in the news, an officer shoots someone at a traffic stop. suspending the search of a canal leading to the kidnapping of a four-year-old boy. >> 55 downtown, 60 oakland. the sun coming up at 7:20. >> good morning, everyone. thank you for joining us. i'm carolyn tyler. oakland police are investigating an officer-involved shooting that left a man dead last night. school district police made a traffic stop just after 9:00 near the intersection of joaquin

miller road and butters drive. they were patrolling that area because there was a dance nearby. a school district official tells abc 7 the driver tried to stab the police officer with some kind of tool. investigators say when the suspect reached force a weapon, a second officer fired into the car killing the driver. oakland police later recovered a gun they say belongs to the man. a female passenger was injured, taken to a local hospital. the officer was protected by his vest and suffered only minor injuries. a woman is in critical condition this morning after being shot by a daly city police officer in san francisco. investigators say the woman was shot after she backed her car toward the officer. it happened near the cow palace around 7:00 last night. officials say the woman crashed her car into a house trying to speed away from officers during a traffic stop. they say afterwards she reversed

her car toward police striking an officer. she was shot and rushed to san francisco general hospital. again, she is in critical condition. the officer received non-life-threatening injuries. police say the daly city police officers attempted to make that traffic stop even though they were in san francisco because the area borders the san mateo county line. a male passenger in the incident was arrested. divers are taking a break today from searching the canal leading to a kidnapping of a four-year-old boy. they downgraded that amber alert. the alert is now confined to the central valley and san jose. police say josé rodriguez, you see him here, snatched the boy from the arms of his grandmother last tuesday. thomas rahman has the latest. >> after five days of searching the canal near the town of patterson, divers have recovered

six stolen vehicles from the water. the car in which the four-year-old was abducted, a 2003 silver corolla is not one of them. >> that doesn't mean we're going to give up our search. it means there's still hope we're going to find him alive. that's always been our goal. >> last tuesday a local man reported he saw a silver toyota corolla with two people inside drive into the canal. that and fairly recent tire tracks where the witness saw the car is why searchers are using sonar technology almost nonstop in an attempt to determine if the car is in the canal. >> there isn't any reason to disbelieve him. he appears very trustworthy. >> he was abducted from his patterson home by an ex-boyfriend of his mother. the boy was taken from his grandmother's hands. >> a coworker of rodriguez at patterson frozen foods describes the man as odd. >> the fact that he was so quiet, never really spoke out and tried to talk to anyone. >> while deputies tried to understand the reasons for the abduction, they suspended their search after combing two miles of the canal. the only lead they have is the witness who saw a car enter this canal. there's been no trace of rodriguez or juliani. >> we're not getting anything. he's not making purchases with a debit card that he was normally using. >> the search will continue after search crews get some badly needed and well-deserved rest. abc 7 news. >> take a look. this is the license plate number on that 2003 silver toyota corolla believed to be driven by rodriguez. 6 hbw 445. if you think you see it, call

police immediately. a search resumes in the delta this morning for a san francisco man who's believed to have fallen from a fishing boat yesterday. the coast guard received reports of an empty 20-foot recreational break off big break in eastern contra costa county yesterday afternoon. the boat's motor was still in the water, food and fishing poles on board. the missing fisherman is identified as 51-year-old harry lee of san francisco. his truck was located in the parking lot of an oakley marina but he's still missing despite a search that lasted until about 9:30 last night. san jose police arrested a 17-year-old boy in connection with the shooting death of another teenager. police say the 18-year-old victim was riding a bicycle on story road friday night when at least two people approached him and opened fire. it is the 7th homicide in san jose this year. at least three of them are thought to be gang-related.

