good morning. thanks for joining us i'm carolyn tyler. san jose police are investigating the deaths of two men in what is believed to be a case of murder-suicide. officers responded to a report of a shooting at a coffee shop just before 9:30 last night. witnesses say one man shot the other in the coffee shop and then ran a short distance away and killed himself. the identities. victims both in their 40s have not yet been released. >> congresswoman gabrielle giffords is showing continued signs of improvement after the week she was shot in a head in a safeway parking lot. she is no longer using a ventilator but breathing completely on her eont knew son they are working on healing. the supermarket reopened yesterday but first there was moment of silence in memory of

the victims. some people brought their children to learn. >> just to show them, there is good in the world and to let them know and not forget. special people, the victims. >> it will take time. one of the victims was arrested yesterday during a taping of the abc program this week. 63-year-old james fuller apparently took offense at remarks made by a member of the local tea party. he was escorted out by police. he is now undergoing a mental health examination. the victims of the tucson shooting were honored this weekend in the bay area at an annual violence rally in san jose. yesterday's stop the violence event was dedicated to congresswoman giffords and the other victim. it was organized by local students and included a prayer

for peace. it also included a talent show and several speakers promoting violence prevention and tolerance. the tucson shootings have re-ignited the smoldering issue of gun owner rights. there is a gun show going on at the cow palace in daly city. as you would imagine there is quite a bit of discussion, but maybe not what you might expect. lisa amin gulezian reports. >> thousands filled the cow palace to attend the crossroads of west gun show. the same promoter is holding a gun show in tucson this weekend. we weren't allowed inside, but outside attendees looked for deals. >> i already have weapons but i may be purchasing another one. >> one reaction to saturday ease shooting is a surge in gun sales. they have gone up in arizona and word is spreading among second

amendment supporters, the open carrier who happened to be shopping nearby when the shooting happened. he saw the gunman jl jm and another man struggling with the gun. he didn't know who the shooter actually was. he chose not to fire his weapon but instead held both men down. he admits in the chaos things could have gone terribly wrong. >> there were a bunch of people watching. and they see me pull a gun out and people are saying second shooter. in arizona where people keep guns in their cars, somebody could have shot me. >> but gun owners insist that he is a perfect example of why americans should have a choice to arm themselves. >> basically saying, people should have weapons in case something like this happens. >> meantime, gun control advocates say it's reason for more regulation. members applaud the nau

california's new state law that takes effect into february. it requires handgun ammunition be bought in person with i.d. and thumb print for extra verification. mark leno backs the bill. >> we should be practicing who is purchasing the ammunition and we know the assailant in tucson walked into a store and bought magazine cases of 30 rounds or more. >> gun owners admit they are stocking up on ammo before the law kicks in. in daly city, lisa amin gulezian "abc 7 news." >> police are still looking foretwo suspects that head led them on a high speed case into oakland last night. police got a call about people breaking into cars in lafayette. when they arrived the suspects took off in a van leaving the chp on a chase through the caldecott tunnel. they came down monterey road into the redwood heights neighborhood. they nearly crashed into a

house. >> one officer said they were going about 100 plus miles an hour and he is backed off because it was too fast and this is where it ended up, in front of my house. >> both suspects took off running and despite a search using police dogs they got away. investigators have been able to check out their van and they believe they recovered stolen property. >> maim jean quan wants to walk the walk and talk the talk. >> we're going the parking lots and watched it. >> the mayor and city officials and local residents cleaned up litter and debris in east oakland yesterday. quan says the neighborhood has been victimized by illegal dumping. >> we want to stop that. we want to catch those people so they stop using this as a dumping ground.

>> the difference is, i'm not doing this for them. i'm helping them organize to keep it clean themselves. >> the mayor's office has planned several other events in east oakland in the coming days, including computers and cleaning up sobrante park. >> the residents of a north beach apartment complex have received pledge of support from mayor edlee. they toured out the burned out apartment complex yesterday. they were getting a look at construction. the apartment complex in caught fire displacing 45 residents. they were living in temporary house and mayor lee says the assistance will continue. >> we don't need people in stressful situations, untouched by help from the city. >> lee is promising to work with the property owner and the

