in the orange bowl. michigan wanted him and the dolphins and the broncos. but he describes the san francisco 49ers as his best competitive opportunity. he says he felt that way from early on this week. >> it's the perfect competitive opportunity for me and the rest of the san francisco organization to be a part of a team, a team that has a chance to win for the san francisco 49ers. >> this marks a new beginning for 49er fans. fired coach mike singletary had passion but not an offensive mind. the 49 faithful of which some had become increasingly faithless, this feels like a good move. >> awesome. exactly what they need. >> i think he's shown he's capable of taking a team from nothing and making it into something and that's what we need here in san francisco. >> that's exactly what the 49ers would hope to hear. teams build fan bases two ways, by building championships or by giving fans a reason to hope.

cuts to his own office to save $7 million. the plan includes returning 84% of the governor's transition funds, eliminating the secretary of education, cutting the governor's washington d.c. staff, also the press and communications staff and eliminating the office of the first lady. but now there's word of a potentially costly problem looming with the state's computer system. nanette miranda has more. >> california is the birth place of technology with some of the world's best products invented right here. but somehow that innovation stops short of sacramento. >> you would think that we would have access to the best and brightest people having to do with information technology. >> the state auditor this week warned governor jerry brown about california's latest effort to modernize its computers and the problems associated with it. siscal, the $1.6 billion 12-year project that started in 2006 is fewer years behind schedule, $300 million over budget, and

the top two project leaders just quit. >> we have some pretty significant concerns about how successful this project's going to be. >> siscal's interim director says they'll hire executive replacements within a couple weeks and the project should be back on track. >> we're doing our best to move this state forward and we think we're doing a good job of that. >> the computer modernization project is part of a long history of technological screwups. in 1994 then governor pete wilson scrapped a dmv computer project after the state spent $50 million on a system that didn't work. in 2008, a $1.5 billion computer project was supposed to better track child support payments but california still has one of the worst collection rates in the country. >> i would note that we are working with the three top vendors in the united states. >> it's expensive. yes, it does worry us.

>> the nonpartisan legislative analyst recommends stealing back the project in sacramento. abc 7 news. >> a lawmaker from the peninsula believes limiting the size of the pension state employees can receive will also help california resolve part of its financial problems. assemblyman jerry hill unveiled his plan at the san francisco civic center yesterday. it calls for barring the state and agencies like the u.c. system from getting exceptions from a federal law that caps pension for government employees. it would cover all state employees earning $245,000 per year. >> the average pension for a calperg member with 20 years of service is $24,000 a year. it's hard to imagine how a $195,000 pension is not sufficient for these executives. >> if the bill becomes a law, it would take effect in january of next year. the city of antioch's police department is hurting for cash

>> an armed robbery case involving a decorated army captain finally came to a close yesterday in a san jose courtroom. it's been a long four-year journey for the west point graduate. vic lee has his story. >> sergeant binkley completed his medical treatment at atascadero mental hospital and finished all the court rehab programs. there was only one more obstacle in the way to a normal life. he was still legally instain since the jury declared him not guilty of armed robbery by reason of insanity. a judge approved binkley's petition to restore his sanity. his attorney chuck smith says this final act puts an end to this sad case. >> he is now free of any restriction from the superior court. >> the decorated army captain and west point graduate was overcome with emotion.

>> at this point couldn't -- just as i've said, just overwhelmed by people, people's help. >> binkley served in bosnia where he says he witnessed atrocities in mass graves, he suffered from ptsd which military doctors never diagnosed. he robbed a walgreens in mountain view, pointed an unloaded gun at the pharmacist and stole painkillers which doctors prescribed for a fractured hip. >> the narcotic painkillers relieved me of stress. >> binkley spoke to me after he was arrested. he said he was addicted to painkillers and that's why he robbed walgreens. his attorney says the system worked for his client. smith hired him earlier this year to work in his law firm. >> he's a bright kid. graduated from west point. >> he continues to go to therapy sessions administered at the

