of clouds and a healthy marine layer. once again a cooler than average day today. >> all right, lowsa, good morning. i'm terry mcsweeney. some were awakened by a 3.3 earthquake just before 4:00 this morning. it was centered 2 miles southeast of berkeley. an oakland resident called us and said it was a short quake but a strong one. a strong jolt. again, the official reading is 3.3 from the u.s. geological survey. there are mow reports of damage or injuries. hayward police say a man who was shot to death inside a car at a gas station yesterday was targeted but they don't think the shooting was gang related. it took place in the parking lot of a 76 station about 5:30 yesterday evening. crime scene investigators worked into this morning processing evidence under a canopy they put up around the gold cadillac. they said the victim, a man in his 20s, was sitting in a parked car when witnesses saw a

man in a black hooddy walked up and shot several times. the shooter got away. budget cuts are coming to superior court and that could slow down the wheels of justice for everything from divorces to lawsuits. really slow it down. johnalston reports the cuts help close a $14 million budget deficit. >> employees left work at san francisco's superior court building and headed home for an unsettled weekend. >> everybody's future is up in the air. i'm trying not to think about it until i know what is going to happen. >> what is going to happen is a drastic reduction in the number of employees and rooms. on monday, 200 notices will be mailed out. they target court reporters and clerks, administrative staff members will lose their jobs, and that's on top of the 11 court commissioners who were let go this week. 25 out of the 63 rooms will close. civil cases will take the brunt. >> you can still file a civil case, but it's going to sit on a shelf with hundreds of papers, stacks of papers, and it won't see a courtroom for at least

five years. it could take at least a year and a half to get a divorce. it could take months to get copies of court records. it could take you a full day of standing in line before you can get your traffic ticket paid in our criminal division. >> san francisco's superior court blew through a $10 million reserve hoping to avoid layoffs and then lawmakers cut $200 million in march and another 150 million last month. court officials say unless there's a miracle, october 3rd will be the d-day for the cutbacks to take effect. >> apparently the governor and the legislature have not put the courts at the top of their priority lists. in fact we appear to be at the bottom and there's going to be really severe impacts for the public as a result. >> senator mark leno are san francisco put blame on arnold schwarzenegger for eliminating the car tax. >> this is dismanteling the state of california and until we can access not new revenue, former revenue strains, we are going to see this horrible pain

placed on californians. >> a lot of people are going to be laid off, about 40% of the court staff, and apparently we will hear next week what is bogey on. >> the layoffs will take effect on september 30th. the new state budget calls for an extra $4 billion in unanticipated revenue. if that doesn't come in, the cuts to the court system could be even deeper. in san francisco, johnalston, abc7 news. >> a federal appeals court has ordered the military to tomorrow prayerly continue it's don't ask don't tell policy for u.s. service members. they base the their ruling on new information provided by the federal government. military had halted don't ask don't tell last week. yesterday's decision comes after the justice department filed a motion on thursday saying ending the policy now would preempt the orderly process for rolling it back. a 10-mile section of the i-405 freeway in los angeles is completely shut down for the weekend. authorities began closing on and

off ramps last night for what is being called carmadedon. it's part of a $50 million -- or billion dollars bridge widening project. they have warned the public for weeks about the closer. they said it could create gridlock onside streets. we found a couple who came up here to avoid the mess. >> armageddon, 405, don't be around the traffic. we came up here. >> we don't want to be around the traffic so we came up here. >> many stocked up on essentials to prepare for the 53 hour closer as people in los angeles are being asked not to drive this weekend. >> the bay area has its own road closer this weekend, not nearly as big. highway 1 between lake street and the golden gate bridge will be closed in both directions from 8:00 tonight through 11:00 tomorrow morning. the closer will allow crews to