city's building inspection department to rebuild quickly. he says he knows the importance of affordable housing in the community. >> there are signs of healing in san bruno as one homeowner has filed plans to build a new house. on one of the 38 lots where homes were destroyed by last year's pipeline explosion. september 9th blast killed eight people and devastated the neighborhood. san bruno officials say one family filed plans with the city last week and they could started rebuilding their home in the spring. another family also plans to rebuild and intends to file their plan in the coming weeks. up next, tunisia moves closer to a new government. gunfire threatens hope for a smooth transition. plus, haiti's efforts to r

gunfire is being heard near the intear yeah ministry in tunisia and they are out in force. tanks are on the streets following sporadic violence the following days after police shot at protestors. they set fire to the main train station. some people are venturing out on the streets and gathering in coffee shops to catch occupy the news.

skies and tahoe valley airport, 39 degrees. let's take you back home. high definition emeryville, you'll notice a bit of haze but we've got sunshine. as we pan around here looking west into marin, also a mixed bag. we've got areas of dense fog and clear skies for marin to sonoma county. so you'll have to wait a little bit until the sun begins to burn back all that moisture. probably about 10:00 or 11:00, everybody will see more hazy sunshine. visibility less than a quarter of mile around santa rosa. also eighth of mile at the airport. definitely pea soup fog around there. we return to the low to mid-60s and some of the fog sitting by the delta. carquinez strait. a high of 52 and we'll see fog linger but everybody will be looking at a dry forecast next

week. a couple of flurries that will affect the wind but overall, no rain. either is the eighth of the mile visibility at the airport. rorptd at oakland airport. hayward, sunny skies and ground fog out there. so with that temperatures are still cool, upper 40s, 50s san jose but we are on our way to a mild afternoon. here is the rest of the afternoon. you will notice around 10:00 or 11:00, you should see more sunshine. fog is hanging right around the delta there. don't be surprised if your temperatures are going to stay cool. here sat visible picture. a pocket of clearing in marin and also parts of the east bay and down by monterey trying to look at clearing. still, good dose of fog is going to stay in the central valley. hour pressure is putting a lid on things. winds are light. the temperature and dewpoint spread, they are about the same. that is why we have the fog. this low sneaking into northern

california bringing a few showers northern sacramento valley. we're on the southern end of that, mild days and cool nights right on through next week. our temperatures today, look at los angeles, 81. palm springs back in the 80s for you -- 70s in southern california. 67 in monterey. 55 in fresno. back home low to mid-60s in the south bay. nice afternoon, saratoga is 65 as well as palo alto. working on the sunshine bringing back the moisture, 63 in millbrae. san francisco, 61 this afternoon. in the north bay, areas of dense fog lingering into late morning hours. then we'll see low 60s by vallejo today. 64 oakland with 64 in castro valley.

welcome back. the father of the youngest victim of the tucson shooting says the family has donated some of nine-year-old christina green's officer begins to help another child. this week traveled there for a

townhall meeting for a shared look at the tragedy. host christiane ammanpour begin the conversation. >> the nine-year-old christina tailor green? >> she wanted to tell a little girl something she felt something impossible in her generation by introducing her to gabby and let her know that opportunity was there for her, too. it was just a perfect event for that to do that. >> and how is your wife coping? >> the emotional side of what has occurred is still sinking in. the extent of the tragedy only really seems to get addressed in quiet moments when there aren't audiences around. >> about 2300 people at the townhall meeting that was held at a tucson church which two of

victims had attended. >> a woman who survived two gunshots is out of the hospital. pam simon is one of giffords' staffers. she talked with the co-workers and with david. >> we first heard from pam simon shot in the chest and arm who smiled wide as she was wheeled back to the congresswoman's office. standing up to meet the colleagues that saved her. >> the bullet went through my wrist. i'm not sure where to where. miraculously did not hit anything. is i took a bullet to the chest. when i woke up from the exploratory surgery the surgeon said you are one lucky lady. >> just like us, as we sat in the room with her, so many were

stunned. wow, that is truly amazing. she is definitely blessed. we reached out to emergency room doctors, one said this is indeed unusual. surprising is what he said. even from trauma doctors who have seen it all but this survivor doesn't have a medical explanation, she is calling what so many of you called it, a blessing as she now prays for others. >> i happened to got hit by bullets but you got wounded, too. >> a private memorial, gabe zimmerman graduated from honors from santa cruz back in 2002. he was a congressional aide to giffords. there was also a memorial for 79-year-old victim phyllis snek. >> one man is dead following a bank robbery. police got a call that a bank was being robbed. an officer chased the suspects in their getaway car.

