a shooting in palo alto took the life of a two-month-old. they were leaving a baby shower when two men approached them and opened fire. both parents were also struck but their injuries are described as nonlife-threatening. the parents drove away from the scene in an apparent attempt to make it to the hospital. they only got as far as downtown palo alto where their car stopped on university avenue. we will bring you more as police release more information. oakland investigating the shooting of three men at oakland and webster. it was in the area between civic center and lake merit. two are hospitalized in stable condition and the other man is undergoing surgery. the incident happened about 2:00 this morning. police say it's not clear what prompted the violence and no arrests have been made. the rainfall yesterday is slowly becoming a distant memory today and hopefully a transition to a more june-like weather

pattern. lisa with the look ahead. >> good morning, everyone. we do have light rain out there. live doppler, and through sonoma and american canyon, the light showers return. very light rain further south in the santa cruz mountains. we will be look at a little more rain today. certainly not in the category we saw yesterday. oakland saw 1.47 inches of rain, easily shattering the record from 1983. and napa .91 and monterey over half-inch. we do have more rain to come. the area of low pressure will sweep through the bay area today bringing scattered showers, then it's out of here. big improvements in the weather coming up. the unusual wet weather comes as many outdoor activities

are planned around the bay area, of course. we set out to see if that's keeping anyone away. >> union street here in strand closed down at 6:00 p.m. but tracy was still loading jerky into his truck after 8:00. he said despite the early rain, his sales were great. >> it was kind of tough. a lot of people didn't want to come in. they were walking underneath the overhang. but by about 11:00, 12:00, it shut off and it was awesome. >> he was right. the union street fair attracted a terrific crowd even though a rain doused the city. seating was quickly taken up when the sun started peeking through the clouds. >> we are glad to be here today. it could be a lot worse with tornadoes everywhere, for goodness sakes. so a little rain won't hurt. >> the pigs were in their element with the rain and the mud. people who braved the rain got just as muddy as the hogs. events went on despite heavy rain. near the hogs there was ironically a barbeque contest

a diamond heights home earlier this week. lisa amin guleziam was at the hospital. >> slowly and silently his body , tony valerio's body, was wheeled to a waiting van. silence broken by the rain and his family's tears. >> he was, as i alleges say, my best brother ever. i looked up to him, and i just want to say he will be greatly missed. >> the pain hung in the air outside san francisco general hospital. a place that became a gathering spot for the hopeful. valerio's family and friends had been there around the clock since thursday. >> i can't even think about life without him right now. i don't know, it seems like he's still here. i can't rally quite process that he is actually passed. >> he and lieutenant vincent

perez were rushed to the hospital after the two were found unresponsive inside this burning house in diamond heights. a sudden blast knocked them down. perez died late thursday. >> it is particularly difficult. you are mourning the loss of one and then to have another one very close from the same fire is challenging. >> today for the first time valerio's doctors gave details about the uphill battle the 53-year-old faced, including the fact that he was in cardiac arrest the moment he arrived at s. f. general. >> between all the injuries he had from the initial blast, the smoke inhalation, the fact that he had rally bad lung injury, which was precipitated by what happened on the same, but we try to do everything we can. >> but in the end it wasn't enough. on this day the firefighters' two families, his work family, where even the most senior firefighters broke down, and his immediate family realized valerio's 40-hour-long fight to

survive was over. >> abc7 has learned the fire department and the families have agreed to have a joint funeral for both tony valerio and lieutenant vincent perez on friday at saint mary's cathedral n the newsroom, lisa amin guleziam, abc7 news. san francisco mayor ed leopold was among those who rushed to the hospital to support the family yesterday. he expressed their appreciation for their dedication and sacrifice. >> i would like to officially thank vincent perez and anthony valerio for their wonderful service to our city and all the residents of this great city. san francisco fire chief joanne hayes white said the fire department is now reviewing procedures and tactics used by firefighters on thursday to figure out what happened and if policies need to change. firefighters say a flashover killed perez and valerio and

that happens when it reaches super temperatures simultaneously and a fireball erupts. there are two investigations going on, one by the san francisco firefighters and one by a task force by the tobacco department of firearms and the contract district attorney's office. sheriff deputies are trying to learn more about human remains found in the santa cruz mountains. park rangers discovered the remains in a shallow, drive ditch friday while doing trail maintenance work. they are trying to determine the age and gender of the person whose remains were found. pg&e wants customers to know they will be conducting more pressure testing on gas pipelines today in san jose and in newark. it is scheduled to begin at san francisco in lafayette street and newark on cedar boulevard and thornton. they said the residents recently received letters

explaining the tests. it has been twice delayed to get word out about the tests. the gas in the pipeline was vented into the air last tuesday. coming up next, why intelligence officials say they have struck another blow to al-qaeda, and a volcano erupts in chile, forcing thousands of people to evacuate their homes.

