♪ in the news this saturday morning, november 13th, san francisco police are investigating a rash of attacks by robbers using pepper spray on their victims. and state health officials find three bay area hospitals for medical misconduct, citations after surgery for leaving behind tools. >> warming up over the weekend. the winds kick up this morning. >> i'm theresa garcia. a new crime wave hits the streets of san francisco and the weapon of choice is pepper spray. police say young men spray it in the face of their victims. there have been five attacks since wednesday in the mission,

lower haight, pacific heights and cal hollow. >> nellie was leaving a friend's house at pierce and silver when she saw a distraught woman on the sidewalk. >> she was crying, kept wiping her eyes. she had five or six police officers right around her. >> the woman had just been robbed. her attacker sprayed pepper spray in her face, hit her in the head, and grabbed her purse. >> we don't think of things happening in that neighborhood very often. >> just ten minutes earlier, they had hit in another unlikely neighborhood, lower pacific heights. >> it makes me feel like carrying around pepper spray. i don't know what else to say. i have always felt pretty safe on the streets so that's a little concerning. >> there have been five attacks in san francisco neighborhoods since wednesday. a sixth one happened tuesday inside market street. a man sprayed the face of an employee and got away with some watches. the only one involving a store.

police don't know if it is related. >> if you wanted to do it. but that's kind of ridiculous and it sucks. this is considered one of the safest cities. i don't know how you would take care of that other than police presence. >> investigators don't know if the same men are committing all the crimes. it's possible a couple of robbers pulled it off, brageled to their friends, and the friends went out and tried it themselves. >> i would be very startled -- i just hope it doesn't happen again. maybe -- hopefully the police will catch them and put a stop to it. >> the robbers have attacked men and women of all ages. >> this is troubling. because i walk my dog at night. so -- you know, that's happened to me. >> investigators here at the northern state were working two cases independently but now figured out that officers in two other stations in the city had similar cases. now they're all comparing notes

and looking at the broad picture. at this point no arrests have been made. in san francisco, amy holyfield, abc 7 news. >> a man accused of beating those who allegedly abused him as a child intend to use it as a platform. he was arrested for beating father jerry lindner, the priest accused by many of sexual abuse. lisa amin gulezian reports from san jose. >> 9-1-1 emergency? >> i need the police immediately. sacred heart. >> sacred heart receptionist karl santos sounded panicked and out of breath as she described what had just happened in the center's parlor. >> he came up and started beating him up. i have no idea. he was beating one of the father. >> police say he is william lynch. the 43-year-old is accused of brutally beating father gerald lindner. >> you understand that? >> lynch denies attacking lindner but the two have a

history. lynch and his brother accused lindner who is their former priest of sexual abuse. they received a $625,000 settlement back in 1998. the statute of limitations ran out and lindner who denies everything was never charged with a crime. >> when he has harmed so many children and so many families. it's not just a child but the families as well. >> outside of santa clara county superior court, signs made it clear which side these demonstrators were on. but prosecutors paint a different picture blaming lynch for a premeditated attack on a 65-year-old man in a retirement home. >> we believe that our laws exist to protect all members of society irrespective. >> this is the man that should be the one in front of the judge right now, not the gentleman standing next to me. >> lynch plans to plead not guilty to the charges but told the associated press somebody needs to be afaced for this abuse and i'm prepared to put

myself on the line. >> if lynch is found guilty, he could spend four years in prison but the prosecutor also tells me he could be eligible for probation. lynch will be back in court december 7th. in san jose, lisa amin gulezian, abc 7 news. >> this morning a patient who escaped from the napa state mental hospital yesterday is back in custody. but the facility is not releasing any details about this. last month a criminally insane patient killed a 54-year-old nurse at the hospital. that has ignited a call by staff for better security. the california department of public health has slapped three bay area hospitals with fines for medical misconduct. they include california pacific medical center in san francisco, petaluma valley hospital and ucsf medical center. nine other hospitals in california were also fined, mostly for leaving objects inside patients after surgery. cpmc was fined where a surgical

