good morning, i'm terry mcsweeney. we begin with a plane crash off the waters of sausalito, both the pilot and passengers are fine but these days everyone walks around with a camera the incident did not go unrecorded. tomas ramon has the story. >> this is video of the plane attempting to take off. you can see the plane starting to take off and apparently hitting a wake. it flipped nose first in the richardson bay. >> we were going along and guns the engine and took off and went right by the restaurant. it had a lot of speed. it looked like it was airborne but it hit a wake from a boat.

>> jennifer saw the plane and immediately starting taking pictures as her boyfriend called 911. >> it was in the water. >> sausalito police chief says the event is being called a plane incident, not an accident. >> either caught a wake in the water or the plane tipped over. it had two occupants, two males, both were able to get out of the plane without any injuries. they were taken to shore by some private boaters. >> one watched the rescue from home. >> they had to like swim or paddle 15 feet or so to the tugboat and then they got on. >> both people were given medical attention but did not require hospitalization. these photos were taken by jennifer and mark who were looking out of their sausalito condo at 7:28.

they show it as it tipped in the water. >> there were no drugs or alcohol involved in the skin incident and they are trying to figure out how to get the plane out of richardson bay. a san jose state university professor has won $750,000 for the loss of papers he owned that was written by albert einstein. he lost two cabins in the lick fire. it was the loss of the einstein papers which had been written to his father who had worked with einstein. >> they weren't just random calculations they were related to a field a theory he was trying to accomplish. there is not a lot of writings on the theory. >> take a look at some of those writings. a school teacher was convicted of accidentally starting a fire.

the fire that killed two san francisco firefighters last month is believed to be accidental. investigators say the cause of the fire on berkeley way that killed two firefighters were most likely electrical in nature. the exact cause is still unknown because the electrical system has not been completed but they have determined that it started on the first floor of the four story home. 4th of july weekend is a busy time for any fire station, most fire stations have extra staff on duty but several in santa cruz county are sounding an alarm. one will be at the lowest level. >> reporter: fireworks are already on sale in the bay area. there is a concern by fire departments, not he for the norm is increase.

>> in general we use the next engine or two or three. >> reporter: but this year things will be differently in central fire in santa cruz county which is responsible for socal and capitola. >> we don't have the staffing we like to have. if there is fires going on. we have to do it one at time. >> they have the normal complement they would have on a monday evening. >> reporter: in other words, no extra engines will be on the streets on the 4th. according to county supervisor the lower staffing levels are a sign of the times. >> the public has to understand we're going to see less public resources available. >> central fire's main concern is for homeowners on the cliff because of access issues and those that live near dry

vegetation like pom pags s grass. >> they don't have the money, i wish we did. >> but central fire isn't the only department struggling because of budget constraints. today san jose's fire department announced it can't afford to have every apparatus, that means that two engines will go out every day. >> the firefighters and the staff and fire engines and trucks so there is no way we're going to go below two. >> the department has felt stretched thin. 49 firefighters were laid off at one fire station and one closed last year. >> central fire can call in extra firefighters in case of an emergency only. they can lean on neighboring departments for help. lisa amin gulezian, "abc 7 news." cal state parks are open for business this holiday weekend but next july the 4th about 70

parks could be closed. the state parks budget is half what it was six years ago, just not enough money to go around. i think that people would be willing to pay a little bit more to camp. i don't think we need to close the park. >> supermarkets will donate a nickel for every shopper that brings in a reusable bag. >> 1.5 million californians are paying more for health insurance. the rate increases mainly effects small businesses and individual policyholders. premiums are climbing as much as 92%. the increase reflects rising costs for diagnosis particular testing. >> i have the authority to reject insurance but not health

boat got caught in debris. >> i was on the phone. i was just telling her what happened and keep her updated. we were there almost two hours. >> because of some ignorance about the ravaging waters at merced river caused our officers to get in distress. >> that rescue ended up taking ten hours when a member of a second sheriff's department team also had to be rescued. there were 14 just on the merced river in 24 hours. high temperatures are melting the snow pack making the rivers fast and swollen and very dangerous. >> a big finish on wall street. stocks had the biggest weekly gain in two years. dow jones soared 168 points, it's going to open at 12582. the dow was up 5.5% jump for the