shift traffic to a new bridge. detour signs will be up to get you around the area. this morning volunteers will resume their search for missing nursing student michelle le. yesterday a new search failed to turn up any new leads. a group went through the else of east fremont. among the group was le's brother, who has worked tirelessly to find his sister. >> i can't imagine life without her. living without her has been a struggle. it's been almost more than i can bear. >> le was last seen going to her car at the hospital more than seven weeks ago. there is a $100,000 reward for information about her disappearance. >> 22 san san jose firefighters

are reinstated. some positions are filled by new hires after some found new jobs. but people in the neighborhood are still not happy. station 33 in that neighborhood was the only one shut down last year and there is no money to reopen that station. >> i was really hoping, given the vulnerability we have up here, they would recognize that and they would try to fill that station with bodies as they promised. again, disappointed. for now stations 13 and 18 are charged with responding to communications hill. not the answer that residents were hoping for. this morning a woman continues to fight for her life after being struck by a bicycle yesterday on the embarcadero. she suffered a liv-threatening head injury. the bicyclist could face charges if it was found he was at fault.

advocates say everyone needs to pay attention. >> about two percent collision owes cur about bikes and 98% occur with cars. fact remaining people on bikes really need to yield to people on foot. >> the base citizen reports that 75% of recent bicycle-pedestrian collisions are the fault of the bicyclist. a suspected art thief pleaded not guilty yesterday to accusations he swiped a picasso off the wall of an art gallery in san francisco's union square. police say this video shows mark lugo appears to be carrying the sketch, but lugo might face more trouble than that. detectives discovered another picasso, along with six other works valued at $6 million

also san francisco is cracking down on hookah lounges and why a federal judge has dismissed a lawsuit filed by the safeway grocery chain that would have allowed them to continue to sell tobacco products. yesterday court upheld a san francisco ordinance that bans the sale in pharmacies. safeway said the ban violates it's constitutional rights to sell cigarettes. originally big box stores had been allowed to sell cigarettes, but the appeal found it discriminated against other pharmacies and the city extended the ban. the smoking ban in san francisco has been in effect for years now, but it changed the law last year, having an

impact on where a certain kind of smoking has continued. the city is cracking down on hookah lounges. abc7, heather, reports. >> you fill it up with water about halfway. >> he demonstrates the hookah at his family's tobacco shop, which is next door to their hookah dream lounge. last year it was ordered to close down because of state and local lounge against smoking in enclosed workplaces. he said his dad put $100,000 into the lounge and isn't sure what to do next. >> a lot of families are going to go broke. who knows what's going to happen now. the hookah is a water pipe for smoking flavor order toe backcast through the same tube. they can share the same tobacco by sharing different mouthpieces. they say it's nothing like cigarette tobacco >> it's safe, not bad at all. >> the department of public health disagrees. >> a lot of science out there now shows the exposure from the hookah is equal, if not greater than cigarettes, and that's

because of the number of people and the amount of time. >> the pride of the mediterranean restaurant on fillmore has a patio where it appears hookah smoke can continue. this man said his favorite flavor is cherry. >> i come once in a while with family. >> health inspector, jean, said she sent letters to 20 hookah lounges and there's 20 more under investigation. this minnesota has until tuesday to remove all smoking equipment and this man is ordered to stop the indoor smoking immediately. in san francisco hookah smokers probably won't be going out at much. >> and you can smoke in your own home and you can smoke in a multiple unit housing unit, you can smoke in your own unit as long as the front door is closed. >> the owner here says he has hired legal help to try to keep the hookahs. loyal patrons here are grateful. the department of health says that the city is committed to try to help hookah businesses find a compromise, a patio,

we have the whole deal going on with the low clouds and fog. the deck about 3,000 feet, extending far inland this morning. the sun was up at six. you notice from this shot, our emeryville camera, we have the overcast conditions. with that a pretty stable atmosphere for afternoon sun on the way. a bit of a breeze this morning. and one hour and nineteen minute delays at sfo. this morning we are starting out at 55. good morning, oakland. 355 fremont and mid-50s in livermore. we have a pretty good delta breeze blowing out of the west at 31 miles an hour. the cool air making its way into the sacramento valley with highs only in the low 80s. most of the bay today 60s and 70s. of course, that translates into temperatures much cooler than afternoon. the morning drizzle around the coast, around the bay. a cool day today. a little more mild tomorrow. and then gradually warmer, say by about wednesday through the latter part of the week. here are the clouds this

