>> in the news this saturday morning, december 4th a shooting in hercules sent a nine-year-old girl to the hospital with life threatening injuries. security video from a union city store shows a child sexual assault suspect running from shoppers. we're going to tell you about the charges he's facing after being tackled. >> kind of mild out there. low 50s downtown. scattered showers in the area now but more rain coming our way tomorrow. >> good morning. i'm theresa garcia. a nine-year-old girl is in critical but stable condition at oakland children's hospital this morning with gunshot wounds. she was shot in the neck and back when she answered a knock on the door of her home on dartford street. this happened in hercules about 10:30 last night. investigators are interviewing people who were in the house at the time. police have released no information about the suspect. the man accused of assaulting a two-year-old girl in a union city dollar store will be back in court monday. eugene ramos is behind bars this

weekend after being denied bail on charges he sexually assaulted a toddler. lillian kim has more. >> from this surveillance video you can see customers and employees turning their attention to the back of the store. the commotion was rape suspect eugene ramos being caught in the act. he's seen running through the aisles making his way to the exit. a couple of customers tackle him outside. he appeared in fremont superior court where he was charged with three feloniously counts. >> lewd act on a child under the age of 14. assault with intent to commit a sex crime and attempted intercourse on a child at the age of 10. >> assault happened in one of the aisles. the girl became separated from her aunt and grandmother when ramos reportedly grabbed her. >> i've seen a lot of really bad

cases but this is the top one of them. >> the two-year-old girl wasn't his first victim. he was convicted of sexually assaulting a seven-year-old girl in hayward seven years ago. according to court documents, ramos' grandmother told the judge he was mentally ill but didn't have money to get him treatment. the court ordered a psychological evacuation after ramos sent a letter to the judge. he wrote i have regained my competence to stand trial. i am familiar with the information i need to know to assist my attorney in my defense. i'm stablelized on psychiatric medication and have been for several months. whether it will play a role in the defense for this latest case remain to be seen. >> i don't know. i don't know. whatever meds he was on or off doesn't make you want to rape a baby. >> that was lillian kim reporting. >> the family of a man shot to death outside his home by napa police is demanding an independent investigation. police say 60-year-old richard

pulled a knife on officers before one tased him and another shot him with a rifle. napa police say they followed proper procedure but now the family's attorney is saying there was no mention of a knife until several days after the shooting. his daughter says her father who was a nurse was not violent. >> he was dedicated to helping people that were sick. and in the end when he needed help the authorities came in did not give him help and he wound up dead. >> investigators say his family called police saying he was depressed and had firearms in the house. a judge has denied a bail request by the former bart cop convicted of killing an unarmed passenger near two years ago. johannes mehserle shot officer grant to death at the fruitdale station 2009. he was found guilty of

involuntary manslaughter. he is serving a two year sentence but asked to be released while his appeals process plays out. south san francisco police are hoping someone will see this story and help them find a man who attacked a woman at a train station. here's a sketch of the suspect. police say last night around 9:45 he grabbed a woman at the caltrain station on dubuque avenue and punched her in the face when she tried to get away. he also robbed her. police say he's hispanic between 5-3 and 5-5 and about 140 to 150 pounds. a young man suspected in a series of pepper spray robberies is under arrest again in san francisco. he escaped from a police station november 26 and we've since learned investigators tracked him down to the sacramento area and arrested him earlier this week. carpenter is accused of pepper spraying and robbing six people. he's being held on a half million dollars bail. lawyers on both sides of california same sex marriage

leaders want san jose to take a stand and pass a social hosting ordinance. it would fine parents whose children throw a party and serve alcohol in their house even if the adults are out of town. >> if your dog bites your neighbor you're liable for your dog biting the neighbor whether you were present or not. and it's the same thing with the teenagers in your home that you're responsible for. >> the proposed ordinance comes after the recent alcohol-related deaths of two san jose teenagers. >> that junior girl killed in a drunk driving accident, the parents who were -- who had the house party should be held responsible. >> but many disagree especially if the ones throwing the party is over 18 but under 21. >> i don't think that it's fair. i think that you should be responsible if you're 18, you're an adult you know what you're doing. >> if he's going to be an adult and everyone out there 18 an adult, those laws why not this

people in the house at the time. police have released no information about the suspect. a san francisco teenager convicted six years ago of hate crimes against a group of asian americans is now going to court to have his record changed. as abc 7's vic lee explains, it is a legal move angering many in the asian community. >> matthew is 23. his attorney says the young man has turned his life around. >> he graduated from high school, college. he's starting out in the business world. >> he now wants the court to reduce his felony assaults to misdemeanors drop the hate crime conviction and have his record sealed. >> prosecutors object saying they're serious cases. >> the case is being heard by judge kevin mccarthy.

he's the same judge who ruled six years ago that he was guilty calling the crimes the most despicable behavior one can imagine. the attack happened june 2003 here in the sunset district near 19th avenue. many of the white students had been drinking at a keg party in stern grove. some ended up at this pizza shop. the assail yants confronted five asian americans teenagers on the street. they say the attackers yelled racial slurs before they beat them up. the whole incident lasted ten to 15 minutes. for them what happened here would last a lifetime. >> this is what ken zing said at the trial. >> something i will never forget. >> wou was kicked repeatedly. they came today to show their opposition to his request. he didn't want to talk about it but his father said the attack changed his son's life.

