four-year-old boy. >> good morning. waking up with flurries in our north and east bay valleys. mid to upper 40s elsewhere. partly cloudy, cooler today. >> thank you, lisa. thank you for joining us. good morning, everyone. i'm carolyn tyler. a federal report is revealing new details about a 2007 tiger attack that's been kept under wraps until now. it was christmas day 2007 when a tiger at the san francisco zoo attacked three young men. 17-year-old carlos sousa was killed. documents obtained by the associated press revealed the tiger was probably provoked into jumping and clawing out of her enclosure. vic lee covered the story when it happened back then and has more now. >> a tiger expert who investigated the fatal attack wrote that tatiana, the female siberian tiger, must have been provoked to jump from her enclosure. chris austria agrees.

>> in order for her to have been agitated enough to jump out of her enclosure she had to be really taunted by the individuals. from the café if you turn the corner and make a right, you go down here and that's where the tiger exhibit is. >> austria is a veteran tiger trainer that's worked at marine world and the san francisco zoo. he read the report and has viewed pictures used by the investigators. they show her claw scratches 50 feet below the north wall, more scratches on the top and blood smear on the sidewalk outside the tiger grotto where tatiana killed carlos sousa. >> to jump up 12 1/2 feet and pull herself up, it's an outstanding feat that is very, very unusual. >> the siberian tiger killed sousa and injured his friends, brothers, on christmas day,

2007. the tiger leaped out of the grat tow surrounded by a mote and that 12 1/2 foot wall that was lower than federal safety recommendations. the report says after tatiana sat with the body of sousa, the tiger likely followed the blood trail about 300 yards outside a zoo café where she resumed her attack on one of the brothers. police finally shot and killed tatiana. sam singer who is a zoo spokesman in the aftermath of the tiger attack says the report vindicates his clients. >> this would never have happened if the brothers and their young friend hasn't enraged the tiger. >> the attorney for the sousa family says no matter what, the zoo is still at fault. >> it should have been their priority and their obligation to keep that tiger in the enclosure no matter what people did to it. >> after the attack, the zoo built a new and taller enclosure in the tiger grotto. vic lee, abc 7 news.

>> muni is investigating an incident in which pepper spray was released in the entrance to the powell street station. two children and four adults had to be hospitalized. the incident shut down the station about 15 minutes around 6:00 last night. two other children and two adults were also sprayed but did not need to be hospitalized. so far muni officials don't know who's responsible or why they sprayed the chemical near the turn styles. the body of a man has been recovered in a canal. a positive i.d. should come later this week but investigators say the body matches the description of the suspect who kidnapped a four-year-old boy last month. abc 7's thomas roman reports. >> the body was found floating in the delta canal by a water district employee at about 8:30. the county sheriff says the body closely matches the person they've been searching for since january 18th. >> our team responded, our

detectives responded and recovered the body, that of an adult hispanic male. the clothing and physical description matches that of our suspected kidnapper. >> the suspect is josé rodriguez. he kidnapped the boy january 18th by snatching the boy from the boy's grandmother's arms. the empty toyota was pulled from the canal last month. the mother showed relief the ordeal she's been living through is finally over. >> i was relieved. and i was just thinkin', you know, about his mom and hoping that she's okay and tough enough to deal with this. 'cause i know what it feels like to lose a son 'cause i lost mine, too, in all this. >> cardenas wearing a t-shirt with julianna's picture on it says she's making sure the baby girl never forgets she had a

brother. she says now that she knows her ex-boyfriend has been found and can no longer hurt her, she can rest. >> we all have our peace now because we don't have to worry about anything else bad happening. >> an autopsy is tentatively scheduled for tuesday at the coroner's division. positive identification will be made through dna, evidence on the body, or dental records. i'm thomas roman, abc 7 news. >> oakland police are searching for two suspects after a high-speed chase injured an innocent driver. one suspect driving a green chrysler led police on a five-minute chase yesterday afternoon through east oakland until crashing into a gray buick at richie boulevard. the buick smashed into an empty store bursting into flames. a witness rushed to help the innocent driver. >> he wasn't bleeding a lot but you could tell he couldn't walk and couldn't stand by himself. so i took him to the hospital where he is now. >> the suspect's car also caught

fire. police say he took off leaving the other suspect, his family passenger behind. an officer helped pull her from the burning car, then she ran off. police searched the area for an hour but were unable to find the man or the woman. they believe he is armed. tomorrow is valentine's day, one of the most popular days of the year for weddings. and once again same sex couples in california will be denied marriage licenses under proposition 8. the voter-approved constitutional amendment which bans same sex marriage. dozens of same sex couples plan to hold a sit-in at san francisco city hall tomorrow morning to protest. last august federal judge vaughan walker ruled prop 8 unconstitutional denying equal treatment and due process but his ruling remains on hold while prop 8 supporters appeal. to egypt now. troops and civilians are working

