>> in the news this saturday morning, april 16th, protesters are camped out in vallejo this morning trying to keep an indian burial ground from being developed. and authorities from east oakland are investigating a murder near the eastmont mall shopping center. good morning, we have partly cloudy skies outside our studios. temperatures in the mid 50's but clouds will be flirting with the north bay and rain arrives for

everybody sometime this weekend. i'll detail that for you coming up. good saturday morning, everyone. it is 6:00. thanks for joining us. native american demonstrators are continuing their protests this weekend over plans by the vallejo city government to convert what they consider sacred burial grounds into a park. they are camping out at vallejo and they say they won't allow construction to take place here. >> about two dozen native americans and their supporters are occupying the 15 acres they consider a 3500-year-old sacred burial site. they want to block any machinery attempting to change this area. norman "wounded knee" deocampo is a miwok. >> no, sir. we don't want nothing to be built on top of our sacred site. a toilet atop of a sacred burial site, i don't believe they would put a toilet on top of their ancestors. >> the stand-off between members of various california native american tribes in vallejo is

because the greater vallejo recreation district wants to develop glen cove raw parkland by the carquinez strait into a park area with a parking lot, benches and restrooms, the native americans say they've been fighting the district for 10 years in order to keep this area just the way it is and not disturb an ancient ohlone grave site. corrina gould is an ohlone. >> i have direct ties to this land, yes, my ancestors are here. i feel their presence here. >> the greater vallejo recreation district says it wants to preserve the site. the district plans on covering the burial site with more soil to prevent any disturbance to remains and crews will take out invasive species and return to what it may have looked like 3500 years ago. native americans have filed a discrimination complaint with the department of justice against the grvd. general manager shane mcaffey could not go on camera but gave us this comment. if the department of justice finds gvrd has done something wrong or illegal, we'll take care of it. we have worked for 10 years with state, federal and local groups who have jurisdiction as well as

native american tribes that are the most likely defendants of the area. >> many times, the most likely descendent isn't actually a person that can lay claim to this traditional area and territory. >> members of many different local tribes are buried here. one group should not speak for all. shane mcaffey says that the gvrd has complied with every regulation regarding culturally sensitive areas like this one including making sure that restrooms and a parking lot are well away from any suspected grave sites. the department of justice will act as a mediator between native american groups and vallejo at a meeting on monday. in vallejo, i'm toma roman, abc 7 news. >> in other news this morning, there are reports of another homicide in oakland. the death stems from an incident that occurred about 2:00 this morning on 73rd and halliday avenues. authorities said an unidentified person was dead of multiple gunshot wounds on arrival at highland hospital in oakland. if confirmed as a murder, this would be the 31st homicide in

oakland this year. the investigation into yesterday's deadly caltrain accident continues this morning. a woman from indiana was killed when her car got stuck on the tracks. video from sky 7 hd, the incident caused major delays at the height of the afternoon rush hour in palo alto. police say the car was hit in the intersection of charleston road and alma streets. the woman who was driving wasn't able to get out in time but her husband did escape from the passenger's side. 400 people on board the train were evacuated and caltrain service was snarmed for over two hours. a muni driver has been fired after he reportedly kicked passengers off his bus. this is surveillance video from on board the 24 line last saturday. a woman says the driver kicked her off the bus after she asked him to open the doors for her husband. just one stop later, passengers say the operator kicked the rest of them off when the bus experienced mechanical problems. muni officials reviewed the on-board surveillance and

concluded it supported the passenger's accounts. there's more improvement in california jobs market. the unemployment rate dipped to 12% in march. the lowest figure since september of 2009. march marks the third straight month of declines for california's jobless rate according to the employment development department, 2.2 million californians were unemployed. down nearly 80,000 from a year ago. a report released yesterday by beacon economics says unemployment in the bay area will likely not return to presession levels until 2015 and adds that san francisco and the east bay are on a slow but steady recovery. one woman whose job search ended with two offers says she is starting to see signs of improvement. >> i've been encouraged by the nature that people are still calling. people are still e-mailing me. will you fill out this application? we're interested in this and that, you know, position for you and -- >> breaking down unemployment by

