investigating a shooting inside a nightclub that left one man with life threatening injuries. and a south bay college student claims the f.b.i. was spying on him. he says he found a gps tracker on his car. >> good morning. skies are clear. we're waking up to temperatures in the 50s. san francisco. 40s at our coast and the north bay but today numbers above the average. >> good morning, everyone. i'm theresa garcia. san francisco police are investigating a shooting inside a nightclub early this morning. police are saying the shooting occurred shortly after midnight inside cafe kokomo. that's off interstate 280 on indiana street. the victim, a 23-year-old man, was rushed to the hospital with life threatening injuries. they don't know who fired the shots or why. detectives stayed at the nightclub into the early morning hours trying to learn about that gunman. a student says the f.b.i. spied on him and he found the tracker to prove it.

this is a picture of the device he found attached to his car. he wondered what it was, then a visit from a federal agent answered that question. here's abc 7's lisa amin gulezian with more. >> i was working in santa clara. just turned 20 last august. i'm sorry a sales manager. we sell laptops and i'm a full-time student. >> on sunday while affi, a half egyptian, half american muslim got an oil change at this garage, he noticed this attached to the underbelly of his car. >> the device i found was stuck by a magnet. >> it was a gps tracking device, affi took it apart. two days later he says the f.b.i. and other police stopped him as he left his santa clara apartment complex. and a federal agent started questioning him. >> have you ever been to yemen for any time of training? no. do you know anybody that's affiliated with anybody that's extreme or abnormal or posting

anything online that they shouldn't be. he said where's the devials located on your vehicle. i didn't answer. i just asked him: did you guys put it there? he goes yeah. they refused to discuss his discovery but did say court decisions have consistently upheld there's no warrant necessary for gps tracking of a vehicle when the vehicle is in a public space. >> you can put it on any person's car? i would argue that's obviously an egregious violation of everybody's constitutional rights and should be challenged. >> recently a u.s. court of appeals reaffirmed the government's ability to use gps devices on cars. still affi's attorney assists his civil rights were violated and he was intimidated and harassed. >> they can try but i'll add that federal officers are protected by robust communities in this context. >> the fbi does say agents spoke with him and that he's cooperating fully. lisa amin gulezian, abc 7 news. >> okay. the giants tortured fans during

the regular season and now the team is doing it again in the post-season. last night at at&t park, a 4-0 giants six lead turned into a 5-4 loss with atlanta tying the series at one game apiece. the giants jumped out to a 3-0 lead in the first inning on a pat burrell three-run home run and added another run. but atlanta scored one run in the 6th inning and later tied it up with three runs inth. they had a huge opportunity to win the game in the 10th loading the bases with one out but buster posey grounded an inner double play. launched the ball into covey cove to give atlanta the lead. >> biggest homer of my career. to be honest i wanted to go from the batter's box to the dugout. i wanted to be with the guys. but what a cool thing to do and what a cool way to win.

>> game three is tomorrow afternoon in atlanta. we know the late innings were obviously disappointing for giants fans who started out dancing in the stands. amy holyfield has more. care. the new budget includes $7.5 billion in cuts and relies on optimistic revenue assumptions which means the next governor will face a similar crisis next year. it calls for the states to sell some of theirs buildings and lease them back. some are historic landmarks like the earl warren building, home to the state supreme court. >> i always believed in buying real estate rather than selling real estate. but, you know, when you are in a financial crisis like we are, then you have to make decisions. >> the sale could earn the state $1.2 billion but long-term the legislative budget office says taxpayers could be on the hook for $1.5 billion, more than 300 bids have already been submitted for those properties. hundreds of people came together in san francisco last night to bring attention to the growing problem of two side among gay and transgender young people. they want schools to do more to project lbgt students from

bullying. they're calling for new legislation. >> david nelson, the executive director of affirmation gay and lesbian mormons reads off the name of 12 gay and lesbian youth that committed suicide in the past two months. >> there are hundreds if not thousands each year that commit suicide. >> robert moore is also with affirmation. he shared his experience of being a mormon gay teen in oregon who managed to -- >> every day i was called names. every day i was literally chased home every day from school. >> affirmation organized this candlelight vigil which drew 700 organizations and 300 people to san francisco's civic center. meant to bring attention to suicides like 18-year-old tyler clemente with the hope of preventing further tragedy. he killed himself after video of