v.a. hospital. >> i find some of them are helpful. i think it's always good to keep in touch with issues i'm still dealing with. so -- >> binkley hasn't decided whether to continue working at the law firm or go back to school. but he's in no hurry because today is the first day of the rest of his new life. vic lee, abc 7 news. >> an amazing report about the recent oil spill off the coast of louisiana. according to the journal of science, microbes have consumed most of the methane and other natural gases released in the spill. the findings are stunning scientists who thought the waters would be tainted for years. most of the oil settled on the ocean floor, washed ashore or dissolved with chemical disperttants in the seawater. they said there was no significant amount of oil remaining and most of the gulf's fisheries have reopened. another day we're waking up to fog this morning. the question is when will we see sunshine? >> yeah. we're hoping for a little more

visibility problems. down to a mile or so. here we go, golden gate bridge. we'll look for numbers to even be cooler here in north and east bay valleys in the 30s where as our south bay, a little more mild in the low to mid-40s. 45 mountain view the warm spot as well as half moon bay, good morning, livermore, 37. a light northeast wind in napa and livermore creating a windchill of about 32, 33 degrees. so definitely a cold one out there although it was colder yesterday morning. and i think we're going to get a little bit more sun. that should make a bit of a difference this afternoon. widespread low clouds and fog from the west, the ocean to the east our tulie fog. becoming partly cloudy and cool today and then we see a sunnier and mild afternoon for the latter half of the weekend. we have two areas of fog which i spoke of. but we will be looking at a little bit of a northwest wind to scour out some of this.

here's our fogcast. as we take you through 9:00, notice still fog in the north bay and the east bay. but southern marin county and our near east bay alameda county looking at clearing but then look what happens. by 10:00, 11:00, the fog's moving around and you see more of it in the east bay than anywhere else. partly cloudy for the rest of the day today and our setup is this, double barrel high pressure keeping the storm track well to the north. here's a weak system to the north and that's really what we need to scour out the low cloudiness. that's gonna happen later on. but throughout the next 24 hours, we'll see just some subtle changes. this really moves on in and cleans things out, the atmosphere that is by tomorrow. so for today then, we're waking up to the cool conditions, the fog. and then throughout the afternoon as that front pushes on through, we'll see the results of sunnier conditions out there.

♪ some good economic news. unemployment fell in december to its lowest level in 19 months. employers though added only 103,000 jobs in december, less than expected. but as i said the employment rate fell but only slightly, 9.8% to 9.4%. the federal chair said it will take five years for the job market to recover. the unemployment numbers and what they really need. >> in west oakland, tobias says he's been out of a steady job for four years. >> due to the economy and being laid off, i wasn't able to find employment. >> bailey says he hasn't given up. he has enrolled in a job training program at the cyprus mandela center learning construction. but the jobless numbers tell a story of hundreds of thousands of others who have given up.

yes, it's true, unemployment fell in december from 9.8 to 9.4% but the number of new jobs is just 103,000, not enough to keep up with population growth, let alone bring down unemployment. >> so then you say how can unemployment rate go down, you realize what's happened? a lot of people have become so discouraged they've left the job force. you find that in fact there's been an increase in the number of discouraged workers. >> the goldman school of public policy says the jobless report is not good news and today fed chairman ben bernanke told congress it's going to be a long recovery. >> at this rate of improvement, it could take four to five more years for the job market to normalize fully. >> the areas of the economy that did grow the most jobs, leisure and hospitality and healthcare, not encouraging for an oakland trainee hoping to land a job in construction. >> are you very optimistic? >> i have faith so that will

carry me through. so our work, i think i'll reap the benefits. >> touring a window manufacturing plant in maryland today, the president called the new unemployment numbers encouraging. >> we know these numbers can bounce around from month to month. but the trend is clear. we saw 12 straight months of private sector job growth. >> and the government did revise its numbers for october and november saying it had underestimated new hiring in those months before the holidays. the revised numbers show that for october, november and december the average job growth was 128,000 per month. that's just enough to keep up with the growth in population. unfortunately the big dive in the unemployment rate reflects hundreds of thousands of workers who grew discouraged and dropped out of the work force. in the news room, mark matthews, abc 7 news. >> the white house wants to see long-term job growth right here

in silicon valley and yesterday they brought in a high-level team to help local entrepreneurs help grow their business. david louie got an exclusive interview with the u.s. commerce secretary on the effort. >> we want economic growth. we want job growth. >> commerce secretary gary lock thinks people in this room are key to making that happen. they're silicon valley entrepreneurs engaged in startups and small businesses. this is a kickoff event by the white house initiative on asian americans and its presidential advisory commission. it's designed to link potential job creators with government programs and services. cofounder of a new clean-tech firm called sun hydrogen. >> there's so many programs out there, you know. and if you really don't know the right person in the department, if you don't have the right connections, you really kind of get lost. >> there are 1 million asian american-owned businesses employing 2 million workers.

