>> cloudy skies and mild temperatures. gusty winds later on today. >> good morning, everyone. thanks for joining us. i'm carolyn tyler. a woman missing six days in the santa cruz mountains is in the hospital this morning after being rescued from her ordeal. her family and friends had feared the worst. 58-year-old deborah collins was carried out of the rugged mountains yesterday hungry and suffering from hypothermia. she was found along an unmarked trail in fall creek state park located off highway 9 at felton. collins got lost while hiking alone last week. she did not have any food. she told rescuers she survived by drinking water from a creek. the santa cruz sheriff's department said a full scale search was not feasible so collins neighbor went looking for her and found her huddled

under a downed tree. >> she had a little plastic bag in her pocket and she said she would use that to drink water but, no, it sounds like she didn't eat anything during that whole time. >> a friend of collins said she injured her ankle while running along a path and tumbled into a ravine. she could not get out and ended up taking shelter until she was found. in san francisco a 20-year-old man is in the hospital with life-threatening injuries after he was shot in the head with an assault rifle this weekend. that shooting happened around 9:20 yesterday morning at fitzgerald avenue and engel street in the bayview district. police are on the look outfor a suspect. they don't know what prompted that shooting. a nine-year-old girl shot while opening the door of her hercules home friday night is hospitalized in stable condition this morning. she is expected to make a fuel recovery. abc 7's lisa amin gulezian reports on the search for the person who shot her.

>> difficult. she looked out the little window. and that's approximate when she was shot. >> in a matter of moments, this house on brighton street was under attack. as soon as the little girl looked out this side window, the shooting started. the nine-year-old's aunt who was home at the time but did not want to be shown on camera explained what happened. >> the window and kept on shooting. shot the door. shot the walls. she got shot pretty bad. >> she was shot in the neck and the back. >> it takes a pretty cold-hearted individual to do that. >> i girl is the key witness but police say there are several others. the girl's aunt and nine children ranging in age from 2 to 18 live here. investigators think this was planned, and someone in the house was a target. they run a day-care center out of the home and disagrees. >> i believe the house wasn't the house they wanted. somebody would come up and see

there's a sign on the door that i was closed, child care's closed. she should have just walked away. >> they're very much the kind of people that everybody around here wishes was gone. >> this neighbor is afraid of retaliation and doesn't want to be identified. he says there have been problems here ever since the family moved in two years ago. hercules police confirm they've been to the house several times over the past nine months and about three months ago shots were fired at the same house. no one was hurt at the time and no one was ever arrested. >> i'm scared to death. like this is just not the neighborhood where we have problems like that. so it just really makes me nervous. >> police reiterate this was a planned attack and an isolated incident. still they are beefing up patrols in that area. in oakland, lisa amin gulezian, abc 7 news. >> the man charged with sexually assaulting a two-year-old girl will be back in court tomorrow

morning. eugene ramos will appear in alameda county superior court to enter a plea on charges stemming from an incident last week in a union city dollar store. police say ramos grabbed the taddeler after she wandered off from her family. her grandmother's screams alerted other shoppers. two blocked the suspect's effort preventing his escape. he is a registered sex offender. a way ward sea lions lost her way and ended up far from home. the sea lion ended up at a school in contra costa county more than 50 miles from the ocean. amy holyfield reports. >>na knew didn't put on any kind of show but the locals were still very i am pressed to see her. >> it's cool! >> the local animal control officers corralled her here on the knights and elementary school campus and then call the animal center to come and get her. while she waited for her rescue

crew, knight student started rethinking the school mascot. >> the new knight mascot. aside from the novelty, nanu's situation is actually a serious one. >> she's been treated at other center before. right now he's just a little disoriented. we'll take him back to the center. our vet and staff will take a look at him and from there we'll see what happens. >> this is nanu's third visit to the center. veterinarians have treated and released the sea lion twice before. the fact she's turned up a third time is a bad sign. >> she might be suffering from chronic poisoning. that's irreversible. >> it's caused by eating toxic algae. nanu's case really is chronic. her days in the bay might be over. >> we want to give every potential opportunity for this animal to be out in the wild.