morning. they are peeling back by about 9:00, 10:00. they will not totally dissipate. here's where we sit today. 60s and 70s. average highs, of course, near 90 in livermore. 15 degrees shy of that today. we should be 83 in san jose. that's 11 degrees cooler than average. low 80s are the norm here so the trend continues, the summertime trend of cool temperatures. the culprit, an area of low pressure to the north of us. yet there's another one setting up shop behind it. that's why the weekend we are getting this one settling in today, taking the temperatures down. the low clouds and fog across the bay. but as this continues to slide to the east, we will see see biy bit some warming. 88 in fresno. we should be looking at upper 90s. triple digits, though, for palm

springs. back home temperatures mainly in the 70s. 72 san jose, 75 in santa clara. we will look in numbers in the upper 60s for san mateo. don't look for a lot of sunshine today in san francisco. maybe some late-day clearing. only 61 degrees. in the north bay look for the upper 50s at the coast. that's pretty typical. look at 73 santa rosa. 75 sonoma. mild there. highs today from berkeley and oakland, 67 in fremont and out over the hills widespread 70s with only 07 danville s walnut streak 72. 74 livermore and by the monterey bay we will see 77 in gilroy. today the cooler day. the gradual warming trend gets underway for everyone monday, but notice the coastal temperatures still in the 60s. it will be the end of the work

>> president obama is calling for republicans and democrats to take a balanced approach in coming up with a plan to raise the nation's debt ceiling. now congress is working on a fall-back plan to raise the nation's debt ceiling in case leaders can't agree on budget cuts by the august 2nd deadline. the president is meeting stiff resistance from republicans as he pushes for spending cuts and tax increase. >> time and again the republicans have offered serious proposals to cut spending and address these issues. i think it's time for the democrats to get serious as well. >> we shouldn't put the deficit reduction on the backs of folks who have already borne the brunt of the recession.

it's not reasonable or not right. if we are going to ask students or seniors to sacrifice, then we have to ask the wealthiest americans and corporations to share in that sacrifice. >> the president has asked leaders to present their final offer by today. the white house said they must have an agreement in place by friday. on august 2nd the treasury department is projected to run out of money and will be unable to borrow more because of the current debt limit. which is $14.3 trillion. state lawmakers are rushing to introduce a second bill that would make it a felony to fail to report a missing child or the death of a child in a timely manner. the california caylee's law could go into effect immediately, prompted by the death of two-year-old caylee anthony in florida. she was missing 31 days. her mother was aquited of the child's death. here's nannette miranda with more. >> california is the latest state to jump on the caylee's

law bandwagon with not one but two bipartisan proposals to make it a crime to not report a child dead or missing within 24 to 48 hours. depending on the version, it could be a felony. the high-profile case of casey anthony stunned most people when they discovered the florida mom did not report her two-year-old's disappearance for 31 days, and that was not a crime. >> as experienced law enforcement will agree, the first 48 hours of a child's disappearance are critical in determining if that child will be found alive. >> when a jury aquited casey of murder, the outcry urged an online initiative to enact casey's law. 2.3 million people have signed, it including caylee's grandfather. he said this is a great legace for my grand daughter. other children still need assistance. but some the legal community say caylee's law is nots in because

-- nots in because child endangerment and child abuse laws are sufficient and that politicians are grandstanding. >> they take an ill-conceived policy decision and try to rush through a law in order to capitalize on the publicity behind a high-profile trial. >> critics, too, wonder if caylee's law may create criminals out of parents who are legitimately grief stricken, which lawmakers counter. >> you can't just call a time-out when you have the life of your child involved. you do have to step up to the plate. >> child abuse experts say state laws need to be clearer on what is expected of parents. >> if we want to have the best opportunity to rescue a child, to save a child, to make a difference and prevent that tragic outcome, we all need to know very quickly that there has been a critical incident. >> california lawmakers will have to act fast. they are on summer break until mid-august and will have a month after that to get caylee's law approved. in sacramento, abc7 news.

