good evening, everyone. the rain came down hard and fast tonight. most moved out of the bay area, but it took its toll. johnal stone joins us from oakland museum where there was some concern about flooding. john? >> there was some minor flooding hereafter a storm drain was overwhelmed. one of the many problems around the bay area from today's burst of rain. the oakland museum may have been closed, but the big attraction was all of the fire department and public works crews dealing with the after affects of the heavy rains. what brought them here was a report of a storm drain that had backed up. the crews spent more than an

hour at the oakland museum before leaving about 9:00 tonight. the downpours created dangerous situations around the bay area including this build up of water on 880 south near the broadway exit in downtown oakland. drivers jammed on the brakes going from full speed to just a few miles an hour after hitting the small lake right in the middle of the busy freeway lane. late this afternoon the chp was working on more than three dozen weather-related crashes. in woodside and san mateo county, tree branches went crashing through power lines on greer road. a few dozen homes went dark part of the day. again, we were told there wrs minor flooding in the oakland museum. we have not heard of any museum officials about what if any may have been damaged by the water. abc7 news. >> thanks, john. now, the storm moved east

and turned to snow in the higher elevations of the sierra. this is the top of the tram at heavenly valley where it is lightly snowing tonight. right now chains are required on vehicles without snow tires over both donner and echo summit. you can see the roads are wet in this cal trans picture at truckee, but the snow was not sticking. and for a look at where that storm is tonight, let's go to leigh glaser who has been tracking it on live doppler 7hd. leigh? >> yes, and you can see behind me that the brunt of the cold front moved through rather rapidly, and we still have lingering showers, and some are producing some moderate areas of rain. petaluma right now reporting moderate rain. also a new fresh line is now starting to move in toward bailey city. south san francisco heading toward the golden gate bridge and even parts of san francisco and ocean beach, moderate rain with that

system. the east bay has dried up a little bit. but you can see more activity gathering off the coast. very heavy rain now moving into the ben lowman area. close to an inch for kentfield. over half an inch for napa as well as oakland and san francisco. lesser amounts in the east and south bay locations. of course, with more rain moving in overnight tonight, those numbers will go up. let's look at the forecast coming up. >> thank you, leigh. the two sides in the debate over same-sex marriage will lock horns at the highest level yet. the 9th circuit court of appeals is set to hear arguments on whether or not proposition 8 is constitutional. more now from abc7's thomas roman. >> a major rally to protest prop 8 rained down, but a small group ignored the weather. they have been together for 23 years and are legally married. they want the same right for others. >> the freedom to marry is so

important to real live families like ours. >> they have to prove they have a right to appeal the ruling that found the 2008 law unconstitutional. abc7 news legal analyst dean johnson says the right to appeal will take up the first hour of the televised hearing. >> usually we don't allow somebody who has that sort of abstract interest as opposed to a particular liesed personal interest in a matter to pursue a federal lawsuit. so they are going to have a very difficult argument as to standing. >> judge vaughn walker allowed the group to present evidence at the trial, but it may not translate to the federal uh -- appeals court. one of the defenders believes they have strong legal standing. >> the united states supreme court has rec cog -- has recognized that where they have allowed to intervene, that the federal courts will do likewise. >> the attorney general decided not to defend prop 8 when judge walker ruled it

unconstitutional last august. same-sex marriage advocates worry the supreme court has a history of reversing many of the rulings especially since the court is seen as conservative. both johnson and campbell believe the case is headed to washington, d.c. >> the decision whether to take any case they are asked to, and we can only speculate, but i do believe that if the court strikes down proposition 8 that the supreme court will take a serious look at this case. >> hundreds of people for and against prop 8 were expected to show up at federal court tomorrow morning. in san francisco, thomas roman, abc7 news. >> the proceedings will be broadcast tomorrow live and eric thomas will host the web cast coverage starting at 10:00 a.m. on abc7news.com. and tomorrow governor schwarzenegger is going to call an emergency session of the legislature to address the budget deficit. he says the state cannot wait

until the next governor jerry brown takes office .'s -- takes office. the plan includes some ugly cuts. >> as governor it is my responsibility to take action. i took an oath to serve california and that's until january 2011 and not until december. why would i stop working until december? you cannot solve problems by waiting and let's be honest. that's not my style anyway. >> the state is facing a possible $6 billion deficit. the governor says the bottom line is they will have to cut more state programs. injured hiker who spent six freezing nights with no food in the mountains will be released tomorrow. deborah collins was found yesterday by a man and his son. she was walking on an unmarked trail when she fell into a ravine and hurt her ankle. the man who found her is a neighbor. his wife encouraged him to search for collins in fall

creek on saturday after she got some strange news. >> she has a friend who a psychic and she calls her friend -- this is crazy, but she calls her friend and she says, well i didn't see any violence voferld and i see her -- and i see her leaning against the tree. >> koll vince -- collins suffered hypothermia and suffered frostbite on her toes. today is colin's birthday and she is said to be in excellent spirits. three people who pleaded guilty in the for tour of a tracy boy will be sentenced tomorrow. karen ramirez, lowe and shoemaker are expected to serve at least 30 years each for enslaving, starving and torturing a sex teen-year-old boy. the teen escaped from the couple's tracy home two years ago and ran to a nearby fitness club with open, bleeding wounds and a chain padlocked to his ankle. a fourth person did not plea

out. after a trial, the next door neighbor was found guilty of the same crimes and he could spend the rest of his life in jail. 1,000 rats were put up for adoption at andy's pet shop in san jose. all of the rats were rescued from a hoarding situation in los angeles. it all started when one man brought home a pregnant rat and let them breed out of control. the man is being featured on the cable show" hoarders." neighbors complain because the rats were spilling into their yards. the show turned to north star rescue to find homes for the rats so they wouldn't have to be destroyed and andy's pet shop took on the task. >> they are very social and active with humans. they want to be your buddy and they want to play with you. >> today the adoption event wasn't very successful. only 13 families adopted two or three rats each. other rescue groups will take the rats in later this week. and up next, an

