good morning, thanks for joining us. nine people are hospitalized this morning in stable condition at six bay area hospitals following a midnight shooting incident in downtown oakland. police are investigating what led up to the shootings on 19 the street near broadway. the victims were attending a halloween party. the biggest college party in the bay area.

a balance room employee tells the oakland tribune there were at least 600 people at the party. the worker says there was a minor too fight before the shooting but he thought who was involved had left. >> san francisco leaders are asking people not to celebrate halloween in the castro. they made the same request last year but tens of thousands showed up anyway. tomas ramon reports on what community groups are doing to survive tonight. >> they are demonstrating how to call for help in the event of violence on halloween. no one wants it to be terrifying. >> the incidents have been isolated but they have affected people. once the crowd gets to a point where it's hard to control it makes the situation more dangerous. >> the 2006 street party did get dangerous, nine people were shot

one woman was trampled. this year and others, they handed out whistles if someone witnesses any kind of violence. they say the whistles saved a nun two weeks ago. >> if you whistle blowing like crazy, please call 911. >> they have stepped up patrols and the triangle martial arts association but people have to celebrate responsibly. >> don't be a victim. we have to take responsibility for our actions as a community. don't allow yourself to be a victim perhaps in overindulging at night. >> they worry about the celebrations turning ugly every year. >> it's very scary walking around and it's nice if you do blow the whistle someone will hear it.

election day and republican candidate carly fiorina was in sacramento in orange county yesterday urging her people to vote, as well. both will campaign throughout california until tuesday. >> there is new poll released on tuesday finding the measure to legalize the recreational use of marijuana is falling further behind. the field poll says 49% of likely voters are opposed to prop 19 with only 2% voting it. proposition 23 is struggling. 48% of those polled say they will vote now while 33% say they will vote in favor of that measure. and prop 25 which would reduce the vote requirement from passing a statement budget from two-thirds to a majority has a big lead. tonight the giants will try again to get a step closer to winning the first world series

since moving to san francisco 52 years ago. last night, texas made it a series again with a win at rangers ballpark. it was the first time world series game and rangers history. in the second inning, mitch moreland hit a clutch three-run homer to put texas ahead. in the bottom of fifth, josh hamilton took sanchez deep making it 4-0. the giants were able to come all the way back despite a homer. >> it's a dogfight at the beginning of this game. they've been doing it all year. we have to get the intensity up and keep grinding and going after them. >> game four is tonight in texas. >> the city seems empty without the team here but you can expect

what the sentence will be for former bart police officer johannes mehserle for the 2009 shooting death of unarmed passenger oscar grant. he was convicted of involuntary manslaughter by a jury earlier this year. he could get probation to 14 years in prison. mehserle's attorney wants him released on probation and grant's family is calling on the judge to issue the maximum sentence. our media partner oakland tribune consulted with experts that his jail term will likely be somewhere in the middle. involuntary manslaughter is between two and four years but the judge must way mitigating factors before deciding. >> california is rethinking nuclear power in this area of global warming. nuclear plants of generated a lot of controversy.

and why some lawmakers are now talking about the nuclear action. >> california's strict global warming law mandating greenhouse gasmihz is sparking the state where it gets its electricity. lawmakers think it may be time to think of a cleaner option that has zero emissions. >> there are people out there who subject that the only way we can achieve the goal is to have nuclear energy play part of our future. we shouldn't take it off the table. >> the state has two nuclear power plants that generate 15% of the overall energy portfolio statewide. california can't move ahead with nuclear plants until it lifts the moratorium. >> it may entertain changing the requirements. >> they are examining the pros and cons in order to expand

clouds and will help insulate us a little bit. partly cloudy skies and more sunshine will warm us up. temperatures are a bit below the average today but we'll surpass that. in some areas of the bay area by the middle of the week but temperatures in the 80s like san jose also by tuesday, we talk about your sunset, 6:12 tonight. clouds are favoring to the north bay and warm front and want to keep some of the clouds here. they have a sprinkle, maybe, but the possibility is a small one. we will see the clouds depart all throughout the bay area but marin, napa and partly cloudy throughout the rest of the day, mainly in the 60s but with that front close to us, it's keeping things definitely a little bit below normal. overall, high pressure builds on in.

this is going to set the stage for a business pattern change. after the front moves in, we'll see a wind shift and temperatures above average. today 67 in sacramento. lots of mid-60s throughout the state. monterey 65. mid-60s in los angeles. here is the outlook for the week ahead. take a look at monday, rain staying to the north. as as we go through tuesday and wednesday and into thursday, still no rain, just a little closer by the end of the week but the overall picture, mild and sunny conditions all week long. 66 in sunnyvale. low 60s to pacifica, 67 in palo alto. 63 in san francisco and five degrees below the average. in the north bay, overnight few clouds and 66 in sonoma. hayward, 65 and also in newark, nice afternoon, over the hills upper 60s.

immigration law will be heard in a san francisco courtroom. a three judge panel will hear arguments from arizona state attorneys and justice department lawyers. the obama administration claims the arizona law can which requires police to check the immigration status of people they pull over is unconstitutional because only congress can make immigration law. demonstrators on both sides are expected outside the courthouse. it could be weeks or even months before the court issues a ruling. >> the clipper card is supposed to make mass transit easier for riders. it's one universal card that works on most bay area transit systems. starting tomorrow, bart and muni riders won't be able to use passes, they will have to switch clipper. >> the clip ser a prepaid

48 in novato and 53 in mountain view and fremont. 24 hours ago we were warmer with the clouds. seven degrees cooler this morning in menlo park and 30 degrees cooler, concord and livermore. five degrees cooler. partly cloudy is the on order of the morning right through the afternoon. more sunshine throughout the entire bay area. that is the trend for the next several days. we're going to see a wind shift, building high temperature and temperatures will really climb. parts of the south bay may see 80 degrees. sunset tonight at 6:12 and then we change our clocks next saturday, falling back. here is the visible picture and notice the cloud cover. sonoma county and napa and off the coast here. this is due to a weak front. it's falling apart. as it does the high pressure will build in and that warmer, drier air will evaporate that cloud cover and see the sunshine as temperatures in the 60s. still cooler than average. we should see upper 60s and

>> when gia had the siding replace order her home she found that the contractor installed ailluminate the anymore trim instead of wood. >> i saw bubbling on the window. i called the contractor. he wanted to come and fix it, nobody came. >> the next trouble when she climbed a ladder to hang christmas decorations. she saw the bubbles up close. >> my hand went right you through it. the aluminum, it has corroded. >> they found there were holes, the size of a small donut. she took these pictures of the damage and these photos how she tried to spackle over them. >> my biggest worry, water could get in. >> she called the contractor, advanced design in san francisco but she says the company did not

respond. months went by. she filed a complaint about the bettor business bureau and still no reply. that is when she contacted 7 on your side and we contacted advanced design. the company looked into the case and week later took action. contractor replacing all the frames around all the windows and garage. the company says the problem was cautioned by chemicals in the pressure treated wound underneath the aluminum. they placed a lining under the new flame, we did take care of it and hopefully she doesn't have any issues in the future. >> i feel so good. it's great. i could hang my christmas decorations there again and i won't be worried about it. 7 on your side really helped me a lot. >> the contractor says pressure-treated wood contains different chemicals. so if you are doing a project with treated wound, make sure it
