in the news this saturday morning june 4th san francisco firefighter continues to fight for his life after a bad have. >> a man suspected of beating bryan stow the daughter speaks up and says they were not at dodger stadium. >> very strong weather and now we have reports of record rainfall and some of those records have been around for a long time. jeff martinez joins us. >> since 1934 we broke the

record for daily rainfall and also in oakland with more than half an inch of rain. many areas picking up three-quarters to an inch stretching all the way down to the south. so you can see light to moderate rain going on in most areas and heavy rain as we head further to the south. from salinas and down to the south, monterey bay we'll zoom in and coming down in santa cruz. we're expecting perhaps two to three inches of rain up in the higher mountains, santa cruz mountains and down in the lower valleys at least two inches of rain. slowly pushing to the east. now, here is the culprit. very unusual for this time of the year. we have a big ridge of high pressure but a huge storm system continues to push moisture into our area and it will be with us for the next 48 hours. we should get a little bit of break as the cold front moves through. hopefully the giants can get

their game off today but showers will pick up once again tonight. >> san francisco firefighter clings to life after being badly burned in a house fire that killed his colleague on thursday. flags are flying at half-staff to honor vincent perez that succumbed to the fire. now a report. >> the outpouring of support is everywhere a steady flow of sadness and kindness. it's all for anthony valerio. >> we try to do the best we can to save his life. >> they are keeping his medically paralyzed in order to help his breathing. if he moves a little bit it will injury his breathing. >> he is in a coma.

53-year-old inhaled hot poisonous spoke smoking which damaged his lung. he also has burns across 12% of his body. mostly on his arms legs and face. >> he still has no idea whether or not it's going to go one way or the other. >> valerio has been unconscious since they found him and perez in the hallway of the burning home. >> we're devastated. this is a tough time. fact to have one down and have one in the hospital in critical condition is hard to talk about. >> it's not easy. >> everyone has a black band. we lost a brother and we have one in the hospital. it's difficult for us. >> but most in public service know they still have a job to do. during shifts if they can't come to the hospital they visit station houses. >> the other firehouses and neighbors are offering coffee

it's touching. >> valerio's family are here from all over including los angeles and bakersfield. in san francisco, lisa amin gulezian, "abc 7 news." we're now hearing the audio from fire department radio transmissions moments after the two arrived on scene and went inside the burning home. >> we're working a working fire. >> we got an active fire -- >> that turned out to be the last radio transmission sent by lieutenant perez a small electronic alarm set off an alert that warned other rescuers that the men were in trouble.

they called 26 but said engine 20 it appears the veteran firefighters followed procedures properly. >> these are all very competent firefighters. great engine companies and truck companies. but it went horribly wrong, this is was a dangerous fire and they were being very cautious. >> there are two separate investigations into the fatal fire. one will review safety procedures and because the fire is not obvious an arson task force has been set up. the suspect in beating fan bryan stow will remain jailed on a parole violation but a hearing official found no evidence to

link him to that beating. his nine-year-old daughter tells investigators and reporters what he was doing when stow was beaten. >> reporter: the nine-year-old daughter of the ramirez says she was with her dad. they were not a dodger stadium and her father did not have a shaved head like the suspect seen in the composite sketch. >> he did have hair. he played around with me but he didn't want to listen. so he had cut the hair and then couple days later he shaved it. >> the fourth grader and the mother don't want to be identified on camera but ramirez daughter wanted to defend her father since the arrest.

the nine-year-old met with detectives on thursday. >> the mother says her daughter was not been coached on what to say except to tell police and reporters the truth. >> she was with her dad. ramirez remains jailed for allegedly violating his probably. a probably commissioner has found no probable cause to hold ramirez to hold stow for the attack but in time more evidence will be presented. >> the call was to bind him over for a full parole hearing that goal was met. if anybody thinks i am going to present a whole case -- >> police have until june 20th to build a case against him when he has full parole hearing on the unrelated gun charge.

