is helping her do it. >> a record $120 million of her own money whitman has spent much of it courting the california latino community, highlighting the shifting electorate. it was working. a poll before the controversy erupted shows she was supported by 26% of a latino voters. a strong showing for a republican. >> it's a growing bloc of voters and politicians need to look through that. >> the news broke last week, these are called october surprises. good news for whitman, she has four weeks to try to explain this issue to latino voters. >> state assembly speaker john perez is calling the new budget agreement a solid but good deal for california.

how it eliminates the state's $19 billion deficit without imposing taxes will come out at a hearing this week. their speaker says it relies on a combination of spending cuts and optimistic financial projections. lawmakers argued to vote on the package this thursday. >> a walnut creek apartment complex now has a fifth female resident saying she fought off a rape attempt. the series of sexual assaults dates back to late june. amy hollyfield reports on last night's incident. >> police say a man tried to shove a woman will into an apartment. she fell down a flight of stairs while fighting him but she was successful at taking him off. >> so scary. we are wondering when it's going to end. >> mattie and her roommate has had a chain lock installed and they have a pit bull and they always use the buddy system but

they still don't feel safe. >> i wake up to the noises more than i ever have. >> police blame the first three attacks on 22-year-old man and they say they have dna to prove it. he is in jail accused of one rape and two attempted rapes. his bail is set at $12 million. investigators have a description of the man who committed the fourth sexual assault and are waiting to find out more information on the other crime. they want them to work harder to protect them. >> they are not checking cars in and out. they think we need to do more than having more bodies in and around the complex. >> we found out what is to get out of lease but there is no way to get out of it unless you pay the difference so there is no way out.

>> the latest victim was taken the hospital because of fall down the stairs, she was not sexually assaulted. police don't have a description of her attacker yet so they don't know if the last two assaults were committed by the same time man. amy hollyfield, "abc 7 news." a high-speed chase along bay area freeways ended early this morning. san jose police were responding to reports of a family dispute. they say a mother and her baby were being held at knifepoint by the child's father inside a truck. it started at 11:00 last night. police, highway patrol and other law enforcement agencies chased that truck all the way to san francisco. the driver changed directions, headed south again into daly city and back down the peninsula on interstate 280. it all ended after midnight with a truck crashing at woodside road. man got out and jumped over the overpass falling to the concrete below. he survived and at stanford

hospital. the baby was in child carrier and not injured. the mother was also uchb hurt but obviously shaken up by the ordeal. >> san jose firefighters spent last night clique up a spill that sent thousand gallons of diesel fuel into the creek. they were called after 5:00. firefighters say a generator on the roof of the at&t building malfunctioned. diesel made its way into drain on the roof and eventually down into the creek where it caused minor environmental damage. no reports of injured wildlife. also in walnut creek, police are dealing with a plague of violent altercations in the downtown area. take a look at this video possible at the time on youtube this weekend shot by a witness friday night on north main street. several people were injured in at least five fights at three locations. one man was hospitalized with head injuries.

once again, oakland finds itself desperately short of police officers. this weekend, dozens of volunteers are going door to door, they are launching a grassroots campaign to put in two ballot measures they hope will prevent more police layoffs. vic lee reports. >> oakland high student carla rehearsed her lines at st. columbus catholic church. they are going door to door campaigning for the two ballot measures that will raise money for public safety and restore many of the lady off police officers. they will provide more funding for intervention programs for youngsters. >> i started stealing cars, stealing clothes. >> she was in and out of juvenile hall from the age of 12 to 17. thanks to intervention programs he is now straight.

>> i recently graduated from u.c. berkeley. i'm a case manager now. i work with other young people. >> oakland has 120 fewer cops due to layoffs an attrition. city councilwoman says it will get worse if the measures fail. >> if it doesn't pass we will probably have to lay off even more police officers. this is where we're about on the police side about $10 million. >> going door to door talking to voters. >> 16-year-old robert pace knocked on doors with his six-year-old nephew brandon. he wants to make oakland a safer place, not only for himself but for brandon. >> i'm going to live here for the rest of my life. i might as well make it better. >> ron and his two companions see public safety as the number

one issue in oakland. >> by voting on that, that is reinstated go those officers. >> they gave the pitch whose home is in north oakland. it's into the question of paying more money but it's accountability. >> i'm happy to pay more taxes if i feel its effectively being used. >> also on the ballot is measure "x". that would bring back dozens more officers by imposing a $360 parcel tax. police officers association wants the city to fill some of the openings that were created by attrition but the city says if it did that they may have to lay off the measure fails. vic lee, "abc 7 news." >> starting tomorrow, san jose commuters can catch three new commuter express light rail trains. those will go to spots in south

lens from heavenly camera where it is raining at the tahoe valley airport with temperatures in the mid-50s. you are going to see not only rain but snow in the next couple of days in the mountains, in the northern sierra to the southern sierra. back home from emeryville, it's cloudy for sure but we're getting some peeks of sun this morning starting out with numbers in the 50s. menlo park, 58. 61, san jose. a few leftover sprinkles with more sunshine throughout the afternoon. scattered clouds tomorrow and then a pretty nice fall pattern coming our way this week. martinez, a light shower but look what happened a very thin line of showers pushed through the bay area. the moisture has been setting up south and lifting to north and