but at the same time we want to make sure we're doing the humane thing. >> officials say the number of way ward sea lions is on the rise and aren't sure why. they rescued 1,000 mari$1,000 m mammals this year. the average is five to 600. >> the ocean trash, these marine mammals are entangled around the neck, netting and fishing line. gunshot wounds. that's another one. >> disease is another reason. that's likely were nanu turns up. they will treat her and determine whether she needs to stay and release back into the wild. >> fisherman lawmakers and scientists are urging state and federal officials to do more to protect california's dwindling salmon population. a meeting this weekend follows the cancellation of the last two commercial salmon fishing seasons off the coast of california and most of the oregon coast. a little more than 39,000 salmon

returned to spawn last year and that compares to the nearly 770,000 in 2002. many fishermen blame the decline on the transfer of water from the sacramento river system to farms in the san joaquin valley. >> salmon are resilient. they'll come right back as soon as we have cool, clean water in our rivers and delta at the right flows at the right times of year. >> the peninsula congresswoman jackie spears son sored the summit. she believes the recovery could spawn 94,000 new jobs and generate $5 billion in new revenue per year. tomorrow a federal appeals court panel of three judges will hear constitutional arguments for and against same sex marriage. they're reviewing a federal district judge's ruling that proposition 8 which bans those marriages is unconstitutional. judge vaughan walker made that

ruling. he also issued a stay blocking same sex marriages while the appeals court examines the case. same sex couples who want to marry have been waiting ever since. >> almost tangible, the way it feels not having legal recognition from the state. it feels like society's discouraging you. >> back in august the two had been hoping they could tell family and friends to join them at san francisco city hall for a legal wedding to follow a commitment ceremony they had but they are still waiting. at tomorrow's hearing, the three-judge panel at the 9th circuit court of appeals wants those who oppose the marriages explain why they have any legal standing or say in the case. >> the united states supreme court has said that if you just -- somebody who supported a law, voted for it or funded the campaign, you don't have standing to challenge, to be involved in the challenge to

weekend. that plane had just taken off from another airport in the russian capital when two of its engines failed. a third engine failed during the emergency landing. russian officials report the plane carried at least 155 people. they know that 83 of them have been hurt. take a look at this surveillance camera which caught a dramatic rescue inside a railway station in madrid, spain. you can see a man in the background fall right on to the tracks. other passengers are waving for the approaching train to stop just as another man leaps on to the track. he pulls that victim out of the path of the train with just seconds to spare. it turns out the hero was an offduty police officer. wow, that really is dramatic. our meteorologist lisa argen is here now with an update on our weather with some storms coming. >> that's right. later on today. the break is now to the early afternoon. temperatures mild in the 50s

i never did anything about it because i felt t ke okay this is not life threatening. maybe i just need to sip a certain way. or eat something a certain way. until i went to the dentist one day. the dentist gave me sensodyne toothpaste. once i tried sensodyne and kept using it i realized okay this really works. i have stopped using sensodyne in the past for like a week. and then i would notice slowly but surely that same sensitivity would start coming back. i said let me go back to using the sensodyne. this one is a keeper.

chicago's o'hare international airport is back on schedule this morning after the season's first major snowfall forced hundreds of flight cancellations yesterday. this is what it looked like in the windy city where more than 325 flights were cancelled. the flights that did make it in and out were delayed. about 5 inches of snow fell in the upper midwest yesterday. right now the only flight delays are charlotte, north carolina, where flights are held 15 to 30 minutes. we can be problems-our own later tonight depending how strong those raindrops are. >> that's a wet snow.

and the sierra, too. the temperatures fairly warm. talking about the snow level lowering after the patches of cold front. out ahead this have that cold front that still sits offshore and a look from our roof camera. a partly cloudy sky. temperatures in the 50s. looking at dry conditions across the bay area right now but we could see a scattered showers early on but the main rain event holds off until later on this afternoon where we see a couple hours of steady rain and gusty winds. 57, half moon bay. livermore valley upper 40s where you picked up five 1 hundredth's yesterday. 51 mountain view and 51 los gatos. 5 degrees warmer in santa rosa. 4 degrees warmer in oakland with a degree warmer in mountain view and san jose. overall looking at the clouds keeping the temperatures up. and the dry portion of the day will be this morning, early afternoon and the rain moves in,

the wind late tonight and the cold front pushing through later on this evening and a wet pattern setting up come tuesday, wednesday and even thursday. so here's yesterday's system. still some scattered showers in the mountains where the temperatures are above freezing. offshore an area of low pressure is winding up and with it the wind and some generous rain widespread across the bay area today. here's the time line as we go through the rest of the afternoon. we'll see the gusty winds really later on this afternoon until the overnight hours with winds over 35 mph gusting at ocean beach and along the peninsula here. the san mateo coast. but elsewhere where you've got the city and the buildings, don't look for that very gusty wind because it will be just really a coastal event. but the rain widespread coming in later on today. 1:00 just in the north bay and beginning to push into san francisco.