they have nothing to look up to. >> cares is a national program based in atlanta. lewis gosset jr. was on hand to celebrate the new initiative which will focus a lot of attention on the well-being of the volunteers so they'll hopefully stay strong when the kids need them most. >> president obama is back at the white house this morning. he arrived at andrews air force base in maryland about 3 a.m. our time. this is after making a quick unannounced trip to visit troops in afghanistan yesterday. he told 3500 military personnel that they are succeeding in the fight against terrorism, that the president did praise their courage and thank them for their sacrifice. >> and we're gonna switchgears because we've got some breaking news to tell you about over in russia. there is a passenger jet plane carrying 155 people that has crashed. it was making an emergency landing but skidded off the

runway. now, it did kill at least two people. 40 others were injured. the plane is a tu-154. we are going to have more on this breaking story as more information unfolds. certainly stay with us on this one. now, in other news overseas, negligence is being blamed for the worst forest fire in israel's history. the fire is still raging in parts of the northern israel forest this morning but the initial investigation discounts arson as the cause. 41 people are dead. 17,000 others had to be evacuated and thousands of acres of woodland has burned. the loss of forest is especially hard in israel where 7% of the land has coverage. an air traffic controller strike causing some to return to work during this nationwide strike that closed eight airports. it stranded hundreds of

thousands of travelers at the beginning of a holiday weekend in spain. they're embroiled in a dispute of working conditions and partially privatizing the country's two biggest airports in madrid and barcelona. spain is threatening to jail air controllerses who do not go back to work. it's the first time they provoked its constitutional provision improved in 1978 to help the government deal with catastrophes. the air force's first unmanned space plane has just returned to earth but its mission remained shrouded in secrecy. the only video of its landing yesterday morning is from this infrared camera. the x-37-b spent 7 months in space. the mini shuttle tested satellite hardware. the air force calls the mission a success. it's prepared to launch the next in the spring aboard an atlas 5

booster. this is the only -- only the second fully audit mated reentry and runway landing in the history of space flight. the soviets achieved the first one in 1988. back here in the bay area, city of oakland is getting a boost to its economy. a major chain store pet food express just moved its corporate headquarters to a master warehouse space near the coliseum. heather has the story. (applause) >> there are plenty of reasons to celebrate at this pet food express headquarters grand opening. the company is celebrating its move into huge new digs. the police are celebrating 10 new k-9 bullet prove vests. mayor elect jean qwan says it'sest it'sest -- it's evident the qualities aren't overlooked.

we have several here in san francisco and the rents are cheaper. >> the 147,500 square foot space is a distribution center and home office. michael levy started the company in san francisco 30 years ago. it outgrew its last san leandro location years ago. >> we wanna have what we call a grade a or class a warehouse. there are very few of those in the bay area. we searched for two years, found this one in oakland. >> pet food express employees 500 people companywide, 110 here in oakland. the company's getting its deal on rent, about 30% less than the last tenant, the u.s. postal service. there are tax incentives since it's in the coliseum redevelopment zone. they expect to fire more support staff here in oakland. >> we always try to promote from within. but we're always looking for great new people. that love pets. >> the building is in councilman

convert ocean water into drinking water on the monterey peninsula. it will be the first of it's kind built near the town of marina. when it's completed in six years it will remove the salt from 10 million gallons of ocean water a day instead of taking it out of the carmel river. it will be costly. rates will probably go up by 63%. while it is an incredible amount refer hopefully in the future that will drop because we have to think of our resources what we have. we're getting rain. >> that's right. getting a little rain this morning. not gonna last all day today. tomorrow a different story. a little snow on the ground there. ominous looking sky and more snow to come especially at the higher elevations. up to a foot of snow is expected by monday morning. back home we're looking at some cloudy conditions and rain along the coast. san francisco numbers in the low 50s. kind of mild in the city.

but elsewhere cooler in the north bay. fog and haze overspread the bay and live doppler 7 hd shows we're looking at very light rain all across the bay this morning due to a weather system off to the south and west of us. here's our first stop. you'll notice from sea ranch through bodega bay and offshore, some very light showers. a little further south. here we're looking from the north bay down to the peninsula daly city. light rain. and finally along the santa cruz mountains you're dry now but more wet weather is headed your way from the southwest to the northeast is the flow today. we'll see the scattered showers this morning and then throughout the afternoon hours so not a really big system today. but we will be looking at some windy conditions. a colder system and much more rain tomorrow. 47 in fairfield right now. some light rain. 47 redwood city with 52. half moon bay. light showers this morning.

the scattered showers this afternoon and more rain tomorrow. here's a bigger perspective. you'll notice much of the activity to the east of us. we're kind of on the tail end of this system which is right here, saturday's system. sunday's system another area of low pressure wrapping up to the west of us with more heavier rain. here we are throughout the afternoon. notice the light shower activity through 7:00 today. through the overnight hours, looking at more rain but by early tomorrow we'll call it just scattered showers. not until 4:00 this the afternoon that you notice more heavier rain throughout the north bay, the peninsula into the east bay through the 10:00 time slot. so we're looking at the scattered showers ending sunday into monday morning. still a few areas of some slick roads and patchy fog. i talked about the snow. mid-30s now. upper 40s throughout the day today, then mid-40s tomorrow. that snow level continuing to lower through monday.