a passenger started shooting at him. the chase ended at dow avenue where the driver was arrested but the passenger ran. police returned fire and sealed off the area. the man and passenger later found dead with a gunshot wound to the head. police cannot say whether he was hit by police gunfire or shot himself. san francisco police have more information this morning on yesterday's fatal shootings atop twin peaks. 100 people were gathered at 3:00 in the morning at christmas tree point, a popular vista point. an argument broke out they say between two groups of men, shots were fired hitting 23-year-old man who died at the scene. police are looking for two or three men who drove off in a white minivan. >> a teenage boy was killed, two others wounded after shots were fired in a bay point residential neighborhood. contra costa deputies say it happened after 11:00 on friday

night. they found a 17-year-old shooting victim dead at the scene on riverside drive. 15-year-old boy and 20-year-old man were treated for minor injuries. so far police have no suspects in that case. >> wikileaks supporters held a demonstration in front of san francisco's "new york times" office at clay and montgomery streets. they say some of the 2,000 documents posted them on the walls of the building. several outlets that they indiscriminately 250,000 sensitive documents online. there is criticizing what they say is persecution of the websites founder, julian assange >> arnold schwarzenegger is telling audiences that his governorship cost him a huge amount of money. he missed out on at least $200 million in acting roles in

hollywood films. he says was more than worth it. he says his family life needs to be repaired. he recalled many sunday evenings where his wife and children were cried because of his heavy work schedule. he quoted family members as saying, we hate your job. four years ago he announced opening health clinics at 500 elementary schools all over the state. but according the california watch which is a project of the nonprofit center for investigative reporting, not a single one has been established. educational reporter lyanne melendez follows up. >> el cerito high has mental health services are also offered. >> they can say they love you and care for you. >> the director, she says if students are healthy, physically and mentally it will reflect in

their school work. >> we knew if we could create a set of services and connect those service with young people that we would support them to do well in school. >> they things, we cry and they are also to cry on when we don't have anybody to talk to at home. >> there are 176 health centers in schools in california. there should have been more by now. four years ago then governor swarzenegger promised to add 500 of them in elementary schools. >> schwarzenegger came about, we were trying to pass health reform legislation. the thinking was the health centers would be part of that. >> but the california legislature never passed health care reform. then came the recession. according to california watch, as a result, to date not a single one of these centers has opened. the new state superintendent of schools.... >> we are in a fiscal emergency.

the state budget is still in crisis. the economy is still in crisis. >> school districts like oakland's unified are going forward. building health care centers by relying on help from the community. they are counting on local bond money, grants, donations and some money from the federal government. any future funding from sacramento is unlikely. >> health care reform to talk about. >> even though there is a financial incentive to fund these centers. >> the health centers give prevent health care to kids right away and they keep kids in school that safes money. they keep their average daily attendance up and they prevent kids from getting really sick and going to the emergency room. >> something that costs three to

welcome back. time right now is 9:42. this is looking east from vollmer peak cam showing you a thick layer of fog and clouds. lisa says it's going to dissipate as the day goes on and very nice weather for the next several days. >> death, instruction and debris are what survivors are left with after flooding in north eastern australia. cleanup continues in the third largest city where 30,000 homes and businesses have been flooded. picking up the pieces could take months. rebuilding could take years. emergency centers have been set up to offer food and shelter to the flooding victims. survivors including wildlife whose homes were flooded out are getting help. >> in brazil, they are lining up

coffins, there are massive burials. it was 40 miles north of rio de janeiro. nearly 800 people have been killed. death toll is expected to rise because of the difficulties rescue workers are having reaching sites. muddy waters continue to flow through the towns where homes are destroyed and much of the infrastructure has been wiped out. >> sad to see pictures like that of all that devastation. lisa argen is here now with a look at all the bay area accu-weather forecast. after the rain we've had, a little bit of sunshine. yes, a lot of sunshine. many dry days ahead and not too unusual for this time of year. take a break from the rain in january. here is a look at sfo where delays are about an hour. it has been super foggy here all morning long.