side by side today to clean up cairo's square after 18 days of clashes and anti-government protests. the military is eager to reopen the roads to try to get the country operating normally again. leaders of the protest that toppled egyptian president hosni mubarak's 30 year rule are debating whether they will continue to occupy the square. many say the military-led government will make way for democratically elected civilian leaders. >> egypt was back again. and the army, they think will be okay. >> some continue to celebrate the victory of pushing mubarak out of power. others are taking part in cleaning up the square, which is deeply symbolic of their desire to clean up the government and take ownership of egypt. coming up next, a conservative

second consecutive year. mitt romney finished second with 23%. meanwhile some gop heavy weights lagged behind. for example, newton gingrich finished fifth with 5% of the vote. former alaska governor sarah palin 3% and former arkansas huckabee just 2% of the vote. major figures gathered in washington to find their choice to run against president obama. mississippi governor hayley barber was extremely critical of president obama saying his economic policies have been more hostile to job creation he says than any other administration. >> now after his policies have contributed to unemployment rates stuck at 9 plus percent for almost two years, suddenly president obama and the democrats are paying lip service to job creation. except this time they call their spending investments rather than

stimulus. >> barber is considering a run for president. so far no republican has officially launched a 2012 campaign. tomorrow the obama administration will release its budget plan for 2012 and is expected to include both cuts and the so-called investment project. one of those projects, a high-speed rail which directly benefits california. president obama wants $53 billion for high-speed rail over the next few years. california plans to build 800 miles of track between san francisco, san jose, fresno, bakersfield, l.a. and orange county. the stimulus already provided $8 billion for high-speed rail but republicans are trying to push that back trying to revoke $2.5 billion of that. meteorologist lisa argen here now to tell you what you need to know about the weather aheed. >> everyone heard it's coming. a change in our weather pattern. today starting that change with

>> more orcas have been spotted just a few miles from san francisco bay. a whale watching group spotted a pod of them swimming about 10 miles from the golden gate bridge yesterday afternoon. that same tour boat got a glimpse of more than 10 killer whales in the same area between the golden gate and the fairlawn islands. they got a special street when 14 orcas pulled up alongside the boat. >> and they were spread out over about 200 yards in a line just traveling. and exhibiting some playful behaviors like slapping tails. they're very curious so some why coming to the boat and watching us as well. >> not unusual to see killer wales off the monterey coast but the captain said he'd never seen that many off the coast of san francisco. >> something we haven't seen in a while is definitely headed this way. >> yep, that's right.

this first one a weak one. that's tomorrow. a little rain, much more rain to come tuesday and wednesday and much colder. as we head outside, mount tam looking pretty nice. the official sunrise 7:02, 5:46 it's setting. that gives us 10 hours and 44 minutes of daylight. looking at numbers today as much as 5 to 8 degrees cooler. we've got high pressure, persistent ridge beginning to fade away today. it's 33 napa, your upper degrees since last hour. 33 santa rosa as well as livermore with upper 40s mountain view and san francisco so a big temperature spread. not talking about any fog. some areas obviously of clear sky. that's why we've dropped off so much and some pretty good frost this morning. it's going to be a cold start with a few more clouds. we will warm up today to above normal but not as warm as we've been. more clouds today, we'll call it partly cloudy and the rain arrives tomorrow favoring the north bay.

this is just the first system. heavier rain coming our way later tuesday into wednesday. here's our satellite and radar composite with the clouds sinking further south. still high pressure in control though but focusing to the north and west where much, much colder air is poised and it will begin to slip a little further south with each day, and the parent low will stay to the north and west. little pieces of energy headed down our way. actually one moved through yesterday, and today another system -- well, later on today into tomorrow will bring the chance of rain and favoring the north bay, not much. about less than a half inch in the north bay and elsewhere, maybe a tenth but by late tuesday we've got the winter storm warnings up and some significant rain. so here we go with monday afternoon. light rain in the south bay, in the east bay and more moderate rain in the north bay.

but look what happens later on on monday. still in the green, the lighter green. but into tuesday and wednesday, look at the sierra nevada, 5 feet of snow the end of the week. but with each successor system, talking colder systems and i think the biggest rain maker will come midweek and end part of the week for the bay area. still some showers but our significant rain looks to be perhaps tuesday, wednesday. high temperatures today, 65 santa clara with 67 campbell. san mateo coming in at 64, breezy. those west winds are back along the coast low 60s. the sunset district partly cloudy, 61 in the north bay. instead of low 70s, how about 67 calistoga. berkeley 64 as well as newark and out over the hills, we see livermore 66. the monterey bay, another day of golf here with low to mid-60s. even cooler at our coast but 62 at pebble beach and our look