county, morin has the lowest rate at 8%. san mateo has the third lowest unemployment rate followed by san francisco at 9.1% and santa clara at 10.3%. stanslaw county has one of the highest unemployment rates. alameda county stands at 10.8% and salono county has a 12.3% unemployment rate. if you still need a job, the next abc 7 job journal hire event is scheduled for tuesday, april 26th at the hilton garden inn in emoryville. and now to the federal budget battle. president obama has signed a compromise spending plan that congress approved on thursday. it keeps the government running for the next six months. then yesterday, house republicans roared back and passed a 2012 budget plan of their own. it slashes core programs like food stamps and medicaid. it replaces medicare funding with payments people can use to buy their own private health insurance instead.

not a single democrat voted for the plan and it's not likely to pass the democratic controlled senate. but house republicans say they are sending a message that it's time for congress to get serious about slashing the deficit. the calendar says april 16th. you have until monday at midnight to get your taxes done thanks to a little known washington, d.c. holiday, taxpayers have until monday to file 2010 returns for both federal and state taxes. emancipation day commemorates president lincoln's signing of the 1862 law freeing slaves in the district of columbia. it was made an official d.c. holiday in 2005. but because it falls on saturday this year, federal workers got yesterday off so this year's tax deadline got pushed back to monday, april 18th. facebook ceo mark zuckerberg was among the guests at a community party in pineville, oregon, to mark the opening of his company's new data center there. that's near bend, oregon. zuckerberg told a crowd of about 300 people that the custom-built

data center will be a green operation using 38% less energy to do the same work as the company's existing facilities. until now, facebook's data centers have been operating out of a leased space at other locations. still ahead, security video shows them grinning as they make their getaway. we'll tell you about the unusual loot taken by some east bay burglars who so far have only been caught on camera. also, a south bay family to find the driver who put a 15-year-old girl in a coma. and we are going to update you on that severe weather that's been ravaging southern and midwestern states in the u.s. dry mouth is uncomfortable. it can also lead to serious dental problems. abc 7's lisa galegan reports. >> this is one of the few nights those closest to shea shaw are feeling a sense of excitement. >> the prizes, the auction, this dinner is all in honor of this 15-year-old who remains in the hospital out of a coma but still minimally responsive. >> i can't tell you how it is, it's like walking through a nightmare and you can't get out of it. >> the nightmare started january 8th on south bascam avenue. this gas station surveillance video captured it all. shea was crossing street with some friends after a party when suddenly a car slammed right into her. the driver kept going. >> you can see it's very, very disturbing to see the victim fly over the car. >> san jose police are making this case a priority. but detectives have no leads.

>> so traumatic and to know that it was a hit and run, whoever does that. >> still at top of mind here is raising money, lots of it because the medical bills are piling up. the family says the system is pushing shea out because she's not improving fast enough. > >> she now is just starting to open her eyes. >> shea has a few days before she has to move out of valley medical center. before shea can even leave the hospital, a lot still has to happen. her mother is in the process of moving to a one-story home with wheelchair access. new floors have to go in and a special bed still has to be delivered. and none of it comes cheap. the goal is to raise $20,000. in san jose, lisa galegan, abc 7 news. >> shea's family has set up a web site with details about her case and how to help and we have a link on our web site at abc7 news.com under seen it on tv.

more residents of a san jose neighborhood are saying they, too, have been threatened by free roaming pitbulls. that follows the mauling of a woman and her dog in the park. the dog had to be put down. the pitbulls ran off and haven't been found. people using the popular park say off leash pitbulls and pitbull mixes are responsible for several recent scares. >> they had me cornered in the park and they were just standing there ready to attack me. >> you have a small dog, too, and there's times i've had to throw him in a trash can to protect him or put him on the top of a car. >> san jose animal officers are patrolling the area looking for the tan pitbull and a larger black pitbull mix. both responsible for thursday's attacks. the weekend is here. so is lisa with our forecast. >> looks pretty good out here and we have some sunshine around the bay area but the clouds aren't all gone. we have low clouds at our coast, you can see them and the stratus, but also a few high clouds and a cold front is getting awfully close.

