chase what matters. just four more times. ♪ the 10-year-old disappearance a los gatos woman took a turn when the last person to see her alive was shot. the man on the right, maurice nazma was charged with murder after spending two years in jail though, those charges were dropped. lilian kim is in the newsroom with more. lilian? >> terry, police say this is a case where the brother took matters into his own hands. he was the only suspect in the murder case. 1k3* now -- and now with his death we may never know what happened to her. >> maurice long maintained his innocence, that he had nothing to do with the murder of

janeen harmes. last night at the shopping center, harmes' brother, wayne sanchez, accused nasma of killing his sister. the two ran into each other at the red robin restaurant where the confrontation occurred. >> we have information that makes us believe the suspect was uh-huh cues 8 tore toward the victim. >> he was already gone. he was headed to the pete's coffee nearby. >> the suspect followed him and they had a second conversation. at this point we are not sure what the conversation was about, but the suspect retrieved a handgun and shot -- fatally shot the victim. >> reporter: bystanders -- >> bystanders called nip-1-1 and then more gunshots. sanchez was in the parking lot when he shot and killed himself. members of the los gatos police department who investigated the murder case took the news hard. >> this is simply a terrible tragedy that because of events that took place at the beginning of 2001, the sanchez

family lost two children and now the nasma family has lost one of theirs. >> nasma was the only one charged with the murder of janeen harms, although her body was never found. he was one of two men drinking with her the night before she disappeared. yet, despite having found what investigators say were key carpet fibers in the car, charges were dropped. a technician said he failed proficiency tests. now it is unclear what will happen to the murder case. san jose police are trying to figure out if harms' brother was stalking nasma or if the two met saturday night by coincidence. >> that's something we always look into whether an incident of this nature is premeditated or if it is something in the heat of passion where they just run into each other and the suspect was upset and retrieved a gun. >> the 10th anniversary of when janeen harms disappeared is coming up in july. before the murder-suicide, her

family was trying to think of a way to bring renewed attention to the case. lilian kim, abc7 news. >> thanks very much. a stunning development out of oakland tonight where police chief anthony bets has told officers he may be leaving soon to take the same position with the san jose police department. an oakland police spokesman said he confirmed he is one of two finalists. the other is chris moore. mayor rondell lums lured him in october of 2009 with promises of full city support. it wept from 800 officers to -- it went from 800 officers to 660. and last year officers agreed to $9 million in concessions, but far rougher in oakland says the president of the police officers' association. >> it has been a tough economic crisis, and there is a level of politics he was not prepared for. maybe that's why he is looking. i also think during his time,

i don't believe he was given the opportunity to exhibit some of the things he wanted to do as far as getting the proper resources and funding. >> they say morale on the force is low, and a number of officers are also looking to jump to other departments. the san jose city officials say they hope to make a decision on their new chief by next month. four people have been found dead of apparent carbon monoxide poisoning in their home in the town of oak hurst near fresno. police say the family was using a gas-powered generator to provide power and heat to the home after electricity was turned off. officials say lack of ventilation allowed the carbon monoxide to flow through the house. a woman living in the home survived and police say it may be because she went out for a cigarette. concord police are investigating an accident that killed a woman and a dog tonight. police were called out to avon avenue just before 6:00. they found a woman pedestrian down on the street. she died of her injuries.

a dead dog was found near the woman. police don't know if the dog belonged to her. police are questioning a driver. there is word tonight that federal authorities have planning to move the trial of the accused gunman jared lee loughner out of arizona. they told the washington post the trial would be moved to san diego for a number of reasons. one, the extensive pretrial publicity in arizona. two, san diego is not that far from arizona. and three, both the federal judge uh appointed to the case and loughner's attorney are based in san diego. one law enforcement official say it is going to happen, but it is a matter of time. meantime, congresswoman gabrielle giffords is breathing on her own after a procedure to remove her from a ventilator. she has been upgraded from critical to serious condition. doctors inserted a short tube into her windpipe to allow giffords to breathe more comfortably and allow her to speak. >> from a patient perspective, it is more comfortable and there is less sedation

required. she can participate in her own care and physical therapy. >> doctors say giffords has made gradual improvements all week. furs opening her eyes and lifting her arms and legs. doctors also inserted a feeding tube, and although they are optimistic, they are still cautious how far she hillary cover. the father of nine-year-old killed in the shooting say some of her organs were donated to a young girl in the boston area. christina taylor green was the youngest victim. he has no other details, but when he learned of the transplant he and his wife were once again proud parents of their little daughter. the deadly shooting was fresh on the mind of congresswoman lofton. the topic was immigration. there was a strong police presence as lofgrin spoke. she is a good friend of the

congresswoman. and said the suspect needed help. >> we need better mental health treatment. it is clear that young man had serious problems, and yet nothing occured that would allow his i will -- illness to be treated. as more political leaders called for toned down rhetoric and increased saville tee following the shooting, two senators are making a symbolic gesture. >> my colleague called for democrats and republicans to sit together at the state of the union. i called up tom after he did that and he graciously agreed that we are going to sit together on wednesday night at the state of the union. >> when senator schumer talks about tom, that is republican senator tom coburn. he will sit at the state of the union address on january 25th. schumer hopes colleagues in the senate follow their lead. along with the prestige hosting the america's cup in

