>> oscar grant supporters are are planning another protest for the sentence of johannes mehserle. most of the streets that run through the san bruno neighborhood destroyed by september's gas explosion and fire will reopen this week. but the crater will remain off limits until officials finish their investigation. good morning, everyone. thanks for joining us. i'm carolyn tyler. we'll get to those stories in just a moment but first rain is falling in many parts of the bay area. if you don't have any yet, you will pretty soon. here's our meteorologist lisa argen with all the details.

good morning, lisa. >> good morning, carolyn. you can see the wet streets outside our studios here so it's been coming down in the north bay since about 3:00 and it continues to sink to the south. live doppler 7 hd, everyone except san jose and morgan hill. not too wet yet. but notice the yellows to the north and we'll take you on a little tour around the bay. mill valley, san rafael and richmond all seeing light to moderate rain. into the east bay and also through alamo, the san ramon valley, all the way down through san leandro and look at the peninsula. yeah, wet right on through san mateo across the san mateo bridge and into the south bay just some light returns now in san jose but as we look, you'll notice much more to come. the cold front not pushing through until later on this afternoon. so it looks like a wet and windy sunday. details of the rest of your week coming up. carolyn. >> pretty good soaker. thank you, lisa.

in the news oscar grant's family and supporters are planning their next move in response to the minimum prison sentence, two years, given to former bart police officer johannes mehserle. they are targeting friday's decision by that los angeles judge to throw out a gun conviction that could have added ten years to mehserle's involuntary manslaughter sentence. they are also promising more protests in oakland. abc 7's johnalston has the latest. >> another saturday night strategy session. every week since the oscar grant killing his family and supporters have gathered at the all event institutional missionary baptist church in oakland. this time they're plotting their next move after johannes mehserle's two-year prison sentence. the man arrested is promising more protests. >> we're fighting it. we're fighting these charges. we don't accept them. just like we don't accept the decision by that judge to give mehserle a slap on the wrist. >> their newest target is judge robert perry of los angeles who

tossed out a firearms conviction and gave mehserle the minimum prison term after deciding the bart officer did not intend to kill oscar grant with his service weapon. >> taking a look at the procedures it takes to have a judge removed or reprimanded. >> mike rains was quick to response. >> that's laughable. i mean, that's my first response is it's laughable. the judge was a very, very thoughtful judge. and he didn't give into the mob threat and he didn't give into the threats of intimidation and all of the nonsense that has characterized this case. >> grant's uncle johnson argues if judge perry gave different instruction, the jury might have convicted mehserle of a more serious crime. >> has been tacked from the judge perspective from his own mistake. so there's a lot to be discussed. that's an error that should not have happened. >> the reporters were not

allowed inside the church and afterward only a vague comment what was to come. >> we'll hold another protest very soon. we'll let you know. >> mehserle plans to appeal the conviction. the multimillion dollar civil rights suit the grant family filed against mehserle and bart will begin next may. >> now authorities in oakland are assessing the damage from friday night's protest over mehserle's sentence. more than 150 arrests were made mostly for unlawful assembly. more than one-third of those arrested were not from oakland. more charges are expected as police investigate acts of vandalism. abc 7's lisa amin gulezian follows up. >> one by one those arrested walked out of oakland's jail. most were charged with unlawful assembly, a misdemeanor, that's infuriating those arrested. >> we are guaranteed our right to assemble. we assembled in protest of the

two-year sentence that mehserle got for killing an innocent human being. >> i was surprised because i felt we weren't doing anything wrong. we were just marching down the street. >> hundreds fill the streets after a peaceful rally at franco's plaza. but vandalism followed. cars were smashed, windows broken, and fences destroyed. near laneny college, police in riot gear were waiting. a splintered group then broke off and headed for east 18th street. a massive police crackdown happened after a gun was ripped from an officer's gun belt. it was recovered in a crowd of protestors. >> you have a right to protest. you have a right to have freedom of speech. you have a right to voice your opinion and your discontent. you do not have a right to tear this city up. >> those who live on fifth avenue where much of the damage occurred couldn't agree more other crazy. they passed by. and then they see angry cops and they broke the window car

