the east bay, a little clearing there. also seeing that heavy rain starting to move out of the milpitas area. san jose reporting rain as well, and we're seeing band of rain sitting near accept -- santa cruz. some of the heaviest rains have moved through. we have another second area of heavy rain that will move in tonight. >> alan: all this wet weather has led to minor flooding and accidents, we're in oakland at third and washington tonight with more. >> reporter: alan, we're getting a break right now. the rain has stopped for the time being, but it hat -- left behind some minor street flooding. that's a block or two off jack london square. the sewer is a little clogged,

and it's piling up on the street. we want to alert you to a dangerous situation on 880 south. we shot this video less than an hour ago. there are several lanes flooded near broadway. this is 880 south. cars come flying down 880 and are stunned to find two maybe three lanes, covered in way, several inches team. -- inches deep. drivers getting on, getting nailed, not expecting the heavy rain, and going from 40-50-miles-an-hour down to 10. so this is 880 southbound near broadway. chp working on 38 weather-related accidents. there was an accident on 880, the broadway offramp, an accident in oakland hills. a pickup truck rolled over on i-80 and apian way.

in oakland, the rain has stopped. but as you heard leigh say, we'll be getting more. abc-7 news. >> alan: and gunshots rang out at the san leandro b.a.r.t. station today where a juvenile was shot b.a.r.t. police were first to respond, and authorities will only say the young victim had been shot in the leg. san leandro please tracked down a few suspects and used a taser on one of them. the juvenile's wound is not expected to be life-threatening. >> the ninth circuit court of appeals is set to hear argument whether proposition 8, which outlawed same-sex marriage is constitutional. here's more now. >> reporter: a major rally to protest prop 8 was rained out bought small group ignored the weather. they have together for 23 years and are legally married. >> the free tom to marry is so important to live families.

>> reporter: proponents have to prove they have the right to appeal a state judges ruling which found a 2008 law unconstitutional. league analyst dean johnson says their right to appeal will take up the first hour of the hearing. >> usually we don't allow somebody that has that sort of abstract interest, as opposed to a personal interest, in a matter, to pursue a federal lawsuit. so they're going to have a difficult argument as to standing. >> reporter: judge vaughn walker allowed the group to present evidence at the triecialg but -- at the trial, but that may not translate to the appeals court. one on prop 8's defenders believe they have strong legal standing. >> the united states supreme court recognizes where a state court eye lous propoke meanted to intervene when the attorney general refuses to uphold the law. jerry brown decided not to defend prop 8 when it was ruled unconstitutional last awesome same-sex marriage advpcates

internet. >> the city of milwaukee, wisconsin, has started a program to reduce the list of forked home. as a result, ten homes soldier -- sold for one dollar. there are 2,000 homes in foreclosure and 6500 filings, some homes are going for less than $20,000. one realtor says after you fix it up, with taxes, the mortgage would be about $500 a month, or less. san francisco officials are pondering a proposed new lieu -- law that would require at least 50% of workers hired on city project would have to be san francisco residents. san francisco chronicle reports the board of supervisors is set to vote on the local hire rules. the new rules would be phased in overtime. in the first year employers

>> alan: rodents may not be your fate favorite things but they make great pets. nearly 1,000 were put up for adoption today. they were rescued from a hoarding situation. neighbors complained because the rats spilled into their yards. the show turned to north star rescue to find homes for the rats. and andy's pet shop had space for them. >> actually very special with humans. they love to interact with people. they want to be your buddy and play with you. >> alan: 13 families have adopted two or three rats, which means there's a lot left for you to adopt. other rescue groups are going to take some of the rats later this week. leigh glaser, do you like rats?

>> leigh: well, they're okay. they're okay, yeah. i like them probably not running around in the house. >> alan: i'd like to see the sun. >> leigh: has it been pouring out there in the last two or three hours, half to inch and a half in some areas. a little break in san francisco, the rooftop cam, the cloud deck, even some fog out there. the live doppler 7hd right now showing you some of the heavy rain that sweeped in earlier this afternoon, and is now starting to push out. we're seeing a few breaks here and there in the north bay, a little rain being reported. petaluma, east bay, you're in a nice break right now. we're still seeing some rain near the peninsula, loss -- los altos, milpitas, and you can see more bands redeveloping off the coast, and this is all moving in our direction. so a little bit of a break now,

but showers will continue to be in our forecast overnight tonight. could be heavy at times. also, some gusty south wound are -- south winds, and then another shot of rain for the bay area mid-week. this is pretty much the storm system. we talked about this last night. you can clear hill see, boom, the heavy rain is here. this is our little break. you can see the leading edge of the front is right here. all of this has to swing in here before we see clearing and that's going to take place overnight. by 8:00, that's when that secondary band of actual cold front will start to bring more band of heavy rain across the bay area, and it will be with us off and on this evening, and behind it some strong southerly winds. tomorrow, some moisture around the bay area, and then once we get on the back side of the front and the drier air moves in, we'll start to clear things up, and tomorrow afternoon well
