♪ in the news this sunday morning, january 16th, san jose authorities are investigating a murder/suicide that occurred last night inside a coffee shop. and the latest developments in the tucson shootings that took place a week ago including encouraging news about the congresswoman's recovery. >> a dense fog advisory. visibility down to an eighth of a mile through 10:00. >> good morning, everyone. thanks for joining us. i'm carolyn tyler. san jose police are investigating the deaths of two men in what's believed to be a case of murder/suicide. officers responded to the report of a shooting at pete's coffee. the saratoga shopping center just before 9:30 last night.

they found two men in their forties dead of undershot wounds. witnesses say one man shot the other in the coffee shop then ran a short distance and killed himself. the identities of the victims are not yet been released. there are a series of new developments in the tucson shootings that happened last weekend. first there is more good news about the recovery of critically injured gabrielle giffords. doctors have removed her ventilation tube. yesterday was an emotional day at the spot where it all happened. one of the victims of the shooting was been arrested for threatening violence. leslie has the details. >> thank you so much for being with us. (applause) >> at a town hall style taping of abc this week program in tucson on saturday, one of the shooting victims was seated in the front row. 63-year-old james fuller was shot last week in the back and knee, reportedly took offense to a comment made by a member of the tucson tea party over gun

control. deputies say he took a photo and then yelled "you're dead." he is undergoing a mental health examine. heroes and survivors included a woman who grabbed the magazine and ammunition away from the gunman. the neighbor spoke out for the first time. >> i wonder living across the street and with that vantage point if you now look back and say there were signs? >> i wish that i would have had more courage to have said more to his parents. >> it was an emotionally trying day at the store in tucson, site of the shooting rampage last saturday. the store reopened for the first time with a moment of silence at 10:10 a.m. local time, exactly one week after the gunfire erupted in the parking lot here. hundreds brought flowers and prayerful intentions. this woman brought her six-year-old son. >> just to show him, you know, that bad things happen but

there's still good in the world and just to let him know, you know, not to forget special people, you know, the victims, you know. i just wanted him to see it. >> there were two more memorials in tucson, one for gabriel zimmerman and another for 79-year-old fill list sneek. they were among the six who died. more encouraging news for doctors keeping watch over gabrielle giffords who was shot in the head at close range. they removed her breathing tube and performed a tracheotomy on saturday. they are still calling her progress remarkable though she remains in intensive care. >> now giffords is free of the ventilator and having an easier time of breathing and doctors hope to evaluate her ability to speak. >> and you can see the town hall meeting this morning in a special this week after the

tragedy, an american conversation, continues. it airs here at abc 7 at 8:00 this morning. the victims of the tucson shooting were honored here in the bay area this weekend at an annual non-violence rally in san jose. yesterday's 12th annual martin luther king jr. stop the violence event at evergreen valley college was dedicated to the congresswoman and other victims. it included a prayer for peace, a talent show, and several speakers promoting violence prevention and tolerance. the tucson shootings have reignited that always smolders issue of gun holder rights. it's the topic of discussion at the gun show at the cow palace but in a different way than you might expect. >> thousands filled the cow palace to attend the crossroads of the west gun show. >> $10, ma'am, and you get a free ticket into the show. >> the same promoter is holding a gun show in tucson this

weekend. we weren't allowed inside but outside attendees lined up looking for deals. >> i already have weapons. but i may be purchasing another one. >> one reaction to saturday's shooting is a surge in gun sales. they've gone up in arizona and a few other states around the country. and word is spreading among second amendment supporters about joe zamutto. he's the open carrier who happened to be shopping nearby when the shooting started. he saw the gunman jared loughner and another man struggling with the gun. at that point he didn't know who the shooter actually was. he chose not to fire his weapon but instead hold both men down. he admits in the chaos things could have gone terribly wrong. >> there was a bunch of people watching. of those people watching seeing me pull a gun out thinking second shooter. in arizona where people keep guns in their cars, somebody could have shot me. >> but now gun owners insist

