president is on his way back to washington, boarding air force a short time ago. emily schmidt laz details on what awaits him when he arrives. >> reporter: the halls of congress right now are crowded with office furniture. all of it for the new members of congress will be sworn in tomorrow. a lot of them haven't spent much time in washington yet. they are hoping to change what was done here during the obama administration. president obama left his hawaii vacation behind this morning. he's headed back to work in washington. just as more republicans are setting up shop. >> this is the reception area. let's see who is here. >> reporter: the 112th congress has the largest freshman class in nearly 20 years. 85 republicans. only nine democrats. more than one-third have never held elected office. >> this is not a time for celebration. the time to roll up our sleeves and go to work. >> reporter: john boehner will take the speaker's gavel tomorrow. next wednesday, house republicans have scheduled a

full vote to repeal president obama's health care law. it will likely pass there, but fail to go anywhere in the democrat-controlled senate. >> if we run an election campaign in the new year, this country's going into heck in a hand basket because we're facing severe challenges. >> reporter: as speaker-effect boehner takes on new democrats, he'll also have tea party republicans. illinois' bobby shilling is leaving his pizza shop for capitol hill. he says, prepare to fight. >> we're here to get this thing back on track where it needs to be so our kids and grandkids have the same opportunities that were afforded to us. >> reporter: president obama has some white house staffing decisions to make when he returns to washington. here is one of them. abc news has learned he is consider considering appointing former clinton secretary of congress, william daley, as new chief of staff. rob and vinita? >> and the first vote of a possible repeal is set for

friday, two days after the session begins. if it has no chance to pass the senate, why even do it? >> reporter: looking at the bill, it's only two pages. but the title says it all. it's called "repealing the job-killing health care law act." this is clearly a symbolic vote in many ways. the new republicans want to prove to their constituents back home they're following up on their campaign promises, taking this on is their first major act of this new congress. rob and vinita? >> doing it fast with an overnight bill to say the least. the navy captain that made the raunchy videos aboard the "uss enterprise," is being temporary relieved of his command. owen honors is expected this morning. martha raddatz has the latest developments. >> reporter: pete captain owen p. honors, top gun pilot, naval academy graduate, and one of a few that commanded an aircraft

carrier. but not anymore. this is captain honors on the videos he broadcast for his 6,000 sailors, as part of movie night in 2006 and '07. jokingly revealing sexually suggestive staged scenes between two women and two men. and that is not the half of it. the captain fakes a sexual scene with himself. lets loose a series of "f" words. >> you [ bleep ]. [ bleep ]. >> reporter: and in this scene, where he plays all three characters, including the surface warfare officer or s.w.o., he repeatedly uses gay slurs. >> that position as a director representative of the commanding officer to be using those words, making jokes, such as those, or participating in anything like that. >> reporter: the virginia pilot newspaper, which obtained "the

enterprise" video said that sailors who complained at the time were simply brushed off. >> i've had several complaints about inappropriate material. >> reporter: and yet, on facebook, more than 1,000 people supported captain honors, just as they did at his home port. >> i did not find them offensive in any way. i thought he was doing it to boost ship's morale. and that is it. >> there's no doubt that he was way over the line, in terms of the language used. in terms of the atmosphere it's created. in terms of the humor. >> reporter: "the enterprise" is supposed to set sail for another combat deployment in a few weeks. but captain honors will not be onboard. martha raddatz, abc news, washington. new reports say the pentagon budget could be slashed by about $100 billion in the coming days. defense secretary robert gates is expected to make the announcement thursday. one program said to be on the chopping block is the expeditionary fighting vehicle being developed for the marines.