week. nasdaq was also up and s&p 500 rose 19. >> for u.c. students economic news not so good. they are preparing to recommend a 10% tuition increase for the board of regents that would make up a loss of $150 million because of steep cuts. the tuition would rise by more than a thousand dollars to $12,200 per year. >> imagine spending only a few dollars to help a student to college. it's possible through scholar match. students post their profile hoping to get people to donate money toward their college tuition. >> reporter: college is an expensive proposition but they are helping students pay for their education. >> the idea to create scholar

match begins here. many of the students are being accepted into college but didn't have a way to pay for it. the executive director of scholar match spoke to us from los angeles while attending a convention there. >> we work with the students once they come to us to figure out how much they need to fill in the gaps between what they get in cal grants and what they need to fill to get the rest of the tuition money. >> each student must fill out a profile stating what their interested in, their major and career goals. >> it's kind of like, selling yourself. >> within two weeks of posting her profile, she had reached her goal thanks to five anonymous donors. he has one donor in los angeles who has pledged to help pay for the remaining three years of her education at st. mary's college. >> that was an amazing thing to

the golden gate bridge. fog is very thick out there now but we're talking about sunshine and heat. more coming up in just a minutes san francisco choir starts a tour of cuba today. ♪ >> last night a sendoff concert on fillmore street for the 40 member choir will be giving four concerts as a special 4th of july celebration. they will take part in master classes and take part in a choir. they sound like angels, don't they? last year they won two grammy awards. so many questions about weather. wet lenses out at the golden gate bridge but hot temperatures what is going on? >> we saw the fog increase since

the morning hours. we were looking at a west wind at about 12 miles an hour at our airport. view right here the sunshine, a little bit of haze but the fog has moved over richardson bay. here is the view from mount tam. layer about 200, 300 feet. that is going to set the stage for a cool day at the coast. comfortable afternoon here and we should get rid of fog altogether for a warmer day on sunday. 4th of july, we'll get to that. 62 in mountain view, 63 in san jose. 58 in oakland, 59 in napa. temperatures are a little cooler this morning. highlights, coastal fog with 50s and 60s. we have a advisory for tomorrow afternoon, the temperatures in the act is valley will be flirting in the upper 90s but bay area mid 90s, hot enough and

we'll look for more hot weather on the 4th. i think the fog is going to sneak back into the picture just in time for the fireworks especially along the shoreline around the embarcadero. look at the extensive fog in point reyes down the coast and southward into southern california. we're looking at a little bit of west wind that will stay with us national weather service has issued a heat advisory really because so many folks outdoors through the next couple of days, with temperatures in the mid to upper 90s and holding for the most part the next several days, you need to be aware of how that can be pretty stressful on your body. along the coast. we'll notice we're going to stay pretty comfortable. we've got high pressure to the west of us and north of us. this high is going to build in more. that will keep the fog at bay tonight as it sweeps out to shore and stay offshore for

sunday. overall the hot weather continues with the sea breeze at the coast. hottest day could be tuesday, the day after the 4th. look for 104 in fresno but close enough in sacramento at 98. in terms of the highs today. 87 near saratoga, 86 in palo alto. that is the effect of the sea breeze, 76 in downtown today. numbers right around normal here, but above normal for the north bay with 93 in santa rosa. 90 in vallejo. getting toasty up in sonoma county. berkeley, 81. 87 in fremont very weak breeze. out over the hills, mid 90s today. i think tomorrow will be a little warmer but it will be hot in pleasanton, 94. down by the monterey bay, you got the fog here and it will

police in san francisco are patrolling chinatown and firefighters are checking for illegal sales. they don't want to see outlawed fireworks endangering communities. vic lee on the city's stepped up efforts. >> reporter: this is what worries cal fire the sale of fireworks, for sale on craigslist. >> it's against lawsuit to sell them on the internet. >> cal fire says in the past five years they have seen an increased in sales. the agency says it's a huge business. >> we have been con physical have comp physical indicating fireworks over year. >> but street sales make the

tougher for some of the poorest residents, billions dollars of funding for low health care program medicaid runs out this week. cecilia vega reports on the impact to millions of people. >> reporter: they are one of the 7.6 million californians that rely on medicaid or medical for health care. she has dreams of becoming a nurse, if there is more cuts to the system she fears the worst. >> everybody that uses this, social services, they are not criminals. >> but the cuts are coming. $90 billion that they pumped in medicaid two years ago the recession worsened runs out this week. she advises the poorest of the poor and she says people are forced to make desperate decisions. >> one versus the other and if you decide medical co-pay to see