zamutto is a perfect example why americans should have the choice to arm themselves. >> opening doors, basically saying people should have weapons in case something like this does happen. >> meantime gun control advocates believe the attack is reason for more regulation. members applaud california's new state law which takes effect in february. it requires handgun ammunition be bought in person with i.d. and thumbprints for extra verification. senator mark leno backed that bill. >> we should be tracking who's purchasing this ammunition. and we know assailant in tucson walked into a store and bought magazine cases of 30 rounds or more. >> gun owners admit they're stocking up on ammo before the laws kicks in. lisa amin gulezian, abc 7 news. >> police are still looking for you two suspects who led them on

a high-speed chase from lafayette into oakland. police got a call of people breaking into cars. when they arrived, the suspects took off in a van leading police on a chase through the caldecott tunnel. they took highway 13 and came down monterey road. they nearly crashed into a house. >> going about 100 plus mph. she backed off because it was too fast. this is where it ended up in front of my house. >> police say both suspects ran off despite a search using dogs they got away. police have been able to check out their van and say they recovered property believed to have been stolen from those cars in lafayette. oakland mayor jean quan is making good on her promise to walk the walk and talk the talk in one of oakland's toughest areas. >> we're going to clean your parking lot. and we'd really like you guys to

do it yourself. >> the mayor city officials and local residents gathered to clean up litter and debris in east oakland yesterday. quan says the neighborhood has been victimized by illegal dumping. >> we want the neighbors to help catch those people so people stop using this neighborhood as a dumping ground. i'm helping them organize and keep it clean themselves. >> the mayor's office has planned several other events in east oakland in the coming days. they include installing new computers in an elementary school, cleaning up the park and beautifying international boulevard. the residents of a north beach apartment complex have received a pledge of support from san francisco mayor ed lee. lee and city supervisor david chew toured the burnt out montgomery street apartment complex yesterday to get a look at the progress on reconstruction. that affordable housing complex

caught fire early new year's morning displacing some 45 residents. they've been living in temporary housing funded by city and red cross vouchers and mayor lee says that assistance will continue. >> we don't need people in stressful situations untouched by help from the city. >> lee promised to work with the property owner and the city's building inspection department to rebuild quickly. he says he knows the importance of affordable housing in the community. some signs of healing in san bruno. one homeowner has filed plans to build a new house on one of the 38 lots where homes were destroyed by last year's pipeline explosion. the september 9th blast killed eight people and devastated that neighborhood. san bruno officials says one family has filed plans with the city. they did it last week. they could start rebuilding their home this spring. another family also plans to rebuild and plans to file their plans in the coming weeks.

high school auditorium. tomorrow the 27th annual freedom train leaves from san jose's station at 9:30 in the morning with stops in sunnyvale, palo alto and san mateo before arriving in san francisco. once in san francisco, there are numerous activities honoring king, including a parade, all-day events at the center for the arts and free admission at the jewish contemporary museum and the museum of the african diaspra. the museum had a family day yesterday in observance of the actual day of king's birthday. there were plenty of fun and educational activities for kids, including a chance to make silk screen images of dr. king and others. during tomorrow's free day, the museum will focus on events for the college-bound with a focus on historically black colleges and universities. the fog out there is just really dense, and i think you checked and sfo has about an hour delay.

♪ welcome back, everyone. now more on developments in the tucson shootings which as you know took place a week ago. a woman who survived two gunshots is already out of the hospital and returning to work. pam simon is one of congresswoman gabrielle giffords' staff evers. she talked with her coworkers and with abc's david muir. >> it was here we first heard from pam simon, the giffords staffer shot in the chest and arm who smiled wide when she was wheeled back to the congresswoman's office standing up to greet the colleagues. >> the bullet went through my wrist. not sure where to where but it did. and miraculously did not hit anything on my right hand.