east taking the showers with it. we have another system one associated with cooler air headed our way. winds are going pick up and going to scour out some of the clouds and bring the temperatures down. that will be the trend again for the tart of the workweek. then we should settle into a more mild pattern by advertise, wednesday and thursday. we talked about the rain, the showers and the know. here we are until wednesday. we are looking at several inches of snow. much colder conditions, windy and the of rain starting today, not much of a break for the next couple of days. if you have anybody headed that way, bring out the rain gear. temperatures in the 60s. breezy and definitely cooler than yesterday. back home we're looking at numbers over the east bay hills in the 70s. mild there but cool 50s and 60s with the fog at the shoreline. a cooler afternoon for you in

the south bay with 71 in south bay. 75 in campbell. mist and drizzle and showers but that is all moving on to the east. we'll be looking at increasing sunshine in palo alto at 70. san francisco, couple degrees cooler, winds kicking up at 62 today. 60s and 70s in sonoma to napa and as we head on over to the east bay, feeling a little bit cooler mid and upper 60s. so the winds will keep it on the brisk side. 70s in castro valley. ten degrees cooler in the inland valleys with numbers only in the low to mid-70s. down by the monterey bay, still cloudy, 62 in monterey and 74 in holster. seven-day forecast, few drops here and there but it should be over. higher elevations will see more of that tomorrow and couple degrees warmer next week. >> so maybe the weather will

advisories issued for europe. abc news is reporting, england, france and germany and possibly italy and belgium are potential al-qaeda targets and could be like this one in mumbai two years ago that killed 175 people. the brothers are sending heading off to a flight to poland. >> it's scary. but you have to worry about getting on a plane. you can't just get on plane. you have to worry that you'll make it home alive. >> there is a concern for major transportation hubs. >> word of a possible european travel advisory comes the same day that osama bin laden released a new audio pleading for relief for flood ravaged pakistan.

>> i think the most important thing is to understand all the security procedures that goes into this. it gets tougher at the airports. >> there are other countries that are more worried than italy >> i don't think it's just people to europe but for all people. the afghan government has begun dissolving private security firms in the country specifically ending the operations of eight firms and including the firm formally known as blackwater. they were embroid in a controversy in the shooting deaths of 17 civilians in iraq. security firms work like militias provided protection for convoys. hamid karzai announced in august that private security

freeways. san jose police say the baby's father was behind the wheel. now, according to investigators, the little girl and her mother were being holding at knifepoint. the incident started in san jose just before 11:00 last night. police the highway patrol and other law enforcement agencies all chased that truck all the way to san francisco on highway 101. the driver changed directions and headed south into daly city and back down the peninsula on 280. just after midnight it ended. police say the truck suddenly crashed at woodside road. the man jumped over the overpass falling some 30 feet to the concrete below. he survived the fall. he is at stanford hospital. the child was in a baby seated and was not injured. her mother was also unhurt but obviously shaken by the ordeal. >> hayward police are investigating the city's 13 homicide of the year. a 24-year-old man was shot to death on terrel avenue early

yesterday morning. investigators got a call about a fight or an argument of some sort just before 3:00. police say the victim suffered at least one gunshot wound. he died at the hospital. his name has not been released. police have no information on a suspect. >> oakland police are investigating a shooting that took place in the back seat of a taxicab this weekend. it happened yesterday morning around 7:00 in the fruitvale district on harrington street. the cab company says one of their drivers picked up a pair and someone walked up and shot the man, a 25-year-old oakland resident. cabbie drove him to a nearby hospital for treatment. >> in north richmond a transformation is taking place. vacant lots are being changed from magnets for crime and blight to small gardens of hope and bounty for urban neighborhoods. eric thomas reports. >> in what used to be a vacant lot in north richmond... hands

unincorporated area that is among the poorest communities in contra costa county. growing crops is free but there is a one time ten dollar charge for a key to the gate that protects the property. organizers say it's worth the money because it puts a positive face on a community known for violent crime. >> this is important to show that these are some of the things that are positive that youth can do. it's more than standing on the corner. you can come in and work. it brings the community closer. >> it also provides fresh produce in a community that lacks a grocery store. the project is funded through a $56,000 grant from fees paid by a local landfill transfer station to offset the more unpleasant aspects. they are working on a vacant lot one of seven spots. >> i don't care who we are, our

ancestors did this. we need to go back and incorporate into our lives. >> it's what organizers call a peace garden. about 20 people grow everything here, from corn, to edible flowers, enough food to share the bounty with lots of others. >> organizers are asking for more money this year in hopes of eventually building 35 of those small gardens. one every five blocks. >> lisa argen is here now, she has had a challenge for this year with the weather, it's been so... although we do have rain behind us. >> very fall like conditions out there today. few drops of rain and most of it is behind us. wind will pick up and partly cloudy day today. any more rain chances? i'll let you know.