more like 3:00, 4:00 the cold front sits offshore. so we're looking at the rain pressing into the east bay and by the dinner hour, we've got moderate to heavy rain across the bay area. not until about 9:00. 10:00 tonight becoming more widely scattered. looking at rainfall totals from 1 to 2 inches santa cruz mountains. about an inch and a half in the higher elevations in the north bay. half inch to an inch the peninsula and our east bay valleys with maybe three-quarters of an inch in the south bay. talks about starting out high. 6 to 12 inches above 7,000 feet and lake levels only about half a foot at best. 60 los gatos. look for 58 san mateo. the gusty winds later on today and the rain later on. so the early part of the day mild with numbers in the 50s. 58 petaluma with 59 calistoga. near east bay upper 50s for you. 61 fremont.

♪ welcome back, everyone. president obama says he is open to more compromise with republicans on extending bush era tax cuts for all income groups. but he tells house speaker nancy pelosi and senate democratic leader harry reid he expects republicans to commit to some democratic priorities in return. this comes after senate republicans blocked two attempts by democrats to eliminate tax cuts for the wealthy.

david curly reports from washington. >> mr. brown of massachusetts. >> democrats brought two tax cut proposals to the floor not expecting them to win but they did expect them to say no in order to protect tax breaks for the wealthy. first a proposal to make tax breaks for those making less than $200,000 permanent failed. and then giving a break to anyone making up to a million dollars also failed. >> the motion is not agreed to. >> no republicans voted for either measure and they were joined by democrats. the 53 votes each bill did east would have been you enough under old senate rules to pass. >> this saturday session is a total waste of the american people's time. >> president obama reacted quickly. >> i am very disappointed that the senate did not pass legislation that had already passed the house of representatives to make middle class tax cuts permanent. >> the president promised to

redouble his effort to reach a compromise with republicans in the coming days. the president did have some good news for the economy announcing the completion of a trade deal with south korea. mr. obama called it a win for american workers, farmers and aero station electronic workers. meanwhile the clock is ticking on the bush era tax cut still set to expire on the 1st of january. >> well, today the president and mrs. obama host a white house reception for the kennedy center honor res and tonight the first couple will attend the ceremony itself at the kennedy center. the lawyer for one of jaycee dugard's kidnappers belief a series of letters sent by the suspect nancy garrido to a friend will not hurt her defense. she wrote the letters to a woman she befriended in the eldorado county jail. she's facing charges of kidnapping dugard and holding her captive for 18 years.

the letters frequently mention god and her husband. nancy garrido even describes herself and her husband as "peas in a pod." the san francisco police crime lab is fating new accusations about mishandling evidence. the san francisco chronicle reports the issue this time enlists dna evidence. it has to do with a criminal trial in 2008 and a mix-up of general material mixed up with a control stamp of distilled water. they were not as concerned about what happened as the way it was handled after the crime lab officials became aware of error. during an interface service in san francisco this weekend, local clergy members urged congress to pass the dream act. the group held a prayer service last night at the old basilica in support of two young people facing deportation. both came to the u.s. as

children with their parents. elizabeth lee recently graduated from lowell high school and hopes to become a social worker after finishing college. the dream act would allow undocumented students who work toward college degrees or join the military to earn the opportunity to stay in the u.s. >> we view the united states as our own country. it's the only country we all know. and the dream act would let us stay here and give back to this country that we love. >> the candlelight march also highlighted the case of city clj nursing student steven lee. senator feinstein put a last-minute stop to his deportation last month. a melee outside pasadena's rose bowl. just before the football game. two police officers also suffered minor injuries while breaking up a brawl between 50 and 75 people in the parking lot. the violence began around 4:30 yesterday afternoon about three

hours before kickoff. police arrested three people on suspicion of attempted murder. officers say the rivalry between the schools fuelled by alcohol played a major role in the fight. paypal is severing ties with wikileaks eliminating a source of donations. the online payment company says it will not allow its service to be used for activities that promote, facilitate or instruct others to engage in illegal activity. it is another blow for wikileaks's founder julianna assange who is struggling to keep the site up and running. in "the new york times" it reveals a chinese leader googled himself and found critical postings and led him to order that campaign against google's operations in china. a police investigation into arson at an islamic center in

i'm ready. i hope you are, too. rain is coming our way. lisa argen will be along in a if you minutes to tell you exactly how much. actually she'll be here in about 15 seconds. carollers greeted diners and shoppers on union street last night. the union street association kicked off its 20th annual festival of lights. stores all up and down the street are dressed up for the holidays. the shoppers were dressed for the chilly air. and tonight they're going to need a little bit more than that, right? >> yeah, that's right. if you live by the coast, the winds are gonna pick up. but if you're in the city, you shouldn't notice much in the way of gusty winds. the heavier rain slated for later on today. as we head outside, we have mixed precipitation in blue canyon. that's 37 degrees. from this shot you can see kind of a wet snow there and back home at sfo no flight delays with temperatures in the 50s.