♪ welcome back, everyone. you may be in for an unwelcome surprise when you file your taxes. you may owe more than you thought. that's because a key change in the healthcare law, a benefit that helps young people but may cost their parents. abc 7's capital correspondent nanette miranda reports on an effort to change that in sacramento. >> the federal healthcare reform law brought relief for thousands of california parents last fall. it meant they could continue

providing health insurance for their adult children up to the age of 26. judy pipkin of silicon valley enrolled her daughter on to her husband's health plan even though it cost more to add an extra person. >> and we're not rich but our children need health insurance. what are we supposed to do? >> as californians are preparing their income tax returns, many of those parents are learning they now have a bigger tax bill. the state considers employment contributions to the benefits of non-dependents an income. it pushed them into a higher bracket and increased their tax liability. >> our taxes are high as it is and we can't even claim our daughter on our taxes. >> assemblyman is championing a proposal to exempt them from taxable income like they are on federal taxes. a similar proposal happened last year. >> we want to make sure as parents continue to work hard, continue to have their children

on as dependents they're covered and not penalized. >> there's not a formal opposition to the proposal yet but the parents do have to pay more taxes, the state would get a $12 million windfall. families like the pitkins hope they pass the exception as soon as possible, otherwise they might be forced to make a difficult decision. >> yeah, we were totally shoc d shocked. >> nanette mir canada. >> health agencies of san mateo county are getting the word out all 7th to 12th graders need proof they've been vaccinated against whooping cough to return to school in the fall. there's a new law that requires proof of the booster shot that covers whooping cough, tetanus and diphtheria. the only exceptions are parental personal beliefs and medical reasons. the boosters are now required for students of middle school age. the number of whooping cough

cases in san mateo county has gone from just ten in 2009 to 183 in 2010. the state is experiencing the most severe outbreak since the 1950s. governor jerry brown's easing overcrowding in state prisons could create a crisis for local jails in the bay area. gr greg monk says they will overflow. the san jose mercury news says such a transfer would increase the inmate population by 40%. he says it could force him to release some prisoners. san mateo county jails are already 120% of capacity. a popular addition to children's parties will be outlawed in one east bay city. we're talking about bounce

houses. last week walnut creek voted to ban them. at the heart of the debate is the permit process. here's heather ishimaru. >> the ubiquitous kids' party bounce house is now allowed in only four of 17 public parks on hard surfaces only, not on the grass, with a $40 permit. budget cuts mean there are no longer enough people to handle the permit applications. 42 permits have been issued since they started to be required two years ago. director barry gordon decided the city permits were necessary after park grass was damaged and realized vendors needed liability insurance. >> once the inflatable was taken down, spikes would be left behind. where the kids would go to the bouncy house, the turf would be troddened down because a lot of people were going back and forth. >> other cities get around the permitting hassle by limiting inflatable use in parks to a list of prequalified vendors.

legally. it's the night before trash pickup in the south of market neighborhood, and the recycling bins are being raided. ricky arcoli sent out this youreport video he sent out earlier this month. it infuriates him to see people stealing recyclables from his bin. >> we love recycling. i do. but 100% of my efforts are going directly into the hands of people who i'm not doing the work for. it was going to the city, great, but it's not. >> fewer bottles and cans for the ecology company to pick up and sell is set to ultimately cost consumers about $5 million a year. much of that comes from organized rings. our viewer says this truck picks up the ripped off recycles on his block. >> so it really helps offset increases in your garbage bill in future years. but if that material is stolen, then that money is stolen with it. >> stealing recyclables is illegal and state and local

penalties are as much as $2,000. the district attorney's office recently put out a news letter calling it the issue of the months. for many neighborhoods, it's a quality of life issue with noise and litter. one strategy discussed is reducing the cash incentive. supervisor scott weiner is considering posting a change in state law to offer vouchers for food and other products. >> basically you're saying these folks are using this money for -- to buy drugs or alcohol? >> some people. i'm not saying that everyone does that. but there are some people -- we've seen it in the areas around some of the recycling centers. some issues around the alcohol abuse and drug dealing. >> ed dunn runs a recycling center and is critical of the proposal to swap cash for food. >> the vast majority of people might want to use that money for

along the san mateo county coast, some big wave surfers are hoping a serious accident last month may ultimately make them safer. they're pushing for improved rescue capabilities. wayne friedman reports what they want and why there's so much resistance. >> it's the case of a near death giving an issue new life and multiple voices. >> it was a miracle! it was an absolutely miracle what happened with dave! >> that's mother of jacob. he's the surfer who nearly drowned last january 22nd. he's alive today because a photographer on a jet ski saved his life, an illegal jet ski we might add, and that's the rub among surfers around here. >> there should be somebody out there approximate when there's big waves out there at any

