nancy garrido in the 1991 kidnapping of jaycee dugard. >> it was revealed in court yesterday afternoon. the couple is charged with kidnapping and raping and holding her captive for 18 years. nancy garrido pleaded not guilty but her husband wasn't allowed to enter a plea. >> this man robbed an elderly man in costco parking lot. the suspect was with another man. both spoke spanish. the robbery happened monday morning and police need your help to find the two suspects who got away in a blue four-door car with tinted windows. both are considered armed and dangerous. >> two art collectingers who claim to be the victims of a multimillion dollar heist in pebble beach have filed a defamation lawsuit against monterey county.

they say officials called them liars. the men were renting a home when they reported the robbery last september of works by art ivptsd including van gogh. >> oakland police are investigating why one of the officers shot and killed a family dog. it happened on tuesday while police were responding to a burglary learm alarm. police say the dog charged at them. they are going to examine its policies for this kind of situation. in the meantime, they offered to bring the family a puppy. >> i feel like i need to get over the shock before moving on to another pet, another dog. >> in may, officers shot and killed a deer trapped in the backyard of a home in east oakland. that case caused an uproar, as well. we have learned that the sergeant in that case has been demoted and the or who fired the shot has been disciplined. >> officials at lawrence berkeley lab are warning visitors that today's open house

state budget cuts are crippling my classroom, so i can't believe the sacramento politicians cut a backroom deal that will give our state's wealthiest corporations a new billion dollar tax give-away, a new handout that can only mean larger class sizes and even more teacher layoffs. but passing prop 24 can change all that. prop 24 repeals the unfair corporate give-away and puts our priorities first. vote yes on prop 24, because it's time to give our schools a break, not the big corporations. i give patients act restoring mouthwash. act kills germs, restores minerals strengthens enamel. act restoring-- for strong teeth act now.

monterey due to a weather system that will throwing mid-level clouds our way. as we start, we will be looking at temperatures this morning, pretty mild, 50s and 60s out there. today, numbers will continue on their downward slide. we're at 60 right now in fremont 57 in san francisco with airport delays on the hour of about 35 minutes. so keep that in mind if you are headed to the airport. this afternoon we will be a little bit cooler but tomorrow, much cooler day. typical fall-like weather after a blustery started to the workweek. the fog quickly retreats and more 60s and 70s with northwesterly wind that will clear us out quicker. low to mid-80s for inland valleys. here is a look at radar. low has been spinning moisture into the mountains and they are

seeing the buildups of cumulus clouds and bringing out a few sprinkles. lear at the back half of it, it looks like it's pushing up into the bay area and the atmosphere is pretty dry. whatever moisture we see in the higher levels of the atmosphere, it's wringing out. not out of question, a trace or two, ben lomond and sanity crust mountains, but all and all, a partly cloudy afternoon and then this particulars this subtropical moisture and breezy flow mix can out the fog. it will be a sunny and brisk day and temperatures below the average. statewide still kind of warm from palm springs to las vegas, 89 there. and 99 in yosemite. higher elevations next week, maybe a few snowflakes at 9,000

good morning. topping our news, a budget deal has apparently been reached in sacramento. a week ago, lawmakers announced a framework for a budget. now, they say a final deal is in place ending a record sale mate over a spending plan. >> we have a comprehensive agreement that we intend to bring our members back next week. we intend to have a public and transparent airing of the agreement, probably next

wednesday through next thursday and we intend to vote a budget finally next thursday. everyone has worked very hard. these are difficult circumstances, not a lot of celebrating. >> the deal is expected to close the $19 billion deficit. leader say it does not raise taxes as democrats wanted nor does it dismantle the state's welfare system as proposed by republicans. details on the substance of the agreement are going to be released and a vote is expected on thursday. >> thursday was the final deadline for governor swarzenegger to sign or veto piles of bills stacked on his desk. for a closer look, here is capital correspondent that net miranda. >> among the laws is radiation safety bill, 260 cases just at

>> but the governor also vetoed some proposals that would have been popular with californians. >> one would have banned those annoying debit card fees. and at gas stations you have to pay an extra 45 cents for using a debit card. businesses will raise the price for everyone to make up the difference. >> obviously he is not for the little man and for the business people. >> and those red light cameras that cost more than $400 per violation, a bill that reduced the fines by half where drivers don't make a complete stop, the governor vetoed that, too, because he doesn't want to encourage dangerous driving. some drivers say that they are not surprised. >> if you veto that money coming into the general coffers you are stopping taxes, the money is being used for certain things and he doesn't want to do that.

