>> terry: good evening, we begin with developing news the san jose. we are finding out a murder -- suicide last night is actual he the result of a high-profile missing persons case. the murder victim, the prime suspect in that case, maurice nasmeh. the man who killed himself, the brother of the missing woman, jeanine harms. lillian kim joins us live. >> reporter: terry, police say the prime suspect in the jeanine harms missing persons case was shot and killed by harms' brother. the brother then shot and killed himself. it happened last night at the el paseo de saratoga shopping

center in san jose. maurice nasmeh was inside pete's coffee when wayne sanchez confronted him and opened fire. the two initially ran into each other a short time earlier at the red robin restaurant, where sanchez cuesed nasmeh of his sister's murder. jeanine harms has been missing since 2001. may was in custody over her murder but was later released. >> the suspect retrieved a handgun and shot the victim. the suspect then went out into the parking lot, and as officers arrived, they heard a single gunshot so they went over to investigate that gunshot, and found the suspect deceased in the parking lot from an apparent self-inflicted gunshot wound. >> reporter: maurice nasmeh has

long insisted his innocence in jeanine harms' disappearance. he was out drinking with her the night before she disappeared. as for last night's shooting, police are trying to determine if sanchez was stalking nasmeh or they made by coincidence. >> terry: a soldier from danville has died in afghanistan. 47-year-old major evan moldike died last wednesday in a noncom bat related incident. he had been in afghanistan for a year and was supposed to come back home in just two weeks. he is survived by his wife and two teenagers. he served a year in iraq five years ago. a new report claims pg&e may have intentionally increased the pressure in at least 11 of its gas pipelines, including the one that exploded in san bruno last year to avoid an expensive test. a 2002 federal law requires any pipeline running under a

populated area to be regulated based on its peak pressure over five years. critics suspect that in order to avoid a test, pg&e has been artificially spiking the pressure on its lines to the legal limit. pg&e confirmed it spiked the pressure on the san bruno pipeline and others and claims the move was safe. congresswoman gabrielle giffords' condition is improving. doctors have upgraded her from critical to serious condition now that she is breathing on her own. earlier today hundreds of people laced up their sneakers in tucson to honor the victims of the shooting rampage. the shootings were the subject of a special edition of abc's "this week." those personally touched by the crime shared their memories and feelings. report roirt was the day they'll never forget.

the america's cup yacht race comes to san francisco in 2013. race organizers will pay the city for the use of some piers and will lease other piers for a decade. that number of businesses taking a hit continues to grow. >> reporter: up to 80 businesses now may have to actually relocate because of the america's cup. the earliest some would have to move by at the end of this year. at the latest by the end of next year. even with that long time frame, there's a lot of nervous business owners out here on the embark dare row. >> from the cabs that cruise the embarcadero. to the soccer players in the parking lots of piers 27 and 29, to this vintage cars tours, they're all included in the list of businesses along the waterfront that are about to begin a wild ride. when the america's cup comes to

town, the port of san francisco says as many as 80 businesses could be forced to move to make room for the venues' viewing areas and racing village and while larry ellisson's yacht race is expected to bring millions to san francisco, some business owners say it won't be good for their bottom line. >> absolutely. i'd love for the america's cup to come to san francisco, but i think that it could be brought here without, you know, sort of slash and burn approach to the waterfront. >> reporter: michael runs american wine distributors on pier 23. moving out of his 1400 square foot space will mean a major headache. all his business licenses are tied to his address. >> i have 65 licenses, all over the country, that are all posted to that address, and if i move, i have to move them all. >> reporter: it's no laughing matter. businesses like this one and a

limousine and transportation are sitting on piers where there's a planned public viewing area. the san francisco board of supervisors say they shouldn't worry. >> the city absolutely values these businesses and we'll assist these businesses in relocation. >> reporter: the port is still trying to decide which of these businesses will got to stay and which will have to pack up and move. many of them lease warehouse space along the embarcadero, it should make them easy to rerelocate to other port property. >> terry: there is much more still ahead. fewfew tuition niece. >> leigh: i'm leigh glaser. you can see what stuck around all day long across many communities, keeping temperatures low.

even called, repeal of the job-killing healthcare law. >> this is a job-killing legislation. >> yesterday, when john boehner talked about the alleged, he changed a word, dropping the word "killing" and saying his colleagues will try to overturn what he called the democrats job destroying jobs. sources say don't make too much of the word change, adding republicans don't plan to change the name of the bill. and don't expect someone to yell that at the state of the union, where the president is expected to again push civility. in fact, democrat's call that rather than sit apart, republicans and democrats mingle, is gathering some support. john mccain has sign on. so while everybody is talking about talking nicer, will we actually see a change in washington's ways? >> there's a sense there's going to be a change in tone but not a

tomorrow afternoon, and looks like a dry week ahead. you can see the central valley fog socked in, and it just lingered across the north bay, out towards the delta area, not a lot of change tonight. the dense fog advisory in place until 11:00 tomorrow morning. slow going if you're going to work. i know it's a holiday, but if you have an early flight, be advised, expecting visibility less than a quarter of a mile. lows tonight, 43 for santa rosa. 46 san mateo. 43, livermore. 45, antioch. and, folks, the high pressure is over us, going to bring us that sinking air. so any fog is being smashed to the surface. tomorrow, better news, as the high builds, we'll get a northerly wind now, and that will scour out the fog. so mostly sunny conditions after the morning fog. notice the high pressure kicking the jet stream well to the north, and that's going to stay