livermore valley. elsewhere lesser amounts. you can see a little dry area out of the next system. it's an area of low pressure and a cold front that's on the way. by later on today we will see the winds pick up. so if you're at the beaches or along the coast from this afternoon until 5:00 tomorrow morning there is a wind advisory. south winds picking up from 25 to 35 mph. some areas you can see the gusts over 45 mph. in terms of the rain, we'll see a lot of cloud cover but not until about 2:00 in the north bay. the rain will begin to come down increasing on the peninsula pushing into the east bay by 3:00, 4:00. we'll get the heaviest rain and the gustiest winds with the passage of the cold front later on this afternoon. 5:00, 6:00 pretty good moderate rain out there and then becomes more widely scattered by 9:00 or 10:00 tonight. rainfall amounts pretty impressive for the south bay.

the santa cruz mountains maybe a half inch in the south bay. half inch to three-quarters of an inch in the east bay. the snow level starting out pretty high lowering to lake level with about half a foot there. that's not until about monday morning. 60 cupertino, 61 campbell. 58 san mateo with dry bulk of the day and then by the afternoon things getting increasingly wet and windy from the sunset, the richmond district, 61 novato today. a scattered showers early and the heavier rain late today. 59 for union city as well as dublin. our inland valleys we're looking at temperatures where we were yesterday. monterey bay bay low 60s with rain tonight. the accu-weather seven-day forecast. the rain coming in earlier, i'd say midday, 2:00 in the north bay. that's south. and on the back side of it by late tonight. our break is tuesday and more showers wednesday, thursday. >> the time of year. >> it is.

>> thanks, lisa. the dramatic recovery of the monterey bay is the subject of a new book. in this assignment 7 report, karina rusk shows us the ecologic ecological success story. >> the stunning beauty hides a history of exploitation. one wild species after another was hunted for profit and many to near extinction. in the early 1800s, it was otters. when they were gone, the target became whales. then abalone. 1915 ushered in a relentless pursuit of sardines. >> at its worst, the bay was a smelly, polluted, empty mess. >> in the decade between 1935 and 1945, the canneries were the heart of the economy hauling in about a million pounds of sardines a day. the process waste was thrown back into the bay and the stench

permeated for miles. dr. steve palumbi says the depth of the destruction makes the revival an amazing story. >> they've recreated an economy in monterey bay that's based not only on tourism but based on the health of the marine ecosystem. >> he's the director of the hopkins marine station and has just co-authored a book called the death and life of monterey bay. >> one of the early pioneers in protecting the bay was a marine biologist who became mayor of pacific grove in 1931. dr. julia plaque couldn't fight the canneries but made five miles of shoreline off limits for single fishing. >> that act now called marine reserves. another turning point was the creation of the monterey bay aquarium. steve was one of four friends who came up with the idea in 1976. it's ironic and appropriate the nonprofit is housed in an old

cannery with a mission of inspiring ocean conservation. >> no one had ever grown kelp in captivity and a lot of folks in the business told us, one, you can't do it and, two, who wants to come see a bunch of brown seaweed anyway. >> the success is giving rise to a new generation of action. cindy is the daughter of a measurerman and a local restaurant owner. she's trying to raise awareness about sustainable fishing practices. that means her menu doesn't include items like tuna and sharks. >> 36% is sold in a restaurant such as passion fish. the chef is the purchaser, the owner of the restaurant. the gatekeeper to the ocean's health. >> today monterey bay has found an economic and environmental balance, one that allows nature and people to coexist and

immediately because i can't stand paying the extra interest. >> the survey of americans by "consumer reports" national research center says the average credit card balance is down to about $3800. that's $1100 lower than in 2009. this doesn't mean people are happier with credit card companies. >> in fact, it's one of the lowest-rated services we've ever analyzed right down there with computer tech support. >> federal reforms now requires a mandatory minimum payment warning on all bills. it spells out the consequences of making only the minimum payment. in this case a $4,000 debt will take 24 years to pay off and end up costing more than $8,000. >> 23% of the people we surveyed said it has encouraged them to pay off their balances quicker. >> the consumer report says there are still credit card gotcha as banks try to make up for lost revenue. >> interest rates are the highest they've been in almost ten years and fees also climbed.