completely. they hurt a lot of innocent people. >> police say more arrests and charges may come. right now they're reviewing videotape and photos of the vandals and investigators say they want to track those people down. in oakland, lisa amin gulezian, abc 7 news. >> this morning oakland police are investigating a double homicide. a teenager under 18 and a young adult, both male, were found dead inside that car they're towing away there. they were found dead yesterday afternoon. police were only say they were shot to death. their bodies were discovered in the car around 3:30 in front of the acorn tower apartment building in the 1,000 block of ace street. no suspects have been arrested. this week most of the streets that run through the neighborhood destroyed by september's san bruno fire will reopen. but the crater itself will remain untouched until the investigation is complete. glenview drive will stay closed north and south of the crater as

you know the pipeline ruptured september 9th killing eight people. san bruno city manager connie jackson tells our media partner, the san jose mercury news, that clairemont and fairmont drive could open as early as wednesday along with the portion north of clairemont. local state and federal investigators are continuing to probe the cause of that rupture. so guards and fencing will remain around the crater site itself. the ntsb is expected to release its second preliminary report in december. a remarkable story of survival in the north bay. it happened yesterday afternoon at the sonoma sky park airport just south of sonoma. emergency dispatchers say it appears that single engine plane took off from the airport and crashed in between two warehouses. the victims were airlifted to the hospital. >> and the condition of the pilot was good other than some lacerations around his face and head. he's in good condition and good

spirits. >> witnesses say the plane did not seem like it had enough power during takeoff. the sky park manager says it wasn't a local plane, and he says it had the words "air design" on it. marin area rapid transit directors have voted to cut a north bay train route by 30 miles. the so-called smart project was supposed to take passengers from cloverdale to larksberg but because the project is $345 million short, it will now only be able to take passengers from santa rosa's railroad square to the marin civic center. directorless said they thought it was important to get the project moving. it was funded by voters in 2008 with a quarter cent sales tax. the smart train is expected to be completed in four years. up next big problems for california's unemployment fund. also...

than $10 billion by the end of the year. employers will see an automatic hike in their federal unemployment taxes. about $21 a year for every worker. san francisco continues to bask in the glow and the afterglow of the giants world series win. it's boosting civic pride and the city's economy. beyond millions of dollars in direct spending delivered by two world series games and four playoff games, a spokeswoman from the -- for the convention visitors bureau says the exposure alone will deliver business to the city for some time to come. san francisco mayor gavin newsom tells the san jose mercury news that the city's successful hosting of a parade attended by hundreds of thousands of people helps future events. it helps larry allison to choose san francisco for the next home for sailing seas america's cup race. we should know more in the next

the bag limit is ten dungous crabs. in pablo bay however crab fishing is prohibited because they're designated crab nurseries. lisa argen here now talking about a real soaker. >> heavy rain in the north bay beginning to spread south. a rainy day across the bay area. that includes of course the raiders game and a live look outside first from our suedios. you see how wet it is here. we're looking at 53-minute delays at sfo due to the rain there and, in fact, the tarmac will be wet all day long because this cold front won't push on through until later on this afternoon. live doppler 7 hd. here's the heavier rain i was talking about in the north bay. you can see it right there in the yellow. so just about to hit jenner and bodega and highway 101. petaluma and novato. into the east bay. all of 580.

berkeley and marin da all the way through walnut creek and alamo. the rain is a little slighter here across the east bay san leandro and hayward. you have the light rain from san francisco into daly city, san mateo and half moon bay. and just about from milpitas. that's when things are really not quite as wet, down threw san jose and morgan hill. throughout the next hour or two, the rain will continue to spread into the south bay and really we'll get hung up there throughout the rest of the day. clearing in the north bay as soon as 1:00 the far north bay but the rest will take through the bulk of the day. through oakland and san francisco, 56 fremont with upper 50s in los gatos. mid-50s napa and fairfield. with the breezy winds out of the southwest ahead of the front, we're looking at actually southeasterly winds gusting to 24 mph from mountain view and at the airport. and the winds also picking up

around oakland this morning with winds out of the southeast at 16. san jose winds at 14 mph. so rain spreading this morning into the south bay. the sun tonight setting at 5:05. that earlier sunset and we'll see clearing conditions tonight with fog developing. a nice start to the work week tomorrow but we have another rainy day next week. i'll tell you about it just in a moment. so overnight the rain up to the north and west now all of a sudden shifting to the south. another perspective shows a stream of moisture right here is what we're going to get into through the morning and afternoon as the cold front pushes through. 8:00 this morning you see the heavier pockets along the coastal hills, half moon bay into the livermore valley and then by 1:00 take a look. here comes the cold front pushing through the north bay but not until about 5:00 elsewhere. looking like 1 to 2 inches of rain north bay.