>> at least 16 people are dead this morning as tornadoes and vicious storms continue to strike the southeastern united states. the severe weather moved from arkansas and oklahoma into mississippi, alabama and then into georgia where strong winds and heavy gusts toppled trees and utility poles. huge tree limbs and poles blocked roadways sometimes crashing on to the roof of a vehicle. electricity was knocked out in some areas and some homes and businesses were damaged as well. we want to check on our local forecast and some changes could be on the way by the end of the weekend, right? >> that's right. we're still talking somewhat cool weather in parts of the bay area but elsewhere, numbers are coming up and we're seeing some sunshine. this is our roof camera. so we do have a few clouds, the low stratus hanging around but we also have a cold front that's to the north of us. but because of the cloud cover overnight, we are looking at mild temperatures. a couple of days to a full moon out there. so you may notice the moonlighting up the bay over the weekend. definitely kind of a pretty

sight with temperatures this morning very mild. 52 in san francisco. 50 napa and santa rosa. so our highlights, mild weather over the weekend. light rain arriving tomorrow night. continuing into monday morning, everyone should see a little bit of light rain. and then it will be over. opportunity for rain next week. satellite and radar composite. the rain has stayed to the north around crescent city and eureka but this frontal boundary will eventually sag to the south over the weekend. not today. it looks like tomorrow. we'll see some clouds favoring the north bay and maybe a few sprinkles. high pressure is going to stay around over the weekend, though, and allow for dry weather. in fact sunnier weather for san francisco south and east. we'll put the timeline in motion for our computer animation and this shows by tomorrow night, the clouds on the increase and we'll look for some showers by

10:00 sunday night, san francisco into the east bay, the delta into the overnight hours, a better chance to rain. the front doesn't move through until early monday morning and then with it, we'll see the possibility of more showers and by mid morning on monday, should be over with and we'll see some sunshine. highs today, look at the heat in southern california. 91 in los angeles. 91 in palm springs. contrast that to cool, cloudy rain in eureka. 55. in between, we have some sunshine in yosemite. 71 there with 65 in monterey. so along our coast, cool but we will see numbers climb into the low 70's today in the south bay so that is a little bit above normal for san jose and campbell today. you'll see some clouds especially along the coast with upper 50's to low 60's here. san francisco, partly cloudy skies. average highs around normal with 66 but in the north bay, more

francisco. one of my favorite cities in the country. i heard you talking a minute ago about our lead story this morning, the hectic night of weather in much of this country. violent storms tearing through the deep south overnight. tornadoes have been reported in several southern states, even as far north as illinois, trees toppled, houses destroyed as twisters howl through towns. death toll is on the rise this morning and our weather team has been tracking this extreme weather all night. we'll have the latest for you coming up in about 40 minutes, as you said, plus gas prices are going up at a higher rate than ever. five states now averaging $4 a gallon. record-breaking numbers are due as early as memorial day which, as you know, is one of the busiest driving weekends of the year. we'll take a look at whether this is just the beginning of a rough ride for drivers that upcoming summer and then some new clues this morning in the search for that woman who was taken from her home by a man in camouflage. our lindsey davis is on the ground in a sleepy town in tennessee with the latest on a developing story and this is a fun one. if you've ever dreamed of owning your very own country, here's

victor martinez there. brian fuentes comes on for the save in the ninth. trouble! hangs a breaking ball. where's the one guy that you can't offer a hittable pitch because he'll do that? ties the game at one with a home run and the roof caves in with the tigers scoring seven times in the 10th. brandon bosh drives in a pair. a's rally for three in their half. the tigers go on to win it. l.a. kings center jared stole did not get whistled for a penalty in game one of the playoff series with the sharks but the nhl made sure he would pay the price for the blatant hit on ian white. is y suspended for one game. stole smashed white's head into the glass. white needed help just to get back to the locker room. he probably suffered a concussion although the sharks do not confirm the extent of injuries especially in the playoffs. white is not expected to be on the ice for game two and could be out much longer with a head injury.

