hours to see the rain in monterey but the north bay will be clearing out this afternoon but wraparound showers and not dry out until tonight. >> residents of an apartment in antioch are waiting when they can return home. firefighters say four apartments were destroyed several others damaged that broke around 2:30 this morning. one woman in a second floor apartment suffered burns and is being treated at a local hospital. a resident says he's he'd been outside. minutes later the complex was burning. >> i said, wow, grab everything i could. >> he told us he's not sure what he lost but everything he owns is inside his apartment. building inspectors hope to know how many units are safe enough

to live in. investigators are determining how the fire got started. >> oscar grant's family is planning their next move to the minimum 2 two-year prison sentence begin to johannes mehserle. they are targeting friday's decision by an l.a. judge to throw out a gun conviction that could have added ten years to his involuntary manslaughter sentence and they are promising more protests in oakland. john alston has the latest. >> another saturday night strategy session, every week since the killing they have gathered at missionary baptist church in oakland. this time they are plotting their next move after his 2 year prison sentence. one that was arrested is promising more protests. >> we're fighting it. we're fighting these charges. we don't accept them just like we don't accept by the decision

by the judge. >> it's judge robert perry of los angeles who tossed out the firearm conviction and gave him a lighter sentence. >> taking a look at the procedures it takes to have a judge removed or rebring mended for what he has done. >> that is laughable. that is my first response, it's laughable. the judge was very, very thoughtful judge. he didn't give in to the mob threats and he didn't give in the threats of intimidation. all of the nonsense that has characterized this case. >> grant's uncle argues that perry's instructions were different they may have convicted him of a more serious time. >> attacked by his perspective by his own mistake. there is a lot to be discussed. that is judicial error that

>> they broke the window car completely. they hurt a lot of innocent people. >> more arrests and charges may come. right now they are reviewing videotape and photos of the vandals. investigators say they wanted to track those people down. lisa amin gulezian, "abc 7 news." >> this morning oakland police are investigating a double homicide. a teenager and 18 years old and a young adult both male were found dead inside that car yesterday afternoon. police will only say they were shot to death. bodies were discovered in the car around 3:30 in front of the acorn tower apartment building on the 1,000 block of eighth street. no suspects have been arrested. >> this week most of the streets that run through the neighborhood destroyed by the san bruno fire will reopen but it will remain untouched until the investigation is complete. they will stay closed north and south of the x-rayser where the

natural gas pipeline ruptured september 9th killing 8 people. they say our media partner san jose mercury news, that claremont and fairmont drives could reopen as early as wednesday, along with a portion of glenview drive. local, state and federal investigators continue to probe the cause of the rupture. the n.t.s.b. is expected to release a second preliminary report sometime next month. a story of survival in the north bay. it happened yesterday afternoon at the sonoma sky park airport just south of sonoma. dispatchers say a single-engine plane took off from the airport and crashed in between two warehouses. the victims were airlifted to the hospital. >> the condition of the pilot was good other than lacerations around his face and head. he is in good condition and good

spirits. >> witnesses say the plane did not seem like it had enough power as it took off. they say it was not a local plane and had the words air design on it. sonoma-marin rapid trance directors cutting a train route by 30 miles. it was supposed to take passengers from cloverdale to larkspur but because it's $345 million short it will only be to take from santa rosa to marin civic center. it's important to get that project moving. it was funded by voters back in 2008 with a quarter cent sales tax. smart train is expected to be completed in four years. >> coming up next to, president obama spends a second day in india trying to create american jobs. how you can help a group trying to rescue bay area sea

time. welcome to abc7 morning news. >> they are trying to help animals to help sea gulls that have been spotted with beer cans around their neck. about five birds collared with cans have been spotted at fisher men's wharf and half moon bay since august. director of wild rescue the group needs to buy a special piece of equipment. it's called a launcher and it runs about $3500. in the meantime, if you see the birds, don't try to catch them. you have to wonder what kind of person would do that to an animal. it is sad. >> lisa argen is here how long this rainy weather is going to last. >> the morning is wet and right now live look outside, 53 minute delays at sfo.