sponge and retractor blade were left inside patients after the surgery. ucsf is contesting the penalty which involved a small piece of drill bit that broke off during surgery and was left inside the patient. at petaluma valley hospital, a sponge was left inside a patient there after surgery, too. five employees with the san francisco school district are the focus of a criminal probe according to the san francisco chronicle. police are investigating whether those employees received money from community groups that were hired to do work for schools. the sources say some of the payments involve grants for afterschool programs. range from a few thousand to $40,000. they all work for the district student support services department. >> while dozens of friends of a san francisco city college nursing student rallied in front of senator barbara boxer's office yesterday urging her to stop his deportation. >> bring steve home! >> 20-year-old steve lee is set to be deported to peru on monday

according to his attorney. he's currently in federal detention in arizona. lee came to the u.s. with his parents at age 12 and didn't know about his immigration status. senator boxer's staff met with lee's mother but says she won't introduce a personal bill just for him. the california attorney general's race is one of the closest statewide contests in decades. and it's still too close to call. the official state count shows harris with a slight lead, 45.9% to 45.8%. a difference of 4500 votes. the l.a. times study county by county updates and found 150,000 votes not yet reported by the state. the newspaper's count shows harris leading by just 3600 votes. the final results may not be known until the election gets certified the end of this month.

a hercules city council member may face charges of drunk driving and carrying a concealed weapon after he was pulled over earlier this week. police say 65-year-old joe eddie mcdonald was stopped after he made an illegal turn. mcdonald says he had one cocktail at lunch but didn't think he was intoxicated. police also found a loaded firearm in the glove compartment in his car. mcdonald lost his re-election bid last week. up next president obama meets with the leaders of china and japan hoping to boost free trade with the world's other two biggest economies. plus while google employees are getting big raises, there's

leaders of the world's three biggest economies, the u.s., china and japan all pledged today to boost trade. president obama is among the leaders attending the asia pacific cooperation or apex. these are in japan. the northern port city is also filled with japanese farmers protesting any lifting of trade barriers. the japanese government is considering joining a partnership of nine nationless now working toward a free trade zone for the asia pacific region. most japanese farmers are worrying about cheaper imports products undermining their way of life. president obama says in his weekly web address that he is negotiating to lift trade restrictions and open new markets for american-made products overseas. >> as i said many times, america doesn't play for second place. the future we're fighting for isn't the world's largest importer consuming products made elsewhere but as the world's

largest manufacturer of ideas and goods sold around the world. opening new markets will not only help american business and create new jobs for american workers, it will also help us reduce our deficits. >> the president says he's proposing a three-year budget freeze and willing to make other concessions so long as congress agrees to cut out pork barrel spending called earmarks. that's where local projects get tacking on to spending bills without proper review. first the 10% pay increase for all rank and file google employees. now the search engine giant has been giving its top four executives a 30% raise. they will each see annual salaries jump from 500,000 to $650,000. they also got equity awards worth a total of $65 million this year. google's two cofounders will continue to earn just a dollar a year. that's because their fortunes are wrapped up in google stock.

been with the department and an officer for four years. this is derrick jones' sister. >> want them arrested and tried and convicted and sentenced to the maximum extent of the law. >> the d.a.'s office and internal affairs units are investigating the shooting which took place after a brief foot chase following a domestic as much as recall. kept reaching into his waistband and was holding a shiny object which was a electronic scale similar to this one, silver in alcohol. don cameron now trains law enforcement on the use of weapons. he says officers may have mistaken the scale for a gun. >> the officers have to react. they can't say is it a firearm? wait that extra second because you don't have a second to wait. >> but friends and family aren't buying it. they hope the community pressure will help put the officers in jail. >> they should be embarrassed if it truly wasn't, you know.

