shooting of oscar grant. grant's family say he should have served a longer sentence. at 5:30 a gathering at 14th and broadway in only will give people a chance to speak out. abc7 spoke with grant's family in los angeles. >> outrage from oscar grant's family after learning that mehserle is set to be released from jail. they have ruled that johannes mehserle has earned enough credits to get a release. >> the judge, robert perry, he served you is months. so it's painful to us as a family. there was no accountability. there was no justice in that courtroom. >> an emergency panel meeting of the members of coalition justice they are voicing their frustration saying mehserle is

expect protests to be peaceful but there will be extra police officers on duty. >> the los angeles times reports that police sources are denying a television station's report of a blood-stained jersey linking the suspect in the bryan stow beating. a blood-stained jersey was handed over to investigators but dna showed to no match to ramirez or to bryan stow. someone brought it to a dry-cleaners shortly after he was beaten at dodgers stadium. >> ramirez is in jail on a parole hold and has not been formally charged with the crime. police continue to look for two other suspects in the case. starting at 2:00 this afternoon, family and supporters of missing nursing student michelle le will distribute flyers in hayward. a family statement they will

continue their efforts to find michelle because hayward has not given them any conclusive evidence she was murdered. police say they do have evidence she was murdered after she vanished but more than half a dozen police searches over the past two weeks have failed to show up any sign of her. mark klass plans to join in the flyer distribution. >> they plan to wade into the deep of crown beach and show how easy it would have been to rescue a suicidal man. the man drowned while police and firefighters stood by on the beach. they say they were obeying policy. the training is now being reinstated. today on similar conditions, ten people will wade in the pools to

welcome back. meg lance to pressure test the natural gas pipeline in newark so residents may smell gas vented from the system. it's part of the state ordered testing of the pg&e's distribution system after the san bruno explosion killed 8 people and destroyed 38 homes. today san francisco examiner says pg&e has pressure tested nine pipeline segments so a far and no pipes have sprung leaks.

so far eight bay area pipeline segments have been tested in six cities. tomorrow morning, a federal judge will hold a hearing on a motion to fill out judge von walkers ruling prop 8 banning same-sex marriage is unconstitutional. the issue is judge walker himself and whether he should have disclosed his ten-year gay relationship before ruling on the ban. most legal scholars agree that his sexual preference is not an issue but the fact he did not disclose his long term gay relationship before the trial could be. the motion to vacated the ruling is brought by backers of proposition 8. supporters of same-sex marriage plan to demonstrate outside the federal courthouse before tomorrow's hearing. >> a new campaign to clean up trash along a san jose creek is designed to give jobs to the

the hospital since thursday night. the 89-year-old radio station owner suffered the stroke at his home in alameda. one of his neighbors told the times the stroke has affected his right side and caused his speech to be splurd slurd. his followers have donated millions to his nonprofit called family radio and he spent a lot of it on media blitz telling everyone the world was going to end back on may 21. >> hayward police are searching for somebody that ran over teenager and then ran off. she was hit by a white car. the girl was taken to eden hospital with serious injuries. she is in stable condition. the car is described as a toyota or volkswagen. a computer mistake is to blame for placing some san francisco students in language

immersion programs intended for other students. they say they have corrected the problem but some parents are still skeptical. education reporter lyanne melendez explains how it happened. >> reporter: when it comes to language immersion programs. the classes are defied like this 50% know the target language, the rest don't. the kids who speak english learn spanish and the spanish speakers learn english but before you can enter the classroom, incoming students are tested and it gives students two codes. >> one code is they are target language because they speak the language and the other one says they don't. >> but they had a glitch and randomly begin switching codes. >> another result of that, the balances fell below 50%. and there were three schools

that happened and these happened to be schools that were highly requested that don't speak the target language. >> initially the school district did not notify parents of the mishap. >> to find out it was mishandled was upsetting. i didn't lose a lottery but potentially cheated out of something. >> i don't know why this would happen, but some of it happened and we'll correct it second time around. >> by the time the district noticed the problem they had too many kids that spoke english. so in order to restore the balance, parents would offered places at other schools or in the case of the chinese immersion school they had to open another kindergarten class. >> there is no doubt they are popular and very much in demand. this year, 39% of all applicants requested some kind of immersion