him and another young man was posted on the internet. the latest in a series of suicide that many attending tonight blame on ignorance and bigotry and a lack of school support. the improvement act now before congress will require any school receiving federal funds to implement bullying prevention programs aimed specifically at anti-gay harassment. a san francisco school teacher says most schools can't seem to or don't want to deal with the problems of these youths. >> i don't think the resources are readily available enough. i think the teachers and the staff need to be more trained how the kids and they're tormenting them. >> the youth should be told they have to survive, that it does get better. in san francisco, i'm thomas roman, abc 7 news. >> here's one we've been waiting for. crews working at a richmond sinkhole have finally solved a six-month-old mystery. yesterday they found the honda civic a neighborhood said was

swallowed in the disaster. crews located another car, a mazda. the owner of the civic had settled with insurance adjustors even though no one was sure if the car would ever be located. coming up next, a break-through. it took more than two months but just this morning rescuers' drilling equipment has just pushed through reaching 33 workers trapped underground in a chilean copper mine. chilean copper mine. the campaign meg whitman's nose is growing again. this time she's lying about jerry brown on taxes. but as governor jerry brown cut $4 billion in taxes and says no new taxes without voter approval. meg whitman -- her nose just keeps on growing and growing.

finally broke through to the mine shaft where 33 miners are trapped underground. a siren sounded signalling to the miners' families that the break-through has succeeded. now engineers insert a steel tube that will reach the chamber 2,000 feet down where the men have spent the last 66 days. they'll be hoisted up the shaft to the surface in an escape capsule one at a time in a trip expected to take 15 minutes each. if all goes well, that rescue could happen as soon as tuesday but the operation is now entering its most dangerous phase. >> it should be certified with x-rays, the process. not a piece of cake. >> to make sure they're okay, those miners will spend at least two days in the local hospital once they're out. a british aid worker kidnapped last month in afghanistan died during an attempt to rescue her. yesterday international forces conducted a nighttime raid in an attempt to free linda norgrove but found her dead after a gun

battle with her captors. also this morning nato officials say four italian troops died by an insurgent attack in afghanistan. >> comments included a warning that al-queda remains a significant threat. >> al-queda is a resilient and evolvi evolvi evolving enemy. its based in some of the most inaccessible areas of the globes. they haven't given up their aspirations for another spectacular attack. >> he said operations including drone missile attacks are decimating al-queda's leadership and making it harder for the organization to recruit and train terrorists. freed iranian prisoner sarah shourd is back in the bay area. she will call for the immediate release of her fiance shane

a nice fall weekend. the weather's gonna change a little here and there and we're gonna have lisa argen detail all of that just ahead. the navy's blue angels precision flying team highlights the fleet week air shows over san francisco bay. the shows begin both days at 1:00 in the afternoon with stunt pilots and military demonstrations and then the blue angels roar overhead from 3:00 to 4 p.m.. all kicks off this morning at 10:00 with a parade of ships on the bay. we can tell you the best vantage point for all this is along the san francisco waterfront from marina green to pier 39. expect the traffic though to be gridlocked and parking superhard to find so public transit is highly recommended. you will find a full schedule at abc7news.com and for a full dose of the weather, lisa, good morning. >> good morning. looking at a storm system to our north. it's gonna stay there though and we're looking for a warming

trend over the next 48 hours as high pressure builds in. view from mount tam, the sun just about beginning to come up. you can see a little bit of daylight out there. 7:13, it's setting at 6:41 tonight. boy, really getting, you know, getting hard to get out of bed in the early morning hours with it staying so dark out. but we will look at a nice afternoon today. a few high clouds drifting by from time to time but a warming trend throughout the next several days. 48 menlo park, 45 santa rosa as well as half moon bay. definitely cool air out there while we have 50 with partly cloudy skies in livermore. sunshine with a few high clouds from time to time due to a storm system to our north but we'll still see mild to warm afternoons. so warmest weather coming in next week, monday and tuesday. looking at temperatures near 80 at our beaches. so here's what's going on right now. we are looking at the fog staying offshore with the clear sky.