many don't know about tax credits or loan programs or help they can get to tap the export market. in an exclusive tv interview at abc 7, gary lock who was the event's keynote speaker said a focus on exports will create jobs. >> the more companies export, the more they produce, the more they produce, the more people they hire. we have programs for free that will find buyers and customers for made in u.s.a. goods and services. >> this white house summit drew more than 800 people giving them access to top economists, agency leaders and policymakers. >> to give you an idea, a high-level treasury official gave out his direct phone number inviting people to call him if he can help. the entrepreneurs also got a pep talk from a senior economist a day can make a difference. >> the idea we can push the boundaries, create more products, business models and generate opportunities we never thought possible.

we're going to need to do that. >> i certainly think that's going to help spur a continuing wave and more energize the wave of entrepreneurship in the asian american community. asian-americans have really been in many ways the backbone of entrepreneurship in the valley. >> massachusetts could affect foreclosures all over the country. the supreme court says two foreclosures are invalid because the banks did not prove they actually owned the militaries they foreclosed on. it addresses the validity of robo loans who often do not check a single line in the paperwork. all state attorney generals are examining whether lenders are forcing people out of their homes improperly. a package that ignited at a washington d.c. postal facility was addressed to homeland security secretariel janet napolitano. it happened yesterday.

the facility was evacuated and no one was hurt. officials say the parcel was similar to two packages that ignited in maryland singeeing the fingers of the people that opened them. each contained a note wailing against highway signs urging motorists to report suspicion activities. >> wikileaks says its twitter account information has been subpoenaed by the u.s. government. u.s. investigators are demanding access to the private messages, contact information and other personal details of julian assange and three other people associated with the website. twitter declined to comment, only that its policy is notify users of government requests for information. rudy giuliani may be plotting a presidential run in 2012. a cording to the new york city post, the former new york city mayor believes the republican race will be full of far right candidates like mitt romney and

lisa argen here with our forecast in a few moments. berkeley hopes small houses will make a big difference in its growing population. the mayor will cut the ribbon on one of these mini homes. what berkeley calls smart growth. behind this nondescript house in berkeley is what city leaders are hoping will be the big new trend in housing. it's a backyard cottage, also known as an in-law unit. >> people walk in and say this has such a sense of place. >> karen took out an equity loan to build this unit she plans to rent out. she's a city planning director at u.c. berkeley and help to add value to her property and curb suburban sprawl. >> we need to lower energy costs as a society. we need to be more sustainable. how are we gonna get there. this is one strategy that's not obtrusive. we call it hidden density or

constantineo's market is closing its doors. the food landmark had been in business 53 years. the three brothers are retiring but the closure leaves 17 employees out of work. another high-end grocery store is expected to move into that space. verizon can start carrying the i-phone in a matter of days. they have scheduled a media event for tuesday next week which is reigniting rumors it will become the only second u.s. wireless provider to offer that i-phone. they have an exclusive deal with apple since the debut in 2007. lisa argen is here with our forecast. >> we could have freezing fog, it could be worse. just plain old fog. 30s and 40s out there. mid 40s at the airport, no delays here but big snowstorm taking shape across much of the eastern seaboard and mid south. maybe delays and from our roof camera, yep, it's a gray start