deep water drilling in the gulf could start again in just a few weeks under a new plan by the white house that was suspended of course last year. the administration impoeszed a moratorium following the bp oil spill. now, the government says 13 companies can go back to a hand full of wells that were under exploration before that moratorium took effect. a united airlines flight from chicago to frankfurt had to make an emergency landing in toronto last night. the boeing 777 carrying a full load of fuel managed to land safely without injuring anthe ey the emergency involved some electronic problems onboard that jet. the water is still rising in northeast australia, where they are seeing some of the country's worst flooding in decades. and this morning, residents have a lot more to be worried about than being swept away. they're being told to stay out of the water because snake and crocodiles are lurking in unusually high numbers, searching for dry land. it is getting back to normal

in las vegas after a blast of bizarre weather. a winter storm brought about two inches of snow to sin city yesterday. and higher elevations got nearly a foot. palm trees were covered in white. flurries came down around casinos. and now, for this morning's weather around the nation. a much milder day in the southwest, as that storm moves out. snowshowers move into the colorado rockies. light snow around the great lakes, north of detroit into gran rapids and green bay. showers along the gulf coast, from east texas to southern mississippi. >> a wet 63 in new orleans. 55 in atlanta. and 40s from boston to degrees in the twin cities. 11 in fargo. 24 in the windy city. sacramento climbs to 51. seattle 40, and billings 30. a stunning sight this morning in the skies above the middle east. what you're looking at is a partial solar eclipse as seen from jerusalem. celestial phenomenon hops when

overseas stocks are surging this morning, lifted by some encouraging news about our economy. tokyo's nikkei average jumped 1.7% today. hong kong's hang seng climbed 1%. and in london, the ftse opens sharply higher. on wall street, the dow rose 93 points yesterday. the nasdaq gained 38 points. bank of america has reached a settlement in one of the cases alleging it sold bad mortgages. the bank has agreed to pay $2.8 million to government-backed mortgage giant, fannie mae and freddie mac. but it is trying to recoup losses from mortgages they say had faulty information. toyoting new facing new leg troubles over its so-called runaway cars. "the l.a. times" reports several companies are suing the automaker. the lawsuit claims certain

>> and if you're flying today, expect just a few airport delays in seattle, houston and new orleans. wildlife experts now say the huge flock of birds that fell from the sky over central arkansas probably died of massive trauma. they say as many as 5,000 block birds happened to fly over the town of bebe during a fireworks show. and that the noise from the show likely caused the birds extensive internal bleeding. now, there's a new bird mystery. tests are under way to determine how they may have died. the body of a military expert who served under president reagan and both presidents bush has been found dumped in a delaware landfill. john wheeler iii was said to be on an amtrak train from washington to wilmington last tuesday. the body was found on new year's eve. it was emptied from a garbage truck. investigators have ruled wheeler's death a homicide. but so far, they have no leads.

a long judge begins hearing testimony in a manslaughter kags against michael jackson's doctor, dr. conrad murray. he is accused of gross negligence in jackson's death. murray insists he did nothing wrong. his attorneys may even argue that jackson injected himself with the drug, committing suicide. jerry brown has been sworn in as governor of california, returning to the job he held 28 years ago. the inauguration was a low-key affair. brown's speech lasted less than 15 minutes. the governor did have a bit of humor during his swearing in. >> without any mental reservation. >> without any mental reservation. or -- >> really. >> as for the larger than life outgoing governor, arnold schwarzenegger says he may write a book about his life. he's been a bodybuilder, action hero and political animal.

so, he has an interesting story to tell. two massage therapists have filed a sexual harassment suit against brett favre. they say they lost their jobs with the new york jets after complaining that favre sent them suggestive text messages when he played for the team. the suit refers to the jets locker room and training camp as sexism, and inappropriate behavior. favre was just fined by the nfl for failing to cooperate in an investigation in a separate scandal over lewd text messages. we'll hear from the woman's attorney later today on "good morning america." more sports news now. the stanford cardinals secured their best season in 70 years with a victory in last night's orange bowl. with all of the highlights now, here is max bretos, at espn news. >> good morning. time for your espn news update. in the orange bowl, stanford and virginia tech met, looking to stem the tide of poor history. stanford hasn't won a bowl game