as lisa amin gulezian reports, san jose leaders are admitted they have a gang problem. >> in the neighborhood. >> everyone here has the same goal, to clean up san jose. a growing graffiti problem is just part of the bigger issue with gangs. >> is it hard to stay out of gangs? >> difficult. >> yeah? >> that's why the city organized this crime and gang prevention summit. it comes just one day after this gang-related murder at story and capital expressway. police say a17-year-old shot and killed an 18-year-old as he rode his bike. it's the city's 7th homicide since january 1st. >> we have it even larger in the past and been able to regain control of our city. >> you can't arrest your way out of this problem. >> the focus here is on prevention, intervention and

suppress. for the first time police are asking them to take a leading role in the effort. it's not just spiritual, it's also economic. >> they have facilities, they have the sweat equity, volunteers, mentors that come out of their parishes in large volume. that's what we need, more adult interaction with these dudes. >> this former gang member says adults are the key. >> when your mom and dad has to work all day and you got down time, the down time is when you're hangin' out in the streets and i just thought it was the right thing to do. >> olga madeira is here with her son. >> very concerned that the school he attends, it's going to be very tough for me to keep an eye on him. it's really highly populated with gangs. >> as part of the city's outreach, volunteers will c contact both the victims and suspects' families to help with services, finances and getting out of the gang life. lisa amin gulezian, abc 7 news. >> more progress to report in the recovery of arizona

congresswoman gabrielle giffords. her chief physician says she's even more alert. she says giffords is doing well with her therapy after arriving at texas medical center. >> moving, sitting, standing. the speech pathologists were there engaging her. through her communication, communication skill. >> he says it is too early to tell whether she'll be able to talk. giffords was one of 19 people shot at a tucson safe way two weeks ago. six people were killed, 13 others injured. the man arrested in the case jared loughner has a court appearance tomorrow. this morning the cruise ship that caught fire off the coast of mexico is expected to arrive in san francisco bay. the carnal splendor was packed with 4,000 passengers when their dream vacation turned into a

nightmare back in november. a fire knocked out the engines leaving the ship with no electricity, no hot water and overflowing sewage. the ship left san diego friday and is expected to be towed under the golden gate bridge around 7:30 this morning. it will be moved to drydock at pier 20 south of the bay bridge and that's where crews will make repairs. carnival hopes to have it ready for passengers by february 20th. still ahead, president obama works on the finishing touches for his state of the union address. what he'll tell the nation tuesday night. and the first straw poll for the 2012 presidential [ female announcer ] every box of general mills big g cereals can help your kids' scho get extra stuff. ♪ like musical instrents.

president obama is spending this weekend putting the finishing touches on the state of the union speech. he'll deliver it to congress and the nation on tuesday. this morning we're learning what the focus of that speech will be. here's abc's david curly from washington. >> i'm not finished yet. still workin' on it. >> but the sneak peek and the state of the union is obvious in one number: 9.4% unemployment. so the speech will be dominated by talk of jobs. >> my number one focus is going to be making sure that we are competitive, that we are growing and creating jobs not just now but well into the future. >> the president will also press for more civility and civil discourse. >> we gotta change the way we talk to one another. tone matters. words matter. >> it's a message the vice president and president delivered to democratic house members who are huddled this

hayward, no wind for you as well as livermore. but you notice we have dropped in some locations, santa rosa, fairfield and antioch with numbers 2 to 6 degrees colder with 9 degrees warmer this morning, oakland and half moon bay. so maybe even the windows open overnight. so clear this morning, breezy in the hills, sunny and mild this afternoon staying dry with minor fluctuations throughout the week ahead but this persistent ridge of high pressure is going to stay here, a pretty strong one, anchored here and allowing the storm systems to stay to the north and really nothing busting through this ridge. a few weak impulses will from time to time. and that will allow for a little more fog. maybe a little more wind. but that's about it. numbers staying in the mid to upper 60s throughout much of the week. tomorrow morning we could have patchy fog to start your workday. 49 in the sierra nevada with sunny skies in the afternoon.

california's straight treasurer says the state may have to issue iou's as early as april or may. state treasure says if lawmakers don't adopt a timely budget, california will run out of money to pay its bills. he says lawmakers need to act by the end of march. the state faces a $25 billion deficit. governor jerry brown has proposed more than $12 billion in spending cuts and wants to ask voters to extend temporary taxes in a june special election. mount diablo school district officials find out tuesday what a committee recommends for closing schools. the district finds itself in the rather unusual position of registering students for kindergarten at an elementary school that could be closed in june. the district is deciding which of seven schools to close to save money in the face of state budget cuts. plans to make that decision by last month were pushed back to give more time for a committee to make its recommendation.