in walnut creek. if you live around that way, temperatures are in the high 50s. as you know it was triple digitals not too long ago. lisa argen will have more on the weather coming up shortly. >> light rail passengers will be getting around the santa clara valley faster starting tomorrow. valley transportation authority is replacing some of the older vehicles with new faster models. they'll shave six to eight minutes off the trip to south san jose into down. they will operate on highway 87, this is the first major change to the system in 23-year history. >> a lot of changes to our weather. we can't keep up with it. >> several degrees off the highs as an approaching trough brings a cooler air mass. we had another earlier system that brought raindrops. plenty of cloud cover from our

roof camp. 7:30 this morning, the rain gauge, brought in raindrops that tipped the bucket downtown. temperatures are cool, 58 degrees in the east bay. we're looking at numbers all around the bay pretty much in the upper 50s to low 60s. cloudy skies in novato. southwest wind at 20 miles an hour. sunshine in the east bay. temperatures will be cool today, few left over sprinkles and then turning partly cloudy. winds kicking up. it be a breezy day tomorrow and after that, more fall-like weather pattern locally while in the mountains, things go downhill quickly and could see a couple inches of snow in the southern sierra. live doppler showing what went through pretty much has evaporated throughout the rest of the bay area.

turlock san joaquin valley, thunderstorms and wet weather continues into the mountains. left over moisture as the area of pressure, subtropical moisture lifts to the north and east today. at its heels another upper level trough that will bring a cooler air mass and scour out some of the cloud cover. we will be looking at a cool start to the week, temperatures below average and winds kicking up tomorrow and later on tonight. definitely feeling like fall but we should settle into a more comfortable pattern with seasonable temperatures next week. wednesday and thursday in the mountains, we've got a mix of rain and snow, maybe a couple of inches in the southern sierra. not totally out of the question or unusual but bring the layers and be advised if you are headed that way over the next few days. at the ballpark, partly cloudy afternoon, temperatures in the low 60s for the giants. we will be looking at warm

weather or warmer weather in the east bay valleys. 80s. 50s and 60s elsewhere and those westerly winds kicking up today. 73 in santa clara, peninsula, cloudy with temperatures struggling into the mid and upper 60s for redwood city. 70 in mountain view today. a cooler inch downtown. only 50s in golden gate park. mid 60s south city. we had airport delays of about 45 minutes and things are a little bit slow going on arriving flights there. 60s and 80s north bay with low 70s sonoma, midday sun here. it's going to take a while for conditions to brighten up and warm up. those low to mid 60s, feeling the cooler air in berkeley. 71 in front. out over the -- fremont. biggest drop is ten degrees cooler, 73 in walnut creek and 76 in livermore. lots of clouds helping to make it 70 in santa cruz. seven-day forecast, most of the

rain is a thing of the past but moisture keeping a slight chance of showers in the forecast for today. pretty windy tomorrow and winds will abated. one of the coolest summers on record followed by the hot fall temperatures could create a wind combination for wine growers. longer the grapes sit on the vine the better the flavor. leigh glaser reports from livermore valley. >> mother nature is trying to replace it. >> wine maker says all those grapes still on the vine are just getting better. a cooler than normal summer coupled with a record heat is making some of most flavorful grapes for some time. >> sugar levels is developing and cooling days, few more days which will put everything in a slower mode. >> this years harvest is three

weeks behind due to the cool weather but that is not bad. the longer the more sugar it produces resulting in a better taste. >> went from last week, okay, we want to pick, we want to go, this week it's full-blown, how many trucks can we get in the door. >> before grapes are picked, they test the juice for sugar content or brick, a sugar level that is measured. this seasonal sample is 23 bricks not quite ready for wine making. >> very close, very close. >> but again, this is will come back a little bit. >> of course, tasting is always the best gauge of when it's time to pick. wineries have done harvesting already but production is going to gear up in the next few days which means a little more time to sweeten up and produce a

it has been three weeks since a neighborhood in san bruno exploded and burned with devastating consequences. people who lived through it continue the struggle with the daunting challenge of moving ahead. >> our family was going to go for this and it's not there. >> this is the new normal for the family. they are renting a house about a block and a half from their old home. it was damaged beyond repair by the san bruno explosion and fire. moving forward has been challenging. >> there is more play book or framework. it would have been helpful if someone said, this has happened to other people. here the bullet points.

these are steps you need to follow. >> it's as if their old life has been erased. >> we're able to order social security cards and for my children, ordered birth certificates. pg&e cut us the initial checks and no obligation thing to get you started. our homeowners insurance, i called them the day it happened because i thought that is what i was supposed to do. we've gotten a couple checks from them. >> they plan to rebuild and say the city has been responsive. they have put together a list of licensed contractors and architects and expediting the permit process. >> i think we have been overall effective but it's maintaining contract with the contact with

state budget cuts are crippling my classroom, so i can't believe the sacramento politicians cut a backroom deal that will give our state's wealthiest corporations a new billion dollar tax give-away, a new handout that can only mean larger class sizes and even more teacher layoffs. but passing prop 24 can change all that. prop 24 repeals the unfair corporate give-away and puts our priorities first. vote yes on prop 24, because it's time to give our schools a break, not the big corporations.