i took a bullet to the chest. and when i woke up from the exploratory surgery, the surgeon said you are one lucky lady. >> just like us as we sat in that room with her, so many of you were stunned at her recovery, her bravery. you tweeted us. so many miracles, still not forgetting those that lost their lives. that is truly amazing. she's definitely blessed. one doctor said this is unusual, surprising is what he said. even from trauma doctors who have seen it all. but this survivor doesn't have a medical explanation. she's calling it what so many of you call it, a blessing as she now prays for others. >> i happened to get hit by bullets, but you got wounded, too. >> a private memorial was held this weekend for another of the arizona shooting victims, 30-year-old gabriel zimmerman. he graduated with honors from

u.c. santa cruz in 2002. he was a congressional aide to gabrielle giffords. there was also a memorial for 79-year-old victim phyllis sneek. one man is dead following a bank robbery in union city this weekend. police got a call yesterday that a bank on niles road was being robbed. officers chased the suspect in their getaway car. i said a passenger started shooting at him. the chase ended at dow avenue where the driver was arrested. the passenger ran away. police returned fire then sealed off the area. that man, the passenger, was later found dead with a gunshot wound to the head. police can't say whether he was hit by police gunfire or if he shot himself. san francisco police had more information today on yesterday's fatal shooting atop twin peaks. police say 100 people were gathered at 3:00 in the morning at christmas tree point. that's a popular vista point. they say an argument broke out between two groups of men.

shots were hired hitting 23-year-old lewis vanagas who died at the scene. two or three men drove off in a white minivan. wikileaks supporters held a demonstration at the new york times office at clay and montgomery streets. they taped some of the 2,000 documents wikileaks has posted online to the walls of the building. the demonstrators say several media outlets reported wikileaks indiscriminately posted 250,000 sensitive international documents online. they're also criticizing what they say is the persecution of the website's founder julian assange. former governor arnold schwarzenegger is telling an austrian newspaper that his time as governor cost him a huge pile of money and he says it could have cost him his family. schwarzenegger sails he milled out on at least $200 million in acting roles in hollywood films. but he says it was more than worth it.

schwarzenegger says his family life though is damaged and needs to be repaired. he recalled many sunday evenings when his wife maria and their children cried because of their heavy work schedule. he quoted family members as saying we hate your job. you might recall four years ago then governor schwarzenegger announced plans to open health clinics at 500 elementary schools all over the state. but according to california watch which is a project of the nonprofit center of investigative reporting, not a single center has been established. abc 7's education reporter lee ann melendez follows up. >> i'm going to take your blood pressure. >> el cerrito high has a modern healthcare center for their students. enrichment programs are also offered. this is the center's director. she says if students are healthy physically and mentally it will

reflect in their school work. >> we knew that if we could create a set of services and connect those services with young people we would support them to do well in school. >> they have tissues when they cry. they are here. they are our shoulder to cry on when we don't have nobody to talk to at home. >> there are 176 health centers in schools in california. there should have been more by now. four years ago then governor schwarzenegger promised to add 500 of them in elementary schools. >> the schwarzenegger initiative came about when the state was trying to pass its own health reform legislation. i think the thinking was that these health centers would be part of that. >> but the california legislature never passed healthcare reform. then came the recession. according to california watch, as a result to date not a single one of these centers has opened. tom is the new state superintendent of schools. >> we are in a fiscal emergency. the state budget is still in

crisis. the economy is still in crisis. >> school districts like oakland unified are going forward. building healthcare centers by relying on health for the community. they are counting on local bond money, grants, donations and some money from the federal government. any future funding from sacramento is unlikely. >> governor brown has not made healthcare and healthcare reform a major part of his platform, his campaign. he hasn't talked about it since he took office. >> even though there is a financial incentive to fund these centers. >> most health centers get preventive healthcare to kids right away. they prevent illnesses from spreading in the school. they keep kids in school. that saves money for the school because they get to keep their average daily attendance up. and also prevents kids getting really sick and going to the emergency room. >> something that costs three to four times more than a trip to the doctor's office. >> and you can read more of the

by california's project. this weekend chinese officials are visiting fresno where a central construction hub is proposed as well as a four-story train depot. reporter shannon handy reports from our sister station in fresno. >> 12 chinese officials got a bird's-eye view saturday what will be the first phase of california's high-speed rail system. with a price tag of $45 billion, the entire project will link l.a. to san francisco through fresno. fresno county supervisor henry grid says aside from china, other countries including japan, germany and france are all interested in the project. >> i think the chinese are going to be very competitive in the application they put forward. but they understand and they embrace the fact they're going to partner with local valley businesses and hire local labor to do the work.