that's thanks to the north to northwest winds today. we'll see the 70s and the 80s for the most part today with some 60s at our beaches. stormy weather here and that's where it's gonna stay. but a few high clouds spilling off from time to time from the system to the north. that's gonna allow for some serous clouds. a week system to our north and we get into an offshore flow coming in monday and tuesday. but as far today, fleet week activities, temperatures downtown san francisco in the mid-70s. we'll see a little more fog heading towards the shoreline tomorrow. so maybe losing a degree with more of a westerly component. but today that in the south bay, look for numbers in the low 80s. beautiful day around cupertino, 81 for you. 82 in campbell.

peninsula numbers maybe a couple degrees warmer than yesterday with 66 monterey bay. plenty of sunshine there. mid-70s san mateo, downtown 74. a few high clouds but overall really nice afternoon. north bay you'll notice with numbers coming up a little bit. that's due to that northerly component. you'll warm to about 83 degrees in sonoma. near east bay check it out with 77 in berkeley today as well as newark. just about 80 in castro valley and numbers here climbing to the low 80s. 83 in pleasanton. walnut creek, plenty of sunshine with 80, santa cruz, 70 monterey. the look ahead, look for a few high clouds from time to time and a very light north to northwest wind. maybe a little more fog tomorrow but notice the fog is nowhere to be seen throughout much of early to mid next week. that's when we're gonna have high fire danger, potentially a pretty strong offshore flow monday into tuesday.

loss in oregon. okay. last night at at&t park, the giants' bullpen had a disappointing 8th inning in game two of the divisional playoff series against the atlanta braves. larry has the highlights in this morning's sports. >> good morning, everybody. the giants on their way to a lead but the atlanta braves made a late comeback and suddenly, suddenly this series might possibly end in atlanta. gorgeous night of baseball. record 44,000 plus at at&t. pat burrell crushing this pitch in the first. three-run blast off tommy hanson. nice support from matt cain. cain helping his own cause for the r.b.i. single right up the middle. the first giants pitcher since 1954 to get an r.b.i. in the postseason. what could go wrong? what took 14 innings in this series but the braves on the board in the 6th, singles home, 4-1 game.

a nightclub early this morning. the police say the shooting occurred shortly after midnight inside cafe kokomo just off interstate 280 on indiana street. the victim, a 23-year-old man, was rushed to the hospital with life threatening injuries. police say they don't know who fired the shots or why. detectives stayed at the nightclub into the early morning hours. they're trying to learn more about that gunman. thousands of documents show tens of millions of welfare dollars have been spent out of state and some at vacation resorts. the discovery is leading to new legislation to prevent welfare abuse. abc 7's capital correspondent nanet nanette miranda reports. >> ridiculous. >> welfare offices have been jam-packed with applicants needing cash assistance for basic needs like shelter. under new legislation about to be introduced by assemblyman ted gains, say they have to spend their benefits only within the

state. los angeles times analysis found $69 million was spent outside state lines during a three and a half year period beginning in january of 2007. at destinations like surfing, hawaiian beaches and cruise ships in florida. critics call that taxpayer funded vacations when taxpayers can't afford ones themselves. >> these are for folks that are hurting. that are out of a job. when you see that money is spent on a cruise, then obviously it's fraudulent. >> benefits are deposits electronically on to welfare cards that are used like a debit card in stores or to withdraw money at certain atm's. the analysis found $12 million was spent in las vegas, a million and a half in florida, 400,000 in hawaii and $16,000 drawn from atm's on cruise ships. they pound out $69 million is less than 1% of the $11 billion

the state gave out during that period. >> when people go on assistance they're going to have the same life situations come up as anyone else. you're going to visit your sick relative, go to funeral us out of state. that's what's going on here. >> the state says accounts aren't normally flagged until out of state transactions continue for more than 30 days because recipients aren't supposed to be gone that long. >> the vast majority of our families who are receiving benefits do so in a legal, lawful manner. someone withdrawing benefits to feed their kid while they're taking care of an aged grandparent, that's allowed. >> taxpayers say it's time to move to a voucher system. >> giving welfare recipients cash is always risk-inherit. >> another problem is when they don't use certain atm's, taxpayers pick up those tra fees. last year taxpayers paid $11 million in surcharges and will likely surpass that this year because bank fees have gone up.