height. >> now the catch 22 because maf vic's break it the national marine sanctuary, the place where it's illegal to operate jet skis except a designated high surf day or the ski is involved in a rescue. january 22nd wasn't one of those days. >> you can't be in a position to rescue unless you're there but our breaking the law -- >> you're not in danger if you don't go out into dangerous waves. >> got an earful from local surfers and environmentalists that hope for a compromise. the committee takes the position it's business conservation, not rescue. the surfers want a certified force that keep their jet skis out of that water. >> nobody should break the law to save a life. >> it's all a waste of time. it seems like come on, everybody! let's just get it together arecognizing your limitations, recognizing you're taking a risk also has to be factored in.

we're trying to be reasonable about this. >> reasonable that they are talking and apparently listening. >> we got what we wanted it we wanted them to open up and say the word volunteer. we wanted to organize a volunteer rescue team that we already have actually but we want it to be legit. >> there is however no timetable for a next step. from princeton by the sea, wayne freedman, abc 7 news. >> the window for this year's contest closes at the end of the month but organizers are hopeful that the competition will be held. so far this year the waves have been less than stellar according to contest organizers. if the surf does kick up, 24 invited surfers from all over the world will be notified and given 24 hours to arrive at the half moon bay surf spot. insufficient waves prevented the contest in 2007 and 2009 but last year they had the most massive waves ever. the surf swept up some of the

cloudy skies this morning. and pretty cold. clouds and cooler today. we'll have a partly cloudy afternoon with temperatures in the 60s. no more 70s. you saw low 70s from santa cruz to santa rosa yesterday. today as much as 5 to 7 degrees cooler. the rain arrives tomorrow favoring the north bay. here's the setup right now. we're still under a weak ridge of high pressure but the clouds beginning to increase along the north coast. and here is the setup. a cold front is offshore. a big area of low pressure, lots of cold air to the north and west poised to swing on through here. the main rain should come in by tuesday into wednesday. and that's when we're gonna see a lot of snow. some gusty winds as well. today though notice underneath the ridge, the jet stream still to the north. we'll see partly cloudy skies, cooler conditions. here's the time line on the rain. by tomorrow morning, some light rain in the north bay. and then by the afternoon, 1:00,

there's a growing new wave of discontent with the california dmv. people all over the state complaining about huge delays in getting their licenses renewed. one young woman in venetian has been waiting months to get her first one. here's 7 on your side's michael

finney with her story. >> behind the wheel there, that's rachel brown. for a young driver she's doing great. she knows the rules of the road, she has a car, now all she needs is a driver's license. >> i am 16. but i've been 16 for seven months now and i still don't have my license. >> it's not for lack of trying. she went to the dmv, passed her test and got her picture taken. she was called back weeks later by the dmv and needed to take the picture again. she was told to wait 4 to 6 weeks when the license still didn't arrive, she called the dmv which said it needed another picture. and another month goes by and still no license. here's rachel's dad. >> the last time i called and they checked the status, said, sir, your december 14th trip to the dmv, the picture is processing. i said, okay, good but what does that mean?

we want to get a permanent license. they said you have to call the dmv in sacramento. >> so they did and they called me. i went to sacramento looking for answers. >> if she had to come in and take her picture three times, that is very, very rare and i really don't know why that happened. (laughter) >> three pictures is out of the ordinary, but a long wait and an expiring temporary license is not. here's the problem. new hi-tech driver's licenses. delays began last year and in recent days complaints to the "7 on your side" office have increased. still the dmv insists things are actually going better now. >> the vendor that makes the driver's license identity solutions was having start-up issues because of the complexity of these driver's licenses. so a little delay and a little backlog. they're starting to get things more rectified and the backlog less and less.

year. >> because i make fresh, i can't start in december to stock up. i work really long hours the last two weeks. >> one thing you can experience is the aroma. you have to be here. and you can find his chocolates in specialty shops around the bay area. he says he's keeping it small. and ironically, his shop is right next-door to a weight watchers. in oakland, don sanchez, abc 7 news. >> that's not good. since tomorrow's valentine's day, you can expect to see feathers flying in san francisco's justinterman plaza. it is time for the 6th annual san francisco pillow fight. thousands gather in the evening each year in front of the ferry building. they quietly wait for the clock to strike six and then it is just madness. it may look like fun but it ruffles the feathers of san francisco's department of public works. no one has ever taken out a required permit and the cost of cleaning up those tinny feathers runs about $35,000 each year.