>> the one thing he should be signing is the state budget. legislature hasn't sent him one yet. it's now going on four months late. go. >> once again, lawmakers are going to vote so the newly reached budget deal on next thursday. only then will the governor be able to sign it into law. >> in the race to become california's next governor the illegal housekeeper scandal confronting the meg whitman campaign is becoming a broader issue this weekend. advocates of immigration reform are using the controversy as an opportunity to call for change. more on this story from lyanne melendez. >> the repercussions of the allegations made their way to san francisco's mission district immigration advocates called for domestic workers bill of rights. >> we can include them in overtime protection, include them in occupational safety and health regulation.

the midst of getting a rooftop solar system installed in san jose. the 300 kilowatt system is largely funded by a $1.1 million donation from two corporations, cypress semiconductor and sun power. it's a gift that will benefit the community. >> rooftop solar system will save the food bank $3 million over the next 25 years. that is 630 meals per day or 6 million meals over the 25-year life of the system. >> every dollar we don't have to spend on refrigeration is going to go right back in giving out more food. >> second harvest is distributing 20% more food than last year serving an average of 231,000 people each month. >> this is great to see our

community doing something like this. >> nick of an energy company is also pitching in with a crew installing the system of 1200 solar panels. they are expected to supply about 50% of the warehouse's energy needs. >> it's definitely a green system. it's going to offset electrical costs. >> and that is a generous transfer from renewable resources of the sun to the people that need the most. good work there. >> we had our heat last week. a lot of changes coming in. especially today as the area of low pressure throwing up clouds, even sprinkles. here is a look at mount diablo. we do have some areas of clear sky, but we're also looking at rain around monterey, light rain. right now, temperatures are definitely on the cool side with some 50s. we blew right by 54 in novato

and 57 in san francisco. airport delays of 30 minutes. mild around the bay today with 80s returning to inland valleys. we will be looking at temperatures coming down overall a little bit today. more significantly more tomorrow with the fog being wiped out due to some strong northwesterly winds that will carry over into monday. pretty nice looking week. the plan for today, with the straturs but we will see mid clouds around the bay and high-level clouds. in the south bay, santa cruz mountains, extra cloud cover. buildups in the higher elevations but cooler day with more 70s around the bay. we will see sun at our beaches. here is the satellite and radar composite. pulling up the subtropical moisture providing the thunderstorms for los angeles, the desert even the mountains and southern sierra.

follow-up on violations. when a retailer is cited for selling jewelry containing lead it's supposed to be removed from the shelf. what if the retailer is cited again and again? >> behind this secured gate and office space in oakland are boxes and boxes of lead tainted products. these items were tested by the center for environmental health. products found with a high amount of lead almost results in a lawsuit by the center and the state or a violation notice from the state attorney general. >> companies have been responding quickly. >> rainbow apparel is one such company. it has 35 outlets in california including others. they tested several pieces of

jewelry. they found 16 pieces with excess levels at rainbow stores. the clasp on this necklace contained 80% lead, the label says lead free. >> people are thinking it's safe for their children. >> lead poisoning can lead to serious health problems and has been connected to behavioral problems and learning disabilities in children. rainbow promptly announced it would remove all 16 pieces cited in the june notice for sales nationwide but joanna of california watch found that wasn't the case. >> when the state says, take it off your shelves none of them go back to make sure it happens. >> california watch decided to do its own spot check. it found those heart-shaped pendant with high levels of lead still for sale at rainbow. >> we bought it on july 2nd. rainbow found out about it on