only at denny's. >> welcome back, everyone. good news this morning on california's recovery from the recession. the state's unemployment rate has fallen for the third month in a row and stands at an even 12%, the best number in more than a year and a half and california is outpacing the rest of the country in creating new jobs. morin has the lowest rate. san mateo county has the third lowest unemployment rate at 8.4%. followed by san francisco at 9.1% and santa clara at 10.3%. abc 7 capital correspondent nanette miranda has more on the state's slowly improving outlook. >> it was discouraging and, you know, i got some rejections.

>> erin has felt the pain of this recession sending out resume after resume on line. >> you go screen after screen after screen and you just and then submit and then you hope. >> but there are some encouraging signs from california's new unemployment numbers that suggests companies are beginning to hire. despite the loss of 11,000 jobs last month, the jobless rate dropped a bit. for march, the numbers stood at 12%, the lowest figure since september 2009. that's 1/10th of a per lower than february but less than 1/2% lower from a year ago. some of that drop shows that more people are getting hired. in the last year, california gained 188,000 jobs. small when compared to the more than a million jobs the state lost during the heart of the economic downturn but it's a start if we're truly in a u-shaped recession. >> we're seeing an average of 26,000 a month over the last six months. that's big news and, in fact,

it's even better than what we're doing on a national scale. >> and more people working is great news for california's deficit ridden budget. revenues are already $2 billion above forecast. >> making more money brings more in terms of income taxes. if there's people that are making more wages they can go out and spend more so more sales taxes and they're spending, that means more corporate taxes. >> but this small job growth isn't happening fast enough to erase the remaining $14 billion deficit. it may, though, mean fewer budget cuts as more taxes keep coming in. after receiving multiple job offers, erin will soon be one more californian contributing when she start her new job next week as an executive assistant. >> yeah! i'm really excited. i got on with a really good company. they're a worldwide company. i'm making more money than i've ever made in my life. >> despite the positive signs, 2.1 million californians are still out of work and as the government sector deals with deficits, any job losses there could drag down any gains.

in sacramento, nanette miranda, abc 7 news. >> if you still need a job, the next job journal hire event is scheduled for tuesday, april 26th at the hilton garden inn in emoryville. even those fortunate enough to be gainfully employed are finding their paychecks aren't buying as much as they once did. now the government confirms that american consumers are feeling pinched at the grocery store and definitely at the gas station. the consumer price index is now at its highest level in more than two years. abc's jim avala shows how that's hurting economic recovery. >> americans already spend one out of five of their hard earned dollars on food and gasoline and now the surging cost to eat and drive is putting an even bigger hurt on the family budget. >> it's expensive. everything is expensesive. >> dorothy ward with a growing teenage boy at home in suburban los angeles spent $400 at the supermarket today. and that's with coupons and cutbacks.