rule. in chile, a violent eruption from a volcano is forcing 3500 people to evacuate. the volcano spewed ash more than 6 miles high. they are on alert after a series of earthquakes. there is an average of 230 tremors per hour recorded. the volcano is 500 miles south of the capital of santiago. lisa is going to be talking about the weather wishes is on the mend. >> that's right. we are backing up considerably on the rain today so we saw over an inch yesterday. richmond, oakland, san francisco, outgoing ties this morning. plenty of clouds out there. so when are we going to see the sun and warm up? well, glad you asked. we have a sunny outlook i think you are bogey to like coming up. >> and tony ross hits a home run the day the giants gave away his bobblehead. could the team get a win against the rockies? schuh has this morning's sports. these sweehoney clustery things have fiber?

couple minutes. you've heard so much about the state's budget problems and the effect on social programs, police and firefighters and the rest. but there's another casualty, oakland's public libraries are in serious trouble. as abc7 cecilia vaga reports, to deal with it the city may be force today take a drastic step. >> these faces from the past hanging in oakland's african-american museum and library might some day be a thing of the past. this institution is on a chopping block, a potential victim to oakland's budget crisis. >> here people come and they learn history of oakland. just not african americans, but the history of oakland. >> history, like the old black panthers' newspapers and a sweeping collection of books written by and about african americans. but this library is not alone in its potentially doomed fate. 14 of the city's 18 libraries may be forced to close to balance oakland's budget. >> it is just not about libraries, it's about how bad it is.

>> she said it's not a scare tactic but a reality. unless voters pass a partial tax or unions agree to a pay cut. >> but to save the libraries you have to save all the services. >> oakland's main library would stay open. but this three-story, 87,000 square foot building would be run with fewer than five employees. it now has 46. that means the children's reading room, a magnet for kids who often have nowhere else to go after school, would be forced to shut down. 90% of oakland's library staff would also be laid off, including children's librarian amy martin. >> we are terrified. we are rally terrified that all that work is going to go away and everything we've tried to do and bring to the community will just be gone. >> a frightening prospect for these librarians and one they can barely stand to imagine. >> where will they go to rally learn about african-american

cruz mountains, economist drizzle. want to give you a sense of the movement of the low. it's still sitting offshore. notice the rain bands a couple miles west of monterey. movement from the rain is from south to north. so it is going to back off considerably today but we are still going to see a lot of cloud cover out there and some hit-or-miss showers. 55 in red wood city, 57 in mountain view. scattered showers this morning with a few peeks of sunshine today. a chance after thunderstorm later on, and dry and warmer weather. that's going to begin as soon as tomorrow. so here is the look. it continues to anyone a counter clockwise fashion. the heavier activity in the san joaquin valley. we see the cloud cover continue to push on shore and with that we will see some scattered rain showers and a few peaks of sun. so this is definitely not out of the picture yet, but it's getting that way. t-)t(vúlook at the rest of cloud cover out there. we will

concord, livermore valley, a few areas of raindrops. but look what happens monday. the monday morning commute. a few light showers in the north bay and then many more breaks out there after a few light showers. we are looking at more in the way of sunshine and a warmer afternoon. that leads the way to rally nice-looking week. so the giants today, you will be under mostly cloudy skies. a few sunny breaks. a chance of showers. temperatures in low to mid-60s. it definitely will be cool out there but we are look at the southeasterly winds, 10 to 20 miles an hour. the forecast for the rest of the bay area then, the scattered showers, the chance of a thunderstorm. a little afternoon heating and temperatures in the upper 50s at our coast. south winds and breezy throughout the day from time to time. 66 in oakland, 67 in fremont. then we will be looking at conditions to definitely improve significantly day-to-day. so today a few peaks of sun. a lot of cloud cover. some light showers. no record rainfall today but we

a warning this morning to anyone with a glass-enclosed fireplace. one company has been ordered to offer protective screens for its products with a number of children burned by the glass fireplaces. there is increasing pressure to make them save. this was investigated by fairwarning.org. heather has the details. >> 21-month-old sidney whalen still wears compression gloves on her hands nearly a year after getting third-degree burns from the glass fireplace in her parents' san francisco home. >> we had no idea the fireplace can get 500 degrees and it takes is 150 degrees to cause a third-degree burn. sidney's 3 1/2-year-old brother had turned on the gas fireplace with a remote that afternoon. the sitter had no idea and hours

later neither did her parents. the flame was too low to see. her mom was in the kitchen and heard her crying. >> i saw her and she had both hands on the fireplace there, and at first i thought why is she crying? because the fireplace has not been on in months and it's july. and then i thought, oh, my god. the valor came with a booklet all in french and no other warning labels. >> i pulled her hands away and her entire hands were brown. i started screaming. >> sidney had surgery that night at san francisco memorial hospital burn unit and a skin graft surgery two weeks later. the reconstructive surgeon said parents can't be too careful about checking their surroundings. >> i had a child who burned themselves on a brand new oven door. it wasn't actually the door. the door was well-insulated but the hinges at the bottom of the door were not. >> according to the nonprofit fairwarning, more than 200