>> we want to take down to los angeles because of court of carmagedon don't seem to be happening. that's a live picture looking at the 405. and the bridge you see in the middle of the screen is coming down over the next two days. today or tomorrow 405, both directions, completely closed. it's one of the busiest freeways in the united states. but as you see, not much going on down there and we are told that surrounding surface streets are free of congestion. the alternate freeway, 101, they are staying off of that too. there's no problem there. so the good news from l. a. is the reports, the concerns about carmagedon, they got the word out and drivers are listening and they are staying off. >> 05 and staying off 101, as well and things are going smoothly so far on this two-day closer of the 405.

space shuttle astronauts have been busy today making minor repairs and preparing to return to earth. when they return to earth next thursday, atlantis will be retired. earlier this week i had the opportunity to talk to the crew as they traveled a couple hundred miles above the earth at 1700 miles an hour. one of the high flyers mission specialists, rex, of san carlos. >> the last mission carries a universe of emotions. certainly pride in being part of the last shuttle program but a major tug at the heart strings that shuttle is no more of a -- as of touchdown next week. >> after we get back down to the ground, after landing, it will hit us really hard and we will all have a hard time leaving the shuttle and doing the walk around and greeting the people down there and just closing out the program that way. >> now that there are going to be no more shuttles to fly, what becomes of someone who was known for his flying on the shuttles? >> the spacestation is now complete. we can end the assembly phase and now we are entering the utilization phase.

we can do the ground-breaking research to find new ways to treat diseases, find out now ways to help us to be able to stay in space longer. a couple days ago i had a chance to see california from space again. i could see the bay area was a little foggy but i could see the outline of it. to think i was a kid down there many years ago looking up at the airplanes and dreaming of flying one day and here i am on the international spacestation cruising along at mach 25, and if i can do it, anybody can. >> there is more to come. nassau thinking of putting astronauts on an astroid by 2025 and in the decade following, putting astronauts on mars. >> they want to unlock the secrets of the solar system with help of a spacecraft from california named dawn. it's beginning to orbit an astroid, called vesta, which is 117 million miles from earth. this image was sent back last month. isn't that remarkable in and of itself. right now scientists are listening to the spacecraft to

send new data and images from much, much closer. again, nasa wants to go to an astroid about 15 years from now. astroids are made from materials that orbited the sun about 14 billion years ago that. is truly out there. >> it looks like there is some fog or cloud cover at vesta this morning? >> yeah, you can see down on earth we have a deep marine layer out there. emeryville look at alcatraz this morning. you expect to see the low clouds there but we have them all the way into the inland valleys. mist and drizzle, to boot, and cooler temperatures today. the forecast coming up. >> also a bear hunt in yosemite. the search for a 200-pound animal that's found its way on

a bear has broken into several homes in yosemite national park this week. this morning rangers are urging people to take precautions to protect both themselves and the bear. we have the story from inside yosemite. >> reporter: this quiet residential area of yosemite national park has become a favorite spot of one unwelcomed guest. rangers say this 220-pound black bear has broken into eight homes in the past week. >> he was on my property on saturday. my dog barked a lot and alerted me to the bear. so i just, you know, stayed in the house. >> norman has lived here for 78 years and has seen his fair share of bears, but not recently. >> this bear that we have now is the first one we've had now for some years. >> park rangers used a trap like this one to catch the bear last weekend. they put a radio collar and numbered ear tag on him and drove him out of the area, but he came back days later. >> he has found food, and