abc 7 news. >> governor schwarzenegger signed the new state budget yesterday morning after lawmakers stayed up all night approving it. the deal was made primarily with cuts of nearly $7.5 billion and $2.5 billion in new revenues coming in. the rest relying on wishful thinking and creative accounting. part of the budget deal calls for the state to sell off some of its land to marked buildings. david louie explains why there's disagreement over whether california should become a renter in order to raise much-needed cash. >> some of them are historic landmarks such as the earl warren building, home to the state supreme court. others house the california public utilities commission. the attorney general's office in sacramento and the state office building in oakland. 11 properties in all up for sale to address the state's budget crisis. >> i always believed in buying real estate rather than selling real estate. but, you know, when you are in the financial crisis like we are, then you have to make

decisions. >> the plan, part of the just approved state budget, calls for these buildings to be sold then leased back. while the before thinks the sale could realize a net gain of $1.2 billion, the problem could be in the lease-back arrangements. according to a study by the legislative office and the state's largest labor union, they think the taxpayers will be on the hook for an additional $1.2 billion. that's because the state would be a perpetual rent are for decades. they may not get top offers because of the renovation when the state moves out. rossi is a real estate agent in san jose. >> i don't know there's much call for chambers and a courthouse and rotunda and all that if the state's not utilizing. the question is how long is the state there and how long will the lease be. >> over 300 bids have been submitted for the properties. the names of the biders are not being released. commercial real estate broker

speculates they are pension funds or investor groups in search of steady income from rent. >> the world today, the yields are low, down. if the state creates a premium yield it's attractive to a lot of investors. there's a lot of money on the side lines looking for deals but they're looking for the right deal. >> david louie, abc 7 news. >> doctors have performed the first of its kind reconstructive surgery on a marine mammal. a sea lions nicknamed sergeant nefvitz had a major head wound fixed yesterday in vallejo. >> the surgery performed on sergeant nefvitz took about 30 minutes. s main goal was cover two holes in his muzzle made by a single bullet. here's what he looked like shortly after being rescued last december. that large hole is where the bullet came out. this doctor flew in from washington d.c. to perform the

surgery. >> used a piece of this foreheader the flap to get that closed and plug the hole. >> the operation was done to repair his nasal passage. >> she couldn't dive underwater. water would go in. usually sea lions seal the nasal cavity. >> because he couldn't dive for his food he lost a lot of weight. but after being rescued and brought here, he gained about 310 pounds. >> now he's up to almost 700 pounds which is about average for a big male, a very healthy male. he's being hand fed so he's probably liking that a lot. >> everybody that participated in the procedure did so for free. >> this animal was wronged by people. there's no doubt about that. he's a gunshot victim, and that's just wrong. that's an adverse human interaction. >> now sergeant nefvitz will be watched carefully by the staff

oakland with some 80s returning not only in our inland valleys but in the south bay and notice the fog right here. but i think by tomorrow we could see more fog on the pacific coast. our radar composite shows the stormy weather to the north for washington and oregon and that's where it's gonna stay. higher pressure building in and that's going to be the trend the next 48 hours. once the high builds in, going to get even stronger come monday and tuesday. we're looking at the wet weather to the north and with just a few high clouds brushing san francisco and our east bay communities from time to time, even the north bay as well. a double barrel high pressure. we've got a warming trend on the way and then those winds begin to pick up come monday and tuesday. stronger in the north bay than in our east bay hills. but for the week activities featuring a lot of sunshine with temperatures in the 70s.

