>> in the news, barbara boxer announces her plans for keeping gas prices from spiraling out of control. the libyan government says n.a.t.o. air strikes have killed several members of colonel moammar gadhafi's family, including his 29-year-old son. >> good morning, skies are cheer, the winds are calm, temperatures are cooler this morning. it will be warmer this afternoon. >> thank you, lisa. good more than, everyone. thanks for joining us. i'm carolyn tyler. we begin with developing news in oakland where firefighters have been battling a spectacular residential fire this morning. flames shot high into the sky as an old boarded-up victorian burned at 32nd street and martin luther king way. the fire started around 2:30 and destroyed that old three-story apartment building.

fire crews just got the flames under control about two hours ago. no victims were found during a nato search of what's left. investigators are now starting to look for the cause of that fire. senator barbara boxer is offering a plan to try to keep gas prices from soaring due to wild wall street speculation about possible future shortages. she announced the plan to take away some of the profits that speculators make by bidding up the price of oil. abc7 has more on politics at the pump . >> i think the supply and demand and profit and the bottom line is profit. >> david is visiting from washington d.c. from d.c. is where president obama in his weekly addressed called for the end of $4 billion in tax subsidy being given to oil and gas companies. will oil and gas companies are

making huge profits already, the tax give aways aren't right. they aren't smart and we need to end them. >> exxon reported almost $11 billion in profits for the first four months of the year. senator barbara boxer slammed oil speculators, blaming them for the gas at the pump. >> speculation adds between $21 and $26 a barrel. that's a fifth of the cost. >> she said the rules need to change. >> so by cracking down and saying to speculators, you can't just put down five dollars on a one hundred dollars, you have to put down 50% in order to make this bet. >> tom is the vice president of the california g. o. p.. he said blaming speculators is wrong. >> speculators exist in all markets. it is obama's failed policies. that is the problem here, not the market. >> kelsey boxerman said she doesn't know anything at all about the political gun play.

>> i don't know the direct cause, i guess. i just thought it was related to all the chaos in the middle east and everywhere else. >> republicans blame obama's economic chaos. >> the price of gasoline has doubled under obama because he shut down gulf oil and the policy at the epa are driving up the price. >> analysts say high gas prices are affecting the country's economic growth and president obama's approval ratings. they say the solution is to drill more as well as. -- drill more wells. >> take a look at this. an average gas prices are inching up in the bay area. the average price in the san francisco area 4:30 a gallon. still 32 cents from the all-time hire. $4.26 in san jose and you see in oakland $4.25. a penny higher in these three locations since friday.

>> governor jerry brown has confirmed he underwent surgery to remove a cancerous growth on his nose. he had the procedure friday after tests revealed a slow growing form of skin cancer known at basal cell carcinoma. all cancerous cells were removed but some reconstructive surgery was needed on his nose. his office said he won't make any public appearances until the stitches are removed, which should be in the next week. basal cell carcinoma is the least dangerous form of skin cancer. in oakland police are investigating a shooting that sent a man to the hospital last night. he was shot just before 9:00 in the 1600 block of eighth street. the man was taken to the hospital in stable condition. police have not made any arrests but they have two suspects. investigators say one was armed with a gun. there was a protest against violence in oakland yesterday. [chanting]

>> members of several oakland churches marched in front of jimmy's nightclub where two people were shot and killed a week ago today. several others were injured. it's just a block away from the police station. demonstrators want to change the mindset of people. >> they are used to hearing about murder on the street. that's why we made it a mission to stand at every location where there has been one committed so that they see the other side of that. >> group leaders say poverty is a major factor driving crime up in oakland. they are encouraging neighborhoods to work together to combat violence. n.a.t.o. air strikes have killed several members of gadhafi's family. his youngest son, his 29-year-old, and three of his grandchildren were killed when a

bomb struck their home. abc chuck seifertson has more on the attack and reaction to it. >> the nato missile struck the one-story house in tripoli, killing his son, three grandchildren and wounding other relatives and friends. gadhafi was in his home in tripoli when the bomb hit, but he and his wife survived. the strike comes just days after reports that n.a.t.o. is expanding its targets to get closer to gadhafi. predawn strikes saturday inflicted heavy damage on buildings in the capital. at the time he was nearby appearing on state television saying he was ready to negotiate and calling for a cease-fire. n.a.t.o. rejected his offer and stepped up attacks. they also refused to negotiate, demanding gadhafi and his son step aside. >> the time for compromise has

long past. too many victims have fell. there is no solution that involves he or his family. >> they have warned the rebels to lay down their weapons or face continued onslaught. the siege has been going on for over two months. chuck severson, abc news. a rate hike is in for anthem blue cross policyholders. the price hikes will be almost 15%. the department of healthcare issued a report calling the increase unreasonable. the first time they have done that. anthem blue cross say the state regulator approved the rate hike. coming up next pope john paul ii is now a step closer to sainthood after pope benedict in beat guys him in pilgrim scared.