reports all 12 cities under the south bayside waste management authority will likely see increased fees as they switch and pay the $11 million still owed to outgoing hauler allied waste. thanksgiving is less than two weeks away. as many of us plan our holiday menus, others simply can't afford a turkey dinner with all the trimming. right now food pantries that serve the bay area's needy. heather ishimaru reports on the struggle. >> yeah. >> san francisco's haight street baptist food pantry is a life line for 400 families with 1100 people a week. >> mainly lower income families and probably 75, 80% homeless. >> pastor robert johnson runs the food pantry. he volunteered here three years before being offered that job and before that he was a homeless client himself. he says centers like this one are dying for volunteers and this time of year for the same

an injunction that would have forced a fish and game department to the state park system. at issue the endangers species dying in atascadero marsh on the san mateo county coast. the battle is just beginning. >> sometimes an image can be deceiving. that may be the case at the atascadero nation preserve along the san mateo county coast. it is peaceful and quiet. >> i think it's an ecological disaster. >> pete blames the state department of fish and game and state park. this week he and a group of concerned citizens filed suit. he's charging they have violated the very endangered species act they're mandated to protect and ordered a judge to order immediate compliance. >> they've mismanaged this resource. >> this looks beautiful. >> but it's devoid of wildlife. >> 1990 state parks expanded the wetlands but in the process that changed the quality of the

water. since then gates which should regulate the flow of saltwater have long since rusted open killing endangered freshwater species in the northern lagoon. they include the san francisco guarder stake and the wet-legged frog. >> the frogs, they -- if it's tidal they can't exist. >> not as if this group wanted to bring action against the state. they're paying for much of this lawsuit themselves. but after 15 years of complaints they felt they weren't getting any solution. >> you complained for a long time. >> a long time. >> what do they say? >> we're going to study it more. >> study that would include these dead steelheads shown in 2003. they say there's been a kill like this every year since 1996. >> when you hear the state say you need more studies, what's your reaction. >> too long. they don't want to do anything. they don't want liability. >> as spokesman for state parks told abc news we're not sure it

morning. so temperatures have bottomed out in our north bay valleys where we're talking some 30s in napa. 43 santa rosa. good morning. kind of cool for you as well but elsewhere a little bit of wind held up numbers into the low 50s. san francisco 54 fremont. and we will be looking at some very comfortable readings at the surface and already warmer than we were yesterday. everywhere except napa where you expect the colder air to drain into the valley. 6 degrees warmer this morning in mountain view with 5 degrees warmer in san jose. the trend will be for much warmer and windier weather throughout the weekend with a gusty wind about 1,000 feet and 2,000 feet. the cooler days beginning on tuesday. but still looks dry right into next week. the gusty winds, you can expect them anywhere from 20 to 40 mph above a thousand feet in the north bay mountains. also the carquinez straight with the diablo range, east bay hills

the typical spots. 50 to 60 mph winds above 2,000 feet. definitely be vitzed of that. across the state, you'll notice the mountains kind of cool, in the upper 40s for lake tahoe. but southern california will experience gusty winds. the temperatures warm into the low 80s. palm springs about 80 today and all due to this setup. high pressure in the lower levels of the atmosphere. the upper levels of the atmosphere as well. not only the storm system to the north and west but really crushing down on the atmosphere. so that's why we're getting the drying, the warming conditions. with a little wind we'll keep the temperatures up from definitely freezing, in fact into the 40s through the overnight hours tonight and tomorrow. a bit of a bonus. temperatures 71 sunnyvale. 73 campbell today with low 70s saratoga and los gatos. numbers coming up around 5 to 8 degrees today. 71 redwood city.