gusty winds up to 25 miles an hour, you see the rainy conditions on the tarmac and also outside, roof camera, looks a little bit brighter if you are looking at the clouds but still more rain to come. look at live doppler 7 hd and the bulk of the activity into the east bay, concord, san francisco and out to sea. so the first off we're looking at heavy rain around 680. moderate rain moving through pleasant hill and down through alamo and peninsula. san francisco is wet and san bruno and over to the east bay, a little lighter out to dublin and livermore and froosmt. you have the light rain and it is rainy in the south bay with a pretty good cell southeast of campbell. and finally the rain moving into santa cruz but it is later as you head down toward the central coast. but you, too, will see light to moderate rain. the flow will be for the cold

front to sink to the south and east today. we'll look for the north bay to clear on out later on this morning into the early afternoon, but not for the rest of bay area. 56 in san francisco. it's 58 in mountain view and 58 in san jose. highlights, rain this morning, becoming more scattered in the north bay and sun setting at 5:05 and a dry day for monday. cold front sinks out rather quickly and it is slicing through the heart of the bay. heaviest is across the east bay and peninsula and pushing in the south bay by 11:00. look what happens in the north bay at 11:00, we're seeing showers from marin to sonoma. game time, 1:00 for the radar raiders and by 2:00 moderate rain by the east bay. then after that, 3:00 or 4:00 we'll see some clearing and then look for fog developing after

pretty hefty totals. one to two inches and also the coastal hills looking the most rain, just about half an inch in the south bay. higher elevations looking at snow in the southern sierra at about 7,000 feet. some gusty winds, still pretty tricky travel back home. if you have anyone up in the mountains. rain starting out this afternoon with a moderate clip and then becoming light. diminishing late in the day, temperatures on the cool side held down, breezy winds, upper 50s down through off and last to clear with will be salinas and hollister. we changed the clock, good day to sleep in with the rain. our next chance of rain tuesday mainly in the north bay.

it's already having an impact on city sidewalks. amy hollyfield reports. >> the sit-lie law isn't in effect yet. but residents on haight street are already noticing fewer homeless people on the sidewalks. >> the mail men is not going over people to get the doors and moving away from the businesses and stores and kind of going for the side streets. making it better for people but opponents say this fight isn't over. >> we are definitely going to bring a legal challenge against this.

>> the supporters of measure "l" says they are tired of aggressive panhandlers but opponents believe they have a constitutional right to be there. >> when people's rights get trampled on, you don't just give up and walk away. you keep on fighting. >> the district attorney's office believes the law will hold up, pointing out seattle's ordinance was taken to court. >> it's most similar to the law that was just approved by the voters here in san francisco. that challenge as well was overcome by the city and the law was implemented. >> employees at snowboarding aren't worried about the court case. >> if they want to challenge it that is there thing. but overall we'll see a big impact and it's going to work. >> police have said they will use discretion. they won't be arresting children with lemonade stands.

that is why opponents they don't think it's fair to target the homeless. so if you want to use this law against one set of people, it's about something else. >> this takes affect in january but prop 8 approved two years ago the fight over sit-lie could last for years. a political guessing game is underway in san francisco. the question -- who will be the next mayor? gavin newsom was elected as lieutenant governor with a year left on his term. a replacement can be anybody in the city that can get the support of six of the 11 members of the board of supervisors. so the maneuvering has begun. all are junkies like me, this is heaven. >> former san francisco mayor willie brown is talking about

front as it slices through the central bay. walnut creek and orinda, highway 24 and of 80, moderate rain, san francisco, all wet for you down through brisbane, san bruno the coast, 280 and in the south bay, you have been looking at the lighter returns but more rain will be heading towards sunnyvale and san jose by about 11:00. you'll see the rain line here sort of end around hollister. but this isn't a quick mover so the rain will be more scattered in the north bay late this morning and follow through the east bay and south bay by the afternoon hours. we're still looking wet fort raiders game. 57 in oakland. 56 in menlo park. we're looking for a mild with a southeast wind, but temperatures today held down with the cloud cover. sunset 5:05 and clearing conditions tonight. fog will be developing with a dry day tomorrow. next chance of rain early in the

week. satellite and composite shows the cold front sliding to the south and east. the trough is going to move later on so that is why when you look at the computer animation, the bulk of the activity is pushing through by 11:00. look at what happens by 1:00, 3:00. into the east bay, it's after that we begin to see some partly cloudy skies in the north bay but still a lot of clouds and temperatures near 60. rainfall totals closing in on an inch in the north bay. half an inch in san francisco but by the time this is over we could see three-quarters to nearly an inch there. rest of the peninsula, maybe an inch, livermore, 10th so far. maybe half an inch later on tonight. same deal in the south bay to three-quarters of an inch. coastal hills, looking at more rain. temperatures are quite warm in the sierra, nevada.