alabama. this morning a million faithful catholics cheered outside vatican this morning at they beatify pope paul ii. >> pope john paul ii from this moment on be called blessed. ♪ with that pronouncement, the late pontiff moves one step closer to possible sainthood. it's the fastest beatification on record just six years after his death, beating out the beatification of mother theresa by a few days. most journeyed all the way from poland, john paul's homeland. the beatification also delivered a wave of protests from victims of the church sex abuse crisis that occurred during john paul's 27-year-old watch.

last summer he tried an experiment using these contraptions called water boxes. they cool at night, pull moisture from the air and use it to irrigate young plants. it's the same process you see here when cold liquid in a glass condenses water from the atmosphere. the results have been surprisingly good. >> all this, the trunk, you can't see in here was last year's growth. the green leaves are this year's growth. the things are popping. >> the water boxes or not expensive, just $25 each. twenty-five dollars to irrigate this vine to maturity. but there's another advantage. they make the vines work for a living. >> work to go get the water, work to get the nutrients, and it's got to work to produce fruit. when we have a vine that has to work to produce fruit, what we get is a more complex and complicated flavored wine. this is the brainchild of petr hof, a dutch man who visited the

napa valley last year. >> back then he told us he can grow crops in the sahara desert even. >> actually what people forget is all the water we see travels through the air. >> as part of the experiment he took acorns from the old oak trees and used water boxes to grow new ones. they are working too. >> in an area where we don't have water, we are trying to get trees established in a cheap, easy way, the water box fits perfectly. >> imagine that, a resource agriculture can use just about any where and it's all right there in surprisingly wet air in a field of old vines and a new trick. from napa county, wade freeman. abc7 news. >> another nice day on tap. is it going to be warmer than yesterday? >> ah-ha. like you said, we skipped right over spring. feeling like summer today. big changes from yesterday. we won't have the wind and we have a cooler start out there. as we look outside, the golden gate bridge looks nice. the sun officially up at 7:14 and setting at 8:00 tonight.

lots of warm weather to enjoyed to. the coast will still be cool. a little bit of a breeze out there. changes come as early as tomorrow. but, you know, we will be working at some conditions around the bay staying pretty much the same. i'll get to that in just a moment. that would being the inland spots with less wind throughout most of the week. then we are going to see temperatures really climb as we get to the middle of the week. 36 half moon bay. good 20-degree spread. 44 redwood city and from yesterday, yeah, we are definitely cooler out there from fremont, in san francisco and a little warmer here. but you get the idea, the less wind the air mass has more time to cool off and those cool temperatures, cool air settles into the valleys. so we are going to look at some rapid warming at high pressure brings a nice, dry air mass today. much of the week we will feature temperatures warmer than what we've been used to.

here's a look at our atlanta and radar come positive where high pressure at the surface and the upper levels of the atmosphere really dominating much of california's weather. so it's a clear start. temperatures will warm rapidly today with another three to six degrees of warming. so more 80s popping up in our east bay valley, even get to go sonoma, perhaps napa with 60s at our coast with a north wind today. tomorrow more of a sea breeze. we have a weak system to the north that will offer a couple stratus areas to develop along the coast tonight. statewide 78 in big sur with fresno upper 70s, mid-60s in the southern sierra with 86 in los angeles. definitely the warmup statewide. then we will see this weak system push to southern oregon. as it does the clouds stay well to the north. so does the rain. a little cooler at our coast but then we will see full sunshine

and numbers mainly in the 60s again tomorrow. temperatures today mid-and upper 70s from santa clara to campbell. 78 here. mid-60s that replace the 50s and the blustery wind yesterday. today more of a northerly wind. 76 redwood city. san francisco average highs in the upper 60s and today is 74. we will be above average today. it's 79. 81 in calistoga. near east bay, wow, big warmup in oakland at 78. 77 fremont. into our valleys, 80 danville, as well as concord today. monterey 70 there and 82 in gilroy. so more warming today. a little dip tomorrow but you will probably just feel it if you are spending time at the coast with the sea breeze. we will go back to warmer conditions tuesday and wednesday and cooler as we head into next weekend. but we are looking dry and above normal for the next several

welcome back, everyone. after debate, one of the trendy food trucks was in this area. customers seem to like the mobile food vendors but some neighbors and merchants, not so much. >> it has a catchy name, docks of the bay. it serves burgers and comfort foods near a park in emeryville. but gaining a foothold in san francisco is a challenge. the owner's application for seven locations are all being contested. >> looks like we are in for a long process. and it might be even harder than we think. >> new rules enacted in march make it easier to apply for a permit and to object. one spot with docks wants to

locate is in this district. >> i support the trucks. as long as i think it's well vetted by the city's permitting process and the neighbors have their abilities and concerns to be aired and merchants. >> john, the owner of john's drill in union square said a food truck wants to roll up on his street. he's concerned about traffic and competition not for his fine dining establishment, he says, but for the small cafe. >> there are a lot of other little businesses in this area who pay, you know, 30, 40, $50,000 a month and someone can come in and be able to rake in the profits. >> i think the reality of the competition is there's space for brick and mortor and trucks. he's with los kasita working with low income she was, including trucks. >> financial assistance allowed a mexican food truck to open in delores park this weekend.