>> closed captioning brought to >> closed captioning brought to the white house and top republicans are nearing a deal , no new taxes. it appears those bush era tax cuts will be extended even for the wealthiest americans. david curly has late details from the white house. >> president obama is preparing to break one of his biggest campaign promises. he is poised to extend the tax cuts to the richest americans. in exchange he will get help from millions of jobless americans. it appear nows that the republicans will get everything they want, extensions of all of the tax cuts. >> it is clear taxes are not going up on anybody in the middle of this recession. we are discussing how long we should maintain current tax rates. >> reporter: for democrats, making this deal and giving in on taxes to get unemployment benefits extended for the

millions americans is a tough pill to swallow. >> we are moving that direction. we are only moving there against my judgment and against my own particular view of things. >> reporter: here is what is at stake -- someone making $62,000 a year could see their taxes going up $2200 starting next month. but extending all of the cuts means someone making $10 million a year will keep $450,000 of their income that could have gone to uncle sam. it is a costly deal at a time of worry about the deficit. none of the cuts is paid for. in fact, keeping taxes at this level over the next 10 years will add nearly $4 trillion to the national debt. source is say a deal could be set in the next couple days and the white house would like to move this along. that's because republicans promise to do nothing else in the lame duck session until the tax issue is finished. abc news, the white house. the city of milwaukee in wisconsin has launched a pilot program aimed at reducing the list of vacant foreclosed

homes. as a result, 10 homes sold for just $1 each. there are currently 2,000 city and bank owned foreclosures in milwaukee and an additional 6500 filings. some of the blighted homes in the program are going for less than $20,000. one reel for says after you fix it up, the mortgage on many of the homes is about $500 a month or less. and facebook is redesigning the profile pages of its 500 million plus users to make it more of a reflection of your real lives. the website said in a blog posted on sunday, "the changes are meant to make it easier for users to tell their story, who they are, where they work and who the important people in their lives are." they say the changes include not only who you are and where you live, but a set of the most recent photos your friends have taged you in. five of the most influential people in the arts

and entertainment world were honored at the kennedy center in washington, d.c. this year includes oprah winfrey and singer paul mccartney and country singer legend merle haggard and jerry herman who composed "hello dolly." >> they are being honored for their unique ability to bring us closer together, and to capture something larger about who we are. not just as americans, but as human beings. >> and that's carol channing who started in "hello dolly" on broadway in 1960. the kennedy center honors will broadcast on december 28th. thousands of spectators watching the holiday parades in san jose dodged the rain today. the san jose holiday parade took place this morning just before the storm blew in.

a number of civic organizations spent several days customizing their floats for the big parade. there was also an appearance by none other than the cat and the hat who brought along his two friends, thing one and thing two. but the future of the parade is unclear. san jose faces a huge budget deficit, and it can't afford to pay the $200,000 in staff time. meteorologist leigh glaser is here with the accu-weather forecast to see if anymore rain is on the way. leigh? >> it certainly is. live doppler 7hd is picking up some moderate showers. check it out right here. you can see some lightning strikes there as this new set of -- or new wave of moisture continues to feed inland. at novato, you are getting ready to be hit with some moderate rain. you can see a bit of yellow there. santa rosa and san rafael and golden gate bridge. the rain is just passed. it is moving quickly. tib bure ron is seeing the rain. some rain is heading over

toward oakland and alameda and over toward the berkeley area. so these little rain bands continue to race off to the east across the bay area. also you can see los gatos, you are getting ready to be hit with a new band of moderate rain and all of this is just sweeping in, and it will continue to move on in that direction. shows -- showers and breezy overnight. some of the showers could be heavy at times. expect clearing tomorrow, and then there will be another round of rain moving in as we head into wednesday and thursday. overnight temperatures are still in the midto possibly even some low 40s if we see a little clearing. so san francisco is 46. 44 for fairfield. they are already 49 right now. and 43 is expected in morgan hill. this is how quickly that cold front was. it hit the coast and it raced toward the east. we are now on the back, and

the front is here. the low is here and the moisture is just feeding what is left of the moisture feed. that's just moving inland. we will continue to see these light to moderate showers rotating inland overnight. that's for the 5:00 a.m. monday morning commute. wet pavement expected, but really folks it looks like most of the heavy stuff is over with, and by noon tomorrow we should break out into some sunshine. if you are going to the sierra, 50 and 80, chains are required on the roadways. we have a winter weather advisory until 7:00 tomorrow morning. a foot of snow is expected above the 5,000 foot level. monday, a few lingering showers tomorrow morning. otherwise we will look for increasing sunshine late in the day. 58 for san rafael. 60 for santa rosa. antioch and livermore, you will climb to 58 degrees. a nice afternoon for fremont, 61. 61 for palo alto. even morgan hill 61. 62 for gilroy.

virginia tech in the orange bowl on january 3rd. it is a 5 p.m. kickoff. the first ever appearance in this bowl and first ever match up between these two teams. the athletic director said today he has made an offer to sweeten coach harbough's contract after the cardinal 111 games lead by of course quarterback and heisman trophy candidate. the only loss came against oregon who will play auburn for the national title. virginia tech won 11 straight to end their season. harbough has turned this team around. he credits the players and they credit the head coach. >> this is the best job of playing by a group of youngsters in the last 50 years. just what they have accomplished and where they were four years ago and where they are now. and they deserve all of the credit. i block and tackled nobody. >> he was saying all these