with the sun making an appearance later on this afternoon. so as we start out this morning, the 30s are mainly north and east bay valleys. 37 in napa. 38 santa rosa. also upper 30s for the delta and livermore but you mix in a little bit of that northeast wind, and it feels like it's about 32. 44 redwood city with 45 in mountain view. so here are our highlights. wid spread low clouds and fog from our coast to the inland valleys. we'll see partly cloudy conditions later on today, and sunnier day tomorrow with numbers coming up just a couple of degrees. still locked into this pattern and we're featuring the tulie fog which is what you usually associate the wintertime pattern. but also the stratus is widespread and with a little wind out there we'll see some clearing but the fog will continue to move around a little bit. so 9:00 this morning, already beginning to see some sun in the north bay and the east bay but

later on in the afternoon it sweeps back on to the peninsula and into the south bay. a safe bet today for a partly cloudy sky and numbers coming out of the 40s. we've got an upper level trough, here it is, the area of low pressure. it's going to sink to the south into the great basin. what that is going to do, it's going to drive this cold front south and that will be our mixing mechanism to scour out some of this fog. so that's on tap for tomorrow as double barrel high pressure keeps us dry. the storm track well to the north. so this is what we're focusing on to bring out clearer skies in the next couple of days. so throughout the day today, you'll notice the fog beginning to erode a little bit. and then it comes right back at night. but by tomorrow we should see a pretty nice afternoon. but back to today, we'll call it partly cloudy with high temperatures in a narrow range from 52 cupertino and sunnyvale. 53 in san jose. that's warmer than yesterday.

peninsula numbers staying cloudy throughout much of the day and then by the afternoon, palo alto, you should see some sun at 53, san francisco low 50s. but daly city and south city kind of locked in with the low clouds there. and in the north bay, even though you may see some sun, still very chilly for san rafael, only 47 degrees and our near east bay with upper 40s and hercules. our inland valleys, looks like that tulie fog is going to be very persistent. only 44 antioch and down by the monterey bay, about 10 degrees warmer here with 55 watsonville. the forecast featuring more fog, a little sun. a little bit more sun tomorrow. staying dry through midweek. best chance of rain wednesday and thursday. >> haven't seen that in a while. >> no. >> we've got a little developing news in south bay. san jose police are asking for your help to find a car involved in a hit and run early this morning that left a 15-year-old campbell girl with life-threatening injuries.

lisa argen will have our forecast and tell us when the sunshine will arrive in just a few minutes. the department of motor vehicles would not budge. it refused to renew the driver's license for a new woman. red tape the dmv would not cut so michael finney took out a good pair of scissors. >> yahoo! i got it! >> you might have noticed nickty mckenzie here is pretty excited. >> i'm free! i can drive! yahoo! >> for nikki, this day marks a return to freedom after a frustrating ordeal at the department of motor vehicles. an ordeal that began two years ago with a speeding ticket in novato. >> i deserved it. i said thank you for stopping me. >> nickty was driving alone for a family gathering when she was stopped in the middle of the night just outside of reno. the officer said she was going 97 mph. >> it's a lot.

way too fast. >> nikki paid the fine and the ticket was cleared, or so she thought. recently she found out differently. >> i lost my purse. so i went over to the dmv at 7:30 to get a duplicate driver's license. >> after her license went missing and nikki applied for a new one, she found out she was still wanted in nevada for that speeding ticket or at least that's what the computer said. nikki told the clerk there was a mistake and she produced these documents proving that citation was cleared. >> took it over. didn't do any good. >> the dmv said it would take at least 30 days to investigate all of this. until then nikki couldn't drive. she also couldn't do plenty of other things that require a driver's license. like cashing a check. or even going to her doctor. >> i'm still without a license, a valid license. that's the problem. so much of our life requires a driver's license. >> so nikki contacted "7 on your

side" and we took her case to the dmv. it turns out the nevada courts had placed a hold on nikki's license that was never cleared from a national database. so the dmv could not issue her a new license. however, after we got involved, the dmv took action. it contacted the nevada courts which immediately connected the database which brings us back here. nikki's going into the dmv office hoping for her license. and a few minutes later, here she is. >> yahoo! i got it! i got it! thanks to "7 on your side"! i couldn't get it, but they did! >> yep. nikki finally got her license back. >> that's my license! >> and she couldn't wait to tell the world. >> "7 on your side" got my license for me! yahoo! look at this! >> you go, girl! >> yeah, thank you! >> the dmv says you may wind up in the national database of problem drivers if you don't