>> we got permit and my dad road a cart for these people that manage the neighborhood and the parks. so it was a little complicated. >> and because of some neighborhood opposition, that truck will eventually move from inside the park to curbside. last year oakland-based blue bottle coffee backed out of plans to operate in the same park because of the backlash. in capitola, the city is moving toward shutting down a mobile home park that was swamped with floodwater in the powerful storms in march. here's what they looked like at the height of the flooding. now many people may be forced to move. the story from abc7. capitola has owned the mobile home park property for about 30 years. >> sidney jackson has been here 40 years.

>> i thought i had seniority over everybody, but i was wrong. there were two ahead of me. now sidney and his neighbors face the prospect of moving when a drainage pipe broke on the 24th and sent water through the property and into downtown capitola. the city says it would cost $1.9 million to repair the damage, while relaxing the 26 full time residents would cost roughly $1.4 million. >> even if the city made the investments to bring the park up to code, the park would remain in the flood plan. the council was worried about the long-term. >> many residents say the city neglected the property for years and the flood is simply a good excuse to close the park. >> it's their property so, you know, they can do what they want and it looks like they are going to do what they want. >> capitola city leaders say any final decision is six months away. the flood damage is so

extensive, many homes are still off-limits. sidney just got back into his place last week. ann got clearance today to return home. >> until the city makes some suggestions for alternative housing, i think i feed to wait and see. but in the meantime i am trying to settle down and get back to my normal routine. >> if and when the formal decision comes to close the park, they will have another problem. 89-year-old sidney jackson. >> i told them that's the only way you are going to get me out, pick me up and throw me out on capitola avenue and i don't think the law will allow that. >> the city said if indeed the park shuts down, it will be at least a year before people have to move out and people like sidney who have been here a long time and are full time residents would be compensated more than someone who has a mobile home here for vacation use. abc7 news. commercial salmon season opens today. it's unclear whether any of the fishing boats will actually go

out because of the rough seas. local fishermen are hoping this will be a normal season after three years without a decent catch. but there is concern because sportfishing boats haven't had much luck out there. the season was virtually shut down three years ago because of a record throw salmon migration to the sacramento river. so it was pretty windy out there yesterday. >> yes, and this morning very little wind. in fact, it's calm by the coast but further out we have the small craft advisory. but we are looking at cold temperatures, the 30s at the shoreline. take a look at this, the nice low sun area shows august the vibrant color there, the golden gate bridge. pretty saturated this morning with color. we will look for a lot of sunshine today. that will warm us up. i'll tell you how much next. >> that is a pretty picture. also ahead, find out how to prevent your spring allergies

the spring have millions of allergy sufferers struggling right now. it's bad enough the california optometric association is offering advice for patients to protect their eyes. here's our health and science reporter, carolyn johnson. >> as spring days go, it's a good one for ramona. this time of year she usually suffers allergies so severe she has trouble getting out of bed in the morning. >> i have really itchy eyes, i get a film over them when i blink. some mornings when i wake up they are kind of stuck shut and i have to use compresses to get them open and look up. >> she turned to a san francisco optomotrist, elio. he said chronic itching can be associated with more severe complications. especially when patients are rubbing their eyes." it's especially common among children with dirt and other germs on their hands. >> there are risks of infection or spreading infection if they have a bacterial or other type of problem.

>> the association recommends cold compresses or ice cubes to reduce the itching and swelling, then a sterile saline solution to wash the eyes. and finally preservative-free eye drops that sting less. but they also recommend that allergy sufferers watch out for warning signs for more serious conditions. >> if there's no sign the itchiness is resolving, you should come in. sensitivity to light is maybe an inflammatory response. or if there is excessive discharge, if the child develops any fever. a new generation of allergy medications can be given to children as young as 2 years old. one recent addition is applied as an eyedrop. >> it's a new antihistamine that was fda approved. it's supposed to relieve itchiness within 3 minutes. the treatment is one ever several options now available by prescription. it had an immediate effect for ramone, which means she can function without the itching in her eyes.