-- 2,000 children were bund on fireplace glass between 1999 and 2009. sidney's parents have filed suit against valor to bring the number down. >> just a big fat sticker on the window that says these things get 500 degrees would have been a good start. >> the other thing i didn't know it was on so i felt like a light, a red light or something. >> abc7 news. building a new stadium in santa clara for the 49ers is going to cost more than $10 million over original estimates. the media partners at the san jose business center reports the projected cost is now up to $950 million. planners originally thought the new stadium would cost about $937 million. the 49ers spokeswoman said she expects the cost estimates to continue to fluctuate as the project moves forward. construction on the stadium is set to begin in early 2013. we've all heard about the childhood obesity problem

playing our nation. in a new california study may shed more light on why. abc7 reports on how few kids are taking p. e. in this state. >> california requires middle and high school students to get 400 minutes of physical education every ten days. but a new ucla study found nearly 40%, that's 1.3 million teens, enrolled in a public school, do not participate in any school-based p. e. class. >> we don't have p. e. in our school and i think it's ridiculous because kids need physical education or else they will get fat. >> it's kind of sad. everybody p. e. because it helps people learn how to be fit. >> and more alarming almost all 12 year olds participate in p. e. class bus by the time they are 17 years old, less than a quarter do. the report also found that more than 80% of all california teens failed to meet the current federal recommendations for physical activity. while high school students can exempt out of p. e. for certain

reasons, researchers blame budget cuts for the lack of school based exercise programs. that, despite new risk studies that show p. e. helps boost academic performance. >> in difficult financial times there are decisions being made, both at state and local levels, that are counter intuitive, they don't make sense. but when you don't have money people start doing things that don't make sense. >> doctors worry about the consequences of cutting p. e. out of academics. this pediatrician, who is also an assemblyman, sees his patients getting heavier and heavier. >> with the obesity epidemic that's happening we are to make sure the kids have good health habits and part of that is physical activity. if the state's expiring tax hikes don't get extended for a longer period of time, schools could see billions more in budget cuts. abc7 news. lease. lisa is a look ahead with a

>> when joshua tweeted this photo of an oakland police officer handing him back his stolen laptop, it was the end of a high-tech cat and mouse game that had gone on more than three months. >> security software is running in the background that's you think be debilityible but he doesn't know it's there, but it takes continual pictures and runs and takes photographs. >> that's right. photographs takes photos of the man sleeping in front of the computer and the same man using the computer without the shirt on. the pictures were taken by a security program called hidden that tracks stolen laptops and sends back photos from the built in camera along with shots with what is on the screen and the computer's location. the man who invented it, toby, told us via skype he came up with the idea when his own computer disappeared. >> mine got stolen years ago in london in a public and there was nothing i could do to recover it. >> oakland police say laptops like this one are reported stolen all the time and they almost never return. the reports wind up stuffed in a

filing cabinet because police don't have real leads to arrest anyone. this case was initially filed away too until police had another look and realized it was different. >> the victim had all the information, including photographs and had triangle -eight using the software where he believed the computer was. >> and they used facebook and different social networks and browsing information on line and they got there quickly. >> in oakland it didn't take long to track down the 27-year-old who police say he admitted bought the laptop knowing it was stolen. >> we conducted an undercover operation which within two hours we were able to locate and arrest the suspect and recover the laptop. >> and there was a limo driver who lured them to meet him in a squad car and he left in a squad car. in oakland, abc7 news. >> maybe the top story of the

day is what lisa is about to tell us. what is it going to be out there on this sunday? >> a little cloudy but no record rain. the records are over. inch, in and a half yesterday. the area of low pressure still offshore. emeryville look at partly cloudy skies but the area of low pressure will weaken and it will move across the southern part of the bay area. so still have some showers to deal with. light shower activity from highway 101. santa rosa, and further east there's no moderate rain. fairfield and vacaville and around the livermore valley, the san ramon valley, dublin looking at light returns here and further south kind of quiet. not as much activity throughout gilroy and hollister but a few showers east of san jose. so there's the low. it's offshore. the rain bands, a couple hundred miles west of monterey.