saturday morning to you live doppler showing everybody getting a little bit of rain. up in the north bay cloverdale you've had half an inch. as we head down to santa rosa here in the city, as well. heaviest amounts has been down in the south bay. santa cruz mountains perhaps two to three inches of rain we're expecting tomorrow. another band off the coast beginning to move on shore monterey salinas and all these areas getting heavy rain right now. look at the storm system. we rarely see this. more of a winter type system. very big area of low pressure drawing up lots of moisture. its cutoff low that will be with us the next 24-48 hours. temperatures in the 50s. it could top off in the low 60s. rain is expected throughout much of the day with scattered showers this evening and again records falling everywhere.

the state controller is threatening to hit lawmakers where it hurts if they don't get a budget deal done in time. if you want your money make sure california gets its money. nannette miranda has the details. >> reporter: the state that churns out lawmakers paychecks could come to a grinding halt the controller is threatening to permanently dock lawmakers pay for every day the spending plan is late. he says he is following proposition 25 which voters passed last november. >> the voters make lawsuit clear if you don't finish the budget you won't get paid. >> reporter: last year it was hundred days late. at typical salary of $935,000 a

year they each lost almost $50,000. while eventually they got the money back when they passed the budget the new law forbids it. no retroactive pay. >> it ought to be their job. when folks do regular jobs don't do their jobs they don't get paid. >> no paycheck is worrisome. >> it's difficult for people who are trying to get by my wife and i are certainly in that category. >> will it be tough on the family? of course, it will, but not having a budget will be tougher on more people in the state. >> critics say lawmakers should not be put in a position to vote for a bad budget just so they can pay their mortgage. privately politicians told me a lawsuit is possible because technically a budget was passed by governor brown in march but it did not involve the entire

deficit. the law does not say the budget has to be balanced but the comptroller believes it does. >>this have to come to an agreement on the budget if they want to be paid. >> reporter: proposition 25 makes it easier to pass a budget meaning just a majority vote but because brown's budget keeps the temporary tax hikes going for five more years, it will be much harder. chuck reed has unveiled his final plan to close the $115 million deficit. his proposal would eliminate 600 city jobs. it would be cuts across the board and affect all dpts departments even police. that department will lose hundred positions despite leaders agreeing to a 10% pay cuts. the mayor projects an $80 million deficit in 2012. >> i want everybody focused on how we can avoid cutting

services to the public in 2012. that is big task but i think we have opportunities to allow us to achieve that. >> the proposal need to be approved by the city council. san carlos members are going to interview 11 applicants for city councilmember. a councilmember died of a heart attack and they have. >> candidates have wide range of business and experience. the council's appointee would participate in the election of a new mayor. >> palo alto is expected to approve a package of ordinances for stanford university's massive medical expansion. $3.35 billion project is the biggest development in the history of palo alto. it will modernize stanford hospital and add a million square feet of office space over 20 years. it's an idea that came up four years ago.

nearly 100 public meetings have been held and still critics worry about increase in traffic and noise and the need for more local housing. once approved work could start this summer and finish up in 2018. >> alameda county's busiest hospital has started a major renovation they broke ground on the new highland hospital. updated new front entrance and seismic safety upgrades. $668 million upgrade is the biggest construction project in the entire east bay. >> supporters call it a medical marijuana cawnabis dispensary but there is new one slated to open up right by a day-care center in the mission district. neighbors and parents are fired up. i'm in the business to help people. >> reporter: that is why dimitri wants to turn this doctor's

office into an alternative health clinic a dispensary for medical marijuana. he says he wants to be a good neighbor. >> it's going to be located in thes in of the building and single entrance. there will be a security guard and cafe will be located on the storefront in front of the building with outdoor sitting. >> the cafe in front and marijuana in back and neighbors up in arms. >> we don't feel it's appropriate business to put at this location. >> christopher passed out 500 flyers to his neighbors. there is already one three blocks away. >> there are so many pot clubs in one corridor. is that fair? you don't see one in pacific heights? you don't see pot clubs in other neighborhoods and they are all here. >> the planning commission approved it unanimously. there were no grounds to deny. >> it it's an alternative medical treatment that allowed
