oakland. >> reporter: tonight, an extra 100 oakland police officers will be on the job. the mayor's office says jean quan is keeping an eye on the situation, monitoring it, but keeping a low profile and the city and police have not gotten an indication that outciders are planning any trouble. >> alan: took nearly two yours for johannes mehserle to be charged, tried and convicted in the shooting death of oscar grant. it happened in 2009 after a scuffle on the platform of the fruitvale bart station. a jury found milesly guilty of involuntary manslaughter on july 8 twowsmght. the judge said there was no evidence that mehserle intended to shoot grant. he was sentenced to main jail sentence, two years minus time

served. he has served a total of 365 days, including the time he was held prior to this -- his sentencing, and mehserle could be released anytime after 12:01 tomorrow morning in los angeles. we'll continue to bring you the latest on his release tonight on abc-7 news at 11:00, and tomorrow morning beginning at 4:30 a.m. updates will also be posted on the web site at abc7news.com. in other news, tomorrow morning a federal judge will hold a hearing on a motion to throw out the judge's ruling that california's proposition 8-which pans same-sex marriage, is unconstitutional. the issue is judge wearer -- judge walker himself and whether most legal scholars believe his sexual preference is not an issue but the fact he did not

disclose his long term gay relationship could be an issue. the supporter0s same-sex marriage plan to demonstrate outside the federal courthouse before tomorrow's hearing. family and friends of missing nursing student michelle li are not giving up hope of finding her alive. they're hoping someone will come forward. >> reporter: you know, it's been almost a week since police classified the search for michelle li as a homicide investigation, but today her friends and family have never been more determined to fine her alive. this is the street where her car was found, and this afternoon her friends and family came to this neighborhood to blanket it with displiers beg neighbors -- with fliers and beg neighbors for help. the neighbors were talking -- the friend were stopping people on the streets asking them for

help to bring the nursing student home alive. the reward has ground to $65,000. there are t-shirts and fliers list her as a missing person although police say they believe she has been murdered and on friday conducted a search, the police did, for ten hours in a remote area of the east bay with search dogs but came up empty handed. one more reason why the friends and family are not giving up hope. >> we're frustrated we don't have any evidence where the case is going or whether or not she -- that -- whether or not we should stop our efforts. so until we get the evidence, we're going to fight for her. >> michelle reside friends and family say they recognize that hayward police have limited resources. the just wish police with share more information with them. the police have inleed the -- enlisted the fbi's help in what they call a search for a putt. but they don't say what leads them to this conclusion. friends and family say that

until they have hard evidence she was murdered, they continue to bring her home alive. live in hayward, abc-7 news. >> alan: swimmers took to the frigid waters off crown beach this morning to make a point. about a dozen people waded out to the spot where suicidal man drowned after firefighters watched. organizers claim the first responders could have done more to save the 53-year-old man. alameda firefighters say budget cuts prevent them from being recertified to conduct water rescues, force canning them to watch. the woman who called 9-1-1 watched the event from the shore and said she felt guilty for not doing more. >> i thought, why didn't i do something? obviously it would have not been that difficult. >> alan: the demonstrators say the conditions, similar to at the weather today, were so mild a rescue would have been ease y.

a 2009 fire department memo explains that firefighters would be certified within 30 to 45 days but the alameda fire department has consistently refused to explain why it never happened. we left a message for the fire chief to respond today, but so far no callback. flooding is a big concern today in press know -- fresno county, and a flood watch is in effect because warmer temperatures are melting the huge snow pack. the flood watch runs through today, and the sheriff's department has shut down parts of the kings river due to rising water. the five-mile stretch of river is a popular spot for rafters. >> a lot of trees that have fallen down that can trap floaters or novice kayakers. you have to be on your game. >> alan: several people were rescued from the tressing -- freezing water yesterday. the sheriff's office is happening out citations to anyone found in the area that is

offlimits. >> a wildfire in eastern arizona has grown to nearly 700 square miles but officials are confident they're close to controlling it. firefighters have only 6% containment but they allowing most of the evacuees to return home tonight. there was some concern about windy conditions yet but the gusts helped crews fight the flames. >> it's actually helped us out because it's burning out the interior of those areas that haven't burned. so that's securing that. the key for us is the direction, and yesterday those directions were really favorable. >> alan: the fire crawled four miles to two major powerlines that send electricity to texas but firefighters managed to hold the fire back. >> the number of top democrats calling for congressman anthony weiner to sign is growing. today the second ranking

view neighborhood as part of its sunday street program. some parents took advantage of the wide-open streets to teach their children how to ride a bike. live music and health booths lined the streets and next month a section of the great highway will be closed for that event. >> leigh glaser is here. >> leigh: great day. a lot of warming. i told you last night it would begin today and it has. some locations as much as 15 degrees over the cool numbers from yesterday. and here's a look at the high definition mt. tam al pies camera. even parts of the coast cleared. you can see ocean beach. some locations still had the patchy fog but really a terrific day. check out the temperatures. concord, 81. 69 in napa. 59 in san francisco. a little fog now starting to creep back in. 60 half moon bay. and los gatos 75 degrees.

san jose 73. here's a look at highlights for you as we head through the evening. we'll go with a little bit of patchy fog near the coast. temperatures really came up today as much as 13 degrees in livermore, up seven degrees in ant york nine degrees in concord. san francisco managed temperatures at two degrees there, and napa up three. we'll continue with a little patchy fog near the coast. expert more -- expect more warming. tuesday will be the warmest day of the work week, and then after that we slowly start to cool things down. thursday friday, much cooler. you can see them talking about nice northwest wind component. pushing the low fogs and clouds off the coast and overnight temperatures, 57 for antioch livermore, 52. 53 with a little bit of patchy fog for san francisco. north bay, santa rosa, 46. and 47 for cloverdale.