and in a world where there is constant worry about keeping information private, a bay area team of film makers is going in the other direction. and they got unprecedented access to highland hospital in oakland. then uploaded some of their videos to abc 7 youreport powered by youtube.com. we had to find out more about their project called the waiting room. here's dan ashley with their story. >> do you take your meds? >> no, i don't. >> daily life at highland hospital captured by a video crew with plans to make each patient's story matter. >> i was injured on the job. i give 110% of my body to the company. >> my readings, just got out of prison. >> some arrive in critical condition. >> as you're aware, others appear because there's no place

else to turn. >> i was having a hard time finding employment. we lost our home. >> i'm basically retired. i have very little income. >> i need more health benefits. so i have to come up here to get my epilepsy medication. without the medication, i'm gone. >> pete nixon says he spent the past five months in highland's waiting room. this is a public hospital that never turns anyone away. >> it's visually an incredibly diverse site. then you start to look and talk to people and realize it's a remarkable manifestation of our healthcare in america. >> as people wait, they have a chance to share what's on their mind. >> for some reason we're seeing more regular people to be happy. >> the crew has shot 150 hours of video that will eventually become a documentary. but a lot is online right now on a website called "what are you

waiting for?" a wide range of people talk about a wide ranges of experiences. from the young woman that refuses to identify the men who attacked her. >> protecting the baby so probably in the fetal position and they were kicking her. >> to another young woman. >> a way to impact people's life. at a young age i wanted to be a doctor. >> also hoping to put a video booth in the waiting room so people can record their stories even when there's no film crew there. >> you have to think about you're not going to work the rest of your life. >> all voluntary. every patient and staff member has given their consent. >> we have to work hard when we have a film crew coming into an environment where people do expect and demand privacy. at the same time i think america's saying we wanna know more about what's going on in our very complex system like our healthcare systems. >> it's been surprising how eager we are even in a moment's

49 this morning. from you one of our cameras in emeryville. the water so still and calm. the winds are expected to pick up quite a bit and that will change things out and about. sunshine, sure, you'll get plenty of that. if you're headed out, it's a bit chilly. there are credit cards that you'd use cash back rewards on purchases but some customers in the north bay said their favorite grocery store does not. they called "7 on your side" for help. here's michael finney with their

story. >> linda does most of her grocery shopping here at natural foods in marin county. she likes it far more than shopping the national chains. >> the food is so much more wholesome. like fresh. when you walk in there you smell fresh food. >> linda finds everything she needs here from fruits and vegetables, chicken and fish, milk and eggs. so she was really surprised when her credit card company said these were not groceries. >> i don't think it's fair to be discriminating against one type of food. >> linda uses the american express blue cash card. it gives customers up to 5% cash back for all the groceries they buy but not if they buy them here. >> they didn't tell me when i signed up for the card that it was limited to certain things that i bought. >> according to this blue card statement, safeway and iga

supermarket chains are indeed grocery stores but not good earth. the opener called american express to find out if organic local products don't qualify as groceries. >> we're a grocery store. why can't our amex customer appreciate the same rewards as if she went to safeway down the street. i got a very respectful phone call the following week saying that we were simply not eligible. the program is set up for bigger retailers than us. >> american express told him good earth is not a grocery store, that it is a specialty store. good earth shoppers we spoke with were certainly surprised to hear that they weren't really buying groceries. >> peanut butter, egg, cheese. >> it's where i get my groceries. >> i don't think eggs are specialty food, i don't think milk, chicken. maybe they're driving me to go to places like albert's and safeway. >> linda said she wouldn't give

up her favorite grocery store just to get cash back but "7 on your side" got involved and things changed rapidly. we questioned american express about the grocery policy and the company did a complete about-face. american express said we updated our records so that our blue cash card members will now be bonused for every day purchases at good earth. they will get cash back for shopping. american express did not explain why the rewards were previously denied but said any grocery store qualifies, not just national chains. >> very cool. >> that would be great. >> american express says it will reimburse customers for rewards they should have earned so far this year. if you're not getting cash back for qualified purchases, american express says call the number on the back of the card and if that doesn't work let me know about it. go to abc7news.com and click on "7 on your side."