2010 ended on a positive note for real estate sales, sales of previously owned homes kicked up to the fastest pace in seven months but overall however the national realtors association says last year was the worst in 13 years, down 4.8% from the year before. and take a look at here in the bay area. sales and prices were down in december in almost every county. karina rusk reports from san jose. >> robert is looking to downsize so he's starting the new year with an eye on both buying a home in san jose and selling. >> the -- being a seller is an uncomfortable position. there's not pressure for people to buy. >> he's right. home sales are down a little more than 8% in the past year. in santa clara county, there were 1646 homes sold in december. that's a drop of 14% from the

previous december. prices faired much better though, dropping just over 3% to 460,000. real estate agents say prices are stabilizing. gone are the days of wild appreciation and investors flipping homes. >> we're probably easing into a more normal market. people are starting to buy homes in terms of long-term thinking. >> many analysts are worried that the market still faces problems with the adjustable mate mortgages and a steady stream of foreclosures. >> one out of every three homes sold in the bay area last month was a foreclosure resale. many say there's a pent-up demand that's being squashed by lending practices that have swung to the other extreme. >> we have the ready, willing and able buyer. we have the ready, willing and able seller but we have to bridge the gap as to making loans easier to obtain for qualified people. >> robert is lucky. he's not worried about getting a loan but he is caught in the

middle, wanting to sell this property for at least $700,000 and buy for less. in san jose, karina rusk, abc 7 news. >> if you're sick and tired of waiting for weeks to get a doctors appointment, there's no some hope. a new law says you should be able to schedule a visit in two weeks or less. capital correspondent nanette miranda reports from sacramento. >> it's been horrible. >> like millions of californians, connie sanchez tries to get in to see her doctor as soon as she has a health issue but it's not that easy. >> people have to wait for long periods of time. that's ridiculous. >> 45 days was the longest i waited one time. >> california became the first to mandate that patients with hmo's and ppo's be seen in a timely manner within ten business days of making a call for most appointments, 15 days if it's to see a specialist. one study of the los angeles area found new hmo patients

waited an average of 59 days for an appointment. >> often that ends up clogging urgent care centers and emergency rooms because patients feel like they need to be seen. >> the mandated time frames took seven years to develop. doctors were worried about not having the flexibility to move appointments around for more urgent cases. in the end, it is health insurance plans that will be responsible for tracking wait times and suffering consequences if they don't comply. >> we want the doctor to be the quarterback of medical care, not the insurer and not the government. these regulations strike that balance. >> sanchez will be starting a new job soon with different health insurance. she is excited being able to see a doctor right away. >> if that's the truth, we can actually do that, wow! >> managed health care has the authority to issue cease and desist orders and tracking consumer complaints closely and

auditing health insurers to make sure wait times for a doctors appointment do go down. abc 7 news. >> a perk enjoyed by muni drivers in san francisco is supposed to change this month but it hasn't. the drivers are fighting to keep their free parking. now, you might think it's a double standard since you pay for parking but drivers feel they deserve it. muni drivers aren't feeling the love. >> just about every day we're under attack. it's terrible. >> first voters overwhelmingly approved prop g in november which means their second highest in the nation salaries are no longer guaranteed. then in december they did not receive their traditional $3,000 year-end payout. >> we're not being treated fairly at all. i don't think so. >> but so far in january, they've gotten a big break. this month they were supposed to start paying for parking in the bus yards and other muni property. $80 a month. that would bring the

cash-strapped agency a half million dollars this year and more than a million next. but that hasn't happened. even though it flies in the face of the city's transit first project. >> i don't think it's fair to pay for projects downtown if we're not going to ask that of employees as well. >> the union says it's more complicated for operators that work odd hours and often come from outside the city to drive the buses. >> easy to say but coming out with the logistics. >> the muni board of directors was to put in place fines for those who continue to park for free but decided instead to reexamine taking away the freebie. >> i have no indention of backtracking but there might be something we haven't considered. >> he believes the parking perk should be part of upcoming negotiations between the city and muni drivers. this year will mark a historic first. >> the whole playing field for bargaining has changed with the