2013, san francisco may be forced to move some high-profile tenants from their waterfront location. it appears 19 through 29 as well as 30 and 32. cecilia vega talked to some of the businesses that may be forced to pull up takes. -- stakes. >> the america's cup race is expected to bring in millions and some even say more than a billion dollars when it comes to san francisco in 2013. but it turns out what is good for the city by the bay isn't necessarily good for the businesses by it. from the pedi-cabs that cruise the embarcadero to the soccer players in the parking lot of pie rz 27 and 29. to mr.ed to's vin teeming -- mr. toad's vintage car tours. they are all on the waterfront that are about to begin a wild ride. the board of san francisco says as many as 80 businesses could be forced to move to make room for the regatta. but the san francisco board of supervisor president says they

shouldn't worry. >> the city absolutely values these businesses, and we are going to do what we need to do to assist some of these businesses in relocation. >> businesses like bowers limo seen and transportation are sitting on teams where they plan to hold a public viewing area for the regatta. >> i would love the america's cup to come to san francisco. but it could be brought here without a slash and burn approach to the waterfront. >> michael denny runs american wine distributors on pier23. moving out of his 2400 square foot space means a major headache. all of his business licenses are tied to his embarcadero address. >> i have about 65 licenses all over the country that are all posted to that address. if i move i have to move them all. >> but it is no laughing matter. the port of san francisco has yet to decide which of the 80

a soldier from danville has died in afghanistan. military officials say 47-year-old army major evan jmue died last wednesday in a noncombat-related insurance department. there are no other details available. he has been in afghanistan for a year and was supposed to come back home to danville in two weeks. >> he was a great man, a great father and when they first told me about when it happened i was devastated for his kids. i knew how much quinn and connor loved their dad. >> he is survived by his wife, leslie and their three teenagers. muldike served as a member of the national guard. changing gears, the story of the social network took home top prize. >> and the golden globe goes to "social network." >>" the social network" won

four awards including best picture, best director and best screenplay ensuring it oscar success. other winners include colin firth, christian bail who won best supporting actor in "the fighter" and best actress went to natalie portman for her role in" black swan" and "glee" won the golden globe for best musical/comedy tv series. many will get a new sound system to go along with the 3-d movies. richard hart reports on the drive to discover the 3-d sound. >> which comes first, the chicken or the egg, or is it the rooster? this is the tri-lemea. existers could not show movies until the con at the present time creator made them.

7.1 sound. so far only one movie has been shot and produced in 7.1 surround, "toy story 3". for theater owners who already have a 5.1 system installed, it is just a matter of two more speakers and a slight rearrange meant of existing ones. for dolby it is heading off competition in the home or theater and using a pig to beat the chicken or the egg. richard hart, abc7 news. and now the forecast. we were enjoying the beautiful view of the embarcadero. you can't even see anything there is so much fog out there. >> yeah. and i want to show you another view from the high definition golden gate bridge camera. a lot of mist and drizzle and some very, very dense fog. it is slow going tonight and most definitely tomorrow morning. i know it is a holiday tomorrow, so not a lot of folks doing that morning commute. and then if you have an early morning flight, you may want to get up sooner and check to see if that thing will take

off. here are the current readings. napa 48. 52 in san francisco. 49 in oakland. the fog is with you in antioch, 48 degrees. 48 in livermore. 51 in mountain view and 51 in san jose. here is a look at your highlights. we will continue with the dense fog advisory overnight. it will be very dense tomorrow as well. and then we should start to scour out a bit late in the afternoon. look for partial clearing late in the day. and tomorrow also is a spare the air day. overnight tonight, the fog is just going to keep us all socked in. it is very dense. it is mainly in the north bay from the golden gate bridge northward. and also toward fairfield and vacaville and toward concord 1k3* livermore valley area. and here is a look at current visibilities. less than a half a mile in novato and you can see much of the reduced visibility in the north bay, santa rosa, napa, fairfield, concord as well. less than seven miles

visibility. livermore, four miles. four miles in san jose. as it continues to develop overnight, of course those visibilities will decrease as well. the dense fog advisory is in affect until 11:00 tomorrow morning. it will take some time for this to burn off. much like we saw today. overnight temperatures, 46, san rafael and oakland 43 for livermore. san jose, you are not in the fog yet. overnight temperature tonight, 47 degrees. and really high pressure is building in. all weekend long it has been those easterly winds just pushing that central valley fog toward the bay as well as the coast. and a high pressure is going to keep the storm track to the north. count on a dry workweek ahead. mostly sunny conditions and by tuesday this high will really position itself over the bay area, and that will help to scour out some of the fog. so tuesday and wednesday look for warmer temperatures. a little more sunshine in our forecast. tomorrow though, 64 for san

the cal bears are going for a sweep of the state of washington. they get 17th ranked washington tonight at house pavilion. the bears are looking for the third straight win. fresh off his 30-point night. the pretty reverse and bears up two. later in the half the bears down 10. the steel and he will coast in