visibility less than eighth of a mile throughout most of the morning and from mount tam. we have areas of some dense fog and also areas of cleared out already. we are looking east and eventually down to the south and west where we have the fog in san jose. finally as you approach the golden gate bridge, you got some of the sunshine trying to evaporate the fog. dense fog advisory is up for another 15 minutes but improving conditions all around the bay area. delta will probably be less to clear on out, may not clear out. but mild numbers and the following will remain patchy in spots where it doesn't clear out. but no rain, that is in the forecast right on through next week. a look at the visibility, fog is down pretty low with quarter mile visibility throughout most of the bay area except in oakland, hayward and fairfield, we're things are continuing to

improve. to 50 in san jose. 45 in san rafael. temperature-dewpoint spread just about the same, saturated air mass. by noontime, pretty much everybody is looking at sunshine although the delta wants to hold on the fog. sacramento valley, stay foggy down to fresno. visible picture about clearly in marin county and well to the north and along the peninsula looking at brightening up this morning. bigger picture, with the high pressure anchored off the west coast and in the upper levels of the atmosphere, we are looking at warming, as well. temperatures coming up in the 60s. a weak system will squash some th ridge a little bit allowing for rain in the northern portion of state. eureka 59. elsewhere, tahoe, 54 still mild and sunny and warm conditions southern california, low 80s

return there. and fog all the way down along the central coast to san luis obispo. 63 in milpitas and sunnyvale with mid-60s returning for los gatos. low to mid-60s here and the fog will remain along our coast during the morning hours. even hazy sun at pacifica, 60. downtown, 61 for you and in the north bay, we're looking at widespread hazy sunshine and sunny afternoon. 66 in calistoga. mid-60s for castro valley. here is a look at the fog sit a little bit with temperatures only in the low to mid-50s for concord. hazy sun in there today. 63 in dublin and mild air continues aware 70 nalinas. seven-day forecast, i think things will be similarly foggy tomorrow.

sunny skies and more 60s with fluctuating temperatures. >> you got it all. thank you, lisa. >> a legendary seafood company in san francisco suddenly closed down. now there is uncertainty when it might reopen. the problem the cleanup of oil pollution near the fish company on fisherman's wharf. >> the alioto fish company has been in san francisco for 70 years. it's part of the culture beyond the tourist view of fisherman's wharf. >> it's hard to imagine what fisherman's wharf will be like without a real fish monger. >> they sell fish and crabs locally and internationally but the tanks are empty. the owners have closed their doors possibly for good. >> we take one day at a time.

>> their planning are on hold because of this oil cleanup in the contaminated waters behind the business. the city of san francisco sued exxon monthly back in 2008 to clean up years of pollution from fuel storage tanks. fish company sued the oil giant and the port of san francisco. but now that the work is underway, it's more than the women expressing it. >> you are feeling the walls and floors shaking like an earthquake. suddenly you can't have conversations. i ended up in an ambulance being evaluated because they did a diesel release and i couldn't breathe. >> exxon monthly released a statement saying the work is being done under the direction and full cooperation with the california water quality control board. the port is monitoring the cleanup. >> the port and city are compelling them to do that. so we're just surprised there wouldn't be complaints about

this very work we asked them to do. >> the owner of california shellfish says he is trying to tough it out and sympathize west side his neighbors. >> what can you do. you are running a business in a building shaking. >> the port says the cleanup work should be over from six to eight weeks. after that the owners of the legendary fish house will decide whether to continue the family legacy. >> this is a way of life that has been passed down for generations. it's in your blood. >> the port says none of the other businesses in the area have complained about the cleanup which began december 29. still ahead, two new furry additions to the monterey bay aquarium.

a warning to south bay drivers, part of highway 101? santa clara county is going to be closed for a construction

project. caltrans is shutting down northbound and southbound lanes at tully road from 11:00 tonight until 5:00 in the morning. drivers will be forced to detour at tilly road off ramps. >> seniors that ride muni will get more time to switch over to the clipper cards. they are fading out the senior monthly passes and only offer those discounts and those clipper cards. muni has extended deadline until may to give riders more time to apply for the cards. agency has issued almost 25,000 of them to seniors and 9,000 to young people. the cards can be bought at vending machines in the nine metro stations. >> two new baby penguins at monterey bay aquarium and you can watch them grow up. they hatched last weekend and another hatched on tuesday. they are available for viewing