>> produce, i noticed, has gone up. like i went to go buy watermelon and it was like whoa! i'm not spending, you know, $20 on a watermelon. >> it's a double whammy. squeezed at the grocery store and on the way to it. gas prices up nearly 28% over the last year. food prices increased twice as much as all of last year. jumping the most, beef prices with a double digit increase. tomatoes also a huge spike. and coffee, that skyrocketing price of tomatoes even led to a string of thefts in florida. six entire tractor-trailer trucks stolen before they reached market. and outside charlotte, north carolina, gasoline thefts. the target -- rental trucks. their fuel lines cut and tanks drained. >> that will cost a little over $100 probably to fill each one of these trucks up with fuel. >> just how desperate are the rest of us? this morning in seattle, washington, drivers lined up for hours to score free gasoline during a radio station giveaway.

one man, his car apparently bone dry rode his bicycle to fill up gas cans. economist stuart hoffman says the one-two punch of gas and food price hikes pinches consumers and forces cutbacks on everything else. >> see that maybe apparel sales, clothing sales, eating out won't be as strong. >> that was abc's jim avala reporting. many analysts expect food prices will come down and oil prices will stablize by summer. one of arnold schwarzenegger's last acts as governor is again stirring up controversy. schwarzenegger commuted the sentence of estoban munoz, son of a former assembly speaker. it's a decision that the governor has refused to discuss but made a rather unexpected comment on it in l.a. abc 7's leigh ann melendez reports. >> good morning, govrer in. how are you? >> don't ask me the same question, ok, because you're already boring the hell out of me. >> well, i think a lot of people want to know. why did you reduce the sentence

for estoban munoz. >> he refused to answer the question and instead made snoring sounds. when she heard that, the mother of the victim was irate. >> it's outrageous. it just makes me so mad. a person that has no soul to abuse power and try to get away with it, it's just unbelievable. >> in 2008, santos, a college student was walking with friends on the san diego state campus. when they stumbled upon munoz and three others. he did not stab santos but admitted assaulting the others with a knife. the former assembly speaker's son pleaded guilty to manslaughter and assault in exchange for a reduced sentence. they each got 16 years. at the 11th hour, then governor

schwarzenegger reduced the sentence by half. santos family is suing the former governor. in addition, they are supporting a bill that would require the district attorney and families to be notified when a governor considers reducing anyone's prison terms. >> district attorney would have fought for our case. >> right. >> we didn't have any say so because they snuck it through at the 11th hour, last day of his office. quietly signed it around 4:00 p.m. and nobody got a heads up about it until, i think, it was january 2nd. >> that bill is 8648. it's cleared the assembly appropriations committee. the last hurdle before a vote on the assembly floor. in the newsroom, leigh ann melendez, abc 7 news. >> the f.b.i. has shut down the three largest on-line poker sites in the u.s. charging the owners with bank fraud, illegal gambling and money laundering. 11 people are charged including the owners of poker stars,

absolute poker and full tilt poker. in order to circumvent laws connected to on-line gambling, the f.b.i. says the poker sites relied on what's called payment processors. they created shell companies to disguise payments to the poker companies. the phony web sites included on-line flower delivery shops, pet supply stores and jewelry stores to handle credit card payments from u.s. customers. well, change is on the way! lisa has the forecast. >> yeah, not a big change today. more like tomorrow. but i've been hoping the shot would -- isn't that gorgeous? right sandwiched in between the low clouds, the bay bridge. isn't that gorgeous? so we have the stratus out there and above a lot of sunshine. that's officially up about five minutes ago. how far will we see? how warm will we get? when is the rain coming? i'll have all the answers. >> if you want to improve your memory, you might want to go on

napa. our highlights, then, mild weather over the weekend with light rain arriving, the chance of it anyway for everyone tomorrow night into the monday morning commute and then it will be over with. but still, cooler temperatures are on tap for much of next week. here's our satellite and radar composite. we had some active weather to the north yesterday. eureka and crescent city. today, you'll notice a few spri sprinkles to the north. it's this area of low pressure that will be sagging to the south tomorrow. you can see today, the warm front is to the north of us. our high pressure ridge holding on for the entire weekend. but it will be weakening tomorrow and as it does, that will allow the area of low pressure and the tail end of the cold front to sweep in through the bay area. so by 5:00 tomorrow, we're cloudy and by about 9:00, the chance of rain moves into sonoma county, san francisco, also the peninsula, san mateo county through the overnight hours, some light rain.
