♪ i'm terry mcsweeney live at the oil refinery in martinez where a shelter in place order was issued yesterday after thick black smoke poured into the air after a power outage. a string of events that don't entirely explain the story. >> a fatal accident in san jose involving teens drinking it changing perspective here in the south bay. live in san jose now there's a proposal for a social host law. it involves parents punishment and alcohol. >> you'll want to grab a coat this morning. it is chilly thanks to high pressure and nearly cloudless conditions. we'll talk about sunshine and warmer than average afternoons the next couple of days. >> right now all westbound traffic across the san mateo bridge is temporarily being held so they can get a big rig in the

right lane. we'll see traffic going there shortly. heres a live shot. no westbound traffic getting through. eastbound delay free and we'll keep you posted on this as well. >> it is 5:01 this thursday morning. it's veterans day so a shoutout to all the veterans out there. thank you for joining us. i'm eric thomas. >> i'm kristen sze. topping our news the air should be clearing for the martinez refinery after a power outage resulted in an intentional spewing of black smoke and shelter in place order. >> all is well out here in martinez right now. a far cry from yesterday when thick black smoke poured into the sky from the refinery you see behind me. take a look at the pictures from yesterday evening right around 4:00 4:30 when that black smoke was pouring out of the refinery at the golden eagle refinery here. the county ordered a shelter in place about 4:40.

in other words, stay indoors. that was in effect until 7:00. so about maybe two and a half hours. it was changed to a health advisory meaning those with respiratory problems should take extra precautions. when the power went out at not one but two sources of power one in rodeo, another at a pg&e substation workers here at the refinery started burning the oily products they were making. >> they did what they were supposed to do. they released pressure from the system due to the sudden power outage. >> at our house the backyard it's really bad and i have to wear a mask out there. >> with smoke only a little more toxic than that. >> this refinery processes about 160,000 barrels of oil a day turning out motor fuels and liquified petroleum gas. so questions remain. how could not one did you two

video or e-mail them. a swim center in san jose expects to reopen after a chlorine leak hospitalized 16 people. the aquatics swim center was evacuated after a malfunctioning pump leaked chlorine yesterday afternoon. several children were exposed and rushed to nearby hospitals for treatment. staffers are trying to figure out what caused that pump to back up and leak the chlorine. >> parents in san jose, you've been warndz. the city has just taken the first step to hold you responsible if you enable underaged drinkers to get alcohol. this follows a fatal drunk driving tragedy. theresa garcia is live in san jose. >> unfortunately the side of this roadway has turned into a marker of pain and loss here in south san jose and you can see there that cross that is what marks where a teen passenger

died after his friend crashed their car. the driver was arrested on suspicion of drunken driving. this fatal car accident in late september involving two 18 year olds is whales prompting the city of san jose to look into harsher action against under-aged drinking. it's unclear where and how the driver got drunk, council member nancy pile said it moved her to punish parents for underaged drinking at home. they began researching a social host ordinance. santa clara county and a number of cities have adopted this type of law with fines up to $1,000 for giving liquor to kids. statewide it's already illegal for adults to provide liquor for those under 21 plus superpenalties if an underaged drinker is caught driving drunk and hurt anyone. come january a new state law will allow lawsuits against social hosts and any adult who

knowingly gives alcohol to underaged drinkers in their home. the critics are skeptical it will make a difference in any teenager behavior but even so the san jose counselor commit is moving forward. they're going to review the research and consider the law next month. live in san jose, theresa garcia, abc 7 news. >> it's 5:06. federal officials are telling santa clara can can't opt out of a program to send fingerprints to people detained by officials. the board of supervisors voted last month to remove santa clara county from the information-sharing program. supervisors are opposed to the program because people with no criminal records were deported after being stopped for minor offenses. >> a bicyclist intentionally ran over a three-year-old boy

playing in a park. eric lamb yelled profanities at two children telling them to moveore he would hit them. lamb then swerved 7 feet to purposely hit one of the youngsters. it left tire marks across the boy's sweatshirt. he has cuts and bruises but it doing okay otherwise. lamb was arrested for assault with a deadly weapon. >> a new report by the nonpartisan legislative analystist says a deficit will sort $25 billion over the next 18 months. debt accrued because the latest budget is coming due. the state is losing $8 billion in revenue from a temporary patch increase that's going to expire soon. voters rejected new tax measures. >> they're not sure they want to pay for it because they don't have the trust and confidence of the state government. in terms of the way they're handling the money.