and 37 in napa. so 24 hours ago much cooler out there. we had all that wind. waking up to temperatures 16 degrees cooler than you were yesterday in napa. 10 degrees cooler in fremont. you get the idea. we have a couple things going on. a ridge of high pressure is stronger and we are losing that wind throughout the afternoon and that's going to allow for rapid warming so a warmer day today. mild to warm next week with some minor fluctuations beginning tomorrow. today take a look at the satellite picture. i've wide ended it for you so you can see washington and oregon. you notice how large this ridge is because the clouds go up and over the ridge and being protected by the strong dome of high pressure. that will allow for a nice dry afternoon. starting out clear. no fog to speak up, with 3 to 6 degrees of warming, taking us up into the low 80s in our east bay valleys and perhaps

some of our north bay valleys as well, while we remain in the 60s here. the winds today out of the north. tomorrow we see the wind shift and that will cool us back just a the bit. across the state then we have 85 in palm springs. 54 in the sierra nevada. the winds have light ended up there as well. 80 sacramento, trying to warm up around you're reek kau as 63. the next system will stay to the north. for us we will wake up to a little bit of stratus, the low clouds and fog. with the return to the west winds will allow for a slightly cooler temperatures tomorrow but rebounding quickly by tuesday. 75 in santa clara, 74 today sunyvale. numbers about 3 degrees warmer in the south bay. peninsula, your numbers coming up as well this afternoon with 76. redwood city, upper 70s. still nice and mild here with 66 in the sunset district.

finney with what that means for customers. >> jan adams had big remodeling plans for her home in martinez starting here in her tiny kitchen. >> it was going to be changed into an l-shape, and that was a pretty expensive undertaking. hoping to save money, she bought a two year membership to direct buy, a consumer club that offers members wholesale prices on home improvement products. jan's membership was expensive, $6,450 up front. but she figured it would pay off in the end. >> the first thing i did was the oven and the cook top. >> jan saved about $250 when she replaced her oven and hood and the membership seemed to be working until she decided to put in new floors. >> went to the concord location of direct buy, and it was closed. >> the showroom in her area in concord had suddenly shut down. so jan went to the next closest direct buy store in fairfield. there she was met with locked

doors. >> fairfield was just gone like it never happened. >> direct buy in pleasanton closed down too. jan contacted the company and was told to go to the nearest showrooms but the closest ones are 70 miles south in mountain view or 70 miles east in rock land. jan said it's way too far. >> it's 140 miles round trip. that's half a day on the road. >> so jan asked direct buy for a refund for half her membership fee since she used just half of her two year term. direct buy refused, instead offering her home shopping through a catalog. >> they weren't providing me what i had thought i had purchased with my membership. >> jan's contract with the north bay franchise includes a membership guide with a guarantee that the showroom would have convenient hours. but it says nothing about what happens if the showroom shuts down. >> that's when i wrote to 7 on your side.

>> then we contacted direct buy's corporate office. weeks later direct buy offered to refund jan $2,700, roughly half of her membership fee. but she had to sign this agreement saying she would not speak with the media or anyone about direct buy. 7 on your side told direct buy jan had already spoke with us long before the refund agreement and, in fact, facilitated the agreement and now wanted to be kept under wraps. after that the company withdrew its refund offer and instead gave jan the opportunity to shop from home. that wasn't okay with jan. >> half my membership back. that's all i asked for. >> they declined our request for an interview. the spokesman did not comment when asked whether the company withdrew the refund offer because we are airing this story. the company said despite the closing ever the franchise direct buy location closest to her home, the same benefits

previously available to ms. adams and all of our bay area members are still available today. they, like ms. adams, have access to our state of the art website, as well as the ability to shop at our other club locations. ms. adams is also receiving the added benefit of our home shopping service, which is normally reserved for our highest level members and allows her to shop from the comfort of her home with the help of a home shopping agent. jan says she can't imagine buying new floors through a catalog. >> i feel in my heart that i'm right. i don't think i'm asking for anything i don't deserve back. >> direct buy says other bay area customers in the same situation with stores shutting down should contact the company about their memberships. now i posted all the information you need at abc7news.com. i'm michael finney, 7 on your side. >> up next the new installment of the fast and furious movie

i'm don sanchez, abc7 news. we will see you on the isle. well, it's may day, the 1st of may. but there's a celebration in oakland today for cinco demayo. there will be a parade starting at international boulevard and 35th avenue at 10:00 this morning heading through the fruitvale district. here you see the parade in 2008. since then eck land's festival has grown, attracting more than 70,000 people in each of the past three years. today oakland mayor, jean kwan, joins a council member in welcoming the council general of mexico for the important mexican holiday. it commemorates an 1862 battle with poorly equipped mexican soldiers successfully fought off a french army invasion. >> and the weather should be delightful for that parade. >> that's right. today warmer than yesterday but not the warmest day of the week. we will warm up further in the middle of the week. 80 in concord, 74 san francisco.