whenever they find food of any kind, even if it's in somebody's house, they will hang around. >> the park has posted flyers on doors of homes in the area where the bear has been spotted, letting people know about the encounters and letting them know to use certain safety precautions. >> make sure that you use the provided bear food storage lockers. and anything with a stink goes in there, not just food and drink, suntan lotions, stuff you wouldn't think about, stuff that has a scent bears are attracted to. >> it appears this bear is eating a lot of birdseed wishes -- which should also be put away. they are reminding people to lock windows, doors and cars. but despite having as many as 500 bears roaming yosemite, they say it's still a save place for visitors. >> there has never been a bear attack in yosemite. >> abc7 news. >> that bear just didn't know when to leave.

they kick him out and he comes back anyway. he's like the drunk at the party. please, go home. what's going on weather-wise? >> in the mountains some nice weather. not hot. usually mid-90s in yosemite, just 83. here's the roof camera. as we fan around the embarcadero area, you notice the cloud cover. it's typical, of course, but the depth of the low clouds and fog, up to 3,000 feet. mist, drizzle all along the coast, around the bay. the clouds almost making their way into the sacramento valley. we will see slower clearing today, maybe no clearing at all. in the city 55 in san francisco. get set for another cool day. upper 50s san jose. fremont 59. 58 concord and 54 napa. we are looking at gusty winds heading through the delta, up to 31 miles an hour. we have airport delays at sfo up to an hour and nine tone minutes here with calm winds in mountain view and as well as san jose.

morning drizzle with cool to mild temperatures this weekend. today is the cooler day of the weekend with a gradual warming trend coming into play after tuesday. here's the setup. plenty of clouds to morning, but by about 9:00, the east bay will see the sunshine, but notice that we will see lots of clouds stacked up along the shoreline, the san mateo coast, the marine coast. only 50s here. it's going to be widespread 60sed to around the bay. that sets the stage for anywhere from 7 to 15 degrees below average today. we should see 89 in livermore. san francisco and oakland just in the 60s. seven degrees lower than average in oakland today. you get the idea and the numbers will continue to trend cooler than average. although today we will look for numbers really bottoming out because of not only one area of low pressure heading out, but another one heading in. and once this begins to settle in, we will see that atmosphere mix a little bit and the marine

layer begin to shrink as soon as tomorrow. but as for today, we are looking at low clouds and fog sticking around for a good portion of the day, allowing for the cooling to make its way into the sacramento valley, the san joaquin valley. and only 77 in los angeles today. back home a cooler day today with 71 santa clara and 72 san jose. 69 sunyvale. more 60s through milbrae and san mateo. and san francisco cloudy afternoon with 61. 57 in daly city. breezy along the coast. 9 cloverdale. near east bay look for more 60s today but low 60s for richmond. 64 oakland. you have to go down toward fremont to make it into the up he were 60s. even out over the hills east of this tunnel, a mild day today with 77 in pittsburgh, 72 in pleasantville and down by the monterey bay we have some sunshine on tap but it will take

6'5". >> this is important because the dmv was determined to make her that size. you see, she was turning 18 years old, so irene needed i.d., mother and daughter went to the dmv. >> we went to the san mateo dmv office and filled out the paperwork. her first i.d. card came back with a height of 6'5". >> here's the i.d. all the information is correct but the height. it says 6'5". she's only 5'5". so mother and daughter went to the redwood city dmv to see if they could get it right. >> they were really surprised, and they said, oh, i don't know how this happened, but we will get it straightened out. >> and here's the second i.d., 6'5". the dmv seemed determined, but she got her anger and headed back to the san mateo dmv.

>> i kind of gave her a hard time because she kept dragging me back over and over again. >> but back they went once again and talked to yet another dmv clerk. >> she was just absolutely amazed and couldn't believe that we had two wrong ones. >> problem solved, right? wrong. a third i.d. came in the mail and again 6'5". >> are you sure you are not 6'5"? >> i'm 100% sure.