everything back to normal. you saw that live shot earlier. no traffic getting through westbound. had to temporarily block the lanes to clear a big rig. it was only for a few minutes. the drive time westbound is 14 minutes from 880 to 101 and vice versa. no trouble at all now across the san mateo bridge. delay free as well at the bay bridge toll plaza making your way into san francisco. and the ride for north bay commuters heading into the city as bell. four lanes southbound out of novato to the golden gate bridge. and no trouble at all reported as well in the south bay. here's a live shot of the 280 and 17 interchange. traffic is light here so you are pretty much good to go everywhere around the bay area at this point. >> it's now 5:10. >> the plan to reduce the deficit that could affect millions of people counting on social security. >> also the promise made 75 years ago to bay area veterans

been selected to design a memorial to be built in this court between the opera house and the veterans building in san francisco. it was supposed to be erected in the 1930s when the two buildings were constructed but it never got built. the committee is raising $2.5 million for the memorial. >> we're going to raise the money. we've got a lot of people that really support this and a lot of veterans. there's more veterans living in california than any other state. >> and thanks to guys like this. >> the winning design team will be announced early next year. >> how much would you be willing to pay to drive your car into and out of san francisco. the city's looking at several options for congestion pricing. heather ishimaru has a look at the latest proposals. >> transportation planners say something must be done about traffic congestion in san francisco. and we have to find new ways to

pay for transit and infrastructure improvement. the san francisco county transportation authority says it's found a way to do both through congestion pricing and it just completed a study of options. >> encourages people to think twice about using a car. >> one option is charging $3 during peak commute times when a vehicle enters or leaves the most congested northeast quadrant. another is to charge $6 when leaving only during the evening commute. a third option put the fees at the san francisco/san mateo line. the authority says the 60 to $80 million revenue would go to transit and infrastructure improvement. >> it sounds a little ridiculous. >> she takes transit to work but doesn't always go home on transit sit. >> sometimes my husband picks me up after work. so he's close by. is he just going to pay $6 for me to get in the car and leave

the sky won't be quite as pretty as it is today as we head into the weekend. if you are a photographer or something, today is a good day to do it. let's talk about temperatures. we're dealing with concord at 39. monterey bay we have mid to upper 40s. that does include salinas and gilroy. sunny, seasonal temperatures and calmer weather than yesterday. that means chilly night in store tonight and warmer than normal afternoons. south bay, sunshine today. 65, 66, or 67. not gonna see huge climate changes today. 64 and 65 for the entire peninsula and near 60 from pacifica to sunset and daly city at 61. downtown south san francisco the mid-60s. even a few upper 60s santa rosa,

calistoga, napa. over on the east bay shore we have mid to upper 60s to oakland, castro valley, fremont, 67. around the east bay valleys mid to upper 60s. brent wood the cool spot. 65. mid to upper 60s around the monterey bay and also inland. carmel may be a little cooler but nice at 62. tonight low to mid-40s in most neighborhoods around the bay and out to the beaches. san francisco 47 a little warmer. inland valleys maybe a lot of 30s. what we're seeing is a jet stream that looks very progressive but this high pressure's going to steer this to the north flatten out the jet stream and make sure it pushes everything to the north of us. that's why we have the dry pattern through the 7-day forecast and the warmest weather this weekend. >> we have a new crash just reported westbound 4.

you can book airline tickets with no blackout dates or restrictions. good morning, everyone. 5:23 on the abc 7 morning news. i know this is a little tough to make out but what you're looking at are live pictures of the carnival cruise ship splendor being towed by tug boats into the san diego harbor. this is a ship that had a fire on board, lost all its maneuvering and electrical power. it was stranded miles off the coast of baja, california. there's been a navy airlift to breezy food and other supplies in food including spam and pop tarts. what a great sandwich that will make. finally though thousands of passengers are looking forward to getting off this ship and that should happen in the next few minutes.