>> cecilia vega, "abc 7 news." french authorities are reporting the first death from the e. coli outbreak. they say a 78-year-old woman died this morning. 48 deaths were reported in germany where 4,000 people are ill. many are suffering from a complication that could cause kidney failure. the former head of the imf is free on bail this morning, dominique strauss-kahn was released from house arrest by a federal judge and still faces sexual assault charges but the case appears to be falling apart. they say the hotel housekeeper that accused him of remaining her has a criminal record and ties to a drug dealer that transferred money to her bank account. >> this is first giant step in the right direction.

minute. people are gathering at justin hermann plaza thanks to the zip line. city's department has partnered with canada company to offer the rides. they checked it out. flocking to the zip line and it was free. this time around, it's going to cost $29 to ride. but not a bad day to do it. san francisco is going to be not so hot. >> mid-70s and fog over the bay. you see the increase throughout the morning hours. it was very little about 5:00. here is a view from mount tam. about 200 to 400 feet deep. it will be hugging the shoreline today keeping it cool but hotter day will be tomorrow and especially on tuesday. here is a look live downtown.

you'll notice nice and clear out there. temperatures responding to all that sunshine east of the caldecott tunnel is 67. 70 in antioch. 65 in concord. 56 in downtown, 58 in santa rosa. 50s and 60s as you head out this morning. we do have the patchy fog at our coast. right now it's pretty widespread from the north coast down to the south but nonetheless the national weather service has issued a heat advisory this afternoon, tomorrow afternoon because of the hot temperatures inland and the heat will hold more or less through the 4th. i think the hottest day will be the 5th. the fog is firmly entrenched at the coast but strong high pressure to our north it will continue to be warm today with numbers flirting in the mid and upper 90s all weekend long except at our coast.

we'll have a weak west wind and stay in the 60s there. but the setup is not going to change for the next four or five days. we're not going to see any weak troughs sneak in. right now we have fog along the coast. high pressure to the north of us that will allow for the fog to push back out to sea late tonight. here is a look at temperatures today. 86 in los angeles, 98 in sacramento, highs today are pretty warm, especially in sacramento, san joaquin valley and look what happens tomorrow. 79 in big sur and 80 in san diego and 109 in palm springs, look for 80s in sierra nevada and mid 90s in yosemite. back home, more 80s and 90s in the south bay. los gatos 94. 86 mountain view and along the coast upper 60s.

federal agency investigating the san bruno explosion has reprimanded for delaying a document. they describe the document as a handwritten note about a 1988 leak in a flawed seam weld in the same pipe that ruptured and exploded last september. chronicle says they kept the note secret for two weeks and pg&e told the ntsb about the existence of that note. >> a san bruno homeowner has been having trouble getting her house repaired after the pipeline explosion. it raises the issue of how much of it needed to be replaced. michael finney complains ho about the fight she had with the insurance company. >> she points to the efforts of

repairs the gas explosion. it happened just down the street from her home. >> the house was going up and down. it was jumping up and down and back and forth. >> reporter: nine months later, this has been replaced and shattered tiles have been repaired. cracks on the walls on the side of the wall has been patched up and bathroom rebuild. state farm paid for all the needed work except one very expensive one. >> the roof has been replaced. it's been replaced but the insurance company refused to pay for the roof. >> tammy sent us two reports both recommending that the 25-year-old roof be replaced. one report stated the majority of the damage was to the southeast facing the site of the gas explosion. the other stated the cause of the newly displaced shakes may have been a wind gust or major

foot traffic. state farm used the analogy of someone getting into a tornado bender to explain its position. -- fender-bender. >> the insurance company in this example is not going to repaint the entire vehicle but it will replace the bumper that was damaged in the accident. >> reporter: state farm agreed only to pay for a roof repair but not for replacement. amy is executive director for an advocates group, united policyholders. >> there is a lot of money involved. insurance companies will clamp down, they will put up obstacles. unless you can negotiate around you are not going to get a full and fair settlement. >> one of the most common problems for homeowners is they are underinsured. >> i think people don't check what the replacement costs of their house and if you don't do