it will sink to the east-southeast and it will weaken as it slides toward the coast. that's why we will see the cloud cover, the chance of showers, a few breaks, but the breaks will be with us throughout the day today. so we are only looking at a couple hundreds inch of rain out there in the wettest conditions. staterd showers and sunshine. possibility with thunderstorm with afternoon heating and dry and warmer beginning tomorrow. so we are looking at the low. you continue to see it wobbling just to the west of us. there are the showers. they will continue to spin up from the south to the north. we will look for the activity to increase around the san joaquin, the sacramento valley. but closer to the coast things are definitely quieter today than yesterday. so throughout the rest of the day today notice the cloud cover. and a few showers popping up. here we are through the afternoon hours. then through the overnight hours

tonight you will notice we get a little more rain throughout the east bay, the livermore valley. then into monday morning the commute, a few light showers, but many more sunny breaks. a few showers lingering into the east bay. but then we are looking at a pretty nice day tomorrow, and then after that, boy, we will get back to normal. so we still have some very unseasonable weather throughout the day today, but giants probably still will be playing today, good bet with some showers out there. temperatures in the low to mid-60s. 1:00 playing the rockies. we will look for our own temperatures well below normal with the cloud cover out there. a chance of showers, numbers in the 60s downtown. 66 oakland, upper 60s concord, half moon bay 59. our look ahead, day-to-day big improvements. in fact, today, backing off significantly on the rain, but still some showers out there. possibility of a thunderstorm. maybe a tenth of an inch of rain. we around seeing any more zeros after that in the inch category. partly cloudy and then tomorrow.

look at that, mid-70s, upper 70s, low 80s. it looks pretty good out there. but we just are not there yet. >> you took yesterday off to go to a graduation? >> a wet graduation. trying to hide my face because -- >> you get blamed. >> sometimes, yes. >> lisa, thanks a lot. schools all over the state are struggling financially, but spending at public schools is far from equal. that's the finding of our media partner california watch, part of the nonprofit project for the center for investigative reporting. what it has found are huge disparities in the amount of cash spent district to district. and more money does not guarantee academic success. abc7 has more. in east palo alto, budget cuts have made it difficult to get things done. >> we can barely afford the textbooks. we can't afford to provide the supplement materials that the classroom teacher needs. >> the superintendent struggles to meet the needs of her student body.

>> what the difference is, at least 49% of that, of our budget, is categorical. it is targeted for specific programs. >> the complicated school finance system is to blame. for instance, california watch found the raven woodward school district gets almost as much money per student as its wealthier neighbor, palo alto, but still does not achieve the same academic success. california watch lewis freed poured over data provided by the state and federal government to pull together the amount of money spent by every district in the state and how those districts perform. >> the research on the relationship between money and student outcome, money and test scores, is very unclear. >> their analysis shows there is no substantial correlation between how much a school district spends and its academic performance index, which is based on student test scores and other academic measures. >> what we found is that the state of california for many

years has been trying to equalize spending among school districts around the state. and what we found is that big differences still remain. >> last year california's schools spent an average of $8,452 to educate each student. that figure includes money from local, state and federal sources, including one-time stimulus funds. but some districts get much more than others. creating huge ranges in funding. for instance, this school district spent nearly $34,000 per student. just across the bay in san francisco, it's about $10,000. here just $7,300. >> our current school finance formula has just built up over the years without any

>> and we've seen a huge success in the program where we have been able to get over 250 meg watts ever solar installed in pg&e territory. >> he said the amount of the rebate check gets smaller as costs to install solar declines overtime. >> we started off at $2.50 a watt and today we are at .35 a watt because of the amount of participation we've been able to receive. >> the rebate locks in once you submit the forms and documentation. she was locked in at $1.10 a watt. now since she installed a 4800-watt system. she was counting on a hefty rebate. >> oh, gosh, i could put it on my mortgage. yeah, any little bit helps because i only work part-time. >> pg&e says it never received her documentation. but gina has the receipt from the post office as proof of mailing and copies of the form she has are dated

february 10th of last year. >> it's rally not my fault. you know, that the ball was dropped. >> the company she purchased her solar panel from tried to assist her with the rebate but pg&e refused to give her the higher rebate. so she called 7 on your side and we contacted pg&e. >> after doing research and speaking with our customer service folks, we found out that the customer did have a receipt saying that she had sent the documents in the mail. somehow we never received those documents. >> gina has since received an additional rebate of $2,700, bringing her total rebate to nearly $5,300. >> since 7 on your side got involved, pg&e has been wonderful. just thank you 7 on your side. i rally appreciate it. >> the california solar initiative rebates will be available until the money runs out or 2016, whichever comes first. i'm michael finney, 7 on your side.