going into the air. thousands could see it on highway 4 pouring from the golden eagle refinery. when the power went out at a facility in rodeo and a backup source at pg&e substation, workers as they are trained to do started burning the oil product they were making out here. a shelter in place order was announced about 4:40 lifted about 7:00 last night. people in part of martinez and concord could smell it. >> we were kind of worried that something really bad was going on but we don't know. so when we got home, there was no power. and so we were asking all the neighbors if they know why there was no power. >> that shelter in place order was replaced by a health advisory about 7:00. that tells people with compromised respiratory systems to take special precautions. a couple good questions one if

ex-girlfriend. jones was killed when he ran from the scene on bancroft after and reached into his waistband as if to pull a gun but jones turned out not to be armed. police sources say an autopsy shows two officers shot him in front of his body not his back as many believed. we're told today's protest will end at the fruitdale bart station where unarmed passenger oscar grant was shot and killed by bart police officer johannes mehserle. >> mountain view based google is the target into an investigation whether its street mapping service took more than just pictures. the sec wants to know if google broke the law when the service picked up personal data from unsecured wireless computer networks. passwords, e-mails and other personal information. they claim at the picked up the information inadvertently. >> veterans day, a lot of events going on around the bay. mike's got a gorgeous forecast.

diego. i realize it is difficult to see anything but light where trust us, this is the splendor being brought in by tug boats and an engine fire on monday cut off power to the ship and turned a dream vacation for 4500 passengers into a nightmare. they've been surviving on spam and pop tarts. this is the ship. progress has been slow for the two tug boats towing the ship back from mexico. there's been no air conditioning no refrigeration. passengers have been able to vent their frustration after the ship moved into cellphone range. >> a lot of people are upset there's no coffee because there's no hot shower. cold showers not our idea of fun. >> we're sorry for the discomfort and inconvenience that our guests have had to deal with in the past several days. >> carnival's president says safety has been top priority and the cruise line wants to get people home as safely as

i wear it independence day, memorial day veterans day. want to keep it special. looking from tam, talk about special. look how far you can see. frances and i were trying to figure out exactly where that is. that's the san mateo bridge. that may be fremont. that's how far you can see how clean the air is this morning. great day to be taking pictures around the bay. let's talk temperatures. and we're still holding in the 40s and 50s. in most neighborhoods. and we were dipping into the 30s at one point in time but it looks like a little breeze has brought concord up to about 41. 40 napa and we have 53 in san francisco. 54 in fremont. that's the warmest spot around the bay. the monterey bay and inland we have low to mid-40s. seasonal temperatures today and calmer than yesterday. not the breeze we dealt with so it will feel what the thermometer says.

chilly conditions tonight. let's take a look at your 24 hour temperature change. everybody's 3 to 5 degrees warmer with concord oakland, san jose and santa rosa 4 and fremont the biggest jump about 5 degrees today. a look at the east bay valleys. mid to upper 60s here. mid to upper 60s also on the east bay shore. down in the south bay we'll have mid to upper 60s. on the peninsula just mid-60s today. low 60s for you downtown south san francisco. mid to upper 60s through the north bay valleys but upper 50s to near 60 at your beaches. mid to upper 60s the monterey bay and inland. tonight we can hit 38 livermore napa 36 santa rosa 37 and cloverdale 38. when the warmth peaks which it will do sunday and monday, temperatures 4 to 6 degrees warmer than today and that puts just about all of us near 70 if not warmer. here's frances. >> mike i don't know anyone who's actually off today but it

pipeline. the san francisco utilities commission is in charge of the $52 million project. the san francisco examiner reports the commission voted to reserve 8 million in emergency funds to dig a tunnel under the redwood city site after archaeologists determined how deep the artifacts go. this should not affect the time line which is set to be completed in 2012. >> a delay in the journey for a north bay rail system. they put off buying trains for a proposed route initially from the marin civic center to santa rosa. not enough smart directors were present so they expect to approve the purchase of 18 trains from japan in december. the cost? northerly $57 million. calls for improving an existing freight rail line and eventually building 14 stations. >> 5:56 now. just ahead at 6 a.m. another flairup at an east bay refinery.