it's a win/win all the way around. >> expected to create 100,000 jobs in the valley. the chinese want to build the trains, the tracks and possibly a manufacturing facility in fresno. jeffrey chang works with a group based in beijing. china can bring its money and expertise to the billion dollar project. >> they've built more high-speed rail in the last ten years than the entire world together. they have the experience, the expertise, the most modern technology. >> whether they'll commitment to investing is still unknown. the chinese are impressed what the valley has to offer. >> this is one of their highlights to the seven-day trip they have in california. this is a very important stop. >> two new baby penguins have hatched at the monterey and you with watch them grow up.

muni metro stations. an instructor at u.c. davis is under fire this weekend. one of his students took a leave from school to have a baby. while she was gone, he polled her fellow students about what grade to give her after she missed several classes because she was pregnant. karen massy has the fallout from that. >> we all make mistakes. i'm thinking maybe it was just a mistake on your part. >> the mistake by u.c. davis veterinarian professor edward feldman is a big one. he's accused having class leaders sending e-mail to fellow students asking how to grade a student mother who was going to miss some quizes. they can choose several optionless. >> why would it be left up to the opinions and whims of however many students in the class. it doesn't seem logical to me. >> the students and workers in the veterinarian complex would talk. we saw the doctor on campus but

he wouldn't return calls. >> they were very understanding, my professors. >> alisha graduated after her teachers made accommodations for her pregnancy. >> the teacher and professor should speak to the students privately and make special -- whatever her conditions are, you know. work for her and works for the professor. >> the way it should be, the student should receive an incompletely until they take those quizes. there are allowances for these things. >> dave storm who recently adopted a child says perhaps some sensitivity training is in order. >> this is one way to make them aware. if this is a misstep, you need to back up, do it correctly. >> in that e-mail to students, the professor gave six options including awarding the student an automatic a agreed or an automatic c. still ahead, a 17-year-old becomes the youngest contestant

(cheers and applause) >> well there she is, miss america. theresa scanlon at the age of 17. she's the youngest winner since the very first pageant back in 1921. the winner that year was 15.

scanlon wins a $50,000 scholarship and a year long run with that crown. the runner-up miss arkansas gets $25,000. ms. california from san diego finished in the top ten. the 96-year-old palace of fine arts is open again this weekend after a major renovation. abc 7's arts and entertainment reporter don sanchez shows us this work of art. >> it is a classic landmark restored to its glorious origins. the palace of fine arts was fading, falling apart. now it's been retrofitted, repainted and even the swans back in the clean lagoon. >> we tore everything out. basically started from scratch. all new concrete, allny landscape and irrigation drainage. >> a $20 million project that took seven years. $16 million of that money came from donations. her grandparents fell in love under the dome. she headed up the fund-raising. >> a lot of people have a great

deal of passion about the palace of fine arts. they have their memories of feeding the ducks and the swans or stories of the 1915 exposition and their relatives being here. so there's a lot of passion out there. over 1200 donors came through for us. >> the palace of fine arts was part of the 1915 panama exhibition. it was never supposed to last but phoebe led a draft to save it. >> reflects the spirit of ancient rome, looking like a roman ruin. a roman it certainly is but ruin, not at all. >> two million visitors a year come here. >> well worth the money spent to actually preserve it. >> they've done a great job. >> the setting inspires performance. the palace of fine arts, meant to be here for another 96 years. >> we hope. that will inspire a lot of people to be involved, to help take care of this legacy