upper 30s to mid 40s, high elevation snow above 7,000 feet and winter storm warning is with us until tomorrow morning where we'll see the snow levels come down a couple of inches at about 6,000 feet. by the afternoon is rain diminishes but early on scattered showers and temperatures will be cool, upper 50s, 59 palo alto and down by the monterey bay, rain picking up for you later on this morning into the early afternoon hours. then by tonight, scattered showers, rain will be over by tomorrow, next chance of rain comes in on tuesday. not as big of a system by any means favoring the north bay. rest of the week is dry. too bad it couldn't have been today, but it's wet for the parade. >> all right. we just have to expect anything this year. it's been kind of wet. thank you, lisa. >> more competition from china is causing layoffs at fremont company. they received a stimulus loan to

build a new factory but as david louie reports, taxpayers now have reason to be concerned. >> they were the epitome of what the government envisioned to be green tech future. president obama toured the production line and so did schwarzenegger and bar practice boxer. they got a 535 amendment stimulus loan to build a new tack tri-in fremont. 40 employees will be laid off. 150 contract workers won't be renewed. the reason is price competition from lower cost chinese solar makes. they need to cut expenses. >> today we would be three to four dollar per watt basis and we need to be a $2 per watt basis. >> suddenly the future isn't as bright as it was a year ago.

the new plant cost $733 million, $535 million came from federal funds, $198 million from private pundz so the government's take is 73%. >> according to a filing by the company with the security and exchange commission, if it were to default on the loan, the department of energy would end up owning that brand-new fabrication plant. >> most of the loan proceeds have been disbursed $402 million. lion's share went to the contractor, smaller amounts to a design firm and to the county for taxes. >> a lot of public money is riding on them to succeed. >> it's not going to be worth anything if i have to foreclose. >> they say moth-balling the plant and laying off workers will save $60 million.

california's unemployment fund is broke with one in every eight workers out of a job. the state is borrowing billions of dollars from the federal government to pay benefits at the rate of $40 million a day. according to the los angeles time the debt now stands at $8.6 billion expected to reach more than $10 billion by the end of the year. and employers will soon automatic hike in federal unemployment taxes of about $21 a year for every worker. >> don't go away. 7 on your side is up next. >> flora has something quiet hatching inside. i'm michael finney, the unpleasantntntntntntntntntntntnt

bigger an pinhead and there were more holes next to it and more holes beyond that. pretty soon, barbara discovered a whole trail running around the dining room and into her kitchen. >> there must be 50 on this piece of wood. in the corner. >> hundreds of holes. just enough to fit the point of pencil. she called an exterminator that the tiny holes meant a big problem. it was infest infested with a bug. >> they are made up of starch and sugar. >> bernard lewis is showing us a sample of the pesky critter. he wasn't surprised to hear of barbara's case. he says the beetles deposit larva in hardwood and few years

later they hatch, chew their way through the wood and pop out the holes. she experienced this firsthand as more and more bugs crawled out of her floor. >> every day we get up in the morning and we look and see another board with holes in it. sometimes you could see the bugs peeking out out of the hole. they are black and have two things that stick up. you notice all these bugs there. >> her exterminator a lot of them must have been inside the wood before her floor was installed. they say that is typically the case. these beetles can bore through the ends of the wood and they can't get in once the floor is laid. >> someone will have a brand-new hardwood floor put in. the problem will resolve in several years had. most likely -- once the floors are installed and varnish and

all that you are not going to have insects. >> she wanted her floor repaired so she asked the contractor where the wood came from. no one would tell her. that is when she contacted 7 on your side and we tracked down the source. >> the next day he called me and gave me the name of the mill. >> it turned out the wood came from don wright lumber company in oakland. right away they stepped up and took action. new owner says he is not convinced the bugs infested the wood at his mill. the only time in 138 years in business that this has happened. it's a rare occurrence but you plan for it and you take care of your customers. finally she received a check for $16,000. and this is the result. workers ripped out the infested wood and installed a brand-new floor. this one made of oak.

this morning san francisco hosting annual veterans' day parade. it starts at 11:00 at second and market streets. it will move west and ends at city hall. this year's event will include a special commemoration of the 60th anniversary of the start of the korean war. veterans will be recognized for their service. pleasanton is holding its parade this afternoon at 1:00. most other barrier cities have their parades and ceremonies on thursday. to all the vets out there, thank you so much. we honor your service. i feel sad that it's going to rain today on those parades. >> this afternoon, a little bit better in some parts of the bay area. cold front has pushed across the north bay and central bay and east bay. over around walnut creek, 680 and down by millbrae and 280,