also the peninsula, the coastal hills and the santa cruz mountains. the snow above 6,000 feet up to a foot. and, yeah, you probably guessed the raiders game is going to be wet, especially in the morning -- i should say the early afternoon when it starts at 1:15. and then we'll see not as wet weather later on, 3:00, 4:00 but still some light rain. upper 50s near 60. not raining yet in watsonville. it's going to take some time for the front to push through there. the other rainy day i talked about was in the north bay on tuesday. other than that actual veterans day on thursday looks good. unfortunately the parade, a wet one. >> a parade here and a parade in pleasanton. both of them getting a little wet and raider nation, they could care less, i'm sure. thanks, lisa. coming up at 7:00 is "good morning america." dan harris is joining us live now from new york to tell us what's on tap. dan, i know you like us had to enjoy that extra hour of sleep

challenges. but it's already having an impact on city sidewalks. abc 7's amy holyfield reports. >> the sit/lie law isn't even in effect yet but residents in business centers on haight street are already noticing fewer homeless people on the sidewalk. >> i heard from the mailman. he's not really climbing over people to go to the doors as much. i've been seeing them moving away from the businesses, stores and going towards side streets. making sidewalks better for people. >> but opponents of the sit/lie say this fight isn't over. >> still looking at different options. >> supporters of measure l say they are tired of aggressive panhandlers who sit all day and harass people. but opponents believe they have a constitutional right to be there. >> when people's rights gets trampled on, you don't just say it was a good fight and walk away. you keep on fighting. >> the district attorney's office believes the law will

clemens took part in a seminar with people who live and breathe san francisco politics. a mayoral vacancy has occurred only once before under tragic circumstances. >> both mayor moskoni and supervisor harvey milk have been shot and killed. >> board president dianne feinstein became mayor. there's speculation that former supervisor now assemblyman tom ambiano has the six votes needed to get the job. he says he don't want it. >> i support tim lincecum actually for mayor. and i think he's the freak that we might need. >> former mayor brown says he's been approached by many who want him to step in. >> are you pursuing it? >> no. no, no, no. i'm not pursuing anything or anybody. >> sophie maxwell believes a caretaker type should be selected. >> somebody that's not political. somebody that will not run for mayor. >> but will she get a say?

maxwell is among four current supervisors turned out of office. they could vote before the new board takes over in january. the mayor has hinted he might try to delay his swearing in until the old board is officially out. but said his main focus is to make the whole process transparent. >> because i don't wanna see the san francisco politics and back room deals and the board of supervisors and people changing one position for another position. those are a lot of rumors that are not just rumors. i know those conversations are taking place and that's not this city. >> just to add to the drama, san francisco city attorney dennis ferreira will not give supervisors any legal advice about all this because ferreira himself is running for mayor next year. council from santa clara county will take on that role pro bono for the city. apple is warning i-phone and i-pod users about a software glitch that could cause the repeating alarm on your device to go off an hour late now that

>> now to a look but don't touches encounter. it was a drama played out 13 million miles away in the space between mars and earth. the players are spacecraft and a comet. here's wayne friedman. >> when scientists at nasa and the jet propulsion lab first turned on their cameras september 5th, this is what they saw, a fuzzy spinning dot in the sky on target in the center of the frame and still a mystery. >> until a few days ago we didn't know what this comet nucleus was gonna look like. >> they knew it was strange and unique. kind of like a bowling pin or a mushroom and spinning with an unusual rotation. >> even then we thought we probably had an elongated nucleus spinning around like this. >> today we saw clearly. this close encounter by the deep impact spacecraft followed a trip of 2.9 billion miles. it's only the fifth time that humans have seen the comet close up and two came from the same

spacecraft. >> what you saw today wasn't virtual. it wasn't a computer simulation. it was real. it was the earth seeing this comet close up for the first time in history. that's fun. >> the smallest of full-time comets which nasa combined to one image. a little more than a mile long with microscopic gravity. this shows jets of heated dump truck and carbon dioxide ejecting from the sun's heat. they have considerable force. >> these than a fire hose. even though the jets behave much like the water coming out of a fire hose, you would feel it. it probably would not be enough to lift you off the surface but it might. sort of on the borderline of being able to lift you off the surface. >> but it doesn't take much to lift off the surface. >> you have to remember the gravity is almost zero. (laughter) >> and that's a little