overnight lows in the 50s and in the south bay today, warming through the 80s. warmer than average campbell, 82. cupertino 81. look for 80 sunnyvale. the peninsula numbers about 2 to 3 degrees warmer than yesterday. if you like it warmer, going in the right direction today with 79 mountain view and palo alto with beaches in the mid and upper 60s. san francisco mid-70s. plenty of sunshine. with that north wind edging up to the lower 80s for santa rosa and calistoga. look at the 70s. upper 70s for berkeley today. 78 union city and with the lighter wind, gonna feel pretty nice out there. a couple 80s towards castro valley with 83 concord, 84 moorland creek. by the monterey bay, 70 for you in monterey. it's clear now. 80 santa cruz, 85 in gilroy. the accu-weather 7-day forecast

"the better part." >> three, two -- >> the weekly magazine show has been running 27 years on community access television started by a club from the cupertino senior center. the only requirement to participate, you have to be at least 50 years old. today 81-year-old ernie is on camera. 80-year-old myrna is on teleprompter and the director is 76-year-old phil. >> it is really mental health, people our age. when you have your mind working so intensely and so quickly this this just keeps all the little things going. >> i want to switch to camera 2 for two shots. go through it twice. >> the better part runs on community action stations. kmvt also trains the volunteers. >> everybody just pitches in

>> 90-year-old virginia connor was repairing her bathroom and thought she might as well install a walk-in bathroom like this one making it easy to get in and out. >> you open the door and you walk in and you turn the water on and then you just bubble, bubble, bubble. >> virginia saw an advertisement on tv for these tubs. the ad said installation could be quick and easy so she called the company rebath of san mateo. during a sales call at her home, virginia signed a contract agreeing to pay $9,500 for installation of a walk-in tub. she paid a deposit of $3,167 by check, one-third of the cost; however, right afterwards, she had second thoughts. >> i wanted to cancel it because then i began to think that, oh, it was too much money. >> virginia realized the contract did not include repainting the bathroom but no problem. the contract said she could cancel within three business

days as required by law. virginia said she faxed over a cancellation notice the very next day and also sent it by certified mail. she called the re-bath salesperson, too. >> she said well don't worry, your check will be in the mail within ten days. it never happened and then i began to worry. >> the ten days passed, then weeks. and virginia still had not received her $3,000 back. she says she kept calling the company and no one would call her back. >> i just thought, well, how many i gonna get my money back. i need to get it back. i called michael finney's office. >> we contacted re-bath and right away it took action. >> the next voice i heard was the president of the company in arizona. >> a few days later, virginia received this check hand-delivered to her home. it was a return of her full deposit. we spoke with the san mateo franchise owner eric lieu pez.

he said he never received virginia's cancellation notice but refunded her money as soon as he found out she did want to cancel. >> we would never hold money from somebody who doesn't want to do a job from us. so as soon as we found out she didn't want to, we noted her daughter and herself that she was going to get her full deposit back. >> he said he served thousands of customers over the past five years and this never happened. but he says virginia's case prompted him to reexamine his refund process. >> we're going to make sure we do a better job in the future of getting the customer a refund or deposit back to them as soon as possible. this situation has made me want to look into that and make it a better system because, obviously, she wasn't happy. >> however, that's all changed now. >> and here i am. a happy 90-year-old. (laughter) >> and i thank you very, very much. >> virginia says she voluntarily paid one-third of the project

the fleet week kicks off this morning at 10:00 with a parade of ships on san francisco bay and at 1:00 this aerial performances begin with stunt pilots and military demonstrations. and then 3:00. >> you'll hear them roar. that's the navy's blue angels and they will be roaring over the bay putting on an hour-long show of precision flying that will leave you breathless. fleet week events repeat sunday. if you plan to come to the waterfront, you are urged to leave your car at home and take public transit and that's because the traffic and the parking in san francisco typically becomes very gridlocked during fleet week. and will the skies be clear for it, lisa? >> looks nice. in fact, heard them yesterday and today starting with clear conditions, mid-50s downtown. 40s at our coast. i went by that pretty quick. that was 74 in san francisco, low 80s our east bay valleys with 81 cupertino, san jose.