passage of proposition g we'll be negotiating wages, work rules and benefits. it is a new day. >> those labor negotiations are scheduled to begin soon, and the muni directors are putting the paid parking plan on hold indefinitely. tomorrow morning road crews plan to close a section of the great highway again. city crews will relocate shifting sands that could pose a hazard on a section of road at lincoln way. they will trim vegetation from the medians to improve visibility. the roads will be closed one week from 9 a.m. to 3 p.m. daily. this time last week we had visibility problems with the fog. it was so dense. >> yeah. like you couldn't get rid of it. well, no fog in the area this morning. we're talking about wind in the higher elevation but right now placid and nice from our roof camera. the sun coming up at 7:20, 50s

there are walking tours between 11:00 and 4:00 and cake is even being served. the pier 39 sea lions have become one of san francisco's biggest tourist attractions. there were 1700 at one time but some mysteriously took off a year and a half ago. fewer show up now. i can remember back when they first came, a lot of the businesses around there wanted them to go away. they thought they were disrupting business. >> yes. >> they're a hot attraction now. >> definitely. nothing hot, just comfortable. >> nice! >> very nice out there. we're looking for another nice day. this is the view right now from tam. beautiful shot. 7:20 is our sunrise, 5:23 it sets. we had higher elevation wind and that should allow that fog to blow on in here except there's no fog in the central valley or by the delta. it's down in the san joaquin valley. the winds transporting the

her story. >> children playing in the school yard once again becoming the afghan way of life. the 1979 soviet invasion then a series of wars practically ended the system. major nina is a reservist. her mission to rebuild the entire education system in the province from setting up schools, purchasing desks to establishing a basic curriculum. as the u.s. military secured the area, parents began feeling more comfortable about sending their children to nearby schools. with the help of afghan community leaders, she has worked to convince parents to invest in their children's education. >> at the end of the day the kid needs to know how to read, right?

if you want to build anything in this country, you've got to build the literal population. >> she has been successful. in just nine months four new schools have been added and the number of students has gone from 200 to 1,000. with girls in the mix. >> so this is a little success story. 40 girls sitting side by side afghan boys is a big deal. >> some of her training and ideas came from this school, middle school in san francisco sunset district where she was a teacher and on track to be a principal. her colleague jen silverman remembers her tenacity. others follow her accomplishments through her blog. >> to me it's overwhelming but for nina it seems -- it's what she does. she comes in with hope to change. >> dimatto is set to return to san francisco in march but she will still have ties to afghanistan. she is on the board of an

this is a live look from our ballmer cam showing you mount diablo. looks like the sun is just beginning to rise. beautiful shot there. thank you for waking up and spending part of your morning with us here at abc 7 news. surfing the web and clicking on websites can sometimes steer you to places you never intended to go. one woman clicked on the wrong site and wound up buying something she did not want. here's michael finney with her story. >> carol decidedto splurge on a season pass to great america in santa clara. her sister's family had just bought passes and besides carol is a big fan of scary rides. >> i like it. need to be a kid for a day again. >> carol went on google, typed up great america and up popped this website. in minutes she was able to pay and print out this voucher good for immediate entry to the park. and then the plunge.

>> i was kind of shocked when they told me the ticket's no good. >> when she arrived at the gate, the attendant said her pacquiao no good and if she wanted to use it, she'd have to go to chicago. >> for a few minutes i was taken aback trying to figure out how i ended up with a chicago ticket. >> when she googled great america, she clicked on the first website. it led her to great america but the wrong one. this park is not only located in chicago, it's owned by a different company, sixflags. >> great america has changed ownership and i assumed the owner was sixflags. >> it does make reference to chicago but it's way up here and carol said it looked like an ad. her receipt and voucher said nothing about the park's location. >> i had no idea there was a great america in chicago. >> now, chicago is a fine town but carol said it's a little far away. so she contacted sixflags saying she'd made this mistake but the

company said all sales are final. >> i understand the policy of not wanting to give refunds but it was a complete error, obvious error so i thought they should make an exception. >> we took the case to sixflags. the company said its website is clear, to purchase a pass, customers must click this box which confirms the location. however, sixflags says management made an exception in this case because it appeared to be an honest mistake by the consumer. and sixflags provided carol with a full refund of $77.09. >> i will definitely be double-checking what i'm purchasing online. thank you so much. i appreciate what "7 on your side" has done for me. >> the santa clara park has changed hands several times. to set things straight, it's now called california great america. this story is a good reminder many companies have similar names and search engines sometimes lump them all together so check before you click. i'm michael finney, "7 on your