highway 1 and south of ukiah. in the north bay take a look from roaner park, pretty good rain from petaluma over into the east bay. not quite as impressive. the lighter rain's in walnut creek. san mateo on and off rain and light rain in palo alto and further south santa cruz and monterey not much going on yet but as we loop the past couple of hours, you'll notice the flow is from the northwest to the southeast. and the cold front will sweep through the bay area later on this afternoon so the rain all day long across the east bay around fremont and in the south bay. but clearing out in the north bay later on this afternoon. 56 in napa. 57 san francisco and menlo park. we are looking at the breezy winds. behind the front we'll get the northwesterly winds but today it's gonna be of course cooler, breezy, southeast winds now at

sfo. 23 mph. we've got delays of up to 53 minutes so far. the rain continues to spread south this morning. the sunset 5:05 tonight and clearing conditions later on with a dry day tomorrow. so here's the cold front. you can see it sharply delineated here from the green representing the rain and the tail here which will swing through the bay area and all the moisture that it is gathering and the cooler, breezy air behind it. if we take it through the next couple hours, you notice much through the morning hours, everyone wet weather, moderate rain through 8:00. look at livermore into the east bay, half moon bay. some moderate to heavy rain. by the early afternoon hours, 1:00, 2:00, the raiders game, of course the wet weather and the front begins to push through the north bay 4:00 but still raining san jose and morgan hill and by 7:00, a lot of wet pavement, the fog forming overnight. 1 to 2 inches of rain north bay,

santa cruz mountains, parts of the coastal hills here and the lesser amounts in the east by valleys and the south bay. 6 to 10 inches there lowering to 6,000 tomorrow. and we will look for about 1 to 2 inches in the hills. sacramento valley could see a dusting and rainy and breezy conditions to start the game at 1:15. and then lighter rain throughout the afternoon but highs kind of stuck upper 50s to around 60. and not raining yet here. so the last of the rain will sweep through the monterey bay this evening. the accu-weather seven-day forecast, hopefully everyone set their clocks back. on track for a pretty good week after today if you wanna dry out. the next chance of rain will be just in the north bay, a much weaker system on tuesday. the rest of the week sunshine and more mild temperatures. >> how do we get to this point of this rain? i mean, obviously some kind of weather system but -- okay.

a san mateo couple's thanksgiving vacation plans hit turbulence when mexicanna airlines declared bankruptcy and they tried to rebook their flight with a partner airline. so 7 on your side's michael finney stepped in to help. >> karen chow and paul willard looked forward to going to their friend's wedding in mexico. the couple used orbitz to book a flight from san francisco to mexico on aeromexico and a return flight on mexicanna airlines. >> all set. had the airline booked and all of a sudden i get an e-mail from orbitz saying mexicanna has -- the flight is cancelled. and so that was shocking. >> aeromexico had a co-sharing agreement with mexican no.

so the money the couple paid was build through aeromexico. they first charged $300 in change fees and the higher fare. >> just frustrating. i feel our ticket is being held hostage. we can go and not have a return trip or we can go and pay an extra $400 to get home after the fact, after we bought the ticket. >> travel attorney al analan says the fee is unjustified for two reasons. >> the reason air mexico can't charge them is it hasn't warned the customer that these are charges. >> he says such charges need to be outlined in the airline's contract which he says it is not. secondly, he says air mexico must stand behind its agreement with mexicanna. >> so they have an arrangement between the two. your partner on that went broke. you can't charge me because your

partner isn't gonna fly me. >> we suggested to the couple that it file a dispute on the charges with their credit card company, american express. we also called orbitz asking for assistance. arrow mexico subsequently agreed to give the couple a full refund. orbitz extended a credit to the couple for all their trouble. they have used the credit and refined to book the new flight at roughly the same cost. >> really excited about going. >> if you're booking travel arrangements you should consider purchasing travel insurance and specifically asked for protection against bankruptcy and natural disasters. some packages do offer those but you have to make sure and ask. i'm michael finney, "7 on your side." >> am could go up next from phantoms to painter. hear why the actor with orbitz, i know what to expect from my vacation. bad dog, balloon pop.
